Father jailed for abuse of children
By Melissa Wishart 9:00 AM Friday Aug 7, 2015
A Wanganui man found guilty of sexually abusing his stepdaughter was jailed this week.
The 36-year-old was also sentenced for assaulting six of his children and stepchildren.
The man, who has name suppression to protect his victims' identities, was found guilty by a jury in June on two counts of performing an indecent act on a child.
The offending was against his stepdaughter, who was aged between 8 and 10, several years ago.
The man had already pleaded guilty to six representative charges of assault on a child, when six of his children and stepchildren were aged between 8 and 13.
Incidents with the man hitting them with his hands, a toy fishing rod, plastic spoons and a leather belt were heard in the Whanganui District Court on Wednesday.
One of the children came home late from school one day after missing the bus, and was told by his siblings "Dad is going to give you a hiding,"
Judge David Cameron said. "[The child] said that the defendant hit him with a force that would have been eight-and-a-half out of 10."
On another occasion the child accidentally broke a picture frame, and the man was about to hit him when the mother intervened, Judge Cameron said.
However, when the mother went to the shops, the man hit the boy in the face, giving him a nosebleed.
In another incident, he hit the boy in the face when he locked the housekeys in the house, and accidentally broke a window trying to get in.
The man also hit other children, and kept them home from school so nobody would see the marks on their bodies.
In one incident the man threw one child against a wall and kicked them on the hip when they fell to the floor.
The boy described the kick as "five out of five - hard".
The man "then stood on [the child's] throat and held his foot down", Judge Cameron said.
The man denied this particular offending, but both Crown prosecutor Lance Rowe and defence lawyer Stephen Ross acknowledged no disputed facts hearing had been held, and it would not affect the end sentence.
Mr Ross said the man moved to New Zealand from Tonga when he was 17.
"The cultural context is raised because it is made clear in the probation report that [the defendant] still holds strong Tongan cultural beliefs," Mr Ross said.
He pointed out it was not until 2007 the law was changed to ban "reasonable" physical force when disciplining children.
Mr Rowe said the "key aggravating feature" of the sexual offending was "the extent of the breach of trust".
Mr Rowe also said the man knew the child assaults were wrong, despite his cultural beliefs, because he hid the children's injuries from other people.
Judge Cameron read from the mother's victim impact statement, where she described violence being part of their daily life: "
She finds her anger against him hard to describe and she describes him as a violent man, hiding behind a quiet demeanour."
A pre-sentence report described the man as being at "moderate" risk of reoffending, and said he showed little remorse.
The man has no previous convictions, but as he committed multiple assault offences, Judge Cameron did not consider it appropriate to discount his sentence for that.
He sentenced him to two years and six months in prison and gave him a warning under the three strikes law.

Dad gets 6 years in jail for killing 3-year-old daughter (Auckland, New Zealand)
Typical fawning over a killer dad. He was "frustrated," he didn't know his own strength, he's really a "good man," blah blah.
Yup. This is the same dude who swung his his 3-year-old daughter INTO A WALL, then STOMPED ON HER PELVIS. Good man my @$$. Is that how low we set the bar for "good men" these days? He's "good" because he didn't then stomp on her skull or throw her off a bridge? I am totally sick of all the people making excuses for and minimizing male violence, especially against children.
Very rarely see this with mothers who kill, who are treated as the very Embodiment of Evil Incarnate.
Dad is identified as KEFU IKAMANU.

Father jailed over child's death
Updated at 7:17 pm on 19 October 2012
An Auckland man has been sentenced to six years and nine months jail for the manslaughter of his three-year-old daughter, who he'd thrown against a wall.
Kefu Ikamanu was found guilty of manslaughter and causing grievous bodily harm at a jury trial in August, but acquitted of murder.
Seini Ikamanu was admitted to hospital in March 2010 with severe injuries to her head, shoulder and pelvis.
She spent eight months being treated by doctors before dying in December.
Justice Venning told the High Court in Auckland Ikamanu became angry at his daughter when she was playing with her brother, grabbed her by the arm and swung her against a wall, before stomping on her pelvis.
He says the incident was a one-off and out of character, caused by Ikamanu's frustrations at his daughter and was one that he almost immediately regretted.
Justice Venning says Ikamanu did not know his own strength, the consequences of his actions and that they would cause the child's death.
Ikamanu's lawyer says the man faces deportation to Tonga once his prison sentence is completed.
His relatives say they trust him to be with his children again.
His wife and the mother of Seini, Sela Ikamanu, says she knows what her husband did was wrong, but he is a good man and of good character.
She says he will be welcomed back into the family when he is released from jail.
Meanwhile his laywer, Simon Lance, is considering appealing the conviction for grievous bodily harm.

Father inflicted shocking injury on child who asked for food, jury told
17 May 2010, 17:37
Nuku'alofa, Tonga:
A father from Popua, Sione Talia'uli (31) appeared at the Nuku'alofa Supreme Court today, May 17, charged with the murder of his four-year-old-son Tutei Talia'uli at Popua in September last year.
The defendant appeared for the first day of his jury trial today represented by counsel Sifa Tu'utafaiva while the Solicitor General 'Aminiasi Kefu represented the Crown Prosecution.
In opening the prosecution's case it alleged that the defendant murdered his son, the youngest of his three children, by assaulting him causing grievous bodily harm to his body causing his death on September 8, 2009.
The four-year-old boy, who has a twin sister, was beaten up by his father for two days firstly on Saturday, September 5, 2009 where the defendant used a wooden stick that left bruises on the young boy's body.
The court was also told that the beating was because the young boy had complained that he did not have enough food to eat.
The Crown also alleged that the father again beat his young son on Monday, September 7 but this time with an electric wire that had a knot at the end. The beating was so severe that the boy was left speechless. The child's mother Siutaisa Tupou Talia'uli who awoke to the beating stopped her husband and got the child.
On Tuesday September 8 the parents saw that Tutei was not in a good condition so they rushed him to the hospital where the Pediatrician at Vaiola Hospital Dr Siaosi 'Aho examined him.
The Crown added the pediatrician was shocked with the injury inflicted on the child who passed away at 10:00am on September 8, after his heart failed.
The Crown would call 10 witnesses to give evidence in the jury trial that is expected to run for the remainder of the week.
No bail
After hearing the prosecution today, Mr Justice Shuster revoked the defendant's bail. He said he would review the bail after the Crown finishes their case.
In Tonga there are only two penalties for murder, one is the death sentence and the other is life imprisonment.
The latest murder conviction was on May 10, when Tupou Vaivai Pole'o Palu (19) was sentenced to life imprisonment after jurors found him guilty for the murder of Silivesiteli Tonga'uiha (35) at Houma last year.
