Custodial dad convicted of sodomizing 8-year-old son (Kitwe, Zambia)

You have to read this account carefully in order to find out that this rapist father had custody of his 8-year-old son. These sh**s are all the same. Threaten to kill the victim, then label them crazy when they finally speak up. Of course, not a word of explanation as to how sicko dad AARON BWALYA got custody, but he certainly managed to cut off any regular contact with the protective mother--a very typical thing for pedophiles to do. This is sometimes called "growing your own victims."

Father sodomises 8-year-old son

Written by Online Editor  MWILA NTAMBI in Kitwe

A 38-YEAR-OLD man of Ipusukilo in Kitwe has been committed to the High Court for sentencing after being convicted by the Kitwe Magistrate’s Court for sodomising his eight-year-old son.

This is in a case in which Aaron Bwalya of house number 1216, Ipusukilo, is charged with an unnatural offence and assaulting his son, thereby occasioning him actual bodily harm. In the first count, particulars of the offence are that Bwalya on dates unknown but between June 2011 and September 10, 2012 in Kitwe had unlawful carnal knowledge of his eight-year-old son against the order of nature.

On the second count, it is alleged that Bwalya on September 8, 2012 in Kitwe, assaulted his son thereby occasioning him actual bodily harm.

Bwalya denied both counts and the prosecution called five witnesses.

During trial, Bwalya’s former wife, who is the mother of the child, testified that she and Bwalya had two children before they divorced in 2007.

The woman testified that in September 2012, she received information from Bwalya’s brother that her son was very ill and that’s when she went to see him in Ipusukilo.

She recalled that her former landlord broke down when she saw her.

She testified that the landlord told her that what Bwalya had done to the child was very bad and that the child also broke down when he saw his mother.

The woman told the court that her former landlord narrated to her that the child had a big wound on his head because Bwalya had been abusing him.

She recalled that medical staff at a nearby clinic referred her son to Kitwe Central Hospital because the wound could not be stitched as it had started decomposing.

She testified that when she went with the boy to Kalulushi where she resides, she discovered that a stick was stuck to his body as she was trying to bath him.

The woman added that when she removed the stick, the child fell to the ground and that she rushed him to the clinic where he was again referred to Kitwe Central Hospital.

The woman said upon being interviewed by doctors at Kitwe Central Hospital, the child disclosed that Bwalya used to sodomise him and that it was very painful.

She said medical examinations conducted on her son revealed that he had suffered injuries, was malnourished and HIV-positive.

The doctor also recommended psychiatry counselling for the child as he was severely traumatised.

The woman added that the child was in good health at the time he was under her custody.

The boy also testified that he was Bwalya’s son and that he lived with his father.

He testified that one day when Bwalya returned from work, he discovered that he (the boy) had a sore in his eye and demanded to know how it started.

The boy testified that when he told Bwalya that the sore started on its own, he hit him with a plank on the head and that be bled profusely.

He also told the court that after his father cooked nshima on the material day, he began sodomising him.

He said Bwalya sodomised him on several occasions but he did not tell anyone because he threatened to put him in a sack and throw him into the bush if he dared tell anyone.

During cross-examination, the boy broke down because he was disappointed that his father was denying the things he had been doing.

And in defence, Bwalya urged the court to dismiss his son’s testimony as he was allegedly insane.

Delivering judgment, magistrate Maxwell Mainsa said he had no doubt that Bwalya had unlawful carnal knowledge of his biological son.

He said Bwalya’s conduct is unacceptable and he is a danger to society.

Magistrate Mainsa said had it not been for the vigilant neighbour, the child would have died in the house.

“Such conduct should not be tolerated, especially from a parent. There are so many people out there crying to have children and yet some parents have seen it fit to abuse their children,” magistrate Mainsa said.

He said children must be treasured and protected by all.

He said the court is duty-bound to send a strong message to would-be offenders.

He also convicted Bwalya for assaulting his son and sentenced him to seven years imprisonment with hard labour.

He said the unnatural offence charge for which Bwalya stands convicted carries a minimum mandatory sentence of 25 years and is beyond his jurisdiction.

He committed Bwalya to the High Court for sentencing on the first count.

Bwalya did not say anything in mitigation.

Custodial dad imprisoned for sexually abusing teen daughter (Lusaka, Zambia)

Notice that the father apparently had little or nothing to do with this girl when she was young. But after she located him "she" (allegedly) decided to stay with him. (The father's role in encouraging or grooming her to stay is not mentioned much less discussed.)  He apparently started to sexually abuse/rape her just after the stepmother moved out. Of course, that's not explained either...

At any rate, we once again have a custodial dad (with no mother or mother-figure in the household) who raped his own daughter and impregnated her.

Dad is identified as KELVIN KAMANGA.

Dad caged 30 years for sex with daughter

December 11, 2012

By DELPHINE ZULU - THE Lusaka High Court has sentenced a man of Kafue to 30 years imprisonment with hard labour for having sex with his 17-year-old daughter.

Kelvin Kamanga, 38, a business executive was facing one count of incest contrary to Section 159 (1) of the Penal Code Chapter 87 of the Laws of Zambia.

Kamanga between January 2010 and September 2011 had unlawful carnal knowledge of the girl knowing too well that she was his biological daughter.

Judge Sharpe Phiri in passing her judgment said the parent abused his position of trust and in so doing he caused irreparable damage to the life of his own daughter.

“I have taken into consideration that the convict is the victim’s biological father who was in a position of trust and ought to have protected his daughter not to cause harm to her.

Instead, he abused his position of trust, as father abusing his own vulnerable child is repugnant to the moral sense, I accordingly sentence you to 30 years imprisonment with hard labour,” she said.

Ms Justice Phiri said incest was a serious offence, which was becoming prevalent in the country.

The girl in her testimony told the court that she was staying with her grandmother from the time she was young, but she decided to start staying with her father when she located him in 2010.

She said she found her father married but he decided to chase her step-mother.

Soon after her step-mother left in 2012, he forced her to have sex with him and asked her not to tell anyone.

She said after a year again in September, her father had carnal knowledge of her but this time she decided to leave him and went to stay with her mother in Lusaka’s Mtendere Township where she became pregnant.

“When my aunt asked me who had impregnated me, I told them that it was Joe who was called and admitted responsibility of the pregnancy and was charged, but later when my father heard that I was four months pregnant, he told Joe not to get worried about the pregnancy because he knew who had impregnated me,” she said.

She said it was at that point that her relatives on her mother’s side got concerned and reported her father to the police Victim Support Unit so that he could tell the police who had impregnated her.

While at the police she revealed that she had sex with her father twice in his bedroom.

Dad strangles 1-year-old son to death (Nakonde, Nambia)

The U.S. and Zambia are very different countries with very different cultures. And yet remarkably the same. Where ever you go, violent control-freak fathers kill their children to get "revenge" against their partners for leaving them or "betraying" them in some fashion.  This is far more common with fathers than mothers, despite popular myths to the contrary.

Fathers rights people will often argue that fathers are "naturally" protective of their own biological offspring, which is nonsense. Notice that dad JOSEPH SICHONE deliberately targeted his biological son, and left his step daughter alone. Maybe because he felt more "entitled" to kill the boy, just to show the mom that Daddy's Not Happy about her alleged transgressions.

A father in Nakonde strangles his biological son to death
December 17, 2011

Posted by: JT

POLICE in Nakonde district of Muchinga province have arrested a 37 year old man for allegedly killing his one year old biological child.

According to police sources, the accused Joseph Sichone of Katozi village in chieftainess Waitwika’s area, has been on separation with his wife for more than a week.

Sources said Sichone got a rumour that his wife has been having an affair with another man within the same village.

Sichone is alleged to have strangled his son to death whom he found playing with his three year old elder sister.

The source said Sichone sent the girl to the market to go and buy biscuits before strangling the boy to death.

When the mother to the boy returned from wherever she had gone, she found him bleeding profusely from the nose.

Neighbours told the mother to the deceased toddler that they heard the baby crying inside the house immediately after his father entered the room were he was.

They added that immediately the boy stopped crying, they saw his father walking out and disappearing.
They said this made the people in the entire neighborhood suspicious that Sichone was the one who could have killed the child. Members of the public immediately set out to look for Sichone whom they later found and handed over to the police.

The self-confessing muderer has stunned people when he asked them why they got so concerned when in fact the person he killed is his own biological child and that he spared the other child because she is not his biological child.

This also angered everyone including the onlookers who immediately descended on him and forced him to take the dead body to the police station. The body of the toddler is currently laying in the mortuary awaiting a postmortem. Efforts to get a comment from Muchinga Police Commissioner failed.

Women reporters organize speak out on sexual violence against girls (Zambia)

Kudos to the Zambia Media Women Association for taking this on. It is outrageous that these rapists--many of whom are the girls' fathers--walk around in free society, while the victims are placed in "children's homes" where they are little more than prisoners.

Female scribes convene to tackle child sexual abuse

JANE and Eve not real names are victims of defilement. Jane, 9 was defiled by her father while ten-year-old Eve was defiled by her mother's friend.

Here is Jane's account.

"We used to stay in Burton and shared one room with our parents. My father, a taxi driver, and my mother had a their own bed while I shared the other with my five brothers and sisters. One night last year while I was asleep, my father picked me up and put me on the bed he shared with mum and undressed me by moving my pants to my knees. And he put his manhood in my private parts," says Jane.

Her mother who was asleep woke up and asked her husband about what he was doing. The father just held Jane's mouth to prevent her from screaming and asked the wife to remain silent.

"In the morning when he had gone for work my mother asked me what he had done and I told her. That is when she took me to the hospital," Jane recalls. "After some time my father drove to the hospital to see us. That was when he was arrested by police."

Jane says she never wants to see her father again. She is currently being kept at a children's home in Livingstone. Jane says she only misses the friends she used to play with in her neighbourhood.

Eve of Livingstone's Ngwenya township was defiled on three occasions by her mother's friend who used to assist her with charcoal.

"I could not tell my mother what had happened on one night when she left me alone in the house when he came and had sexual intercourse with me. He did the same on two different occasions before my mother noticed that I was limping. When she asked me, I told her what had happened. That is when he was called and he agreed that he was having sex with me," Eve says.

A meeting was convened with the defiler's relatives who offered to be paying K100,000 per month as compensation, but the news leaked and he was finally arrested.

Both perpetrators in Jane and Eve's cases are currently appearing in court.

These are sad tales which journalists were told by the victims at a recent workshop on sexual violence against girls organised by the Zambia Media Women Association (ZAMWA) in Livingstone.

Lushomo Danny's Home in Livingstone's Libuyu township is a haven for abused children and currently has 19 girls.

Home administrator, Victoria Mwansabamba, said the justice system was tormenting the children, as they felt imprisoned at the transit home while the perpetrators were out on police bond.

"The biggest challenge we are facing at Lushomo is the delay in the justice system as the girls feel imprisoned as they are not free to walk the streets. We also fear that the offenders may harm them if they come in contact with them, but the cases are being adjourned now and then," Mwansabamba said.

Lushomo coordinator Sr Brigita Sanding said the children were afraid to come face to face with the perpetrators as the law required.

"We are counselling the girls and a few of them now are able to talk of their experiences. But the situation is very bad as you find a father defiling his own child. We need the media to keep on talking of this issue so that we put a stop to it as it affects the future of the girl," Sr Sandings said.

ZAMWA programmes officer Pauline Songiso said there was need to have recommendations and strategies for legal reform based on an analysis of substantive and procedural laws in formal and traditional legal systems that impede and or facilitate girls' access to justice and perpetuate or condone sexual violence against girls.

"This should include activities, include a review of law, procedures and practice, customary on response to SVAG (sexual violence against girls). Increase knowledge among the legal community such as lawyers, law school faculty and prosecutors on international, regional and national legal standards applicable to the rights of girls," Songiso said.

She said the police's Victim Support Unit (VSU), which was often the first contact for victims, faced several challenges including resource constraints thus affecting its ability to respond and follow up cases effectively.

"The challenges include office space where survivors can be interviewed and cases can be dealt with in privacy. Many officers working in the VSU lack the necessary skills to enable them to deal adequately with gender violence including skills in psycho-social counselling, the long process of collecting forensic evidence such as DNA which is done in South Africa," she said.

Songiso said health centres, which were usually the second point of contact are also constrained by systemic lack of resources, shortage of staff and facilities.

"The law requiring corroboration of a child's evidence should be abolished and there is need to amend the medical and allied professions Act to expand the legal definition of who is able to sign a medical examination form to allow other hospital clinical staff such as nurses to support this role," she said.

Songiso said there was need to review key legislation affecting sexual violence against girls such as the constitutional provision on defilement, laws on marriage and the media could greatly help with identifying cases for strategic litigation and other support.

And Derrick Sialondwe, who is a child sex abuse coordinator at the Livingstone General Hospital, said child sexual abuse (CSA) in Zambia had received minimal attention to date and there was virtually no data on it published.

"Regardless of these factors and difficulties in quantifying CSA, it has been repeatedly reported in the media on the daily basis. In examining the nature of the perpetrator at Livingstone General Hospital CSA One Stop Centre, it has been found that 30 per cent account for relatives, 60 per cent account for trusted people known to the child such as teachers, fellow pupils, neighbours, and 10 per cent accounts for the strangers," Sialondwe said.

"According to statistics, most of the cases seen at LGH CSA One-Stop Centre come from within and outskirts of Livingstone. However, it is well known that there are enormous numbers of sexual abuse incidents which are never reported to any health facility, Victim Support Unit or the police.

"It is a common secret within all ethnic groups. It exists among the rich and the poor, the highly literate people and the illiterate people. According to the rapid assessment of the incidence of child abuse in Zambia report on literacy and gender, 33 per cent of sexually-abused children did not go to school and 67 per cent attended school; 72 per cent were females and 28 per cent were males."

He said signals and symptoms of defilement that parents should look for in their children fall in two categories - physical and emotional.

"The physical symptoms include swelling on the genitals, abrasion or bruises on the body, genital sores or ulcer, genital watts, vaginal discharge. Under emotional you have behaviour such as excessive crying, an increase in irritability or temper tantrums, aggression towards others, poor school performance, bed wetting or soiling of pants, knowing more of sexual behaviour than what is expected of a child of that age, sexualised play such as trying to have sex with other children," said Sialondwe.

Dad burns 2-year-old daughter after "marital dispute" with mom (Zambia)

Dad JOHN PHIRI was so upset by his wife DARING to ask about food for the children that he forced their 2-year-old daughter to sit on a hot charcoal brazier.

Notice that in Zambia, suburban stupidity is apparently not very common. No moronic neighbors proclaiming "shock" or how the perp was such a "nice guy." Nope, the neighbor quoted here knew very well that Daddy was "fond" of beating his wife.

Observe that in the same area, another 10-month-old child was recently killed by her father in reaction to a "marital dispute" with his wife.

Zambia: Father burns 2 year old baby after marital dispute with wife
25th January 2011
By Zumani Katasefa

A two year old baby was burnt on her buttocks by her father after a marital dispute with wife.

Lucy Nampungwe Phiri of Kitwe’s Twatasha compound told UKZAMBIANS yesterday that her husband John Phiri picked the child and made her sit on a hot charcoal brazier.

“It was after I asked him about food for the children that is when he got upset and started shouting at me and threatened to beat me.

“I told him that I was just worried about the children who had not eaten anything for two days. I told him that he was the father of the children and that he is responsible to ensure they have food. That was when he picked the child and put him on fire,” she said.

Mrs. Phiri further narrated that she quickly picked up the child from the fire and called for help from neigbours.

“At this point my husband ran away from home but people started chasing him, so that he could be taken to the police,” she said.

Mrs. Phiri said she took her child to the clinic and reported the matter to the police. She said police are still pursing the matter adding that she would like her husband punished for the offence.

And her neigbour, Bridget Banda, who witnessed the incidence told UKZAMBIANS that Mr. Phiri was fond of beating his wife each time she asked him about food.

Mr. Phiri, 33, has seven children most of them do not go to school, just two attend community school.

Last week, police on the Copperbelt arrested a man of Chingola town for murder after he allegedly threw his ten month old daughter into a well. The man threw his daughter following a marital dispute with his wife.

A 33-year-old man of Mulenga Chipalo village in chief Chipalo’s area in Luwingu district of the Northern Province has killed his son over beans.

Ruben Bwalya killed his six year-old-son yesterday after the boy ate the entire pot of cooked beans.

Police in Luwingu confirmed to ZANIS that the incident happened during lunch hour after discovering that there was no relish for lunch as the beans which had just been prepared had been eaten.

When he asked, the child admitted to having consumed the beans because he was hungry. The answer annoyed Mr. Bwalya who then whipped the child until he died.

Police said Mr Bwalya whipped his son before being rushed to the district hospital where he was pronounced dead. Mr Bwalya later ran into the nearby bush.

Police have since launched a man hunt for Mr Bwalya who is suspected to be in neighbouring Kawambwa district in Luapula Province.
