The Hague upholds US custody rulling: 10-year-old girl returned to junkie child molester dad (Washington, DC)
Sickening that a father like DAVID HUNTER is not only NOT behind bars, but getting custody of a 10-year-old girl. This is directly due to the courts being infiltrated and controlled by the fathers rights/pro-pedophile groups.

International custody quagmire: Court sends girl to father she fears
by Michael Volpe - May 30, 2015 1 128
Despite expert opinion warning against it, The Hague upheld US custody rulings and sent "Ruby" now aged 10 or 11 to live with her father who she says has been sexually abusing her since age 5
WASHINGTON, May 30, 2015 – A court in The Hague recently forced a child to live with the father she claims has molested her. This is the same court which recently heard cases involving notorious international criminal scofflaws like José Maria Sison, Frans Van Anratt, Heshamuddin Hesam, and Habubullah Jalazoy.
Geerte Frenken first met David Hunter in 1998 while doing intake work for with Ibogaine for Ibeginagain, an alternative detoxification clinic for hard drug addicts, where Hunter was a patient. According to statements Hunter made on the internet, he has been using drugs off and on since he was eleven years old.
Frenken and Hunter met again in 2000 in San Francisco. They began dating and married in 2001. They had a daughter “Ruby” in 2004.
Frenken told CDN that when “Ruby” was about six months old, Frenken caught Hunter doing heroin. Later the same week, he admitted he was having an affair. The marriage, Frenken said, quickly fell apart. She and Ruby moved to Texas a few months later.
Frenken said that she had primary custody of Ruby, with Hunter getting visitation. Hunter, says Frenken, never asked for sole custody until allegations that he was molesting Ruby surfaced.
Frenken said that initially Hunter only visited Ruby sporadically. This lack of consistency became a source of tensions between Frenken and Hunter, because Frenken wanted Hunter to participate more regularly in Ruby’s life.
An email from Frenken to Hunter on December 4, 2008, reflects that view.
In the email, Frenken writes,
“Can we get back to the discussion of earlier this year where you said you would be coming more regularly? At that point we talked about every six weeks. I understand if that is not feasible financially any longer, but I think there is a serious need for some consistency- a regular schedule Ruby can get used to.”
In 2009, a Nevada County Court, California family court gave Frenken custody of Ruby 80% of the time with the rest to Hunter. However, Judge Julie McManus of Nevada County then changed the custody agreement, giving both Frenken and Hunter 50% custody.
In 2010, Hunter admitted to a drug relapse and failed two drug tests. Hunter was required by the courts to provide Frenken with the results of his drug tests. However, when he started to fail those tests, Frenken lacked the financial ability to challenge the custody ruling with the court.
Hunter told CDN that the failed drug tests were for prescription drugs. However, test results revealed levels of opiates, the primary ingredient in heroin.
Frenken said that around this time, “Ruby” started coming home angry and agitated from visits with her father.
“Ruby comes back from the visit with uncontrollable behavior again. Similar scenario as the previous visits: kicking, screaming, biting herself, biting me, bedwetting etc.” Frenken said of one visit. “This time she also starts leaving the lights on, even during the day and she won’t let me out of her sight. I even have to go to the bathroom with her. In my mind I am thinking: ‘what is going on’? She tells me she was being forced along a steep cliff by her father and she was afraid.”
In 2011, Frenken took Ruby to Kathryn Carter, a child therapist in Texas. Carter’s report concluded that Ruby was processing “humiliation, cruelty and revenge” and noted “sexualized behavior.”
In 2012, Frenken’s mother in the Netherlands became ill. Frenken and Ruby went to the Netherlands for what should have been a short visit.
During that trip to the Netherlands, Frenken said her daughter confided that Hunter had been “touching me in the private parts” and that this had gone on since she was four years old.
Days later, Ruby was referred by Dutch Child Protective Services to a State Mental Health Institute for Children called GG Net Jeugd where for the next eight months experts in child abuse tested, interviewed, and investigated the claims.
Dr. Rita Zecher Ianhoro led the investigation and submitted a report January 31, 2013.
“I ask her what the visits with father were like. Ruby becomes anxious and the building blocks with which she was building a portal on the table fall down. ‘Father should be locked up,’ says Ruby.” Dr. Zecher’s report stated. “When I ask why, Ruby becomes angry, ‘because he touched my private parts.’ When I ask when this started, Ruby said it happened at age 4 and when she was five and six years old.”
“Since the start of her treatment, Ruby states that she definitely does not want to return to her father. She is quite emphatic about this,” reported Dr. Zecher.
Frenken said that when she told Hunter about the results of the investigation and about her intention to stay in the Netherlands because she no longer had the funds to fight custody he filed an appeal with the International Court in The Hague demanding that Ruby return to the United States.
Hunter, his current U.S. attorney Kelly Reiter, and Dona Woods Glanz, who represented him in custody hearings in Nevada County from 2009 to 2014, all say the charges against Hunter are false.
“These incidents did not happen,” Glanz said.
Hunter added that he was “thoroughly investigated by the Fairfax Police Dept. and the Marin County DA’s special investigator on all of her allegations, all of which were dismissed.” Hunter also stated that the DA’s office and Child Protective Services conducted the investigation. He also claimed that Ruby was questioned in his presence. If true, this would represent a substantial breach of protocol for investigations of child abuse.
CDN could not independently verify that any investigation has been conducted.
“I think she suffers from some pretty serious mental health issues,” Reiter said about Frenken in a voice mail. Those sentiments were echoed by Hunter in an email, “You sir, are dealing with a pathological liar / hypocritical ex-junkie/ sexworker woman with serious emotional problems.” But a 2010 custody evaluation paints a more complicated picture, showing that both parents were dealing with some normal psychological issues.
“Dave scored in the high category on the histrionic clinical personality scale, and in the low category on the compulsive, narcissistic, and antisocial clinical personality scales, in that order.”
“Regarding diagnostic impressions, Geerte’s psychological testing is associated with moderate paranoid personality functioning, and partial breakdowns of reality testing under stress. Concerns with respect to psychosomatic problems were also suggested, but this may be an understandable spike in her psychological testing based on her ongoing physical disability issues.”
Frenken said that the child abuse team at GG Net was not allowed to testify at The Hague. Ruby, according to Frenken, did testify, and repeated that she didn’t want to go back with her father.
According to information from the Court,
“In the interview for this appeal the minor child showed a great resistance to returning to the USA. She does not want to return because she is afraid the Father will visit her and states she does not feel safe with him. She is very angry because she has the feeling no one is listening to her.”
The Hague Court dismissed Ruby’s testimony stating that it was of the opinion “that the minor child did not show a sufficient degree of maturity during the hearing in the judge’s chambers, so that the views of child cannot be taken into account.”
Frenken’s Dutch attorney, Ariane Hendriks, said that the psychiatrist hired by The Hague court also concluded that Ruby should not be reunited with her father:
“(a) child psychologist spoke with Ruby during the cross-border mediation that took place between Geert and Mr. Hunter. The child psychologist had agreed to supervise a meeting between Ruby and her father within the context of the mediation UNLESS she would find that Ruby’s resistance against meeting her father was so strong that in her professional opinion, enforced contact would be against Ruby’s best interests. And this is what she found. No supervised meeting took place during mediation because the child psychologist was of the opinion that this was not responsible.”
The Hague ignored Ruby’s request and recommendations by both psychologists, and ruled in jurisdictional grounds,
“Now that the grounds for refusal as referred to in Article 1 paragraph 13, subparagraph b, and paragraph 2 do not apply, while less than one year has passed since the illegal detention and submitting the petition, the minor child must be returned at once.”
The decision stated that since a US court gave joint custody to both parents in the USA, this situation should continue. #In issuing this decision, The Hague Court ignored its own convention which states that a child would not be sent back if, “there is a grave risk that his or her return would expose the child to physical or psychological harm or otherwise place the child in an intolerable situation. The judicial or administrative authority may also refuse to order the return of the child if it finds that the child objects to being returned and has attained an age and degree of maturity at which it is appropriate to take account of its views.”
An email to The Hague Court was not returned.
On May 21, 2015, Hunter’s girlfriend emailed Frenken, scolding her for starting a website on the story. However, in the email she suggested that Hunter was in fact abusing her daughter,
“You name her school and show her photos though. She will be a teenager soon and will have Internet access, if you were a young victim of abuse; would you want all that splashed all over the world for anyone to see?”
She later clarified to CDN that she only wrote this because Frenken believes the claims,
“My comment was taken entirely wrong. I only meant for Geerte to reconsider sharing all that personal information in the permanent context of cyber space. I believe that Geerte was, personally, a young victim of abuse and I believe she’s putting all her past experiences onto Ruby.”
Frenken denies that she was ever abused and this purported claim, she told CDN, is part of a campaign to gas-light her.
Neither Hunter nor his girlfriend provided any evidence, besides their accusations, that Frenken had been abused.
After the verdict, Frenken hid with Ruby for about six months. She then returned to the Netherlands, at which point a SWAT team removed Ruby from her custody. Ruby was then deported back to the United States.
Ruby has been living with her father since April 2014. Frenken said she has been allowed only one session on Skype with Ruby over the last six weeks.
While CDN is the first media to cover this story in the USA, her story has received some traction in the Netherlands.
Reiter said Ruby is doing “great” since moving back to the USA. She also admitted, however, that she has had no personal contact with Ruby.

Custodial dad, step arrested for abusing 12-year-old daughter; girl in critical condition (The Netherlands)
I don't pick up a lot of stories from the Netherlands, but in format, it is virtually indistinguishable from the stories we see in every other country. Custodial dad and step misrepresented as "parents." Zero mention of the mother or how Dad acquired custody. No interest in whether a father who did this to the kids was equally capable of doing something to their mother. No curiosity as to how she "disappeared" from the picture.
But we do see an interesting hint here in that that the step's involvement in a child "protection" agency (i.e. abuser protection agency) may have helped them get away with this for so long.

A seriously injured 12-year old girl from Roelofarendsveen, Zuid-Holland, who was taken to a hospital last week, was abused for years by her father and stepmother, according to the family’s neighbors, an Omroepwest.nl report reveals. Both are suspected of abuse and neglect and are being held in custody. The father will face a magistrate on Friday.
The girl was in a critical condition last Monday and had to be resuscitated four times before being transported to hospital, neighbors comment. When doctors noticed serious wounds not caused by CPR, the hospital notified police. The girl remains in an unstable condition, the broadcaster said.
Neighbors on Geestweg say that they have repeatedly reported problems with the family to child care authorities and emergency services. They say the brother of the abused girl was often locked in a shed and made to stay on the street in his underpants with tape over his mouth as a punishment. The children were systematically beaten and did not get enough food.
The case has lead to unrest, since the stepmother is the Vice Chairman of a child protection organization.
But we do see an interesting hint here in that that the step's involvement in a child "protection" agency (i.e. abuser protection agency) may have helped them get away with this for so long.

Father of missing boys wrote suicide note, did not mention his sons
Tuesday 14 May 2013
The father of two boys missing for over a week left a suicide note on his computer, police said on Tuesday.
In the letter, the man said he did not see any point in living any longer but did not give a motive. The letter made no mention of the brothers, aged nine and seven, who were last seen on Monday evening a week ago.
Their father’s body was found in woods near Utrecht on Tuesday morning.
The letter was written on Monday afternoon, after the man had collected his sons from their mother. He told his ex-partner they were going on holiday to Luxemburg.
More details are emerging about the man’s final hours. Police say they now know he withdrew €175 from his bank account on Monday but only €45 has so far been accounted for.
He also bought petrol in Limburg on Monday evening and phoned his girlfriend to say he was in a hotel. Police say that call was actually made from the car.
Searches of woodland in Utrecht and Limburg have failed to turn up any sign of the boys.
Their disappearance will be the subject of a television appeal on Tuesday evening.

New documentary tackles flawed family court system (Boston, Massachusetts)

New Documentary by BU Professor Tackles Flawed Family Court System
By Lauren Michael | Dec 5th, 2011
In 1992, Holly Collins went to a Minnesota family court intending to secure full custody of her two children, Zackary and Jennifer. She had believed that if she told the truth–that her ex-husband had repeatedly abused her and their children–everything would be okay. But her evidence of abuse, including several medical records and the children’s statements that they always feared visiting their dad, were repeatedly rejected by the court. Her husband claimed she was lying and trying to alienate their children from him. Then, like thousands of battered women each year, Holly lost full custody of her children to their abusive father.
After two years with limited supervised visitation, in which the children weren’t permitted to discuss the ongoing abuse, Holly decided to do something. One day, she asked her kids to meet her at a video store near their dad’s house. They got into a car and started driving. They tried going to Canada, Mexico and Guatemala. Knowing the FBI was searching for them because Holly had in fact kidnapped her kids, she decided to try escaping to Australia or New Zealand. They managed to sneak through airport security without passports and got onto a flight to Amsterdam. There, they were detained and sent to a refugee camp. Years later upon finding a lawyer willing to take her case, Holly became the first U.S. citizen to be granted asylum by the Netherlands on the grounds of domestic violence.
For COM Professor Garland Waller, Holly Collins’ story was the perfect outlet for her to make a documentary on the shortcomings of the American family court system. “My first documentary was about three women who all lost custody of their kids to men who had battered them and sexually abused them,” she said to me when I interviewed her last Thursday. The documentary was never aired for the public, however, because people considered it way too controversial.
“I thought, I know this is an issue that is going on in the family courts, every single day,” Professor Waller explicated. “How can we do a story on this issue of domestic violence and child abuse that people will want to see; that will have a story that has a beginning, middle, and end; that has a hero; and that doesn’t make them feel suicidal at the end?” That’s why she decided to center her film around Holly’s story. ”Holly is one of the few women who has been able to save her children from years of being abused,” she affirmed.
On December 2 at 7pm in COM 101, Professor Waller and her production team screened the film No Way Out But One for a packed lecture hall of students and faculty. The hour-and-a-half long documentary, which was followed by a Q;A session, follows Holly’s story and also outlines the grievous problems 0f the American family court system. Made for under $40,000, the not-for-profit film was a way for Professor Waller and her husband Barry Nolan (who also produced and narrated the film) to make a difference.
“This is what I do to give back,” she explained. “Some people work for charity, some people give to the United Way, but this is what I do.”
As the documentary cites, each year 58,000 children are placed in contact with an abuse parent after divorce, and batterers win custody in 70% of family court cases where abuse is involved.
Professor Waller also cited the lingering gender bias in the family courts. “Courts do not have to consider domestic violence in their rulings, ” she said. “Now that is anti-woman, because it’s usually the women who get beaten up.” Money, she says, is also involved. “The men who want custody are the ones who can afford to have the kids, and you have to be able to pay the court costs,” she explained. “This is something that doesn’t happen in poor families…it costs hundreds of thousands of dollars to pay all these people.” If the father is paying for the court evaluator, she says, often they’ll skew the evidence in his favor.
But even in ugly divorces, she says, usually the parents still want to do what’s best for their children. “When there are cases that involve domestic violence and child abuse, that is not the case,” she explained. “Women often get custody when there’s not domestic violence. But oddly, a batterer is more likely to go after custody than a non-batterer. So its a very complicated issue.”
Since the release of No Way Out But One, Professor Waller and her husband deal with angry father’s rights groups every day. These groups, like Fathers and Families, make an impassioned–if not entirely factual–argument for why they believe the Holly Collins case is a hoax. “After a nice review in a Boston Magazine blog, many pro-father’s rights men were highly critical,” she explained, but “none of them had seen the film and none of them had access to all the thousands of pages of legal documents and medical records and correspondence from experts and FBI documents that we had.” Many of these documents are shown and quoted in the film.
In their writings against Holly Collins, father’s rights groups cite Parental Alienation Syndrome, which means that a mother is trying to alienate her children from their father. Though it is not accepted as a legitimate diagnosis by the American Medical Association or the American Psychological Association (the psychologist who first wrote about PAS had conducted no actual studies), in family court it is often used to legitimize giving custody to an abusive parent.
As Nolan puts it, “these are people who do not and will not respond to evidence, or facts, or medical records, or court transcripts, or expert testimony if it does not fit their preconceived notions.” The groups say that Holly fabricated the evidence of her husband’s abuse, but in reality false allegations of abuse are very rare.
“Holly may not be perfect, but she was clearly a battered woman who only wanted to protect her children from abuse,” Professor Waller affirmed.
Still, this is an issue that has mainly been ignored by the mainstream media. “The mainstream media is terrified of getting sued, and this is a subject where everybody sues everyone all the time,” she explained. “It’s all he said/she said…so the mainstream media says, this is a mess and we’re not going to get into it. Just as the mainstream media did not cover pedophile priests abusing children, just as for years they did not cover the things that were going on at Penn State, it is the same thing only worse by thousands in terms of the children who are being abused.”
Many years after their mother kidnapped them, the Collins kids, now adults, are healthy and grateful for everything their mother has done for them. Jennifer Collins, Holly’s oldest daughter, is the executive director of Courageous Kids, an organization for young adults who suffered from court injustice as children to speak out and share their stories.
“I guess for me, the most important thing is that I would like people to realize that this is a national issue that is not going away until people begin to understand that in a family court, if you beat your wife and abuse your child, and go after custody, most of the time you will get it,” Professor Waller concluded. “I want to live in an America that protects the children.”

A Kearns father has pleaded no contest to harming his 7-month-old twins by handling them too roughly and will be deported as part of his sentence.
Antoneus Deslegte, 24, entered the pleas this week in 3rd District Court to two class A misdemeanor counts of child abuse. According to court documents, Deslegte picked up the children by one arm and was "generally rougher in his handling of the children than was appropriate for their ages," court documents state.
Deslegte originally faced five second-degree felony counts of child abuse after his daughter was admitted to Primary Children’s Medical Center in June with a broken leg. Doctors also examined the girl’s twin brother and found he had an older, healing skull fracture, police said.
Salt Lake County prosecutor Rob Parrish said the plea deal came about because of "issues that we weren’t aware of when we first charged him," but said he could not elaborate because the issues involved a juvenile court proceeding.
Judge Robin Reese sentenced Deslegte to 18 months probation and ordered him released to Immigrations and Customs Enforcement officials. Salt Lake County prosecutor Rob Parrish said Deslegte could be deported back to Holland as early as next week.

Documetary wins Telly Award (Boston, Massachusetts)
GARLAND WALLER PRODUCTIONS
PRESS RELEASE
For Immediate Release
June 10, 2011
(Boston, MA) The producers of No Way Out But One are proud to announce that it has received a 2011 Telly Award. Telly Awards “honor the very best local, regional, and cable television commercials and programs, as well as the finest video and film productions, and work created for the Web."
No Way Out But One tells the story of Holly Collins, the first American to ever be granted asylum by the government of the Netherlands as a result of domestic violence. In a desperate attempt to keep her children safe from an abusive father, Ms. Collins kidnapped her own children and went on the run. Hunted by the FBI, she used a loosely organized “protective moms” underground to escape and eventually made it to Amsterdam, where she first lived as a refugee, and was later granted asylum. Ultimately, she was vindicated and all charges against her were dropped.
No Way Out But One won in the short form documentary category. Work is now underway to expand it into a full-length documentary. Hundreds of pages of never before seen FBI files are now being carefully reviewed, and efforts are underway to recruit a cast of enormously talented, high profile vocal talents to help tell the story. Wendie Malick, currently starring in Hot in Cleveland, was the first to volunteer. More announcements will follow.
Garland Waller and Barry Nolan are the producers. Sid Levin of First Frame is the photographer. Erika Street is the editor.

Dad shoots to death 9-year-old son, 19-year-old daughter; mother injured (Zierikzee, Netherlands)
Yet another murder-suicide by an UNNAMED DAD. This one murdered his two children, while the mother was injured. Like many of these guys, he had a history of domestic violence and child abuse. But it appears he was never actually convicted and sent to prison. This one had been re-arrested in February for abusing his daughter. But the clueless authorities let him go, although they "banned" him from going near his family. Fat lot of good that did, right?

Father kills children and himself
In a house in Zierikzee in the Dutch Province of Zeeland, a 9-year-old boy and his 19-year-old sister have been found shot dead. The mother of the two children was injured.
The father, who is believed to have killed the children, has died in hospital after he shot himself through the head in a park near the house.
A third child, a 14-year-old boy, who was at the neighbours when the incident happened, was unharmed.
The Dutch Public Prosecution Office says the man had been in held custody for domestic violence and abuse, but was released in January. He had also threatened his wife.
Last month, the man was rearrested on suspicion of abusing his daughter. He was subsequently released but banned from going near his family.

Dutch father with "joint custody" abducts daughter; U.S. judge gives him "sole custody." So much for the Hague Convention (Pennsylvania)
During the MARK GOLDMAN fiasco, it was pretty disgusting watching all the pious handwringing in the U.S. about the sacred Hague Convention and how awful international "kidnapping" was. It's all hypocritical nonsense. These people--mostly fathers rights advocates--are more than happy to swing the other way when it's convenient to do so, and so do the U.S. courts.
Take this dad (identified here only LEENDERTZ). He is a Dutch national who had "joint custody" of his daughter with his ex-wife, a Ukranian national living in the Netherlands. Joint custody! This is a major demand of the fathers rights people. But it's all a ruse in many cases; it was in this one. Daddy wanted more, total control. So he abducts the child and takes her to the United States, where a U.S. judge granted him SOLE CUSTODY just two weeks ago. So much for the sacred Hague convention! Only now is a U.S. District Court judge saying, well, maybe she better go back to Holland. Dad's HOME COUNTRY and PLACE OF CITIZENSHIP. The girl's former place of residence.
So what "American authorities" were aiding this father and why? Who are they? What agency or organization are they with? Where do they get their funding?

Abducted Katja Leendertz to return to Holland
Published on 5 March 2010 - 12:50pm
Katja Leendertz is to return to the Netherlands, a US judge ruled on Wednesday. The eight-year-old girl has been caught in a transatlantic legal battle between her father, a former Dutchman who lives in the United States, and her Ukrainian mother who currently resides in the Netherlands. The district court’s verdict contradicts an earlier ruling in the US.
Mr Leendertz, Katja’s father, caused quite a stir when he took the girl to the United States in May last year: he went to her school and took her away unannounced. The girl’s sudden disappearance set the Dutch missing children network into action, resulting in a nationwide search. It later turned out that the American authorities aided Mr Leendertz.
The incident triggered a legal battle over the child’s custody. Mr Leendertz pleaded his case in the United States and was awarded sole custody two weeks ago.
Ms Karpenko, Katja’s mother, meanwhile appealed to a Dutch court. The Dutch judge found that there was no treaty between the Netherlands and the US on child custody matters and concluded that she could not recognise an American ruling. Under Dutch law, Katja’s parents still have joint custody.
On Wednesday, a district court in Pennsylvania ruled that the manner in which Mr Leendertz took his daughter to the United States qualifies as kidnapping. Mr Leendertz is therefore to return his daughter to her mother in the Netherlands.
Katja Leendertz has an American, Dutch and Ukrainian passport. She has been living with her father in Pennsylvania the past year.

Research in Child Abuse and Neglect: Familicide: A comparison with spousal and child homicide (2008)

Familicide: a comparison with spousal and child homicide by mentally disordered perpetrators

1Willem Pompe Institute for Criminal Law and Criminology, Utrecht, The Netherlands
2Pieter Baan Centre, Utrecht, The Netherlands
Abstract
Background Familicides, the killings of multiple family members, are believed to constitute an overlap between child homicide (filicide) and intimate partner homicide (uxoricide).
Aim The aim of this paper was to examine and compare the socio-demographic, contextual and psychopathological factors of familicide perpetrators with factors of filicide and uxoricide perpetrators.
Methods Data were extracted from files in a forensic psychiatric observation hospital in Utrecht, The Netherlands, for the years 1953-2006. The sample of 536 persons was identified in one of the three categories of interest; 23 were accused of familicide, 133 of filicide and 380 of uxoricide.
Results Familicide perpetrators are more likely than filicide perpetrators to be male, to be older, to be more educated and to commit the offence with physical violence. They are more likely than uxoricide perpetrators to be married, less likely to have committed a previous violent offence but more likely to suffer from a personality disorder and more likely to attempt suicide following the homicide.
Conclusion Although similarities exist between the three groups under study, those accused of familicide cannot be equated with those accused of filicide or uxoricide. The finding that a large majority of the perpetrators were mentally ill at the time and that many killed when faced with divorce and/or custody over the child(ren) may suggest that increased monitoring of this group might have preventative value.

Dad on trial for female genital mutilation of daughter (Haarlem, The Netherlands)
Dad MUSTAFA EL M. (last name not given) is charged with mutilating the genitals of his daughter, now 5 years of age.
http://www.expatica.com/nl/lifestyle_leisure/news_focus/Trial-opens-in-first-Dutch-genital-cutting-case_14625.html
Trial opens in first Dutch genital cutting case
A unique court case opens today in Haarlem: for the first time in the Netherlands, a man is on trial for female genital mutilation.
A 30-year-old man of Moroccan origin is charged with mutilating his daughter. During a pro forma hearing earlier this year, the public prosecutor read the charges:
“The accused is charged with wilfully and severely abusing his child. He is charged with inflicting grievous bodily harm on his daughter, Zoë, born in 2003, by cutting away the labia minora and the clitoris using scissors or another sharp implement.”
The accused, Mustafa el M. (surname withheld for legal reasons) denies everything, including the charge that he repeatedly beat and bit the child in the face and on the arms.
Islamic
Dineke Korfker is a cultural anthropologist and midwife. She lived in Africa for 12 years and now works as a researcher on female genital mutilation for research organisation TNO in Leiden. Female genital mutilation, also referred to as female circumcision or genital cutting, is practised in countries that include Somalia, Sudan and Egypt. But not Morocco, the country in which the accused has his roots. Neither is it originally a Muslim practice, says Korfker.
“People often see it as being Islamic and think it’s prescribed by the religion, but the highest Islamic body, the Al-Azhar University in Egypt, has officially distanced itself from the practice and calls on people not to do it. It has taken a long time for them to dare to do so, but now they clearly distance themselves from it. In a country like Saudi Arabia, where you might expect it, it doesn’t occur at all; they don’t have the practice there.”
Hidden
Female genital mutilation is a criminal offence in the Netherlands, and it is outlawed by the United Nations Convention on the Rights of the Child. But victims often remain hidden, because the cutting takes place in a closed family setting.Vanessa Penn is a policy advisor at the Dutch Child Protection Council, a department of the Justice Ministry, and a specialist in the field of female genital mutilation: “It isn’t often properly detected, so the Child Protection Council doesn’t deal with many cases. It’s estimated that around fifty girls a year undergo genital cutting, but not all of these cases are referred to the Child Protection Council and the practice is not reported to the police often enough – rarely or never. It’s a criminal offence and falls under abuse. It’s a deliberate injury to health and a form of abuse, and if parents are involved it’s an aggravating circumstance.”
Mustafa M.’s defence lawyer sees the five-year-old daughter’s statement as highly questionable and has applied for a second opinion from a legal psychologist. The girl and her sister have been taken into care.
