Dad arrested for drunk driving; 4-month-old son in car (Elmhurst, New York)

A man driving on the Southern State Parkway in Roosevelt with his 4-month-old son in the backseat had a blood-alcohol level almost twice the legal limit when he was stopped and arrested Sunday night, state police said.

Win Kyaw, 39, of 51st Avenue, Elmhurst, was driving a Nissan Pathfinder west on the parkway near Nassau Road and Exit 21 at 8:10 p.m. when a state trooper saw the driver "move from his lane unsafely," a police report said.

When the trooper talked to the driver he noticed Kyaw had alcohol on his breath, watery eyes and slurred speech. The trooper also saw Kyaw's infant son was "a rear seat passenger in the vehicle." A state police report did not say whether the baby was buckled into an infant car seat.

Kyaw was arrested and charged with driving while intoxicated and child endangerment. He provided a breath sample that showed a .15 blood alcohol level, police said.

He was held for arraignment at First District Court, Hempstead Village. Bail information was not immediately available.
