A Dukes County grand jury returned a two-count indictment Monday against Shaun A. Sicsico, 19, of Oak Bluffs, who is accused of causing substantial injuries to his prematurely born daughter, who was 12 weeks old at the time of the crime.
The grand jury charged Mr. Sicsico with assault and battery on a child with substantial injury, and permitting substantial injury to a child. The first charge carries a sentence of up to 15 years in state prison. The second charge carries a sentence of up to five years in prison.
The victim, Jaelynn Elizabeth Metell was born on May 2, at Massachusetts General Hospital. She weighed 2 pounds, 8 ounces at birth, according to her birth announcement.
On July 27, the child's parents, Andrea Metell of Oak Bluffs and Mr. Sicsico, brought her to the Martha's Vineyard Hospital. She was later transferred by MedFlight to Boston Children's Hospital.
Doctors there came to the conclusion that the child's injuries, including severe brain injury, bruising on all limbs, and bruised eyelids, were consistent with abuse, according to court documents.
Sources close to the investigation say the infant was released from the hospital, and is in the care of the Massachusetts Department of Children and Families. The extent of her brain injury is not yet clear.
Mr. Sicsico was originally charged with similar crimes in Edgartown District Court where the maximum possible sentence is 2.5 years in a house of correction. The grand jury indictment moves the case to Dukes County Superior Court, where longer sentences are possible.
Mr. Sicsico remains in custody at the Dukes County Jail, held on $50,000 bail.
