A 30-year-old man has been remanded in custody in Jersey charged with the murders of six people, including his wife and children.

Damian Rzeszowski is alleged to have stabbed Izabela Rzeszowska, 30, and their children Kinga, five, and two-year-old Kacper.

He is also accused of killing his wife's father Marek Gartska, 56, and her friend Marta Dominika De La Haye, 34, and five-year-old daughter Julia Frances.

Detectives waited nearly two weeks to question Rzeszowski about the attacks which took place in St Helier on Sunday August 14.

He was treated in hospital immediately after the incident after reportedly stabbing himself in the chest.

Post-mortem examinations carried out on the six victims, who were Polish, confirmed they all died from stab wounds.

Rzeszowski will appear at Jersey's Royal Court again on October 28.

Decision causes outrage among defendant's family, friends

After the first trial resulted in a hung jury, prosecutors on Thursday scheduled a new trial for a Vancouver man accused of seriously assaulting his infant daughter.

The decision comes despite the fact that the 12-member jury reportedly voted 11 to 1 earlier this month to acquit Ryan Buck Kannegaard, 26, of first-degree assault of a child. Verdicts must be unanimous.

“After a long and arduous trial … the jury clearly felt that the evidence presented by the state was insufficient,” defense attorney David McDonald said in a statement. “Based on the jury result, it is disappointing that the state has determined it is necessary to reset this matter for trial.”

At Deputy Prosecutor Rachael Probstfeld’s request, Superior Court Judge John Wulle set a new trial date of Oct. 31.

However, Clark County Prosecutor Tony Golik said he is still not sure whether his office will retry the case. He said he planned to make a decision next week.

Golik said the reason his office hasn’t made a decision yet is because of the seriousness of the case.

“It’s obviously a difficult case — very emotional. We just want to make sure we’re making the right decision,” he said. “We don’t want to make a quick decision on such a serious case, one way or another.”

Citing court rules, Golik couldn’t comment on specifics because it is a pending case.

The prosecution’s decision Thursday to reset trial led several of Kannegaard’s friends and family to contact The Columbian in outrage.

Kannegaard’s uncle, Clyde Holloway, said he couldn’t believe prosecutors wanted to go forward with another trial, especially after knowing the jury’s opinion. He said that after the announcement of the mistrial on Aug. 3, he was standing with Kannegaard in the courthouse lobby when several tearful jurors approached the family.

“There were numerous jurors who stopped to hug Buck,” Holloway said. “They said, ‘We’re so sorry. We wanted to acquit you. It’s obvious you didn’t do it.’”

Kannegaard’s friend, Adam Trent, who was a character witness at trial, said he wants to stage a protest outside the courthouse.

“I know without a doubt that he is innocent, and this trial is ruining his life,” Trent said by email. “He hasn’t been able to see his child in over two years, let alone have anything resembling normalcy.”

According to several sources, jurors said they voted 11-1 to acquit on the assault charge. Jurors were fuzzier on the second charge of criminal mistreatment; some said the vote was 9-3 to acquit and others said it was 10-2 or 11-1.

Charges related to a Nov. 2, 2009, incident when Kannegaard’s 5-month-old daughter Phoenix was rushed to the hospital with a perforated bowel, possible lacerated spleen and broken wrist. She eventually recovered.

During trial, prosecutors said Kannegaard had been watching his daughter the evening she was injured and put her to bed without consulting family or taking her to the hospital, jurors heard.

Mom Lydia Kannegaard came home that night and, after checking on her daughter a couple times, found her coughing up blood. She took her to the hospital.

Prosecutors alleged that Kannegaard snapped due to financial and marital stress, causing the baby’s injuries.

The defense said the baby’s injuries were caused by her 3-year-old sister jumping on her. A new, young father, Kannegaard put her to bed, not knowing what else to do, McDonald said.

Doctors who testified at trial said they could not rule out the possibility that a toddler could cause such injuries to an infant.

Trials cost the county approximately $1,500 or $2,000 a day, including staff costs.

Dad threatens "beatdown" on mom during supervised visitation session (Haverhill, Massachusetts)

Your tax dollars at work, folks. Notice that Mom lost custody to CPS because of dad JOSHUA WEST and his "violent behavior"--not because of anything the mom apparently did. And yet BOTH PARENTS are on supervised visitation! Despite the fact that Daddy was on probation for assault and battery against the mother!

So let me get this straight:

We coddle Daddy by putting him on probation for a violent crime against the mother, and thereby put the mother at additional risk.

We then punish Mom by taking her kids away from her.

We then reward Daddy by granting him supervised visitation despite his criminal record. 

We then punish Mom some more by giving her supervised visitation as if she were a criminal just like the father, and not the victim of a violent crime.

We then subject Mom to additional trauma and humiliation by requiring her to endure supervised visitation with the man who assaulted her, who (naturally) uses the occasion to threaten her with additional violence.

Is the father-friendly, abuser-friendly agenda clear yet? Shame on the Haverhill justice system. And shame on the Massachusetts Department of Children and Families.

Next time you hear the fathers rights groups in Massachusetts moan and groan about how oppressed they are, remember this case and what REALLY goes down in the Commonwealth.

HAVERHILL — A man who allegedly threatened to give the mother of his two children a "beatdown" if she had anything to do with other men is being held pending a probation hearing Sept. 21.

Joshua West, 20, of 25 Bateman St., pleaded not guilty to a charge of threatening to commit a crime, assault and battery, in Haverhill District Court on Monday. Patrolman Bradley Andrews arrested West after he made the threat to the woman during a July 24 supervised meeting with their 1-year-old child at the state Department of Children and Families, according to a police report.

The child is in DCF custody because of West's violent behavior, according to Andrews' report. The woman is pregnant with another child and West is the father, police said.

West is already on probation after being convicted of assault and battery on the mother of his children. He struck the woman in the face three times last year, according to a police report.

Judge Patricia Dowling imposed $500 cash bail on West on his latest charge, but determined there was probable cause that he had violated his probation on the 2010 offense and ordered him held until Sept. 21.

At that time, West will face a final hearing on whether he violated his probation on the assault and battery conviction, as well as a pretrial conference on the alleged threat he made to the mother of his children.

A Penticton father has been charged with pimping out his underage daughter for sex to at least three men, including a local mayoral candidate.

The 46-year-old father was arrested July 22 and has been charged with nine counts, including sexual assault, sexual exploitation, living off the avails of prostitution and a parent or guardian procuring sexual activity for a child under 18.

The man has not been identified due to a publication ban. He remains in custody pending a bail hearing in September.

Police are also keeping mum on the age of the girl - who is receiving support from victim services and social workers - in order to protect her identity.

Police began investigating the father in May after receiving a tip a young girl had been sexually victimized, RCMP spokeswoman Cpl. Annie Linteau said Thursday.

"We are continuing the investigation and it's possible other arrests could be made."

So far, three men - aged 34, 63 and 67 - have been arrested for allegedly receiving sexual services from the girl.

Police have not released their names, pending approval of charges, but one man - a fringe political candidate who plans to run for Penticton mayor in the fall - has come forward to admit he was a client of the girl.

Benny Wolfe, 67, said he met the girl and her pimp at a bus-stop bench. He said he asked the girl's age and hired her after he was told she is of legal age.

"She was reasonable, $100 for an hour of her time," said Wolfe, who claims he is innocent because he did not know the girl was underage.

In a letter to the editor published last week in the Penticton Herald, Wolfe said police arrested him on July 30 in front of the giant peach near Okanagan Lake for allegedly procuring the sexual services of a minor.

The alleged offence wasn't violent, Wolfe said, and that "what I have alleged to have done may not be acceptable to the majority of law-abiding citizens but I take full responsibility for anything I do in life and what I do in my personal life has nothing to do with my public life."

Wolfe and the two other men were released on the condition they not be in the presence of anyone under the age of 18. They are scheduled to appear in court in September and October.

DALLAS (AP) _ Dallas police say the father and stepmother 10-year-old who died last month were arrested after it was discovered the boy was denied water for five days as punishment.

Police had initially thought the death of Johnathan James on July 25 could have been heat-related, but the Dallas County medical examiner has ruled that he died of dehydration.

Michael Ray James and Tina Alberson remained in Dallas County jail Thursday after being arrested and charged with injury to a child causing serious bodily injury. Bond for each was $250,000. The jail website did not list attorneys.

Temperatures in Dallas hit 100 degrees or more every day but one last month. Police had said the home didn’t have central air conditioning and two window units and fans weren’t keeping the house cool.

Judge grants delay in hearing on daughter's death

GRAND RAPIDS, Mich. (AP) — A Michigan man charged in the choking death of his 3-month-old daughter during a sexual assault was granted a delay in hearings before a federal judge in Grand Rapids.

Steven Deuman was ordered jailed Wednesday by U.S. District Judge Ellen Carmody pending Sept. 2 preliminary and detention hearings.

Federal Public Defender Richard Stroba had requested more time to speak with Deuman and review evidence in the case.

The girl died Aug. 12 on the Grand Traverse Band of Ottawa and Chippewa Indian Reservation, northwest of Traverse City. An autopsy indicated the baby was asphyxiated.

Federal authorities investigated the death because it occurred on a reservation. Deuman, the baby's mother and another child live on the reservation, according to court records.

Deuman claimed that he left the baby, surrounded by pillows and a comforter, on a bed in his bedroom while smoking a cigarette outside, an FBI agent said in an affidavit.

He went back inside after hearing the girl cry and said she was unresponsive on the floor between the head of the bed and a wall. Deuman claimed there was blood around her nose and mouth and that the fall may have killed her.

"Deuman was unable to provide any explanation for how (the baby) could have rolled off the bed, past the pillows and comforter, and onto the floor," the agent said.

He did not call 911, but called the baby's mother, put the child in his brother's car and began driving to a hospital. They turned around and returned to the house after seeing the baby's mother, Natasha Maitland, drive past them, according to the affidavit.

Maitland called 911 and was heading back toward the hospital when paramedics caught up with their car and began life saving procedures. The girl later was pronounced dead at the hospital.

An autopsy showed no injury consistent with a fall from a bed.

Stroba said Deuman has pleaded not guilty. The Associated Press left a message Wednesday afternoon seeking comment from Stroba.

Dad LEE ROSS BARBONE is charged with 1st-degree murder. Notice that he has already confessed to hitting his infant son when he would not go back to sleep. The baby died from multiple head injuries.

Father Charged with Killing Son Waives Hearing

The Pocatello man charged with killing his 7-month-old son waived his preliminary hearing in magistrate court Wednesday morning.

Lee Ross Barbone, 19, had a short appearance before a judge following a motion by his defense to waive the hearing. In the waiver agreement between his defense team and the court, there was a recommended sentence of up to life in prison and ten years fixed.

Wednesday’s courtroom was also full of family and friends of the infant's mother who wore shirts that read "Justice for baby Richard."

Barbone will now have an arraignment in district court on the first degree murder charges.

Court records indicate that the 19-year-old father admitted to hitting the child back in May when the infant would not go to sleep. An autopsy later showed that the child died as the result of multiple head injuries. Barbone remains in custody with a $1 million dollar bond.
