‘Sadistic’ dad jailed for baby cruelty

A dad has been jailed for carrying out a series of “sadistic” assaults on his newborn daughter.
Joshua Stephens, 22, was told by a judge that he posed a significant risk to the public as he imposed an extended prison sentence on him.
A court heard Stephens was violent to the baby from her being born until she was six weeks old when he confessed to his wife that he had hit her.
Leeds Crown Court heard Stephens slapped the girl “as hard as you would hit a man”.
On other occasions he held a pillow over her face and forced her head under water while he was giving her a bath.
After admitting to his wife what he had done, Stephens went to a police station and told officers he had an overwhelming desire to hurt his daughter.
He was jailed for four years and told must serve an extended licence period of four years upon his release after pleading guilty to cruelty to a child and assault occasioning actual bodily harm.
Judge Geoffrey Marson, QC, told Stephens: “It is obvious that these incidents occurred as a result of your sadistic desire to cause pain and distress to your daughter.
“This was a gross breach of trust on a vulnerable child.”
The abuse came to light on September 4 last year when Stephens hit the youngster “as hard as he could” when she woke up crying for a feed.
The baby was left with a bruised cheek from the blow. Stephen’s wife was out of the room at the time and he admitted what he had done when she returned. Stephens, of Crowlees Road, Mirfield, also told his wife’s father about what he had done before going to Dewsbury police station and telling officers: “I hit my daughter and smothered her.”
Stephens underwent a psychiatric assessment and told a doctor that he had a history of self harming from the age of 14 and had strong urges to punch objects and use knives.
The doctor diagnosed Stephens as suffering from obsessive compulsive disorder and was prone to impulsive and unpredictable behaviour.
Judge Marson added: “There is at the moment a significant risk of serious harm to the public.”

Dad murders two sons during visitation, even though mother had restraining order (Santa Fe, New Mexico)
The insanity of the courts just boggles the mind. The ex-wife, the mother of these murdered little boys, filed for a restraining order a little over 4 years ago. Even 4 years ago, dad MELVIN MARTINEZ was "threatening to take the boys away." Daddy's other threats to the children? "Excessive anger, obsessiveness, threats, belittling (and) badmouthing." (We should know by now, that "badmouthing"--sometimes referred to as parental alienation syndrome or PAS--only counts when MOMS allegedly do it.) She also mentioned Daddy's "severe depression" and "obsessive-compulsive disorder."
However, "a motion filed" in November 2007 cancelled out the restraining order, which was supposed to run till January 2008. So who filed the motion, and who approved the cancellation? You won't find out that information here.
But despite the huge number of red flags in this case, Daddy still had his rights. The custody "agreement" stipulated that the boys had to spend time at "both parents' homes."
Well, it's more than apparent now that Daddy made good on his threats, didn't he? He certainly did "take the boys away." Permanently. With a handgun. And then Daddy offed himself, as he lay between the two boys on the same bed.
Do judges EVER listen to or read the evidence before them? Do they just automatically assume that all mothers are liars? Or do they just not give a sh**? How come the judicial authorities are never held accountable as accessories to murder?

SANTA FE, N.M.—A northern New Mexico man who authorities say killed his two sons and himself had "excessive anger," his former wife wrote in a request for a restraining order 4 1/2 years ago.
Paula Martinez said in her Dec. 27, 2005, application for a restraining order against Melvin Martinez that he was threatening to take the boys away.
State police have said all evidence at the La Puebla home where the bodies were found Monday shows the 44-year-old father shot 12-year-old Derek and 10-year-old Devin with a handgun, then killed himself.
In a restraining order petition section asking what threats caused her to fear she might be injured, Paula Martinez listed "excessive anger, obsessiveness, threats, belittling (and) bad mouthing."
State District Judge Raymond Ortiz granted the restraining order on Jan. 10, 2006. He later extended it to January 2008, but a motion filed in November 2007 canceled it.
Paula Martinez also told the court that "Melvin suffers from severe depression and obsessive compulsive disorder. He obsesses about everything. He makes mountains out of mole hills."
Her petition said Martinez continuously belittled her, and once created a scene during a meeting with the older boy's principal in which he was "full of anger" and "making comments on how stupid I was."
Paula and Melvin Martinez were married Aug. 25, 1992, and divorced in October 2005, according to court records. The custody agreement over their sons had the boys spending time at both parents' homes.
State police Lt. Eric Garcia said Wednesday autopsy results on the father and sons are expected Friday or Monday.
He said all three bodies were found lying on the same bed, with the father between the boys.
A next-door neighbor, Flossie Montoya, told the Santa Fe New Mexican she saw Melvin Martinez mowing his lawn and getting rid of tree branches Sunday afternoon, Father's Day.
She said she wondered the next morning why he did not leave at his usual time for his job with the state Department of Transportation.

Dad who murdered two sons had history of domestic violence, mental issues--but apparently had visitation rights anyway (La Puebla, New Mexico)
We've posted on this case before. Now we find out that dad MELVIN MARTINEZ, who murdered his two young sons, is basically a classic textbook abuser who just had to go "all the way." Dad had a history of domestic violence and his ex-wife had "concern over his anger." Plus we have all the ubiquitous "depression" issues--not to mention the obsessive-compulsive issues--which explains his suicidal ideation, but not the murder of two little boys. It was obviously enough for the mom to file for an order of protection at some point, but of course even a dad with this history--dicey at best--appears to have been granted child visitation rights. And though this article doesn't spell it out, the children must have been murdered during Daddy's visitation time, if the divorce was in 2004.
Mom's brother has an interesting comment regarding how the boys were "always happy and joyous to be with their mother." Is that a guarded and diplomatic way of saying they weren't so happy and joyous around their father? Based on what is said here, I can't imagine Daddy would have been very fun to be around. Too bad the people who forced these little boys into visitation with this depressed, violent, angry, obsessive-compulsive child killer won't be held responsible. They never are. Still, it would be nice to see the names of the idiots behind this. Why is it that they never get it--or don't care? If the guy is not safe around Mom, he's not safe around her children.

LA PUEBLA, N.M. -- Family members are shocked and looking for answers after Melvin Martinez, of La Puebla, shot and killed his two children and then turned the gun on himself.
Action 7 News uncovered Martinez's divorce papers and found several issues that could have been plaguing the 44-year-old father.
Martinez filed for divorce in 2004, but roughly a year later the mother of his children, Paula Martinez, filed for a order of protection from domestic abuse.
No incidents of violence were reported, but Paula Martinez described Melvin as depressed and suffering from obsessive compulsive disorders. She also described several incidents in which she showed concern over his anger.
According to Paula Martinez's brother, Harry Salazar, Melvin's depression was well known in the family.
"Melvin had depression issues that he has been dealing with for years," said Salazar.
He also said despite Melvin's issues, no one thought he was capable of taking the life of his children.
"We want to remember their smiling faces. They were always happy and joyous to be with their mother," Salazar said.
Family members made funeral preparations on Tuesday for Derek and Devin Martinez.
A fund has been set up to help cover the cost of the funerals under the boys' name at Valley National Bank.

Court: Custodial dad locked 10-year-old son in feces-covered basement for months (Fort Wayne, Indiana)
Custodial dad ERIC URBANO has been jailed on neglect charges after leaving his son locked in a feces-covered basement while he went on vacation. By the father's own admission, the boy was locked in the basement nightly, and the house was utterly filthy--feces everywhere, syringes, vials. Seems the boy told his teacher at school who reported the abuse to CPS, who in turn (naturally) fumbled the ball.
Mom lived out of state, and said she hadn't talked to the boy in 6 months. Of course there is no explanation here as to how Daddy Dearest got custody. I suspect the usual abuser-wants- total-control scenario. The boy is now in foster care.
The boy is labeled as "psychologically disturbed" here. But it's well-known that solitary confinement will eventually produce psychotic disturbances in virtually anyone who's subjected to it, so I wouldn't take all the diagnostic labels at face value without further investigation.

FORT WAYNE, Ind. (Indiana’s NewsCenter) - A Fort Wayne man is behind bars after police say he locked his son in a feces-covered basement while vacationing in Florida.
Court documents show 38-year-old Eric Urbano locked his emotionally challenged son in the basement of a home in the 1400 block of Spy Run Avenue from October to March.
Police responded to a call about a fight on March 6th, and followed what neighbors say is a 10-year old boy home and found him living alone in horrendous conditions.
According to court documents, the boy told police his father locks him in the basement every night. He says he would also be locked up if he ate too much. The boy says he would sometimes escape to use the bathroom at a local fast food restaurant and try to get food there.
“We’ve never seen anything like this in this area,” Department of Child Services Communications Director Ann Houseworth said.
Court documents reveal that the boy was sleeping on an air mattress surrounded by feces. But the boy says once his mattress popped he slept on the deflated plastic and bundled his jacket for a pillow.
Court documents show the boy’s mother, who lives in Arizona, told police her son has Tourette’s Syndrome, Obsessive-Compulsive Disorder and Bi-Polar disorder. She says she hasn’t spoken with her son in six months.
Neighbors say they were happy to see the family move into the neighborhood in October, but are shocked to learn the disturbing details.
“Last time we saw he was playing outside with his dogs in October,” a neighbor who didn’t want to be identified said. “And he seemed happy then. No bruises or anything like that. There were no warning signs. That's horrible. That kind of sickens me that we didn't see anything.”
Another neighbor said he returned one of Urbano’s five dogs to the house a few months ago. He says he was very friendly at the time.
“The guy was so oh thank you, oh thank you, for finding my dog,” Jeffery Schweyer said. “He was so nice that day. That's why I can't believe all this is happening, because he was so polite.”
Court documents show the boy told his teacher about his living conditions. The teacher then reportedly notified the Department of Child Services. But no word when this happened or what DCS did about the situation.
Urbano told police on March 8th he was in Florida and had been there for three days. Court documents show he admitted that he does keep his son in the basement of the home frequently.
According to court documents, the Urbano left the child notes to remind him how to care for himself while he was gone, what dishes he was allowed to use, not to eat too much, and not to use the phone unless some one calls.
When police entered the home they say they found feces in every room and syringes and vials containing a liquid substance.
Urbano turned himself into the Allen County Jail Wednesday. He is behind bars and faces a Class D felony for neglect of a dependant.
Department of Child Service officials say the boy is in foster care.
