Mahila court finds father guilty of raping daughter

COIMBATORE: The father of a 23-year-old girl was found guilty of sexually abusing her for four years after she turned 17 and making her pregnant. Though the girl had changed her testimony during the trial, the mahila court here found him guilty on the basis of medical evidence. The sentence will be pronounced on January 28.
Mahila court judge M P Subramanian found the 51-year-old accused, R Palanisamy (then 45) guilty of raping his daughter. When asked by the judge about the quantum of sentence to be awarded, Palanisamy pleaded that he was innocent of the charges leveled against him. His daughter had got married and she was living happily with her family.
Judge Subramanian ordered that since the charges have been proved, the accused should be kept in judicial custody till January 28. Palanisamy was sent to Coimbatore Central Prison.
The victim was not present in the court when the judgment was delivered. However, P Kalamani, 50, the victim's mother and P Sakthivel, 21, the victim's younger brother, were present in the court.
The victim had lodged a complaint of rape with Ramanathapuram police station on June 30, 2009, and an FIR was registered against Palanisamy under section 376 (rape) and 506 (ii) (criminal intimidation) of the Indian Penal Code the same day. The victim, her mother and her younger brother were listed as witnesses. But all three turned hostile when the case came to the mahila court for trial in June 2012. However, medical evidence proved the girl was indeed subjected to rape and sexually abused.
According to Ramanathapuram police, Palanisamy and Kalamani were living in Krishnan Temple Street in Ramanathapuram with their two children. Palanisamy, an alcoholic, drove an auto rickshaw while Kalamani worked in a lathe workshop in shifts. The victim was studying in Class 12 while her brother was a Class 10 student.
In March 2006, a drunken Palanisamy threatened his son to leave the house and raped the girl. The victim took refuge in her aunt's house. Later, she told her mother about the ordeal, but Palanisamy threatened Kalamani to keep quiet. Two weeks later, the girl was raped again. On November 2, 2007, she was diagnosed as six months pregnant. The fetus was aborted.
A month later, Palanisamy raped her again and threatened to murder the entire family if she told anyone about the incident. Unable to bear the torture, the girl lodged a complaint with Ramanathapuram police station. Based on the complaint the police registered the case.
