Oakland Park father charged with murder in shaken-baby case

An Oakland Park father who allegedly shook his fussy infant, causing injuries consistent with shaken-baby syndrome, has been charged with murder after the boy died from the injuries three years later, authorities say.

According to a Broward Sheriff's Office report, Paul Day, 41, violently shook his 6-month-old child, Anibus Day, after he grew frustrated with the child's crying on June 11, 2009.

The incident occurred in a home in the 4300 block of Northeast 19th Terrace in Oakland Park.

Day called 911 after the baby stopped breathing and the boy was transported to Holy Cross Hospital where doctors determined his condition was caused by shaken-baby syndrome, the report said.

The child never regained consciousness and was transferred to Broward Children's Center in Pompano Beach. At the time, Day was charged with aggravated child abuse and child neglect.

Little Anibus Day, who had never regained consciousness following the incident, died on Dec. 15, 2012, authorities said. He was 3 years old.

A nurse at the Pompano Beach extended care facility found the boy lying unresponsive on his bed. The medical examiner later determined the child's death was a delayed homicide upon reviewing the boy's previous medical records.

Day appeared before Circuit Judge Andrew Siegel Thursday, where the prosecutor, Hussein El Rashidy, told the judge: "The victim in the aggravated abuse has passed away."

A new hearing for Day has been scheduled for April 12. He is currently being held without bail.
