Once again, a babysitting daddy who flipped out on a crying infant and killed him.

Montrose Township father pleads guilty to killing 3-month-old son

FLINT, MI -- A Montrose Township father has pleaded guilty to killing his 3-month-old son after the child would not stop crying.

Jeramy David Wagner, 24, pleaded guilty Tuesday, Feb. 4, to second-degree murder and first-degree child abuse after he killed his child, Andrew, by punching him in the head Oct. 15, 2012. The plea included an agreement that will call for a sentence of life with the possibility of parole.

"This is a good resolution for all parties involved," said Wagner's attorney Tricia Raymond. "He accepted responsibility and there was no history of abuse to the child."

Wagner was charged with felony murder and first- and second-degree child abuse after authorities say the boy died from blunt force trauma to the head.

"Jeramy Wagner plead(ed) guilty to murder and will be sentenced to life in prison," according to Genesee County Prosecutor David Leyton. "The family of the victim was in agreement with this outcome."

Montrose Township police responded to an emergency call for an infant in distress at Wagner's home in Riverside Mobile Home Park on Oct. 15, 2012.

The infant's mother, Wagner's live-in girlfriend, was administering CPR to the infant when police arrived. Police took over CPR efforts but the child was pronounced dead on arrival at Hurley Medical Center.

Raymond said Wagner was watching his son while the boy's mother was not at home. The baby was crying and Wagner snapped, punching the infant once in the head with a closed fist, Raymond said. The unresponsive baby was placed in his crib and discovered by his mother.

"I don't think we'll ever understand why these things happen," Raymond said.

Wagner briefly addressed the court during Tuesday's plea hearing.

"I'm truly sorry for striking and killing my son, Andrew," Wagner said.

A sentencing hearing is scheduled for Feb. 26. Wagner will be eligible for parole in 15 years under current state statute.
