Charge levied against father in child assault case

The father of a 3-month-year-old girl has been charged with child assault, according to Kitsap County District Court records.
Colin Richard Arthur, 28, of Port Orchard, was charged with first-degree child assault on Nov. 15. He was arrested early Friday morning and booked into the Kitsap County Jail under a $100,000 bond.
According to charging papers, on Nov. 13 the infant was taken to Mary Bridge Hospital in Tacoma with a serious head injury. Doctors told investigators the initial diagnosis was acute and chronic bilateral brain bleeds deemed non-accidental trauma consistent with shaken baby syndrome. The infant’s twin brother also was examined and initial X-rays showed he had a healing rib on his right side, but doctors were concerned about his brain scan and additional tests were planned.
According to court documents, Arthur’s wife told investigators that she left the infant girl with her husband while she went to a birthday party with her daughter on Nov. 4. She also provided investigators photos taken in September of the other twin infant with a severe bruise on his left leg and left side. Also, the wife said she took the sick infant girl to the doctor several times since Nov. 4.
Court records stated that Arthur confessed to investigators that he had violently shaken and tossed both infants down several times, including while he was drinking during the past month and a half.

Dad kills 9- and 13-year-old sons, their mom in murder-suicide (Pleasant Valley, New York)
Yet another family annihilator. This one is identified as dad SARWAT LODHI.
http://www.poughkeepsiejournal.com/article/20131122/NEWS01/311220036/
PLEASANT VALLEY — Finally, answers became available this evening regarding a tragic story that captivated Dutchess County for the last two days.
New York State Police announced at a 5 p.m. press conference that Pleasant Valley tragedy was the result of a murder-suicide perpetrated by Abbas Lodhi.
Police said he killed his wife, Sarwat Lodhi, at a location in the Town of Wappinger, where her body was found today near the Dutchess County Airport.
Abbas Lodhi and his two sons each died of a shotgun wound to the chest, according Dutchess County Chief Medical Examiner Dr. Kari Reiber.
"All three died of a shotgun wound to the chest," she said.
Police identified the sons as Mujtabah Lodhi, 13, and Zain Lodhi, 9.
Capt. John Ryan, of the Troop K Bureau of Criminal Investigation, said in a press conference this afternoon that the owner of a vacant home near the airport found Sarwat Lodhi's body this afternoon. He said it was by a stroke of luck that she was discovered and that it would not have been visible overhead, where police were searching by helicopter since Thursday.
State police public information officer Trooper Melissa McMorris said the person called 911 to report the body around 3 p.m. today.
Police found Abbas Lodhi, 49, and his son shot dead in a vehicle, along with a shotgun, at the Milestone Square shopping plaza parking lot on North Avenue in Pleasant Valley around 8:30 a.m. Thursday after a worker called 911 to alert authorities. Police later found another one of the man's sons shot dead at the family's apartment, about a mile away on West Road, state police said.
Before her body was discovered, state police said, "We do not feel that she’s a suspect," McMorris said. "Our theory is that she’s a victim."
Before the press conference today, police had not named any suspects in the case, but said they did not believe anyone outside the family was involved.
"We can't just jump to conclusions," McMorris said at the time. "We have to have some kind of evidence. We have a theory but we’re still looking for that missing piece."
Police have not confirmed the location of the family's home, but have confirmed that it is a private, gated community in Pleasant Valley.
Police said Zain Lodhi and his father, found in the vehicle in the shopping center, "appeared to have been fatally injured by a gunshot wound,” Maj. Robin Benziger, who commands state police Troop K.
Autopsies on all three are scheduled for today, which could provide investigators with a better timeline, McMorris said.
“The motive, at this time, is not clear,” Benziger said. “We believe this is a family tragedy and we have no reason to believe the public should be concerned for their safety.”
Capt. John Ryan, of the Troop K Bureau of Criminal Investigation, took questions at the Thursday news conference after Benziger spoke. He said he couldn’t confirm the deaths were the result of a murder-suicide.
A shotgun, found with the vehicle at the parking lot, was secured as evidence, Ryan said. New York state does not require a license for shotguns.
“That’s a weapon that was found at the scene,” he said.
Pleasant Valley residents Patty O’Brien, 33, and Jenifer Adams, 36, were among the numerous residents and volunteer firefighters who attended the news conference at the firehouse. Adams said there were seven police cars on her road earlier Thursday, and she wasn’t able to learn what was happening.
“My child called me and said, ‘There’s a helicopter hovering over our house — what’s going on?’ ” she said.
Despite assurances by police that the public was not in danger, Adams said she’s concerned. She said it’s also likely that one of her four children, who range from age 5 to 14, knew the victims.
“It’s terrible, terrible,” she said.
Dutchess County Chief Medical Examiner Dr. Kari Reiber said the autopsies are scheduled for today.
School district
In response to the police investigation, officials at the Arlington Central School district released a written statement on their website. The statement read, “They have assured us that there is no threat to any of our schools. The police have advised us that all schools should continue on their normal schedule.”
Later, district Superintendent Brendan Lyons said the two Arlington students were a fourth-grader at Joseph D’Aquanni West Road Intermediate School and an eighth-grader at LaGrange Middle School.
“As a school, our hearts grieve for these children and their family,” he said. “The entire Arlington community mourns the loss of these young lives.”
Counseling will be available today at both schools, Lyons said in the written release. Lyons said there is information on the Arlington website to help parents discuss the incident with their children.
Too close to home
Charlene Clark, 29, lives down the road from Brookside Meadows at the Pleasant Valley Estates.
She said family and friends called her all morning to make sure she and her son, Gavin, were safe.
“It’s way too close to home,” she said. “It seems like terrible things always happen around the holidays.”
Clark said her son was intrigued when he heard the helicopter. At first, she said, she didn’t think anything of it.
“As a mom, it’s terrible thing,” she added.
The investigation
Crime scene tape cordoned off nearly half of the parking lot outside the A&P supermarket until about noon Thursday.
Troopers, forensic specialists and police leadership were all working the scene Thursday. They could be seen walking around and talking amid a large number of state police SUVs, police cars, two Pleasant Valley firetrucks and an unmarked police van.
Rebecca Ogden, 24, of Hyde Park, works in the plaza. She said the scene was eerily similar to what she encountered when bomb experts — and many police — were called in to examine an unattended Makita power-tool carrying case in the Milestone Square shopping plaza on July 22.
As the troopers dispersed from the scene Thursday, one SUV followed a tow truck carrying a silver Nissan Pathfinder on its flatbed out of the parking lot. The Pathfinder did not appear to have any damage to its exterior.
Where the third body was found a state trooper stood in front of the black gate at the entrance on West Road as residents and police vehicles quietly went in and out.
A second vehicle was taken from this community — a white Honda Accord — police confirmed today.

Dad charged with manslaughter in death of 1-year-old son (Floyd, New York)
Appears that dad IAN GULBIN bashed the baby to death while the pregnant mom was working the night shift. Then he dumped the baby's dead body on the floor for Mom to find the next morning after she got home.

FLOYD, N.Y. (WKTV) - Ian Gulbin, 31, the man charged with manslaughter in the death of his one-year-old child, Brayden Gulbin, appeared in the Town of Floyd Court Monday and waived his right to a felony hearing.
Gulbin appeared before Judge Christopher Clarkin.
Clarkin said the prosecution asked for no cameras to be allowed in the courtroom. The reason for this, if Gulbin did not waive his right to a felony hearing, the prosecution would have presented witness.
One of those witnesses, would have been the baby's 8-year-old brother who was in the family's Bridgewater home Sunday night into Monday morning when Brayden died.
Authorities say the boy's mother was working the overnight shift.
She arrived home after 7 a.m. that morning and found the baby dead on the floor outside the crib.
The felony complaint in this case says Ian Gulbin grabbed and slammed one-year-old Brayden into a hard object causing bruising and contusions to the head and facial areas. He also had two skull fractures, a lacerated liver, and internal bleeding.
Oneida County Assistant District Attorney Dawn Catera-Lupi said, "Basically the case was held for the action of the Grand Jury, which means in the next 45 days it will be presented to the Oneida County Grand Jury."
Brayden's mother, Anastasia Hogen, who is currently pregnant, was in court along with her 8-year-old son. Both would have testified if Ian Gulbin did not waive his right to a felony hearing.

Confirmation: Dad with history of DV killed infant son, baby's mom in murder-suicide (New Market, Maryland)
We reported on this case before, back when the police refused to identify the killer. But we knew the killer had to be the dad, it almost always is. And the fact that he has a history of domestic violence? Totally predictable.
And yet everybody is wringing their hands, wondering about the motives. This is what abuser/control-freak sh**heads do, folks.
The killer dad is identified as BEN ASEFA.
Oh, and that first line. The "murder/suicide that claimed the lives of two parents and their infant son." Oh, that's just classic. Nice attempt at erasing criminal agency. No killer dad here. Just murder/suicides roaming the land and "claiming" lives.

Sheriff’s Office: Father Was Shooter In Double Murder-Suicide
November 25, 2013 6:15 PM
Reporting Monique Griego
NEW MARKET, Md. (WJZ) — Disturbing new details are released in the New Market murder/suicide that claimed the lives of two parents and their infant son.
Monique Griego spoke with Frederick County Police and has the latest on exactly what they believe happened inside the couple’s home.
Monday, investigators revealed that it was Ben Asefa who shot his wife as she held their son. That same bullet ended up killing the infant. Then Asefa turned the gun on himself.
As the New Market community came together Sunday night to mourn the loss of a family shot to death in a murder/suicide on Woods Court, painful questions lingered about who pulled the trigger.
“You go through the emotional spectrum,” said neighbor Dean Mosher. “Start off angry.”
Monday, Frederick County Sheriff’s investigators revealed what they believe happened in the house. They say Ben Asefa killed himself after shooting his wife, 42-year-old Barbara Giomarelli, in the head.
That same bullet then traveled into their infant son, Samuel, who she was carrying on her shoulder. “That same projectile struck the infant, killing the infant, as well,” said Captain Tim Clarke.
Before the shooting, police say Giomarelli was putting the couple’s 5-year-old daughter in a bath upstairs when Asefa came in. The two got into an argument and both parents went downstairs.
“We really don’t have a good clear picture of what the argument was about,” Clarke said.
Unlike what was previously thought, investigators say they do not believe the couple’s daughter was hiding inside the house. They say she remained in the bathtub during the incident and had no idea what was going on.
“She did call for her parents; they didn’t respond. She got out, dressed, went downstairs, discovered the bodies and then exited the home and went to the neighbors,” Clarke said.
Police say family members revealed a history of abuse against Giomarelli but didn’t know if it was physical or just verbal. With no exact motive, they and the community are struggling to understand why.
“We may never know why this happened. We certainly never approve of it but we must find a way to forgive,” Mosher said.
The only survivor, the couple’s daughter, is with Child Protective Services as family members work out the details surrounding her care.
Both Giomarelli and Asefa were accomplished scientists but he’d recently lost his job. She was set to start a new job in December.
And yet everybody is wringing their hands, wondering about the motives. This is what abuser/control-freak sh**heads do, folks.

Dad with "temporary custody" pleads guilty to manslaughter in death of 9-month-old son (Utica, New York)
I'm sorry, but dad JEVON WAMELING has been totally full of crap from the beginning. I have zero sympathy for this @$$hole.

Father admits not getting medical help for injured baby Levon Faces 7 1/2 to 15 years in prison after manslaughter plea.
By ROCCO LaDUCA
Observer-Dispatch

UTICA — If only Jevon Wameling had sought medical attention for his baby son’s head injury.
Maybe 9-month-old Levon would still have been alive to turn 1 year old.
Maybe teddy bears would not now be lining the bridge over the Mohawk River, where Levon’s body had been tossed to its watery grave.
Maybe he wouldn’t be heading to prison soon for allowing his son to die.
But after failing to do what prosecutors say any reasonable parent would have done, knowing that their child was in pain, 27-year-old Wameling found himself ultimately accepting blame for a series of deadly mistakes that never should have happened.
In Oneida County Court, Wameling pleaded guilty Wednesday morning to second-degree manslaughter and will face the maximum 7 ½ to 15 years in prison when he is sentenced Thursday, Jan. 30.
No matter what the public might speculate about how Levon’s head injury was caused, prosecutors firmly point out that nothing suggests Wameling meant to harm his son.
“We have absolutely no proof that this was an intentional homicide,” Oneida County District Attorney Scott McNamara said. “Based on the totality of the facts that we knew and the facts we could prove in court, I can only hope that we have given justice to baby Levon and to baby Levon’s mother, Amy Warney.”
What prosecutors did have were two contradictory stories: On June 11, Wameling first said Levon disappeared from the front porch of his East Utica home. But then in a jailhouse letter to the Observer-Dispatch two weeks ago, Wameling said Levon died in his sleep.
Wameling insists Levon hurt himself after falling off a sofa, McNamara said. And during a visit while Levon’s mother was in jail on May 18 – about 10 days before Levon’s death – Warney claims she told Wameling to take the boy to the hospital after she noticed an injury behind Levon’s left ear.
But Wameling never did, and an autopsy found a crack on the same part of Levon’s skull where Warney says the injury had been, McNamara said.
During Wameling’s surprise plea Wednesday, Wameling simply responded to a series of questions asked by Judge Barry M. Donalty, while Warney sat nearby in the courtroom.
“You knew this child had a medical condition, is that correct? A head injury?” Donalty asked, according to court transcripts.
“Yes,” Wameling replied, acknowledging that he had responsibility for Levon’s welfare as his sole caretaker at that time, starting May 13.
“On May 29 of this year, the child died, is that correct?” Donalty continued. “And rather than call 911, rather than call anybody, you in fact took it upon yourself to put the child in a bag and then the child was placed in the water at the (Mohawk River), is that correct?”
“Yes,” Wameling replied, without elaborating on what prompted him to dispose of Levon in a backpack full of rocks.
Around 2 a.m. that May 29 morning, however, Wameling did leave a frantic voicemail on the phone of Wameling’s mother, McNamara said. When his mother called the next day, Wameling told her he had already taken care of whatever the problem was.
On Wednesday, Wameling also pleaded guilty to two unrelated charges: second-degree burglary for stealing money from his uncle’s home and fourth-degree conspiracy to sell drugs. Wameling will receive five years in prison for the burglary, and two to four years for the drug conspiracy, which will run at the same time as the more serious manslaughter sentence.
Although Wameling had told state police in September where he dumped Levon’s body, investigators continued to interrogate him after he had already asked for an attorney – a legal snafu that prevented prosecutors from being able to use Wameling’s long-awaited answers against him, McNamara said.
Yet, Wameling’s defense attorney, Rebecca Wittman, realized it was best to resolve these matters all at once.
“Because of Jevon Wameling’s actions in disposing of the baby’s body, the District Attorney faced some challenges in establishing the cause and manner of Levon Wameling’s death,” Wittman wrote in a statement. “Conversely, those same actions presented challenges in defending against any charges related to the death of Levon.”
Wittman finished, “We feel we have reached a fair resolution of all matters related to Mr. Wameling.”
Here's a timeline of the series of events from Levon's death to father's guilty plea:
May 18: While in jail, Levon’s mother notices injury behind boy’s left ear and claims she told father Jevon Wameling to take him to the hospital.
May 29: Wameling finds Levon dead in his sleep and leaves a frantic but unrevealing late-night voicemail to Wameling’s mother, then sometime later disposes of baby’s body in Mohawk River.
June 11: About two weeks after Levon died, Wameling tells Utica police that boy disappeared after he was left briefly unattended on the front porch.
Sept. 5: After being charged with burglarizing uncle’s home, Wameling finally tells police where to find Levon in North Utica waterway; a legal mistake, however, prevents prosecutors from being able to use that confession against Wameling.
Sept. 6: Levon’s remains recovered from Mohawk River in backpack full of rocks; autopsy later finds skull fracture, but cause of death is never determined.
Nov. 14: O-D publishes jailhouse letter from Wameling admitting that he was “scared out of my mind” after finding Levon dead in his sleep. Wednesday: Wameling unexpectedly pleads guilty to second-degree manslaughter, admitting that Levon died after failing to seek medical help for boy’s head injury; faces 7 ½ to 15 years in prison when sentenced Jan. 30.

Father admits not getting medical help for injured baby Levon Faces 7 1/2 to 15 years in prison after manslaughter plea.

Dad pleads not guilty to locking 6-year-old son in urine-soaked cage (O'Fallon, Missouri)
Is TERRY G. SMITH a custodial father? Notice that "his wife" is never referred to as the mother of this child, which makes me think that she is not the mother. So if she is not the mother, what happened to the mother of this poor little boy?
By the Geneva convention, prisoners of war are (supposed to be) treated better than this. This is out-and-out torture.

O'Fallon Father Pleads Not Guilty to Locking Autistic Son in Urine-Soaked Cage

Terry G. Smith of O'Fallon says he is not guilty of keeping his six-year-old autistic son naked and covered in excrement in what police describe as a crude, makeshift cage.
Smith and his wife, Victoria, were charged with felony child endangerment when an anonymous tip to the Missouri Child Abuse and Neglect Hotline spurred a police investigation into their St. Charles County home.
In 2010 the O'Fallon Police Department found the six-year-old boy in the basement, trapped in a three-foot-by-six-foot plywood cage held together with zip ties, tension straps and bungee cords, according to the probable-cause statement.
Three years later, Terry Smith has entered his official not guilty plea, and his wife Victoria is still awaiting arraignment, according to KMOX. The couple is scheduled to stand trial in March 2014.
Details about the child's rescue are sickening and heart-breaking. The child's five siblings -- ranging in age from eleven months to eight years old -- say they fed him hot dogs and chicken nuggets through the bars of his cage.
Terry and Victoria Smith were not at home when first responders arrived, and it took three hours to track them down. An older relative was watching the six children, although she said she had a difficult time looking after them since she was recovering from a stroke.
The home was unsanitary and cluttered, police said, and doorknobs to children's rooms had been installed backward to allow the parents to lock their children in from the outside.

Man raped daughter for 11 years, fathered a child
Nitasha Natu, TNN Nov 28, 2013, 01.19AM IST
MUMBAI: In a horrific case of incest, a 50-year-old man was arrested by the Malwani police on Wednesday for having raped his daughter for the last 11 years. The 26-year-old survivor also has an eight-year-old daughter fathered by him.
She summoned courage to seek help now because she found out that her father was planning to get married to her. The accused shuttles between Jaipur and Mumbai for work, while his wife, son and daughter live in Malwani.
The police have learnt that the accused is involved in forcing women into prostitution. "There are reports that he had brought a minor from another state and confined her in his house. His daughter has been sent for a medical examination," said an officer.
The survivor's ordeal began when she was 15 years old. "The accused initially told his daughter that he was teaching her about human anatomy; he then raped her regularly. Her mother got wind of the goings-on, but the accused would thrash her as well as his daughter and often confined them in the house and starved them. He also ensured that his daughter did not get married," said the officer.
Whenever the survivor resisted, he would threaten to kill her mother and brother.
The survivor got pregnant when she was 18 years old. The accused got her admitted to a public hospital and submitted a fake name when asked about the baby's father.
"When the survivor recently learnt that her father was getting papers ready to tie the knot with her, she broke down. A social worker noticed her and enquired what had happened. She was taken aback on hearing her story and made arrangements to bring her mother, who was in her hometown, back to Mumbai," an officer said.
The social worker got in touch with the Malwani police and registered a complaint against the accused. The police arrested the father and booked him on charges of rape and criminal intimidation under the IPC, besides provisions of the Protection Of Children Against Sexual Offenses Act.

Dad charged with "intentionally" dropping 2-month-old daughter; baby in critical condition (Tucson, Arizona)
Not much detail here on the family arrangement here. The baby was "in the care and custody of her father"--just what does that mean exactly? That he was babysitting while Mom ran to the grocery store? That this was court-ordered visitation time? That Dad had legal custody of the child? What?
Dad is identified as ANTHONY ESPARZA.

Tucson father faces child abuse; 'intentionally' dropped infant daughter, police say
November 27, 2013 7:30 pm • Carmen Duarte Arizona Daily Star
An 18-year-old man was arrested and is facing child abuse after he "intentionally" dropped his infant daughter, police said.
Anthony Esparza was booked into the Pima County jail for one count of child abuse, said Sgt. Chris Widmer, a Tucson Police Department spokesman.
The 2-month-old girl is in critical condition at University of Arizona Medical Center-Main Campus, he said.
On Tuesday at 1:38 a.m., officers responded to University of Arizona Medical Center-South Campus for a report of an infant who had been brought in with life-threatening injuries, Widmer said.
The baby was brought to the hospital by her parents, and was transferred to the medical center's main campus because of the "serious nature of the injuries," Widmer said.
Detectives from the dependent child unit began an investigation and it was determined that the child was in the care and custody of Esparza at the time of the incident, he said.
It was "revealed that the baby was intentionally dropped by the father, causing serious head trauma," Widmer said.
Dad is identified as ANTHONY ESPARZA.

Dad given unsupervised access to kids he molested; mom labeled "crazy" by authorities (Vancouver, Canada)
Contrary to fathers rights movement lies, this is how it usually works: Blatant father favoritism and mother bashing. Actual facts and evidence of abuse goes out the window, as the authorities in the police and child "protection" agencies support and coddle child molesters and pedophiles--especially when they are the fathers of the victims. To that end, mothers are labeled "crazy" or "mentally ill," so they can be marginalized and Daddy granted full access to the child victims.

Father given unsupervised access to children he molested Woman discovered spouse was sexually abusing their kids, but he convinced authorities she was 'crazy'
CBC News Posted: Nov 28, 2013 5:30 PM PT| Last Updated: Nov 28, 2013 8:16 PM PT
A B.C. Supreme Court judge reviewing evidence from a custody dispute determined that the father of four children sexually and physically abused three of them, contrary to the findings of a flawed Vancouver Police Department investigation.
The mother of the children, who was awarded sole guardianship and custody in the 2012 court judgment, is now suing the province, saying it was negligent and acted in bad faith in allowing her former partner unsupervised access to the children during the dispute.
The mother's lawsuit against the province is currently on trial at B.C. Supreme Court in Vancouver and has already gone on for more than 80 days.
In addition, the mother is asking the Vancouver Police Department to reopen its investigation into allegations her former partner sexually abused their three children. The department closed its investigation in 2010.
"I want what is proper law. It's nothing vindictive, or anything like that," said the woman, whose identity cannot be revealed in order to protect her children.
"My ex is — he obviously is a very dangerous person. Like he didn't stop. I would like to see him properly prosecuted... That's all, because there's no sign that he's gonna stop unless something like that happens."
She says her world was flipped upside down two months after she and her husband separated in the fall of 2009 when, acting on only slight suspicion, she asked her three eldest children whether their father ever did anything to them.
She said she was expecting her children to respond with blank looks and confusion, but instead they began blurting out disturbing allegations that shocked her.
"The only thing I can think of now is Jekyll and Hyde, because… I just actually never could have fathomed what he was doing," she told CBC News in an exclusive interview.
A 'Kafkaesque' nightmare
She called the Ministry of Children and Family Development's helpline the next day, and called the Vancouver Police Department several times to seek assistance.
An order of the court was issued in October of that year, restraining the father from any contact with the mother or the children.
However, in December 2009, Justice Paul Walker — the same judge who ruled in the couple's later custody dispute — varied this order to allow the father supervised access to the children for specific hours.
Throughout this period, the father, along with his family and friends, made calls to Ministry workers and eventually the police, registering concerns about the mother's mental capacity.
In his custody dispute judgment three years later, B.C. Supreme Court Justice Paul Walker deemed the behaviour "a baseless attempt to discredit her."
However, at the time, the authorities decided the frantic mother was unreliable, and also likely in need of a mental assessment.
The Ministry took the kids away from their apparently unstable mom, and placed them in foster care, with an aunt and uncle, in December 2009.
After a series of interviews with the parents and children that December and January 2010, the senior investigating VPD officer, along with officers from the RCMP Behavioural Sciences unit, determined that the allegations against the father were unfounded, and closed the investigation.
Later that year, a social worker began allowing the father unsupervised access, contrary to the original 2009 court order, which their mom says allowed the abuse to continue.
"It was, it was like, one professional described it: 'Kafkaesque' is the best term that comes to mind. It's as if the people involved were just twisting everything," the mother said.
Jack Hittrich, the mother's lawyer, says the Ministry of Children and Family Development was negligent, reckless, and acted in bad faith.
"When mom was frantically trying to convince the ministry that the sexual abuse allegations were real, they basically labelled her as crazy. And the more she protested, the more she was labelled as being crazy," he said. "It's a horrific nightmare."
Hittrich doesn't think the mother could have accomplished more by protesting more, and that institutional failures must be corrected.
"Until the child sex abuse lens is refined and there's more sensitive processes in place, children are at risk," he said. V
PD officer 'smitten' with father
A former RCMP superintendent who reviewed the police interrogation videos, testified in court that the VPD investigation was deeply flawed.
"I think the police formed the opinion that the mother had no credibility, therefore they didn't react and follow the investigation the way it should have been followed," said Glenn Woods, who worked for the RCMP for 35 years.
Woods, who spent 11 career years as a criminal profiler, said after watching the footage, he believes the senior officer involved in the case developed negative attitudes early on about the mother — and positive feelings about the dad.
"I used the word 'smitten.' I just got a sense that the interaction between the officer and the father was almost at times kind of a social interaction, as opposed to a police interview or interrogation."
Woods told the CBC that Vancouver Police should have fresh eyes look at the file, saying "I think an effort has to be made to take another look at this case."
In his judgment on the custody dispute last year, B.C. Supreme Court Justice Paul Walker agreed with Woods' critique of the police interrogation, writing "I was struck by how quickly and easily [the father] took control of the interview. It appeared to me that the officer was enamoured of (the father) in some way."
In his conclusion after reviewing footage of what he characterized as several flawed interviews, Walker wrote "I have determined that I can place no weight on the conclusions reached by the VPD… that there was no merit in the sexual abuse allegations."
Walker also determined, from the evidence presented, that the father sexually abused three of his children, exposed them to inappropriate sexualized knowledge, and physically assaulted them and their mother.
He gave full custody to the exonerated mother, and said a restraining order would be required against the father.
Father maintains innocence
CBC News spoke with the father, who maintains that his ex-wife fabricated the sex abuse claims in order to gain sole custody of their children.
"By itself, that allegation is nuclear. You light off that allegation and there's radioactivity forever. It never, ever goes away," he said.
The senior Vancouver Police officer who cleared the father refused comment, referring CBC News to the department.
Sgt. Randy Fincham, media relations officer for the department, wrote to the CBC in an email, "The judge is more than entitled to have an opinion about the quality of the police investigation" and "in the event that new evidence is brought forward in any investigation, the police retain the ability to reopen, continue or advance their investigation."
Beyond that, he stated the department "is not at liberty to discuss an ongoing court process, as it may impact the final outcome of the proceedings."
Mr. Justice Walker's decision was rendered last year. The Vancouver police are not party to the current negligence lawsuit against the province.
Sgt. Fincham did not answer questions about whether the case merits a review, or what should be done about the father in the community, given the judge's finding that he sexually abused his three children.
The Minister of Children and Family Services, Stephanie Cadieux, wrote in an email it would be inappropriate for her to comment on the case, as it is before the courts, stating "the safety and well-being of children is always the Ministry's first priority."

Dad arrested for abusing 5-month-old son; baby in critical condition (Lincoln, Nebraska)
Sounds like another scumbag who tried to blame the baby's injuries on a toddler. Nope, just another short-tempered dad.
Dad is identified as RAAD S. AL-MASAUDI.

Police: Baby's condition critical after dad hurt him
November 21, 2013 11:25 am • By JONATHAN EDWARDS / Lincoln Journal Star
A 5-month-old boy is fighting to live a week and a half after his father allegedly beat him, causing several brain bleeds, Lincoln police said.
Raad S. Al-Masaudi was arrested at his home at 4111 X St. just before noon Wednesday, Lancaster County jail records show.
Prosecutors charged him with felony child abuse Thursday, and Lancaster County Judge Timothy Phillips set his bond at 10 percent of $500,000, meaning he'll have to post $50,000 to get out.
Al-Masaudi, 43, called his wife at about 6:30 p.m. Nov. 12 while she was grocery shopping to tell her that her 23-month-old daughter threw a fit and head-butted their baby and knocked him out, Officer Katie Flood said.
He said the baby went limp and stopped breathing, Officer Brytten Sorgenfrei said in an affidavit.
Al-Masaudi said he tried to revive his son by doing CPR, Flood said.
The mother returned to the house, and they took the infant to Saint Elizabeth Regional Medical Center, Sorgenfrei said.
Doctors found several brain bleeds and think his injuries don’t jibe with Al-Masaudi’s explanation of what happened, Flood said. They think someone hurt him on purpose.
A rescue crew took the baby to Children’s Hospital & Medical Center in Omaha, where his condition “significantly declined” and a doctor found he suffered a cerebral injury, subdural hematomas and retinal hemorrhages, Sorgenfrei said. She, too, said the injuries suggested abuse.
The baby's mother, day care provider and baby sitter told investigators he was fine when they were with him earlier in the day, Sorgenfrei said.
The 23-month-old girl told police Al-Masaudi abuses his 5-year-old daughter and gets mad when his baby son cries, Sorgenfrei said in the affidavit. “The father was the only one caring for the child at the time, and the only one who witnessed any symptoms,” Flood said of the Nov. 12 incident.
A Lancaster County Juvenile Court judge removed the 5-year-old and the 23-month-old from Al-Masaudi’s house Friday, and prosecutors are pushing to terminate his parental rights, court records show.
Al-Masaudi said in a Sept. 12 Facebook post that he had gotten married. A week earlier, he posted photos of the baby and wrote: “Fun playing with my boy today!”

Dad charged with felony child abuse for swinging 5-week-old daughter while assaulting baby's mom (Tahlequah, Oklahoma)
November 21, 2013
Dad is identified as CORNELIO GONZALES.
Notice the typical way that an assault on a woman is minimized as a "domestic dispute." If this guy randomly assaulted some guy on the street, would it be a "public dispute"? Of course not.

TAHLEQUAH — Prosecutors on Wednesday filed felony child abuse charges against a Tahlequah man who allegedly swung his daughter by her clothes during a domestic dispute.
Cornelio Gonzales, 20, is charged with child abuse by injury, aggravated assault and battery, two counts of domestic assault and battery in the presence of a minor, and obstructing an officer.
Cherokee County Sheriff’s Deputy Dexter Scott said Gonzales allegedly grabbed his 5-week-old daughter during a dispute, and refused to the give the child to a nearby person who was not involved in the fight. Gonzales allegedly kept the baby in his hands during the fight.
The child was eventually removed from Gonzales by force. A woman involved in the dispute, along with a bystander, then took the child into a room to get away, but Gonzales allegedly forced his way in and attacked them.
Gonzales allegedly ran before deputies arrived. He was later captured by a Cherokee Nation marshal and booked into jail. Gonzales was given a $15,000 bond, and he remains in jail. -

A North Union Township father will face a preliminary hearing in the alleged beating death of his 20-month-old daughter in late January.
Domer Burkholder, 30, of 600 Washington Ave., was charged Friday by police with criminal homicide and child endangerment in the death of Caylee Jo Burkholder.
A preliminary hearing had been scheduled for Wednesday before Magisterial District Judge Wendy D. Dennis, however, that hearing has been continued.
According to court records, the hearing has been rescheduled for 9 a.m. on Jan. 29 before Dennis.
Trooper Heather Clem-Johnson said the charged against Burkolder were filed after police were called to Uniontown Hospital at 12:30 p.m. Friday when physicians diagnosed the child with severe internal injuries. The child was then taken to UPMC-Children’s Hospital in Pittsburgh for further treatment where she died.
Clem-Johnson said the girl’s mother, Jessica Marie Burkholder, told investigators that she saw her husband discipline the child, which included a spanking on her butt and “roughly” grabbing her arm and also saw her husband using his fist and punching the child in the abdomen in a playful but rough manner.
On Friday morning, Clem-Johnston said Jessica Burkholder found found bruises on the girl's stomach, and it was swollen.
Dr. Adelaide Eichman of Children’s Hospital told police that the child suffered a lacerated liver, perforated intestines and internal bleeding.
During an interview with police, Domer Burkholder admitted to officers that he had been “too rough” with the child, Clem-Johnston said.
He remains in Fayette County Prison without bond.

Dad kills 3-month-old son, boy's mom in murder-suicide (New Market, Maryland)
The authorities must know that this was committed by the father, but they are playing coy. Mothers very seldom commit crimes of this type.
Dad is identified as BENYAM ASEFA.

A mother, father and their baby son have been found dead in their home in an apparent murder-suicide after their five-year-old daughter managed to run to neighbors for help.
Benyam Asefa, 40, Barbara Giomarelli, 42, and three-month-old Samuel Asefa were found dead in their home on Woods Court in New Market, Maryland just after 8pm on Wednesday night.
Investigators discovered the bodies after their daughter, who had reportedly hid in the home as her parents argued, fled the home and told a neighbor that her parents were hurt.
When authorities went inside, they found the three dead from gunshot wounds in the same.
Deputies found a handgun at the scene but Captain Clarke said they do not yet know who was responsible for pulling the trigger.
Clark said he was not aware of any suicide note and said many details were still unknown as the child was the only witness to the deaths, NBC Washington reported.
'We're still trying to piece a timeline together,' Clark said. 'The problem is, we have a five-year-old who is severely traumatized, so we're trying to limit the amount of discussion we have with her.'
Asefa was an American citizen but his wife was an Italian citizen. Her Facebook profile indicates that she worked at the Center of Marine Biotechnology. Investigators believe it was a murder-suicide, Captain Tim Clarke of the county sheriff's office said.
Clarke said the sheriff's office has not handled any previous calls to the address.
Their daughter is in the care of Child Protective Services, who are determining where she will go.
'The goal is to find another family member. That's the best thing for a child,' Clarke said.
Giomarelli's family is traveling from Italy to discuss the investigation with the sheriff's office and Clarke said he was hesitant to discuss further details before sitting down with the family.
On Wednesday, police swarmed the home as investigators worked throughout the night.
Captain Clarke said his officers, some of whom are parents, were extremely moved by the gruesome scene and the brutal death of the baby and would be receiving help if necessary.
The three family members will be transported to the Medical Examiner's Office in Baltimore for autopsies.
'I don't know how anyone could do that, especially a baby, neighbor Brent Preston told NBC Washington. 'I don't, you know, [there's] nothing a baby could've done to deserve that. Nobody would deserve that, but especially a baby.'

Custodial dad found guilty of starving teenage daughter, but not of false imprisonment (Madison, Wisconsin)

Wis. Man Found Guilty of Starving Daughter
MADISON, Wis. November 23, 2013 (AP) Associated Press
A Wisconsin man accused of locking his teenage daughter in the basement and starving her down to 68 pounds was convicted Friday of child abuse and other charges, but was acquitted of false imprisonment.
The case came to light in February 2012 when a passing motorist found the girl wandering the streets after she had run away from home. The girl told investigators she had spent most of the past five years confined to the basement of her family's home and was denied food despite begging to eat. She said her stepmother beat her and her stepbrother repeatedly forced her to perform oral sex on him.
A jury Friday found the father guilty of reckless endangerment, intentional child abuse and causing mental harm to a child. But it found the Madison man not guilty of a charge of false imprisonment for allegedly keeping his daughter in a basement.
It was the second trial for the father of the girl, who is now 16. A separate jury in March convicted the father of felony child neglect but acquitted him of a misdemeanor neglect count. They deadlocked on four other charges, and prosecutors decided to retry him on those counts.
The 42-year-old father took the unusual step of testifying in his own defense during his second trial, saying his daughter suffered from severe behavioral problems and he did his best to get her help. He put her in the basement after a psychologist said she should live on a different level of the home than the rest of the family, he said.
He boarded up the windows so she wouldn't climb out and raid the neighbors' trash, he said. But he denied ever locking her in or withholding food, saying she simply refused to eat the meals he made for her and chose to dine on crumbs and garbage.
The trial began on Nov. 12, and jurors began deliberating the case on Thursday.
The girl's stepmother was sentenced in July to five years in prison for reckless endangerment and causing mental harm to a child. Her stepbrother is set to stand trial in February on two sexual assault charges as well as a child abuse count.
The Associated Press isn't naming anyone in the family to avoid identifying the girl.

Local father admits to abusing 7-week-old twins
HUNTERSVILLE, N.C. — A local father will not spend another day in jail after admitting to abusing his 7-week-old twins.
He first confessed in January, after his infant son died and his daughter ended up in the hospital.
Eyewitness News was in court on Friday, and asked attorneys why he didn't face a tougher sentence.
The assistant district attorney called it a loophole in the law that has since been fixed. It just was not fixed in time for the case.
Cory Geisler was silent when Eyewitness News asked him about the case involving his twin infants.
In January, Huntersville police were called to his home for an unresponsive child.
They found Geisler's 7-week-old son Aden limp, Geisler was doing CPR.
The baby died.
An autopsy showed he had been abused. A doctor confirmed so had his twin sister, Addison.
On Friday, Geisler pleaded guilty to two counts of felony child abuse.
Geisler was sentenced to supervised probation for the next two years.
The assistant district attorney said that sentence would be different if the crime was committed now.
"As of October of this year, the child abuse statute has changed and North Carolina has increased punishment for child abuse. This occurred prior to those changes," said the A-DA.
The sentence would now be a mandatory minimum of three years in prison. No charges were filed in the baby's death because the medical examiner could not determine the cause.
Geisler's former girlfriend moved to Texas taking his daughter Addison with her.

BOWLING GREEN, Ohio (AP) — An Ohio father has been sentenced to 14 years in prison for fatal injuries inflicted on his 3-month-old son.
Wood County Common Pleas Judge Robert Pollex on Friday gave 32-year-old Brian Steinmiller four more years than prosecutors sought under a plea agreement.
The (Toledo) Blade (http://bit.ly/1eb7mXb ) reports Steinmiller pleaded guilty in September to one count of involuntary manslaughter and two counts of endangering children.
The judge said Carter Steinmiller was "basically tortured" by his father, suffering 23 bone fractures and cigarette burns before his May 2012 death.
Brian Steinmiller told the court he was sorry and that he wished he could give his son his life back. Defense attorney Alan Konop says Steinmiller will appeal his sentence.

A father who subjected his young son to horrifying sexual abuse was given a 10-year prison sentence today.
The middle-aged man from the midlands had pleaded guilty to 12 charges of the defilement of a child under 15 and the Director of Public Prosecutions entered a nolle prosequi in respect of several other counts.
The offences took place in 2009 and 2010, when the boy was aged nine to 11, the Circuit Criminal Court sitting in Tullamore heard.
Judge Tony Hunt voiced his concern that, while the accused had pleaded guilty and was making some progress in dealing with his problems, he did not fully appreciate what he had done to his child. His actions had gone against all the natural duties and instincts of a parent to nurture a child. It was a most fundamental breach of trust.
While there had been no victim impact statement, it was “highly likely” that long-term damage had been done to the victim, the judge said.
The court heard that the abuse, which took place on a weekly basis, had come to light when his son disclosed to a relative what had been happening to him. When the accused man was later interviewed by gardaÃ, he made limited admissions.
The man had been assessed on the low range of an intelligence scale, but that did not prevent him from appreciating the enormity of what had happened, Judge Hunt said.
‘A danger’
“I’m satisfied he doesn’t have a conventional view of sexuality and is a danger unless managed,” he stressed.
The headline sentence for such offences was 14 years, the judge noted, and the case seemed to him to be well above the medium point in the scale. But there were also a number of mitigating factors, including the guilty plea, which he had to take into account.
He imposed concurrent sentences of 10 years on each count, but suspended three years on condition that the accused keep the peace, comply with post-release supervision requirements and have no contact with his victim.

In a gruesome incident, a six-year-old and his father were burnt to death in a self-immolation attempt by the latter. The police said the man hailing from Tamil Nadu committed the act following a dispute with his wife.
The deceased were Sreedeva Sarma, 45, of Pathukani, in Kanyakumari, and his son Anandapadmanabha Sarma. The youth had doubts over the chastity of his second wife Ajithakumari and quarrels were common in the family. The youth was a temple priest by profession and they were residing at Pathukani, the police said. On November 10, Ajithakumari left home following a quarrel and reached her sister’s residence at Kochuvayalmukku, Kuttamala in Amboori. She later secured a job at a textiles shop in Kottayam with the help of the sister’s husband.
On Saturday morning, Sreedeva Sarma, along with his son, reached the sister’s residence. Presuming his wife was inside the house he tied his son and himself to a tree behind the house and set himself and his son on fire after pouring kerosene.
Though the locals rushed to help seeing the blaze, the child died on the spot. Though Sreedeva Sarma was rushed to the MCH he succumbed to the injuries around 10.30 p.m.

Dad charged with 1st-degree murder of 5-year-old son during "custody battle" to be set free; boy died during court-ordered visitation (Maricopa County, Arizona)
Utterly disgusting that Arizona managed to f*** up this case so badly. Clearly the father was responsible for this boy's death; no one else is even suspected. Yet now this piece of sh** walks.
Notice that all this took place during court-ordered visitation, and that the father was battling the mother for custody. Very typical scenario of an abusive father who kills the children rather than lose control of them. Murder is the same to these guys as winning a custody battle, as it's all about hurting Mom. The kids are just collateral damage in their blood lust for power.

An Arizona judge has freed a man who was charged with the first degree murder of his son nine years ago.
Judge Sally Duncan cited 'a pattern and practice of misconduct' by prosecutors during the controversial trial of Jeffrey Martinson, 43, who was being held on a charge killing his five-year-old son, Josh, in 2004 while in the midst of a custody battle.
Duncan dropped all charges against Martinson and ordered he be released at noon on November 26, saying the prosecution team acted with a ruthless 'win-by-any-means strategy'.
Because of the theory double jeopardy, Martinson cannot be tried again on the same charges, according to UPI.
The body of Martinson's son Josh was found by a neighbor on a bunk bed in Martinson's Ahwatukee apartment in August 2004 during a court-ordered weekend visitation with his father. Whether Jeffrey Martinson killed his 5-year-old son, Josh, in 2004 may never be determined in a court of law because of prosecutor misconduct in trying his case.
Martinson claimed he had found the child floating in the bathtub and could not resuscitate him.
The neighbor also found Martinson unconscious in his bedroom with a plastic bag over his head and superficial cuts to his wrists.
Martinson claimed he was distraught and tried to kill himself but failed.
However muscle relaxants were found in Josh's blood, with a medical examiner ruling he died of a drug overdose.
On the night the boy died Martinson was in a custody dispute with his ex-wife.
Prosecutors argued it was a case of murder and attempted suicide.
In a 28-page ruling, Duncan said Deputy Maricopa County Attorney Frankie Grimsman charged Martinson with felony murder, on the grounds that Josh had died from child abuse inflicted by Martinson.
However, when it came to the court case, Grimsman tried Martinson as if he were charged with premeditated, intentional murder.
Grimsman had been warned by Duncan several times over the course of the trial not to treat the charge as premeditated.
'When viewing the totality of circumstances, the Court finds that during trial the Prosecutors engaged in a pattern and practice of misconduct designed to secure a conviction without regard to the likelihood of reversal,' Duncan wrote.
Martinson, 47, has been in jail for nine years awaiting a final verdict. Whether Jeffrey Martinson killed his 5-year-old son, Josh, in 2004 may never be determined in a court of law because of prosecutor misconduct in trying his case.
After several years of changing defense attorneys, Martinson finally went to trial seven years after Josh's death, in July 2011.
He was found guilty in November 2011, with the jury deciding there were aggravating factors that made him eligible for the death penalty.
But before the jury could sentence Martinson, a juror came forward accusing the forewoman of browbeating other jurors into a guilty verdict.
The verdict was thrown out in March 2012.
In fall that year, Grimsman told the judge that the original indictment and the intent to seek the death penalty had been dropped and asked that another judge and defense team be appointed.
In late 2012, The Arizona Court of Appeals ruled that Grimsman could indeed re-indict Martinson, unless Duncan found that Grimsman had done so in bad faith.
On Tuesday, Duncan made that finding, in addition to the finding of prosecutorial misconduct.
The Maricopa County Attorney’s Office however still has options to appeal.
'We will review the Judge’s allegations as well as refer the record of the proceedings to our Ethics Committee and Appellate section for review,' County Attorney Bill Montgomery told The Arizona Republic.
'We will also review the conduct of defense counsel and that of the Judge for appropriate action.'
Defending the case had cost taxpayers $2.97 million as of last July, nearly twice the amount paid for the defense of Jodi Arias, who was convicted of first-degree murder in May following the 2008 stabbing and shooting death of her boyfriend, Travis Alexander, in his suburban Phoenix home.

Court rules that former reality star 'clairvoyant' Graham Bishop was sane when he attacked his children
Englishman Graham Bishop, the 59-year-old medium/clairvoyant who has appeared on reality television shows such as ‘Ã…ndernes Magt’ and ‘Klarsyn’, was sentenced to eleven years in prison and deportation by Copenhagen City Court yesterday. Bishop was found guilty of the attempted murder of his four-year-old twin daughters last week, but sentencing was delayed while the court considered Graham’s contention that he was temporarily insane at the moment of the crime.
He blamed the attack on medicine he was taking for his ADHD.
The stabbing occurred in August 2012, when the father took a knife to his daughters in the Ronald McDonald patient housing at the city hospital, Rigshospitalet. The family was there because one of the girls was receiving dialysis treatment for chronic liver failure. Graham locked himself in the room with his daughters and his wife notified police that he was making threats with a knife. After throwing himself out of the girls’ window, police kicked down the door to find that the girls had been stabbed.
Brutal attack
The court ruled that the attack on the girls was so vicious that Graham must have intended to kill them. The assault has left both girls with permanent injuries, particularly the one who was already suffering from liver failure.
It was revealed during the case that she had endured spastic paralysis, lost much of her sight and will likely live a shorter life because of her father’s attack.
Bishop moved to Denmark from Swindon in southwest England in 2000. He is described as being “active in the spiritual environment in Denmark”, which helped land him spots on several television shows. Graham claimed to be able to communicate with spirits by going into a trance and being possessed by someone who Graham calls ‘Dr Karl’. According to Bishop, Dr Karl is a German physician who was born in 1848 and began performing operations on people at the tender age of 12. Bishop claims that Dr Karl is his “main spirit guide” who uses Bishop’s body to help “heal” people in need.
On his now defunct website, Graham detailed his connection to Dr Karl:
“All of my life I felt a bit of an outsider and I have experienced many things that seemed to have no practical explanation,” Bishop wrote. “It has been many years now that I have been honoured with sharing a very deep personal connection with Spirit Dr Karl, and work in the state of ‘deep trance’ (from my viewpoint a totally unconscious state). This particular spiritual ability is rare and so I am one, of only a few, able to offer this unique service of providing such strong and direct access to those in the spirit world.” After Bishop serves his sentence, the court ordered that he be immediately deported.

HOUSTON — The Texas Court of Criminal Appeals has upheld the conviction and death sentence given to a North Texas man for the December 2009 slayings of his pregnant wife, 5-year-old daughter and father-in-law.
Attorneys for 38-year-old John Hummel argued evidence was legally insufficient to convict him at his trial in in Fort Worth in 2011, that his trial judge unfairly rejected over a dozen pretrial motions and that one of the sentencing issues decided by jurors is unconstitutional.
Hummel was convicted of fatally stabbing his 34-year-old wife, Joy, and using a baseball bat to beat his daughter, Jodi, and his 57-year-old father-in-law, Eddie Bedford. Evidence showed he then torched their home in Kennedale, a Fort Worth suburb.
Prosecutors said he killed his family so he could pursue other women and party.

Judge praises dad with history of domestic violence as a "responsible parent"--despite being found guilty of kidnapping and assaulting his 15-month-old son and son's mother (New Zealand)
Ladies and Gentlemen: This is almost a parody of the standard domestic violence/child abuse news story.
Start with the headline. Makes it sound like Daddy just forgot to fasten Junior in his car seat, doesn't it? All while driving just a wee bit too fast.
Not even close.
Dad CHARLIE NGAPERA is a freaking total menace.
He is no longer in a relationship with his son's mother (note language about "former" partner), and yet he has the freaking nerve to accuse her of "seeing other men." What, jackass. You own her for life now?
Next:
1) He grabs the mom by the throat, puts her in a head lock and threatens to use a butcher's knife on her.
2) He abducts her 15-month-old son--apparently after Mom flees for her life.
3) At some point, Mom and Dad meet up again, and she confronts him over the abduction. She tries to get the child out of the car, but is not successful.
4) Mom supposedly jumps in the car as Dad is speeding away.
5) Dad proceeds to drive like a total f**king lunatic at high rates of speed, because he's all angry you know. The whole time the poor baby is on Daddy's knee or the center console. He refuses to hand the baby over to the mother.
5) Dad runs a stop sign yelling "watch this." Total Daddy Drama.
6) Dad threatens Mom that he intends to take her and the child "down with him."
7) When the car stops, Mom manages to jump out of the car. Dad chases her, grabs her by the hair, and pulls her back in the car. Apparently that doesn't work, so he tries to force her into the trunk. But she escapes.
8) Daddy takes off again, and throws the baby from the driver's seat to the passenger's seat. Baby suffers "minor" injuries.
Daddy later caught and arrested.
Daddy eventually goes to trial, and now we have the Idiot Judge. Check this out:
Judge Mackintosh acknowledged that Ngapera acted out of character. He had just one previous conviction for assaulting a female in 2007.
What the f***! Just one other conviction for assault? So Daddy acted "out of character"? Well, if you figure in all the times he wasn't convicted, or somebody was afraid to press charges, I bet we're looking at a guy who was acting VERY MUCH IN CHARACTER.
Then Judge Moron, er, Mackintosh, praises this menace as a "responsible parent"!!!
The mind boggles. Of course, Daddy's family are total enablers too. So surprised....

Charlie Ngapera, 32, was sentenced in the Napier District Court today to two years seven months in jail. He was found guilty of eight charges including kidnap, assaulting a child, assaulting a female, threatening to kill, reckless driving and theft.
On the morning of August 2 Ngapera, understood to be a Black Power member, accused his former partner, Tessa Rollinson, of seeing other men. He grabbed her throat, put her in a head lock and threatened to use a butcher's knife on her, the police summary said.
She fled the house and arranged to meet a friend, Natasha Brocklebank, at the Napier police station to lay charges.
While they were waiting, Ngapera pulled up outside in his car. Brocklebank went out to confront him and tried to get the child out of the car. She jumped in as it drove away.
Ngapera drove at speeds of up to 180kmh while the infant sat either on his knee or on the centre console. He refused to let Brocklebank take the child from him.
Ngapera shouted "watch this" as he sped past a stop sign and through an intersection, making no attempt to stop, the summary said. He told Brocklebank he intended to take her and his son "down with him".
Brocklebank managed to jump out when the car stopped briefly. Ngapera chased her, grabbed her by the hair and pulled her back to the car. He then tried to put her in the boot but she escaped.
At the sound of police sirens, he got back in the car and flung the child violently from the driver's seat to the passenger's seat.
He drove off, leaving Brocklebank behind. He drove through an orchard gate in Whakatu before running away, carrying his son. He then tried to disguise himself by putting on a hooded jacket from an unlocked lorry cab.
By this time, police had placed cordons around the Whakatu area and Ngapera was found in a car after asking for a ride to a nearby address.
The car owner said she was worried for the baby's safety and recognised the address, so put the baby in her car seat and gave the man a lift.
The child suffered only minor injuries and was reunited with his mother shortly after.
Ngapera pleaded guilty last month and wrote a letter of apology which was given to Judge Bridget Mackintosh. He handed up a second letter today.
Judge Mackintosh acknowledged that Ngapera acted out of character. He had just one previous conviction for assaulting a female in 2007. Judge Mackintosh said Ngapera was generally a responsible parent having cared for his two sons - letters from health professionals and the boy's school backed this up.
Judge Mackintosh said it was an appalling state of affairs that bought Ngapera before the court. In addition to the jail sentence, she disqualified him from driving for 12 months and issued a three strikes warning. The disqualification will be served while he is behind bars.
Family called out in support as Ngapera left court.

"Primary caretaker" dad who killed 9-week-old son dies in prison (Canon City, Colorado)
So basically this "primary caretaker" daddy tortured this baby from birth to the time his life was mercifully cut short at just 9 weeks. Like so many male "caretakers," Dad just couldn't tolerate a crying baby. So instead of comforting the baby, he'd just bash him.
Dad is identified as JOSEPH DOWLER.
Why was this not considered 1st-degree murder?

CANON CITY, Colo. - A father convicted of child abuse resulting in the death of his 9-week-old son has died in prison.
Joseph Dowler was sentenced in 2003 to 60 years in prison. He died November 6 at the Colorado Territorial Correctional Facility in Canon City, according to a news tip sent to 7NEWS and confirmed by the Boulder Daily Camera. Dowler was 45.
In October 2002, Dowler's son Tanner was brought to Community Medical Center in Lafayette barely breathing and ''gravely ill,'' a doctor testified at Joseph Dowler's trial.
Tanner died after being taken off life-support equipment.
Doctors said Tanner had signs he had been severely beaten or shaken on more than one occasion. He died of brain injuries, but doctors said the baby had 11 broken ribs and second- and third-degree burns on both feet when he was taken to the hospital. He had been shaken so hard that parts of his eyeballs had separated.
At trial, a detective told the jury that Joseph Dowler confessed to twisting his son's arms until they popped and to lifting him by his jaw to get his attention.
Dowler's defense team tried to shift some of the blame on the mother -- Audra Dowler. Dowler, 19, was sentenced to 10 years in prison for negligence in connection with Tanner's death. She was released after serving about three years, the Camera reported.
Audra Dowler testified that Joseph was the primary person who took care of the baby and he was often frustrated by the boy's crying. She said her husband balked at getting their son medical attention because he was concerned he would be accused of child abuse.
Joseph Dowler was convicted on seven counts of child abuse resulting in serious bodily injury, but was found not guilty of first-degree murder.

Dad arrested for abusing 3-month-old daughter; baby faces lifetime of brain damage (Glynn County, Georgia)
In many ways, this is a typical abuser daddy story: a baby apparently abused from birth (signs of healing injuries even at 3 months). Fractures including a skull fracture. All because poor Daddy got all frustrated and bashed the baby's head on to a hard object. Just to show everybody how Daddy's Not Happy.
But check out the last line. The authorities don't even know who the mother is! Why? Is this a single dad? A single dad with custody? Or just lots of unsupervised visitation? What?
And how freaking asinine is it to even ASK what Daddy's "motive" was for bashing a 3-month-old infant? Maybe it might be more helpful to ask what Daddy was on parole for, and why this POS was allowed within ten feet of a baby.

A 3-month-old girl is in the hospital, facing a lifetime of brain damage, and her 21-year-old father is in jail, accused of causing it.
Glynn County police were called to the Brunswick hospital of Southeast Georgia Health System Thursday after the infant, identified in an arrest warrant for her father as Ma'Kayla Reed, was taken there to treat breathing problems that required her to be placed on a ventilator, Chief Matt Doering said Tuesday.
Doering said doctors discovered she had a fractured skull, neck and several broken ribs, all of which had occurred previously, because they appeared to be healing.
"Three-month-olds typically don't have broken ribs or skull and neck fractures without there being a violent act of some sort," Doering said. Investigators concluded that the injuries were not the result of an accident, he said.
Ma'Kayla's father, Genoa Jaquan Reed, 21, of 185 Highland Park Drive, Glynn County, was arrested Friday and charged with first-degree cruelty to children and aggravated battery.
Police alleged in an arrest warrant that Reed had slammed Ma'Kayla's head into a "hard object with such significant force that Ma'Kayla sustained a broken neck, a fractured skull and bleeding on the brain." He was also charged with probation violations.
The arrest warrant put Reed alone with Ma'Kayla when the injuries occurred.
Doering said Ma'Kayla, who was transported to Memorial Medical Center at Savannah, is alive, but has irreparable brain damage.
It could not be determined Tuesday if other children lived at the house, who Ma'Kayla's mother is and if there was a motive for the alleged assault.

ROCK HILL — A Rock Hill father who went to a friend’s house to play video games while he was supposed to watch his 4-year-old son has been charged with neglect after police say a neighbor found the child wandering at an apartment complex without any clothes or supervision on Monday.
Police were sent to Market Place Apartments off Heckle Boulevard at about 11:35 a.m. after a neighbor reported finding the boy walking around in the area, according to a Rock Hill police report. The neighbor took the child to his apartment and notified apartment management.
The apartment’s manager gave police the boy’s address, where he lives with both his parents and a 2-year-old sister, the report states. The manager had been unable to contact either parent. Police found the apartment’s front door open. Officers reached the mother by phone. She told them she left for work in Charlotte at about 9 a.m., leaving the boy with his father, Antwain Sutton, 24. Typically, the boy goes to daycare but he was not able to attend on Monday.
Police spoke with Sutton, who claimed he was unaware the boy did not attend daycare that morning and left the house at about 10:30 a.m. to play video games in Rock Hill’s Sunset Park neighborhood, the report states. Officers wrote in their report that they believed Sutton was “well aware” that the boy was inside the house and deliberately left him.
Police arrested Sutton, charging him with unlawful neglect of a child, the report states. He is held at the York County Detention Center on a $10,000 bond. The child was given to his grandmother until his mother returned home from work.

A man was charged with child cruelty for delaying medical treatment to his two sons after they were injured in a car accident, Vermont State Police said. Justin Galenski, 40 of Fairlee, was charged Saturday. He said Sunday that the Nov. 12 crash on a snowy road in Strafford was an accident. ‘‘I love these boys. The sun and moon rises with them with me,” he said. “It was a horrible, horrible night. By no means did I mean to hurt my kids.” Galenski’s sons, ages 4 and 9, suffered concussions, a broken arm, and a broken clavicle but didn’t see a doctor until the day after the Nov. 12 accident, State Police said. Police said Galenski and his sons walked more than a mile to the home of a friend, a registered nurse, who helped assess the injuries. Police were contacted the following day by the boys’ mother.

Dad charged with 2nd-degree murder in death of 6-month-old son; baby had burns over more than 80% of body (Baton Rouge, Louisiana)
It's not spelled out here, but I think it is highly likely that CURTIS KING was one of those "stay-at-home" dads--meaning he was basically an unemployed/unemployable deadbeat who did drug dealing rather than support his family with a real job.
These kinds of dudes are typically unable to care for any living thing, especially a baby. They're too vicious, short-tempered, and self-centered.

Father booked in baby's death
Updated 7:12 am, Tuesday, November 19, 2013
BATON ROUGE, La. (AP) — Police have arrested a Baton Rouge man in the death of his 6-month-old son.
Police say the father is accused of a pattern of neglect that included placing the baby in scalding bath water that left him with burns on more than 80 percent of his body.
The Advocate reports (http://bit.ly/18jaOi4 ) Curtis King, 23, was booked Monday on counts of second-degree murder and second-degree cruelty to a juvenile in the Nov. 6 death of Aiden King.
He also is accused of selling drugs out of his home and storing marijuana in the newborn's closet.
In late May, when Aiden was just a month old, he suffered second- and third-degree burns while in the care of his father, said Sgt. Mary Ann Godawa, a Baton Rouge police spokeswoman.
Placing the baby in the hot water was "a gross deviation below the standard of care expected to be maintained by a reasonable man," Detective Zac Woodring wrote in an arrest document.
Aiden was airlifted to Shriners Hospitals for Children in Galveston, Texas, where he was in critical condition. He survived his wounds but received permanent scarring and had to undergo multiple skin grafts, according to court records.
Despite the burning incident, the child was released at some point to his parents, King and Daria Thomas, Godawa said.
Officers responded to King's residence Oct. 29 after the baby was found unresponsive.
King left the child unattended and behind a closed door on an adult-size bed while King was in another room separating marijuana to sell, authorities said.
The baby was taken to a hospital where he remained on life support until Nov. 6.
It was unclear whether Kings has an attorney.

Dad slaughters twin 11-month-old sons, their mom in murder-suicide (Arlington, Massachusetts)
It's pretty common in murder-suicide news accounts to tiptoe around as to what happened. So the lack of agency here is pretty common.
Still, it's clear that dad SCOTT JONES committed a triple homicide.
There are enough hints to provide the real story, if you piece them together. A father with "marital problems" (i.e. a history of abusive/controlling behavior) and a history of suicide threats. A mother who wanted out, who had already filed for divorce. That a family caretaker was nervous enough about Daddy to call the police for a "well-being check."
So like too many abusers who fear the loss of control, Daddy kills everybody in a final blood bath exercise of Total Mastery.

Massachusetts couple found dead with two infants said to be having marital problems
Published November 19, 2013/ FoxNews.com
A Massachusetts couple who were found dead along with their two infant sons inside a Massachusetts home Monday were having marital problems, a family member has revealed.
The bodies of 43-year-old Scott Jones, his wife 43-year-old Mei Kum Jones and their sons Colt and Cameron were discovered in a two-story, multi-family home in Arlington, a Boston suburb north of Cambridge, after police were asked to do a well-being check on the family. The twins would have turned a year old on Nov. 26.
Authorities have released few details about the deaths, but Mei Kum Jones' brother, Ben Li, said in an interview with Boston's WBZ-TV that the couple had recent marital problems.
"I think he just moved out a couple of days ago, and I think she's going through the motion of the divorce," Li told the station.
He called his sister "a great person, a loving mom, a loving, caring person."
A source also told the Boston Herald that the home was the scene of at least two police calls in the summer of 2010.
The source said one visit was sparked by Jones, who was threatening to kill himself, and the second was for an unspecified reason.
“There were signs of trouble,” Clare MacFarlane, whose mother lives next door to the Jones' home, told the Boston Globe.
Authorities say the case appears to be an isolated incident and there is no threat to the public.
Arlington Police Chief Fred Ryan told the Boston Herald that an officer stopped by the home to conduct a well-being check and discovered the bodies. Ryan told The Boston Globe that a caretaker for the children called in and asked for the family to be checked on. The state medical examiner's office removed the bodies Monday evening.
A source told Fox 25 that the weapon appeared to have been involved in the incident is some type of cutting tool.
Caroline Ronten, a former co-worker of Mei Jones at two companies, said her friend had seemed happily married when they reconnected last fall after several years and she was pregnant with the twins.
"She seemed really happy and really positive," Ronten said.
Ronten said she never met Scott Jones but she and Mei Jones would chat when they crossed paths.
"We ran into each other at Starbucks and in the neighborhood, and I saw her and her husband walking the twins in their double stroller," she said. "The babies were adorable."
Neighbor Stephen Trebino, who grew up across the street from the couple's home, said he often saw one or the other of them walking with the babies. He said Scott Jones was nice to his father and would shovel the sidewalk without asking when it snowed."He was friendly," Trebino said.
Mei Kum Jones had worked for Road Scholar, an educational travel program formerly known as Elderhostel, which called her "a valued member of our team" and said her loss was "deeply felt by all of us."
"I'm heartsick for the kids. It's heartbreaking," neighbor Amy Iannelli, 74, told the Boston Herald.
