BUFFALO, N.Y. (AP) — A jury Thursday convicted a New York father of second-degree murder for shattering his 10-year-old stepson's skull with a rolling pin, rejecting defense claims that he was just trying to get the child to do homework and didn't mean to kill him.
A state Supreme Court jury in Buffalo deliberated about three hours before finding Ali-Mohamed Mohamud guilty.
"Justice has been done," prosecutor Thomas Finnerty said. In closing arguments earlier, he'd mocked the idea that there was no intent to cause death, a key element for a second-degree murder conviction.
"How about intent to slaughter?" Finnerty asked.
With the mother of victim Abdifatah Mohamud and other relatives crying quietly in the courtroom, the prosecutor had walked jurors through the prolonged and grisly killing that occurred in the family's basement April 17 while the boy's mother worked the second shift cleaning offices in downtown Buffalo.
After the boy known as Abdi had tried to run away, Mohamud stabbed him with a kitchen knife, tried to drown him in the bathroom and brought him into the basement where he gagged him with a sock and duct tape, bound his hands with an electrical cord and struck him nearly 70 times with a hardwood rolling pin, stopping only when the child was obviously dead on the floor.
Finnerty recounted a medical examiner's testimony that Abdi suffered four lethal injuries among damage covering his entire body, including a blow to the head that had "internally decapitated" him, separating the skull from the spinal column.
The child's mother, Shukri Bile, gave birth to Abdi while living at a refugee camp in Uganda, having fled violence in Somalia that killed her older children's father. Bile and her children arrived in Buffalo in 2004, where Bile met Mohamud, who also is from Somalia.
"Why did he lose control?" Mohamud's attorney Kevin Spitler asked during closing arguments. "He just wanted his son to succeed. He just wanted his son to be ready for that state-mandated test. He just wanted his son to do his schoolwork. He just wanted him to be educated."
"Good reason to fall into that rage? No," Spitler said.
But without an intent to kill, the lawyer told jurors, they should acquit Mohamud.
"It's a very sad and tragic case," Spitler said after the verdict. He said he would appeal.
After killing Abdi, Mohamud waited for Bile to return home and told her Abdi had run away. He went to The Buffalo News, where he worked as a security guard, and was arrested there after police responding to Bile's missing child report found Abdi's body in the blood-spattered basement.
Mohamud faces up to 25 years to life in prison when he is sentenced Nov. 15.

Dad 'drugged children then murdered wife' (Southhampton, England, United Kingdom)
Sounds like dad GEORGE KIBUUKA is the type who leaves nothing to accident. He PLANS. So it seems he "allegedly" drugged the children before taking a sledgehammer and knife to his wife. That way, there are no witnesses to the murder, see.
Are we supposed to be grateful he didn't slaughter the kids too? That he's only left them traumatized and without a mother?
Notice that Dad is trying to play the mental health card ("diminished capacity"), but that in reality, this is a classic domestic violence homicide. He had a history of battering, and the mother was attempting to get a divorce. Leaving an abuser is always the most dangerous time for women and children.

A wealthy husband used a sledgehammer and knife to murder his wife after drugging the couple's children so they would not witness the attack at their Southampton family home, a court has heard.
IT consultant George Kibuuka, 48, launched the "truly terrible killing" as his estranged wife Margaret lay asleep beside one of the children. Another child was also asleep in the room. He then stabbed himself in the abdomen and took organophosphate pesticide, but was found by paramedics and survived, Winchester Crown Court heard.
Kibuuka denies murder and administering a stupefying drug to three of his children so he could carry out the attack. He admits the killing but his defence said it was because of diminished responsibility as he was suffering from an abnormality of mind.
Part-time carer Mrs Kibuuka, 40, had filed for divorce, claiming her husband had been violent towards her, but Kibuuka did not accept the marriage was over and did not want to lose his considerable assets. The mother-of-four had gone to the police to complain about her husband's violence and emotional abuse in the weeks before her death in November last year. She even told a neighbour she slept with a knife under her pillow because she was scared of Kibuuka, who she described as domineering and unpredictable, the jury heard.
Nigel Lickley QC, prosecuting, said that Kibuuka earned £90,000 a year from his job and he was well thought of. He owned four houses as well as land in his native Uganda. The couple had married in Uganda in 1987 and moved to the UK in 1990, but Kibuuka had affairs with other women, including Mrs Kibuuka's two sisters and he fathered two children with one of them.
Tension had been building in the family home over the months as Mrs Kibuuka moved on with her life and considered a university course while Kibuuka worried he would lose money because of the split, Mr Lickley told the jury.
The barrister said that on November 7 last year, Kibuuka put sleeping tablets into the food and drink of the children and in the early hours of the next day he woke up and went to his wife's bedroom with the sledgehammer in darkness. That day he had also bought the knife he used in the killing, the court heard. He told officers his intention was to break his wife's legs so she would be dependent on him and stop the divorce.
Mr Lickley said: "He told officers he struck at what he believed were his wife's legs but he could not see what he was doing. He turned on the light and he realised he had hit his wife's head by mistake. He said it was an ugly image. He told police he believed she was dead but in order to 'minimise her pain' he went to his bedroom, selected the knife, returned and cut his wife's throat."
He then picked up the still-sleeping child and put the youngster in his bed. The blows caused two fractures to Mrs Kibuuka's skull and the knife wound sliced right through her throat and into the vertebrae, the court heard. The children awoke the next day to see their mother dead in a pool of blood and they thought their father had also died.
"The children on that Sunday morning having found that scene wandered out into the street and found a neighbour. They thought their parents had been killed by an intruder or burglar," Mr Lickley said.

Dad kills son in "ritual sacrifice;" had possession of child after he "chased off" mother (Kisowera, Uganda)
Apart from the role played out by the witchdoctor, this story could have taken place anywhere in the world where an abusive father has "chased off " or excluded a mother from protecting and caring for her child. In this case, dad DAVID MWESIGYE suffocated his 1-year-old son to death and "partially detached" his genitals. The mother, who was separated from the father, had been attempting to see the baby, but had been prevented from doing so.

DAVID Mwesigye suffocated his son to death. He then carried the body from his home in Kisowera along the Mukono-Kayunga road to Godfrey Ssajjabi, a witchdoctor in Kigunga, about 15km on the Kampala-Jinja highway.
Under the cover of darkness, the two dug a hole at the edge of the witchdoctor’s compound, placed the body in the hole and planted a banana sucker to avoid suspicion.
It was Saturday 23rd September, 2007. Only Mwesigye and the witchdoctor knew that little Derrick Mutebi was no more. At the age of one and a half years, he had been brutally killed by his father, a television technician, the very person who was supposed to nurture him.
By coincidence the boy’s mother, Ephransi Namuddu, who had separated from Mwesigye, felt the urge to go and see her son.
When she did not find her son in the house, Mwesigye lied to her that the boy was living with his grandmother in Maganjo on the Kampala-Gayaza road.
She went all the way to Maganjo, only to be told that Mwesigye had not taken the boy there. It was then that she reported to Police that her son had gone missing.
Mwesigye was arrested and he led Police to the witchdoctor’s place where they had buried the body. Police exhumed the body and took it to Kawolo Hospital for a postmortem.
As Mwesige confessed in court on Wednesday, he could not come to terms with what he had done to his own son.
He broke down and cried while testifying before a special High Court Session in Mukono which was presided over by Justice Jane Kiggundu.
“I didn’t intend to kill him. I was only disciplining him,” he pleaded.
Initially Mwesigye claimed that the boy had been electrocuted. But his landlord, Katende Bumali, testified that he did not have electricity in the house.
Later he changed, claiming he was only administering a disciplinary beating when they boy died. But the post-mortem report from Lugazi hospital showed that the boy suffocated to death.
The report also showed that the child’s genitals were partially detached.
Left with no other lie to tell, the two pleaded guilty. But they pleaded for lenience arguing that they were first offenders.
Mwesigye added that he had learnt a bitter lesson that it was not proper to punish a child like an animal, and that he would not repeat the offence.
Their lawyer, Musa Sembajja, also asked court to be lenient to them by giving them the minimum sentences because they had not wasted court’s time by denying the offence.
The lawyer further asked that the witchdoctor should be given a lighter sentence of seven years in jail since he did not participate in the killing. “He only accepted to have the body buried at his place.
The only offense he committed was that he never informed Police.”
But the Resident State Attorney Gladys Nyanzi asked court to give the duo a maximum sentence, which is death.
She argued that killing one’s own child and cutting off the genitals was strong evidence of ritual murder, for which the two should be severely punished.
Nyanzi said that by killing the boy, Mwesigye violated the responsibility given to him by the Constitution to protect his children’s rights to life.
“The boy suffered twice when Mwesigye chased his mother from home and when he killed him.
This is a case of murder of a child. It is one of the child sacrifice cases which are rampant in Uganda today. It is my request that in your sentence you show that murder is punishable in the courts of law,” she added.
Nyanzi explained that Ssajjabi was equally responsible for killing the boy because he did not report the matter to the Police.
“Child sacrifice is an inhuman habit that must be fought. Scenarios have shown that body parts of human beings are on a high demand by the witchdoctors.
The deceased’s genitals were partially detached meaning that they were the target,” she said. “I therefore appeal for the same sentence for Ssajjabi.”
The ruling was set to be made yesterday but the judge postponed it to Monday after the defence lawyer asked for an opportunity for his clients to make an additional plea.
He argues that much as they pleaded guilty to the murder, it was not ritual sacrifice as depicted by prosecution.

Seventeen-year-old girl rescued from custodial dad who "defiled" her (Bamunanika, Uganda)
Dad RICHARD OKUMU is being held at the police station, while "investigations" continue into his repeated "defilement (i.e. rape) of his 17-year-old daughter, who became pregnant and was forced into an abortion. No mention of the girl's mother. Sounds like this is essentially a custodial father, since the girl lived with him.

A seventeen year old girl has been rescued from her father who repeatedly defiled her and became pregnant as a result.
The girl has been living with her father identified as Richard Okumu in Bamunanika, Luweero district. She has been rescued today by the area LCI chairperson after a tip off.
Okumu is being held at Bamunanika police station as investigations continue.
The girl told police that her father had defiled her over five times. The police officer in charge of family affairs at Bamunanika police, Rosemary Atim says they are planning to take the girl to the African Network for the Prevention and Protection Against Child Abuse and Neglect or any other organization for help.
The girl says her father forced her to abort when he learnt that the girl had become pregnant.

A 43-YEAR-OLD man has been detained over allegations of defiling his daughter.
John Rusongwire of Kamuli Zone in Kira town council, Wakiso district was arrested after the girl’s mother, Florence Nshemerirwe, complained to the Police at Kira division.
The girl, 12, was defiled last December, said the Police spokesperson, Judith Nabakooba.
The suspect allegedly went to the victim’s grandmother, Barbra Nanteza, saying he wanted to stay with his daughter. Nanteza’s home is in the same locality with Rusongwire’s .
“One night, the man went to the girl’s bedroom and told her that he was looking for something. He lit a candle and looked around the room,” Nabakooba said.
“Suddenly, the man pounced on the unsuspecting girl and had sex with her.”
“The victim did not report the incident to anyone. However, when her father defiled her two more times, she fled back to her grandmother’s home,” Nabakooba added.
Nanteza, the victim and her mother went to the Police station where they recorded statements.
The victim was taken to Mulago Hospital for examination and the findings would be used as evidence in court, Nabakooba added.
Despite denying the offence, Rusongwire allegedly told the Police that he was under the influence of alcohol.
Nabakooba said investigations were going on.
According to the amended Chief Magistrates Act, a man who performs sexual acts with a girl aged 14 years and below commits aggravated defilement that attracts a maximum of a death sentence.

“We found a will which means the man had planned killing the wife and himself,” Mr James Katushabe, the Kiruhura District Police Commander, said.
Mr Katushabe said the children reportedly said their parents have on several occasions been involved in quarrels. The Police have detained the children as investigations proceed while bodies of the deceased were taken to Mbarara Hospital Mortuary.

Dad kills son over dowry demands; village women then kill dad (Acolicoli, Uganda)
Dad LOGWATELE LONGOLE was apparently irked by his son's demands for dowry money so he could be married. So Dad stabbed the son to death. The women of the village were infuriated, and quickly mobilized so that justice would be done. They attacked the dad with stones and clubs and killed him. Not that I'm a big defender of violence against anybody. But if the killers of women and children knew that the community at large TRULY did not tolerate violence, I think we'd see some different results. And a salute to Uganda women who defend the innocent. Wish women in the west would show some similar backbone.

A Pokot father on Sunday stabbed his son to death in Moroto district before a group of village women descended on him, killing him instantly.
Logwatele Longole, a resident of Acolicoli village in Looro sub-county, stabbed his son, identified only as Lopejon, 25, in the abdomen. He died instantly.
Lopejo, had reportedly gone to his father, who is also a local councillor, on several occasions demanding for dowry to pay for a girl he wanted to marry.
The Looro sub-county LC3 vice-chairman, Mary Kizza, confirmed Lopejon’s death saying it infuriated the women.
“They mobilised quickly and attacked Logwatele with stones and clubs, killing him,” Kizza said.
Acting District Police commander Cox Apamaku, when contacted, said he was not aware of the murder.
“Certainly I’m not aware of the death of these people,” he said.
By press time, father and son had been buried in Acolicoli village.

Two daughters rescued from rapist dad (Busaale, Uganda)
Two daughters have been rescued from their father, MUTUMBA MUGGAGA, after they reported that he had repeatedly "defiled" (raped) them. One became pregnant. It sounds like this is a single dad.

TWO teenage girls aged 12 and 15 have been rescued from their father who repeatedly defiled them.
The elder girl became pregnant as a result.
The girls have been living with their father identified as Mutumba Mugagga in Busaale village Nakisunga sub-county in Mukono district.
They were rescued last week by a local Non-Governmental Organisation, the African Network for the Prevention and Protection Against Child Abuse and Neglect (ANPPCAN) after a tip-off.
Information officer Haruna Mawa said Mugagga was being held at Nazigo Police Post in Mukono district.
“One of the children testified to the Police that she was defiled four times by her father,” Mawa said.
Addressing a press conference at ANPPCAN offices in Kampala yesterday, Mawa said when Mugagga learnt that one of his daughters had become pregnant, he forced her to abort.
Mawa explained that Mugagga connived with a local council official to hush up the matter.
The LC official, Mawa added, had also been arrested to assist the Police with investigations.
“We condemn these ill-practices and call upon the Government to expedite the process of prosecuting defilers, including parents who have down-graded their role by defiling their own children,” Mawa stated.
He said defilement was common in Mukono.
Mawa decried the slow pace in which the justice system handles the cases.
“Last year, 4,124 cases of defilement were taken to the courts, but only 333 convictions were made.
This represents only 3.8% of the cases,” Mawa said.
He proposed that that the Police be equipped with more skills and resources to enable them execute their duties.
He pointed out that there were less than 20 Police surgeons in the country to examine defilement victims.
“This has made the examination of defilement victims difficult. This state of affairs has made the reporting of cases complex,” Mawa noted.

According to the judge of that judicial institution, Aníbal Manuel Francisco, the charges against the 45-year old defendant were accepted and proved by the Prosecuting Council, that he committed the rape, which is punished by the Criminal Code.
The judge explained that the father arrived home drunk, held a knife and forced his daughter to have sex with him, threatening to kill her if she had screamed, but during the act the victim did scream.
He added that a neighbour heard the scream and went to the house, finding the father on top of the girl.
