A father charged with abusing his 9-week-old daughter has waived his preliminary hearing.
Michael V. Valdez, 38, of 1511 N. Huston Ave., is now scheduled for arraignment in Hall County District Court at 9 a.m. June 7. His case was bound over from county court Thursday.
He is charged with two counts of felony child abuse resulting in serious bodily injury for incidents that occurred on April 1, April 10 and April 18. The charges were filed on April 21 after Valdez was arrested in Omaha.
The baby, who was born Feb. 11, was being treated at Children's Hospital in Omaha for retinal hemorrhaging and fluid and blood on her brain, Deputy Hall County Attorney Gail VerMaas said at Valdez's initial court appearance. The baby's long-term prognosis was unclear at that time.
VerMaas also said Valdez had admitted "to hitting the child in the head, causing the injury."
He had been scheduled for a preliminary hearing June 23.
His bond of 10 percent of $250,000 was posted April 22.
If convicted, he faces up to 20 years in prison and a $25,000 fine for each count.

Notice that although the baby's seizures only took place when dad was "caring" for her, Mom has lost custody to CPS anyway. On one hand, we admonish young mothers to not be selfish, and to co-parent and "share" with the fathers. Then we punish them and hold them responsible when they do so, after the father acts out violently....

CARLSBAD — A 19-year-old father was found guilty in District Court on Friday of child abuse involving his infant daughter.
After two full days of testimony and a morning of deliberation, jurors found Arthur "Trey" McClintock III guilty of child abuse resulting in great bodily harm.
McClintock, represented by Shawn Lunsford, testified at the trial on Thursday, saying he may have used "too much force" with his daughter, Baylee McClintock.
When asked, McClintock said Baylee's birth, after a planned pregnancy with Baylee's mother, Sharon Lactaoen, was the "proudest moment" in his life.
The defendant said on March 6, 2010, when Baylee was 3 months old, she was napping when she suddenly began screaming uncontrollably. Baylee had reportedly begun having seizures when she was 3 weeks old, and McClintock said she appeared to be having another one.
He told the court that he put cold water on her head before trying to call Lactaoen for help. Failing to reach her or her parents, he ran outside yelling for help and a neighbor called 911.
According to a previous report in the case, Baylee was flown to a Lubbock, Texas, hospital where a CT scan revealed multiple subdural hemorrhages in her head in various stages of healing. She was found to have bleeding into the brain and swelling of the brain. She also had a skull fracture and hemorrhaging in the retinas of her eyes, leaving her permanently blind although possibly responsive to some light.
According to McClintock, Baylee had been taken to the hospital twice before in January 2010 for similar seizures.
Baylee's white and pink-clad crib was placed in front of jurors, and Lunsford asked McClintock to use a toy teddy bear to show how hard he placed Baylee into the bed in an earlier instance. McClintock obliged, dropping the bear onto the mattress.
In closing statements from the state, Assistant District Attorney Robert Perozynski said the only times Baylee had seizures were when she was in the care of McClintock."He told you he slammed her into the bed," said Perozynski, adding that medical examiners said her injuries were trauma-related.
According to one of the state's witnesses, a representative from the Children, Youth and Families Department, Baylee, now 16 months old, is developing more slowly than other children her age.
"This was not an accident, this was someone who could not control themselves," Perozynski concluded.
Lunsford pointed out that McClintock was "only guilty" of being a caring and concerned father who rushed Baylee to the hospital at any sign of trouble.
Lunsford said the injuries were so massive that they could have only been caused by a force equivalent to a car wreck - not the small drop onto a 6-inch padded mattress like the one McClintock demonstrated. Lunsford said the injuries could also possibly be from an undiagnosed medical condition.
The defense concluded by saying "the path of least resistance is not always the truth."
According to a previous report, Carlsbad police began an investigation after emergency medical personnel were called to McClintock's home in the 2700 block of Eunice in response to a baby having seizures.
These injuries indicated non-accidental trauma, and hospital staff notified the Carlsbad Police Department.
During his interview with Detective Sgt. Chris Kohler, who testified in the case, McClintock described how he had treated the baby during other seizures. He said he had left bruises on the child when he pinched her to keep her from falling asleep during a seizure. Once, he said, he held her the wrong way, and because of his size - 6 feet tall and weighing 300 pounds - he left bruises on her shoulders.
McClintock's stories to police changed several times. Police also learned from the mother that every time Baylee had experienced injuries, she was under her father's care. In fact, Lactaoen quoted McClintock as asking, "Why does this keep happening when she's with me?"
Eventually, McClintock admitted that he was the cause of Baylee's condition, but he did not want to come forward with the information because he was afraid of losing his daughter and afraid of going to jail, said the report.
District Judge Thomas A. Rutledge, who presided over the case, set sentencing for June 17.

The county medical examiner's office today said three of the dead family members were Lynette Gasparre, 38, Nina Gasparre, 1, and Quinn Gasparre 7. The name of the man was not yet released.

Shaundra Langille knows the bullets were meant for her.
The 28-year-old was embroiled in a heated custody battle with James Cooper, her ex-boyfriend and father of her 9-month-old daughter. He threatened to kill her and arrived at her apartment Friday afternoon to do just that, she believes.
"He just came in and started shooting," she said. "I can't even tell you how many gunshots there were."
A day after Langille was granted temporary custody of their child at a protection from abuse hearing, Cooper barged in her apartment around 3:20 p.m. and opened fire. She hid in a closet with the child, escaping the flurry of gunfire that struck three neighbors, whom police say were innocent bystanders.
While Langille hid with her daughter and a 3-year-old girl from next door, the homicide victim Shana Bagley attempted to call 911, Langille said.
"He (previously) threatened to kill me and threatened to kill Shana because she was an eyewitness when he abused me and (police) refused to do anything about it," Langille said.
Langille and Cooper had filed dueling petitions for protection from abuse orders after an incident May 11 at Langille's home. Both PFAs were granted Thursday, and the pair was ordered to avoid all contact for a year. Langille said Cooper violated the temporary PFA but police did not track him down and arrest him.
"If they would have done something, if they would have picked him up on his violation, he would have been in jail, but they refused to do so," she said.
On May 11, Langille filed a PFA against Cooper, 39, of Scranton, for herself and their daughter. She said Cooper refused to leave her home, and hit her in the head when she picked up a bag of groceries. When police responded, they advised her to get a PFA, Langille said. Langille further wrote that Cooper has been violent before, including choking her, cutting her with a knife and smacking her in the face. When she threatened to call the police in the past, he threatened to kill her or have his family members come after her, Langille said.
Cooper filed on May 13 and said Langille invited him over to help her with child support and other bills. When Cooper did not respond to Langille's questions about her child support payments she became upset, he said. Shana Bagley "edged her on," Cooper said. Langille became violent and started throwing things. When Cooper attempted to leave, Bagley blocked the exit and shoved him, he said.
Cooper also reported Langille previously threatened to kill him and their daughter in their sleep, threatened to poison his food, "lost" two other children in foster care and threatened to give their daughter up for adoption and cut herself and tried to have Cooper arrested.
Langille said she lamented the fact her friend died as a result of the domestic controversy.
"She was there when he hit me," Langville said as tears ran down her face. "She was a witness. She was my best friend."

Once more, we have a "frustrated" caretaking dad, SAUL CORTEZ, who just couldn't take it. So the baby died after he had the gall to start crying, and Daddy Dearest started punching him.
Also note that this wasn't a little "shake." This baby was ASSAULTED.

Saul Cortez, 25 admitted to Queens Supreme Court Justice Richard Buchter that while he was watching his son, Mario, on April 5, 2010 he became frustrated and angry with the baby's crying and so repeatedly shook and punched the infant in the back.
Cortez, of Arverne, pleaded guilty to assault and manslaughter and will be sentenced to 18 years in prison on June 6. He faces deportation to Mexico upon completion of his sentence.
Baby Mario succumbed to his injuries after he was hospitalized with lacerations to the liver, injuries to his eyes, fractured ribs and brain injuries.

The Daily Camera reports that Joaquin Campos entered the plea Friday in the death of his 10-week-old son, Lyon, last fall.
He is expected to be sentenced to between 20 and 32 years in prison with a mandatory five years of parole July 6.
Campos was accused of shaking, squeezing and throwing the baby.
Police say the boy had a punctured lung, split lip, bruised tongue, knee abrasions, broken bones, brain swelling and a skull fracture.

Once again, we see that daddies like WILLIAM "WILL" INMAN aren't interested in "sharing" child custody. They're interested in terrorizing the mother of their children because she dared to leave them. And the same fathers are more than happy to act out violently--whether they win or lose. 'Cause it's all about total power, control and entitlement, don't you know. Never mind that the three children are now without a mother for the rest of their lives. So much for "sharing."

The father-in-law and estranged husband of Summer Inman, the mother of three who was abducted, strangled and then left in a septic tank, have each been indicted on aggravated murder charges. Each could face the death penalty if convicted.
The case was indicted with capital specifications, Hocking County Prosecutor Laina Fetherolf said today in a news release.
A grand jury on Friday issued indictments against William A. "Bill" Inman, 47, and William A. "Will" Inman II, 26. Each is charged with two counts of aggravated murder and single counts of murder, kidnapping, tampering with evidence and gross abuse of a corpse.
The younger Inman pleaded not guilty today to those; he was in court on a kidnapping charge for which he was indicted earlier. Common Pleas Judge Thomas Gerken continued the $1 million bond on which he is being held.
The elder Inman is expected to be arraigned tomorrow morning before Gerken on the additional charges at a previously scheduled hearing on a kidnapping charge, Fetherolf said.
The Inman men, and Sandra K. "Sandy" Inman, 46, are being held in lieu of $1 million bond at the Southeastern Ohio Regional Jail. They were indicted in March on kidnapping and abduction charges.
Mrs. Inman is the wife of Bill Inman and the mother of Will Inman.
Further charges against Mrs. Inman were not presented to the grand jury, Fetherolf said. She has pleaded not guilty by reason of insanity to kidnapping and abduction charges, and her attorney has filed a motion claiming that she is incompetent to stand trial, Fetherolf said.
Summer and Will Inman were going through a contentious divorce and child-custody fight.
The 25-year-old was abducted from downtown Logan March 22. Her bound, strangled body was found in a church septic tank near Nelsonville March 29 after Sandy Inman made an unspecified deal with prosecutors and told authorities where the body could be found.

The case was indicted with capital specifications, Hocking County Prosecutor Laina Fetherolf said today in a news release.
A grand jury on Friday issued indictments against William A. "Bill" Inman, 47, and William A. "Will" Inman II, 26. Each is charged with two counts of aggravated murder and single counts of murder, kidnapping, tampering with evidence and gross abuse of a corpse.
The younger Inman pleaded not guilty today to those; he was in court on a kidnapping charge for which he was indicted earlier. Common Pleas Judge Thomas Gerken continued the $1 million bond on which he is being held.
The elder Inman is expected to be arraigned tomorrow morning before Gerken on the additional charges at a previously scheduled hearing on a kidnapping charge, Fetherolf said.
The Inman men, and Sandra K. "Sandy" Inman, 46, are being held in lieu of $1 million bond at the Southeastern Ohio Regional Jail. They were indicted in March on kidnapping and abduction charges.
Mrs. Inman is the wife of Bill Inman and the mother of Will Inman.
Further charges against Mrs. Inman were not presented to the grand jury, Fetherolf said. She has pleaded not guilty by reason of insanity to kidnapping and abduction charges, and her attorney has filed a motion claiming that she is incompetent to stand trial, Fetherolf said.
Summer and Will Inman were going through a contentious divorce and child-custody fight.
The 25-year-old was abducted from downtown Logan March 22. Her bound, strangled body was found in a church septic tank near Nelsonville March 29 after Sandy Inman made an unspecified deal with prosecutors and told authorities where the body could be found.
