Dad arrested on child endangerment, drug charges (Utica, New York)

Was druggie daddy GARY KINGSLEY custodial? Sure sounds like it as there is no mention of the mother, and the grandparents now have custody. So how did a 4-year-old and a 2-year-old end up in this man's "care"?

UTICA — A Utica man Friday was arrested on numerous charges after responding to Birnie Bus employees’ reports of a child endangerment situation, city police said Saturday.

Utica police would later arrest and charge Gary Kingsley, 31, with two counts of felony third-degree criminal possession of a controlled substance, two counts of endangering the welfare of a child, two counts of second-degree criminally using drug paraphernalia, misdemeanor seventh-degree criminal possession of a controlled substance and unlawful possession of marijuana.

The call came after bus employees attempted to drop off a four-year-old child at 1 Minot Place, where police were told the employees saw the father staggering and stumbling and the child running out of the house, away from his father.

Police said they then were told the father came back to pick up his child and went back in side. A short time later, the father came back out and told the bus employee that the child wasn’t his, officials said.

When police arrived at the scene, they spoke to the father —who appeared under the influence of drugs and alcohol — who told police he also had two daughters inside. Upon entering the home to check on the welfare of the kids, police saw in plain view different illegal drugs and packaging materials. Officials said they also found a two-year-old daughter sleeping in her crib with a dirty diaper.

Child protective services were notified and the grandparents took custody of the children.
