Father charged with third-degree murder forgoes preliminary hearing

An East Frankford man waived his right to a preliminary hearing Tuesday in the death of his infant son, whose bottle had been spiked with narcotics.

Orlando Rosado's decision to forgo a Municipal Court preliminary hearing means his case will move directly to trial in Common Pleas Court on third-degree murder, drug, and child-endangerment charges in the May 11 death of his son, Christopher.

According to Assistant District Attorney Lorraine Donnelly, Christopher Rosado was found dead in his own vomit by his father and his mother, Crystal Miller, just two days shy of his first birthday.

An autopsy showed morphine and methadone in the infant's system and heroin in the liquid inside the bottle, Donnelly said.

According to Donnelly, Rosado, 45, told investigators that he must have mistakenly put the drugs in the child's feeding bottle. Miller has not been charged.

Defense attorney Bruce Wolf asked Judge David C. Shuter to reduce Rosado's $1 million bail - defendants may apply for bail if charged with third-degree murder. The judge rejected the request, citing Donnelly's statements about Rosado's record of robbery and drug arrests in his native Brooklyn, N.Y.
