Records show mother of slain boy tried to regain custody
SACRAMENTO, Calif. (KCRA) —The mother of a slain Sacramento boy is grieving after the death of her 9-year-old son.
In a text message to KCRA 3, Jessica Hernandez, who was involved in a child custody fight with the boy's father, Phillip Hernandez, said, "Even tho (sic) Phillip and I had our differences, I never imagined this could be possible. He loved those boys. But he did have a drug problem."
Phillip Hernandez is the father of two boys.
Matthew Hernandez, the younger son, was brutally attacked and killed in his Sacramento home on Tuesday night.
Sacramento police arrested the boy's father, Phillip Hernandez, about a mile away from the south Natomas home.
Phillip Hernandez is now facing a murder charge.
Court records show Hernandez has a history of violence, including spousal abuse, and served time in prison. Upon his release, he was awarded custody of the two boys.
Jessica Hernandez lost that custody battle. In a text message to KCRA 3, she blamed the judge for her son's death: "If the judge had did her job and not abused her power im certain my baby would be alive today." (Excerpts of her text message are reproduced here just as she wrote them, without correction.)
Hernandez called the judge, "unethical, and I blame her for this incident, for it could've been prevented."
Hernandez identified the judge who presided over her case as Sharon Lueras. She said the judge "refused to listen or look at the physical evidence ...and made her decisions based on her personal opinions of me (she doesn't like me) based on my employment."
In court documents, Phillip Hernandez identified Jessica as a stripper.
KCRA 3 contacted Sacramento Superior Court for a response from judge Lueras. A court spokeswoman called back, stating that under the canons of judicial ethics, judges are prohibited from commenting on a pending case or any case they are presiding over.
Phillip Hernandez's arraignment is set for 1:30 p.m. in Sacramento Superior Court.
