Dad accused of 2nd-degree murder in death of 6-week-old son; had fractured hip of girlfriend's son the year before (Hamilton, Ontario, Canada)

Fathers rights folks often make a big distinction between "real fathers" (who allegedly don't abuse) and Mom's current boyfriend, who is labeled the true "Bad Boy." Very often, the distinction is meaningless.

Dad TERRY LEGACY is accused of 2nd-degree murder in the death of his infant son, who was only 6-weeks old.

Eight months before, he assaulted the mother's 16-month-old son from an earlier relationship, and managed to fracture the toddler's hip. That child had to be kept in a body cast for weeks as part of his recovery.

So what it comes down to is this: Scum is scum. Scum doesn't limit abuse to those with no DNA relationship. Scum is indiscriminate. Scum targets those who are least able to defend themselves. Period.

Judge to decide if evidence warrants trial in baby's murder, tot's assault

The suspicious death of a six-week-old baby and a fractured hip suffered by a 16-month-old toddler the year before are being probed at a preliminary inquiry now under way in Hamilton.

Terry Legacy, 27, is accused of second-degree murder in the death of his infant son on May 11, 2008, and of an aggravated assault the September before on an older brother of the dead child.

Hamilton police responded to a 911 call at the King Street East apartment that Legacy shared with the mother of his newborn son and her two older children from previous relationships.

The distraught mother handed her baby, who was still and had no vital signs, to a police officer. The sudden death of Baby Cohen led police to investigate another incident eight months earlier when a toddler in Legacy's care suffered a broken hip and had to be placed in a body cast for weeks. Assistant Crown attorney Michael Fox is prosecuting the child-abuse case and Toronto defence lawyer Greg Leslie is defending the accused father.

Ontario Court Justice Marjoh Agro is expected to hear two weeks of testimony and will then determine if there is sufficient evidence to order Legacy to stand trial as charged with murder and aggravated assault.
