Father guilty of manslaughter in baby's death

HALIFAX – A judge convicted a Halifax man Friday in the death of his baby daughter, finding the new father slapped, shook and tossed her after becoming frustrated by a series of business failures and the cries of his child.
Nova Scotia Supreme Court Judge Felix Cacchione found Ashiqur Rahman guilty of manslaughter and aggravated assault, and described him as a manipulative, domineering man who controlled much of what happened in his home.

Cacchione said Rahman, who’s in his late 20s, had little interest in his new baby and was solely focused on starting an online business in Canada after moving here from Bangladesh.

“The evidence satisfies me that Mr. Rahman had no bond with his daughter,” Cacchione said in his ruling that took 2 1/2 hours to read.

“His focus was on his business, himself and nothing else.”

Rahman, wearing a black T-shirt emblazoned with an Ashiqur Industries logo, sat quietly during the lengthy proceeding, but appeared surprised when the judge remanded him into custody and said “I didn’t do anything,” as he was led away by justice officials.
A sentencing hearing was scheduled for Aug. 7.
Rahman had pleaded not guilty to both charges in the death of seven-week-old Aurora Breakthrough in July 2009.

The prosecution argued that the case hinged on Rahman’s credibility versus that of the baby’s mother, Jane Gomes, who testified she saw her ex-boyfriend slap and shake the newborn in the weeks before she died.
Gomes received a conditional discharge with six months probation for failing to provide the necessities of life for Aurora.

Gomes sat in the second row of the court gallery and was surrounded by supporters as Cacchione read his verdict. One of them had her arm around the petite woman, who had her head down for much of the verdict.

Gomes didn’t speak to reporters as she left court.

Crown attorney Denise Smith said she was pleased with the decision and that Gomes was relieved to have a measure of vindication in the death of her daughter.
“She was quite tearful. I think she felt very vindicated,” Smith said outside court.
“We were attempting to show that … Mr. Rahman was frustrated by the demands of a young infant and the crying of a young infant, particularly. The judge found those facts as indications of a motive by Mr. Rahman.”

Cacchione found Rahman slapped Aurora “in anger and frustration” on June 29, only to slap her forcefully enough a week later to cause bleeding around the brain.

He said that on July 22, a frustrated Rahman either tossed or dropped the baby on the couple’s bed, causing the injuries that led to her death.

Rahman and Gomes are both from Bangladesh and came to Canada to study computer science at Acadia University in Wolfville, N.S., before moving to Halifax.

In closing arguments in April, the Crown argued that Rahman’s denials that he abused the child didn’t stand up against the testimony of the baby’s mother.

Smith said Gomes made some poor choices in failing to take the baby away after witnessing the abuse, but added that Gomes was telling the truth about Rahman’s tendency to lose control and harm Aurora.

The defence argued that Gomes’s testimony was motivated by a desire to shift blame away from herself, and came only after reaching a plea bargain with the Crown.

“I still stand behind my client as to what he had to say about his involvement in his daughter’s death,” Don Murray said outside court.

“It’s unfortunate that the judge chose not to accept what he had to say.”

Murray also argued that evidence from pathologists and medical experts didn’t prove Aurora died as a result of being shaken or hit. He said a pediatric cardiologist found Aurora had a congenital heart condition and it’s possible that played a role in her cardiac arrest on July 23, 2009, four days before she died in hospital.

Cacchione accepted that Aurora had an undiagnosed heart condition, but he said he doesn’t believe the condition caused her death.

He also accepted evidence of the emergency room doctor who testified that Aurora’s injuries were likely caused by non-accidental trauma and not from a cardiac event.

Testimony from several physicians who treated Aurora revealed that she had multiple rib fractures, retinal hemorrhages and brain injuries from various times in her short life.

The medical examiner who did the autopsy on Aurora concluded that the cause of death was a blunt force injury to her head, a finding that Cacchione accepted in his verdict.

Cacchione said Rahman became frustrated after a succession of business failures, “dire” financial circumstances and the stress of caring for a crying newborn.

He also called Rahman a “manipulator” who dictated where they lived and how money being sent from Bangladesh was spent.

“He is someone who likes to be in control and not someone who likes being told he is wrong,” Cacchione said.
He added that Rahman was physically, emotionally and verbally abusive to Gomes, who met him at Acadia University in 2008.
Rahman had little interest in his daughter, the judge said, noting that he left the hospital more than an hour after she was born and took a month to name her.

Jury recommends 125-year sentence in child abuse case

A Tulsa County jury Friday recommended a man found guilty of abusing his newborn son serve 125 years in prison.

The man's 6-week-old child underwent emergency brain surgery in February 2011 after suffering a severe skull fracture and brain bleeding, according to a police affidavit filed in the case.

The child was in the care of his father, Jeffery Reece Isbell, now 25, at their Tulsa home when the baby was injured. He was charged in July 2011 with two counts of child abuse by injury.

A jury found Isbell guilty of causing a skull fracture, epidural hematoma and bruising as presented in the first count and recommended a 100-year sentence on the charge. Jurors also recommended a 25-year sentence after finding him guilty of causing rib fractures as presented in the second count.

Prosecutors asserted Isbell broke five of the baby's ribs by forcefully squeezing or slamming him in early February 2011, and 10 to 14 days later caused the skull and brain injuries by inflicting significant, and intentional, force on the child.

Isbell told Detective Mark Hodges during a Tulsa police investigation into the abuse that he was diagnosed with schizophrenia and had not taken his medication in several years, according to the affidavit. He also told the detective he "sometimes blacks out but does not know it."

He told family members "maybe he had kicked (the baby) while he was asleep," the affidavit states.

The boy's mother found him when she returned home from work and took him to the hospital. She told police the child "appeared to be dead," the affidavit states.

"The injuries were so massive and caused by such force, that it could not have been accidental," Assistant District Attorney Sarah McAmis told the Tulsa World. "The skull fracture was so large that it was from extreme impact, so either he slammed the baby into the wood frame of the couch or punched or kicked the baby with significant force."


Isbell remains at the Tulsa Jail. He will be formally sentenced July 20.

Tonight's top fugitive is a serious threat to children in more ways than one - a sex offender who struck young, and years later as a father, did unspeakable damage to his 3 ½ year old son.

David Nyhart is a convicted level three sex offender - the worst of the worst - and highest risk to re-offend. He preyed on his victim, a young girl, when he was just a teenager, sexually assaulting her for several years.

That's revolting enough, but what he did to his toddler son - is simply unimaginable, convicted of suffocating the child with a blanket. The baby suffered extensive brain damage as well as internal organ damage.

And the abuse he’s unleashed doesn’t stop there. In investigating that horrible abuse of his son, Seattle police discovered Nyhart was behind several domestic violence crimes involving his wife, including one attack while she was holding their son in her arms.

A member of the Lummi Tribe is facing a federal murder charge after allegedly crushing his infant daughter’s skull last weekend.

Lawrence Virgil Tom, Jr. is charged with second degree murder. The incident happened at a Bellingham address, but on Lummi Tribal land, making it a federal case.

According to federal court documents, Tom called 911 last Sunday to report his 6-month-old daughter wasn’t breathing. The girl was transported to the hospital where it was discovered she had a fractured skull. She died just before midnight Sunday.

Tom allegedly told an FBI investigator that, during the previous week, the girl had rolled off the couch and hit her head and also rolled off a mattress and hit her head on the floor.

An autopsy two days later by the Whatcom County Medical Examiner’s Office found the girl’s skull was broken in several places and could not have happened the way Tom described.

During another interview with the FBI, Tom allegedly admitted he was home alone with his two daughters two days prior to the 6-month-old’s death. Court documents say Tom admitted he had gotten frustrated because he was tired and the baby would not stop crying. The investigator said Tom admitted to squeezing the child’s head between his right bicep and forearm until it made a popping noise. He claimed he didn’t know how badly he hurt the girl.

The investigator wrote that the medical examiner believes the injuries he found were consistent with the injuries that caused the girl’s death.

Dad charged with abusing 2-month-old son (York, Pennsylvania)

Abused by his father at his apartment? The vague language suggests that this teen dad did not live with the mother, but was in some sort of custody/visitation situation. Notice that there is no mention of the mother around.

Which is insane. Teenage fathers have no clue how to take care of young children. And the child abuse statistics bear this out. Teen dads are in the highest risk group there is. And two young children at once? Recipe for disaster. Dad is identified as DERRICK DEGROFT.

Police have charged a York County teen for allegedly abusing his two-month-old son, causing him serious injuries.

Police in York County say the child's father abused the baby, finally landing him in the hospital and then lied to Officials about what happened.

19-year-old Derrick Degroft of Hanover faces charges of aggravated assault, simple assault, and endangering the welfare of children.

Court documents reveal that back in December, Degroft's infant son was taken to Hanover Hospital with injuries including bleeding in his brain and injuries to his face causing his eye to be swollen shut.

Investigators believe the child was abused by his father at his apartment on West Walnut Street in Hanover. Degroft reportedly told the child safety team at Hershey Medical Center, where the baby was transported for treatment, that the injuries happened when Degroft was in the bathroom.

He added they were caused by the child's two-year-old sibling who he said has been known to hit the baby. He says a double stroller was found lying on top Of the baby.

A doctor at Hershey Medical Center told police the injuries did not match up to Degroft's story and there were signs of prior abuse. Degroft's preliminary hearing is scheduled for next month.

Father Faces Charges In Baby's DeathBaby Suffers Head Injury, Fractured Femur

ORLANDO, Fla. -- An Orlando man was arrested Saturday and charged in the death of his 2-month-old son.

Authorities with the Orlando Police Department said Eddie Lee Daniels was booked in the Orange County Jail without bond in connection with the baby's death.

An arrest report stated Daniels was with the child Friday and called 911 when the boy became unresponsive. The baby was taken to Arnold Palmer Hospital and pronounced dead a short time later.

An autopsy was completed, and a charging affidavit stated the cause of death was a closed head injury with subdural hematoma, as well as a fractured left femur. The manner of death was ruled a homicide.

The report added the child had, "frontal bulging and retinal hemorrhaging behind the eyes which were both preliminary indicators of possible abuse."

During an interview with detectives, Daniels denied hurting the child, but authorities said he was the only person with the child for the last five hours of his life, and another adult at the home told police the child had no signs of injury when she left in the morning.

WOODBRIDGE, Va. (WUSA) -- A man shook a 3-month-old girl so violently, she suffered "severe head and upper body trauma," Prince William County Police said in a news release.

Shahid Nazar, 30, of Woodbridge shook the baby on two occasions, once on January 10, and then again on February 23, police said.

"The investigation revealed that the victim, a 3 month old infant girl, had been shaken by the accused, her father, so hard that it caused severe head and upper body trauma. Medical staff examining the child alerted police after finding the injuries suspicious and possibly a result of "Shaken Baby Syndrome,"" police said.

Nazar was arrested and charged with two counts of malicious wounding and two counts of felony child abuse on March 7, police said.

He is being held, without bond.

A former Edmonton man was put behind bars Friday after admitting in court he had seriously injured his two-month-old daughter by shaking and twice throwing her.

Christopher Murphy, 25, was sentenced to 30 months in prison after pleading guilty to aggravated assault.

Court of Queen’s Bench Justice Adam Germain said Murphy “failed to protect the child” and then “put his interests before hers” by failing to reveal what happened.

According to an agreed statement of facts, Murphy had moved from Cape Breton, Nova Scotia to Edmonton with his wife and their two children in the summer of 2008.

On Sept. 27, 2008, Murphy was unable to stop his infant daughter from crying and he threw her into her playpen, causing her to strike her head on a metal support bar.

The baby suffered bruising to her forehead and began vomiting and was unable to keep food down, court heard.

She was taken to emergency at the Stollery Children’s Hospital, but the throwing incident was not disclosed.

She was released, but continued to be unwell, suffering from increased lethargy and vomiting until Oct. 5, 2008.

Two days later, Murphy was left alone with the baby and he again could not stop her from crying, court heard.

“He stood over the couch and repeatedly and violently forced (the girl’s) back and head into the back of the couch. After this shaking, (she) cried harder and Murphy shook her again and then threw her into the couch, causing her head to strike a remote control and resulting in bruising to the inside of her ear,” say the agreed facts.

The infant began having numerous seizures and bouts of unconsciousness and vomiting. She also had bruising on her cheeks from Murphy “panicking” and squeezing her cheeks in an effort to wake her up after the shaking.

Murphy again did not reveal what he had done.

The baby was taken to hospital and testing eventually revealed she had suffered bleeding to her brain.

Murphy later confessed.

Court heard the baby has been diagnosed with symptoms consistent with shaken baby syndrome and there is currently “guarded optimism” about her prognosis.

The mother has since returned to Cape Breton with the children and is no longer together with Murphy.

In a victim impact statement, she said her “world was shattered” as a result of both the incident and of being initially treated by police as a suspect in the case.

“I was filled with anger towards him that will never go away,” she wrote, adding she wonders what to tell her daughter later when she asks questions.

“How can I let her grow up knowing that her own father hurt her this way,” she said in the statement.

In a letter read by his lawyer as he cried, Murphy admitted failing his “little girl” by hurting her and called it a “horrible lapse in judgment” and a “huge” mistake.

“I was impatient, careless and stupid,” he said.
