Dad ROBERT J. WILKES has been convicted of killing his 3-month-old son, apparently by inflicting a non-accidental traumatic head injury (shaken baby syndrome).

Missoula man gets 30 years for killing infant son

MISSOULA (AP) — A 38-year-old Missoula man convicted of killing his 3-month-old son has been sentenced to 40 years in prison with 10 years suspended.

District Judge Ed McLean sentenced Robert J. Wilkes on Wednesday for the Oct. 4, 2008, death of his son Gabriel. Wilkes, who has maintained his innocence all along, was convicted in December of deliberate homicide.

A baby sitter who had been watching Gabriel the day he died testified at trial that Wilkes picked up his son but returned to her apartment about an hour later and asked her to call 911. Deputy Missoula County Attorney Suzy Boylan said the boy was “limp, blue, unresponsive, cold and struggling to breathe.”

Child-abuse experts testified that the trauma was consistent with shaken-baby syndrome and could only have occurred under the father’s care.
