Boro dad faces up to 25 to life in wife’s murder

A South Richmond Hill man charged with killing his wife in front of his children was ordered held without bail last week, District Attorney Richard Brown said.

Oscar Novakovsky, 37, of 103-24 121st St. in South Richmond Hill, allegedly stabbed his estranged wife, 32-year-old Diane Sharma, in the neck with a knife between 12 a.m. and 1 a.m. Jan. 15 inside her 117th Street home, the DA said.

The killing occurred in the presence of the couple’s three children — ages 3, 5 and 9 — and Brown said Sharma also had multiple cuts to her arms and hands in addition to the fatal stab wound.

Novakovsky was arrested a short while after the murder by 102nd Precinct officers, who took him to a local hospital where he was treated for cuts to his arms and hands, the DA said.

Novakovsky allegedly told police “the kids were screaming. The kids were trying to pull me off and were crying” during the encounter.

“It is difficult to imagine a crime more heinous than that of a father viciously attacking his wife in front of their three small children,” Brown said in a statement. “The children will have to bear the emotional scars of what they witnessed for the rest of their lives. The charges against the defendant will be prosecuted to the fullest extent of the law.”

Novakovsky was arraigned Jan. 25 on charges of murder, aggravated criminal contempt, criminal contempt, endangering the welfare of a child and criminal possession of a weapon before Queens Criminal Court Judge Suzanne Melendez, who remanded him without bail, the DA said.

The South Richmond Hill man, who faces up to 25 years to life in prison if convicted of the charges, is expected to appear in court Tuesday.

Read between the lines. JAMES E. "BUTCH JACKSON II is obviously a custodial father. He lives with a "girlfriend" who is apparently not the mother of any of the children in question. In fact, as is typical, there is NO MENTION of the children's mother. The media has erased her out of existence.

So how and why did this father with a long history of child neglect have custody of two young children? Who gave it to him?

MARIETTA - A jury could decide today if a Belpre father is responsible for the death of his 2-year-old daughter by failing to supervise her.

Prosecutors claim James E. "Butch" Jackson II, 51, left the girl and her 4-year-old brother unsupervised outside their Belpre home on Oct. 18, 2010. The 2-year-old, Bianca Jackson, was killed in a fire that started in a vacant neighboring residence.

Jackson faces up to 10 years in prison if convicted of involuntary manslaughter and child endangering.

The defense is expected to continue presenting its case this morning and closing arguments and deliberations could begin this afternoon. It remains to be seen if Jackson will take the stand in his own defense. The trial began Monday.

Eight witnesses testified Tuesday, including a past neighbor of Jackson who said the man and his girlfriend routinely failed to supervise their children.

Leonard Wilfong, who lived across the street from Jackson at the time of the fire, testified the children often played in the street and wandered as much as 50 yards from the home without supervision.

"At least once a week they would play unsupervised," Wilfong said.

Washington County Children Services caseworker Karen Seagraves said she also had concerns about the safety of the children prior to the fire. She testified Jackson and his live-in girlfriend, Chrystal Dillon, 25, had been getting monthly visits from her since June 2009 after she witnessed Bianca Jackson, then 1, wandering along a Belpre street.

Dillon faced identical charges to Jackson and was convicted in September of child endangering and sentenced to six months in jail and ordered to complete a six-month rehabilitation program. The jury in her case could not reach a verdict on the manslaughter charge.

"I had clearly made my concerns known to them," Seagraves said, adding that she requested gates be installed on a deck and that she insisted the parents keep a watchful eye on the children as they play.

"I said that term many times...'Keep your eyes on the children,'" Seagraves said.

Jackson's attorney, Jack Blakeslee of Caldwell, noted that Seagraves did not note anything of concern during a visit with the family a week or so before the fire. He said the visits from Seagraves were part of a voluntary plan drafted by the caseworker and that the couple were taking direction, including the installation of a gate on their deck.

"You wrote in your report there were no safety hazards noted (in the last visit)," he said.

Assistant Washington County Prosecutor Kevin Rings asked Seagraves to better explain the report.

"Does indicating there were no safety hazards noted mean that you had no other concerns?" he asked.

"No," Seagraves said, adding that supervision was always a concern with the family.

Another witness on Tuesday was Belpre Police Chief Ernie Clevenger, who said he helped organize searches for the missing girl when the fire was first reported. He said instructions were given to look for the child under cars, in dog houses, trash cans and under bushes.

"I told (officers and firefighters) you will look anywhere a 2-year-old may hide... and I'll worry about the legal ramifications of if we have the right to look in (someone's) garage later," he said. "The neighbors were 100 percent cooperative in helping to find this girl."

Clevenger said two canvasses were conducted in the area of the burning Belpre home. The child was found hours later in the rubble of the burnt home.

Clevenger said he had asked Jackson and Dillon about where the child may be.

"At that time did the defendant or Chrystal Dillon know where their child was?" Rings asked.

"No, they did not," Clevenger said.

Once again, we have a violent dad, CHADWICK EMMANUEL TAYLOR, who repeatedly terrorized his 2-year-old child and his ex, the child's mother. True to form, his abuse extended into a "custody battle" over the child, which of course is just another way to terrorize the mother (through the courts). And then Daddy finally shoots Mom in the head while she's sitting in a car, like some sort of bloody executioner. Miraculously, the mother lives. But for some reason, the authorities dropped the attempted murder charges and let Daddy plead guilty to wanton endangerment. For that, he gets FIVE FREAKING YEARS in jail. AND WITH A CRIMINAL HISTORY THAT'S A MILE LONG. And of course, he gets all kinds of BS excuses."Upset" over his son? My @$$.

Young father gets 5 years for domestic shooting

A Charleston man who shot a woman in the head in a domestic dispute pleaded for mercy in court Tuesday but will spend five years in jail for what the judge termed "an intentional, violent crime."

Chadwick Emmanuel Taylor, 23, of Charleston turned and looked pointedly at his victim and then bowed his head and said, "Oh man, oh man."

After the hearing, Lydia Spencer, who suffered a bullet wound to the head while sitting in a car, said she wished Taylor could have been put behind bars for longer.

Taylor was arrested after the June 11 shooting and indicted on charges of attempted murder, malicious wounding and five counts of wanton endangerment. He pleaded guilty to one count of wanton endangerment, which carries a maximum five-year penalty, and the other charges were dropped.

Spencer and Dianah Thompson, the mother of Taylor's 2-year-old child, said Taylor repeatedly terrorized them.

Thompson, who is in a relationship with Spencer, said, "He has no remorse that he shot her, only that he got caught and he got time.

"I never was involved in any gun activity of any kind, I never even saw a gun except on TV," said Spencer, who suffered some nerve damage from the incident. "I can't believe I got put in that predicament. But I was lucky."

Thompson said she has been embroiled in a custody battle with Taylor. Spencer said he came to her home earlier in the day prior to the shooting, angry and brandishing a gun. He left, and police were not called.

But in the early morning hours of June 11, she said she was in a vehicle with her cousin, Kareem Hunter, that pulled over near the intersection of Virginia and Elm Streets. Spencer saw Taylor pull over behind them, jump out and start shooting.

Taylor's attorney, Duane Rosenlieb, told the judge the man didn't act rationally because he was upset about his son.

"This had been a running dispute over Mr. Taylor's child," he said. "And it built, and built and built to the point where these events transpired."

Rosenlieb said Taylor was an abused child in a family that included several felons and wanted to devote himself to raising his son properly.

Taylor said, "I have a bad juvenile history, it could be a movie. But my original intent was never to bring harm to anyone. My back was up against the wall."

Taylor said he didn't want to be seen as a "stereotypical young black man who wreaks havoc in the community."

But Judge Jennifer Bailey said Taylor has a long criminal record that included charges of obstructing an officer, driving without insurance or license, drag racing, domestic battery, brandishing a weapon, domestic assault, wanton endangerment, first-degree robbery, destruction of property, disorderly conduct and possession of counterfeit.

She said his juvenile criminal record is also lengthy.

"Your conduct has kind of caught up with you," Bailey said. "If you cared about your child and what you hope will happen to him, your adult record would be crystal clear.

"I will not condone a person shooting a gun at another person," she said. "At some point in life it's time to accept responsibility and be a law-abiding citizen or you don't belong in our neighborhoods."

Dad SKYLER WADE GARNER basically gets probation and useless anger management/parenting classes for beating up on a newborn. (My gut feeling is that anybody who assaults babies is already lacking a few screws, and isn't going to really get how such actions are morally wrong in a classroom. It's a little bit late for that.) Notice that Daddy is getting the kid-glove treatment even though there is evidence that this wasn't the first time Daddy had abused the baby (evidence of older fractures). Though Mom is not accused of any wrongdoing (at least none that is reported here), she has lost the baby to foster care. Notice that the violent perpetrator (Dad) and the non-perpetrator (Mom) are treated virtually the same. This is typical of the double standard in these cases. We expect more from mothers, but then layer up the family courts with fathers rights/joint custody dogma so moms can't exercise any real authority over their children and their safety.

Burley Father Pleads Guilty to Child Injury Charge

BURLEY • A Burley man pleaded guilty to an amended misdemeanor charge of injury to a child Tuesday after his infant daughter was hospitalized with broken ribs and a punctured lung in November.

Skyler Wade Garner, 27, also pleaded guilty to violating his probation for misdemeanor driving under the influence in 2011.

Cassia County 5th District Magistrate Judge Rick Bollar sentenced Garner to 365 days in jail on the child injury charge, with credit for three days that he already served in jail and the remaining 362 days suspended. Garner was placed on probation for two years, with another year of probation running concurrently for his probation violation.

“I’m not a child abuser,” Garner said when Bollar asked if he wanted to speak. “No, there’s nothing I’d like to say.”

Garner was also ordered to pay fines and court costs.

Bollar said he understands that the cause of the injuries Garner’s daughter suffered is still under investigation.

According to court records, the 2-month-old girl was hospitalized with broken ribs and a punctured lung. Further investigation revealed that the infant also had multiple older fractures including a fractured vertebra.

The baby’s mother allegedly told detectives they believed their 14-month-old son may have caused the infant’s injuries. The mother said the boy often jumped from couch to couch and sometimes landed in the infant’s bassinette, which sat on one of the couches. Garner also allegedly told investigators that the couple’s dog may have caused the child’s injuries.

The child has been placed in foster care, while Garner is currently enrolled in parenting and anger management classes.

He wasn't supposed to be there since she had a restraining order. He also broke into her home and smashed her cell phone and stole her car. Just goes to show how domestic violence and child abuse go together like peanut butter and jelly for these guys.

BRICK, N.J. (AP) - Authorities are seeking a New Jersey man who they say injured his young daughter when he threw a brick during a domestic argument with the child's mother.

It doesn't appear 25-year-old Edward Smith of Hamilton Township (Mercer County) was intentionally trying to injure the 3-year-old, who was struck in the face by the brick. It knocked out a tooth, and she needed stitches for a cut on her upper lip.

Brick police tell the Asbury Park Press (http://on.app.com/AcVhu4) Smith went to his ex-girlfriend's apartment Saturday night, violating a restraining order. Smith left when the woman told him to leave, but then grabbed a landscaping brick and threw it through a glass sliding door.

He then allegedly re-entered the apartment and broke the woman's cell phone before stealing her car.

Police said a Cedar Rapids man who had a loaded handgun in his possession used his young son in an attempt to protect himself during an altercation early Sunday.

Keith J. Cerney, 24, of 1518 12th Ave. SE, was arrested on suspicion of child endangerment and assault while displaying a dangerous weapon after the incident at his residence, police said. The young boy was not hurt.

Sgt. Cristy Hamblin said Cerney and his son’s mother returned home around 4:30 a.m. Sunday and began arguing while their son and the babysitter were at the house. The mother called relatives, who came over to the house.

One of the relatives, Kizzie S. Eison, 31, of Cedar Rapids, tried to intervene in the argument. Police said Cerney got out a loaded revolver, pointed it at Eison’s chest and said “I’m going to kill you.”

During the incident, police determined Cerney used the gun to strike Eison in the chest, but no rounds were fired. The two wrestled over the weapon, and at one point, Cerney picked up his young son and used him as protection from Eison, police said.

Police said Eison punched Cerney in the face, causing a cut to his right eye, and was able to get the gun away from him, police said.

When officers arrived, Cerney was in the house and claimed to be the victim in the case, police said. Eison had left, but returned with the gun still in her pocket, police said. Witnesses disputed Cerney’s claims.

Cerney was arrested at the scene and taken to the Linn County Jail. He was no longer in custody Monday afternoon.

PASCAGOULA, Mississippi -- An 18-month-old child is in critical condition with multiple injuries and Sheriff Mike Byrd said investigators believe the boy's father is to blame.

Jackson County investigators arrested Matthew Warren Baria, 34, of Big Point, on Tuesday and charged him on a felony child abuse offense, Byrd said.

"That baby is in bad shape," Byrd said. "It will be a miracle if he survives."

Baria was arrested in connection to deputies responding to his Carters Road home for a medical emergency involving his son late Thursday night, Byrd said.

"Something about his story just didn't add up," Byrd said.

The sheriff said Baria told investigators his son fell from his crib and hit the floor.

"But, there is no way that baby could have fallen out of the crib and had the injuries he has," Byrd said.

Byrd said the child had a severe head injury and was immediately airlifted to the University of South Alabama Children's and Women's Hospital in Mobile.

Byrd said the infant also had choke marks around his neck and bruising all over his body," Byrd said.

"You don't get choke marks around your neck falling from a crib," Byrd said.

Byrd said doctors had to remove a portion of the infant's skull to relieve brain swelling.

"The child is currently in very critical condition." Byrd said. "A sibling, a 3 year old child, was also removed from the home and is in state Department of Human Service's custody."

Byrd said the reason the older child was removed from the house is the children's mother was not home when investigators arrested Baria.

"She was at her father's house," Byrd said, noting the couple is married. He said the children's mother has been cleared from wrongdoing by investigators.

"The older child could be released back to her custody," Byrd said. "It just sickens me when I see a child treated like this."

Baria is currently in the Jackson County Adult Detention Center pending a bail hearing. The charge carries a penalty of up to life in prison and $10,000 fine.

"And we're going to push for the maximum penalty," Byrd said. "We're going to push for life."

Drunk dad assaults mom during visitation, abducts child armed with shotgun (Brookstead, Australia)

In Australia, any dad with a pulse pretty much gets child custody rights/visitation on demand. This is the result. You have a violent substance-abusing father like UNNAMED DAD, who gets "his rights" to a preschooler without any consideration for the safety of others. When Mom arrives to pick up their son from visitation, Daddy assaults her in some kind of drug-induced rage and smashes her windshield. Armed with a shotgun, Daddy then takes off with the 3-year-old.

How does the media react? They nervously reassures us that this wastrel didn't make any (direct) threats against the child.

So? Are you people idiots? What kind of assurance is that?

Luckily, the child is found three hours later and is apparently "unharmed" (this time). Physically, I suppose they mean. In terms of psychological impact, you tell me how a 3-year-old would react to seeing his Mommy being beaten up, and Daddy taking off with him in some kind of scary rage while brandishing a shotgun.

So how has this been handled by the authorities? CLASSIC DADDY CODDLING.

Daddy's arrested and charged with lots of stuff. But he's in jail for ONLY ONE NIGHT before being let out on bail. That's sure saying a lot about how much you value the safety of mothers and children, isn't it? It's basically saying you don't.

But they wagged their finger at Daddy and told him not to bother Mom anymore! (Big deal). And they sternly informed him he wasn't to drink or drug anymore, and that they were going to do (random) tests just so Daddy knows they really mean business! (Even bigger freaking deal.)

But notice what we DON'T SEE in this article, which is that Daddy's visitation has been revoked. Nor is there any mention of taking Daddy's guns away. Even though we know these orders are basically unenforceable, it doesn't appear that the authorities even bothered to go through the motions.

So it appears that Mom and the child will continue to be put in harm's way so this criminal can continue to exercise his "rights" as a father.

This tells you everything you need to know about the triumph of fathers rights in the west. And the elimination of everyone else's.

A BROOKSTEAD father has been banned from drinking alcohol and taking drugs after he armed himself with a shotgun and drove off with his three-year-old son.

The incident on Monday night sparked a statewide child abduction alert and huge response from police including multiple general duty crews, detectives and the police dog squad.

The three-year-old boy had been visiting his father, 28, at his residence when the child's mother arrived to take the boy home.

An argument broke out between the pair and the offender assaulted the woman.

Police said he also smashed the windscreen of the woman's car.

He was armed with a pump-action shotgun and drove off from the property with his son about 6.30pm.

He did not make any threats against the boy's safety.

Police searched the area for the man's white 2010 Toyota LandCruiser.

Police issued a statewide child abduction alert at 8.15pm and requested media broadcast the vehicle description and registration every 15 minutes.

Officers located the man and child hiding back at his house three hours later.

The boy was unharmed.

Officers also discovered cannabis and a drug utensil inside the man's home.

He was arrested and charged with common assault, wilful damage, unlawful possession of a weapon, possession of a dangerous drug and utensil, and breach of a domestic violence order.

He was held in custody overnight and appeared in the Toowoomba Magistrates Court yesterday.

Defence solicitor Brad Skuse applied for bail on behalf of the man.

Magistrate Haydn Stjernqvist granted the man bail with strict conditions including having no contact with the complainant woman or her father.

He must also subject himself to random alcohol and drug testing by police.

JOPLIN, Mo. — A judge assessed a Joplin man 20 years in prison Monday for a violent beating of his 2-week-old son that left the baby with numerous broken bones and bleeding on his brain.

Circuit Judge Gayle Crane sentenced Dwight W. Pierce, 25, at a hearing in Jasper County Circuit Court on a conviction for first-degree assault.

Pierce pleaded guilty Dec. 5 in a plea agreement limiting the prison time he might be assessed to no more than 20 years. He had faced from 10 to 30 years or up to life in prison if convicted in a trial.

Kimberly Fisher, assistant prosecutor, told the court at the hearing that almost two years after the crime was committed on Feb. 27, 2010, Pierce’s son remains confined to a wheelchair, unable to walk or crawl.

A probable-cause affidavit filed at the time stated that Pierce became upset with the baby’s crying, and punched the infant in his stomach, on a leg, in his lower and upper back, and on the back of his head.

“He then picked him up, twisted his head back and forth, and dropped him to the floor from a standing position,” the affidavit reads.

The document stated that the baby suffered skull fractures and bleeding on the brain. The blows also broke a clavicle, a wrist, an ankle and six ribs.

A Joplin Police Department report stated that the mother of the child, Tiffany Tosh, left him with Pierce at his apartment on Byers Avenue while she went shopping with a friend. She returned later that afternoon and found the child suffering injuries.

Police were called to the Freeman Hospital West emergency room after the parents took the injured baby there for treatment. The child later was taken to Children’s Mercy Hospital in Kansas City.

The police report states that Pierce was interviewed at his apartment after leaving the hospital and the next morning at the Joplin police station. The affidavit stated that he admitted causing the injuries to the child.

A drunken father who seized his 13-year-old son by the scruff of the neck and banged his head repeatedly against a wall has been spared a jail sentence.

The Keighley man, who cannot be named to protect the boy’s identity, pleaded guilty to causing him actual bodily harm on April 2 last year.

He attacked the boy in front of his younger brother when they turned up at his home because there was nothing to eat at their mother’s house, Bradford Crown Court heard yesterday.

Prosecutor Joanna Butler-Savage said the boy told police he did not like his dad because he was drunk and violent.

He said he ordered him out of the house, grabbed him by the neck of his top, dragged him into the hall and pushed him. He seized him by the arm, banged his head repeatedly against the wall and slapped his face.

The man pushed his son out of the house and told him not to come back.

The boys went for help to their mother’s neighbour. They were hungry and one was sobbing, Miss Butler-Savage said. His mother took the older boy to hospital for a check-up. He had suffered a lump, scratches and reddening.

The boy told the police: “I was frightened when my dad was hurting me.”

The court heard his father accused his son of being violent and abusive when the police interviewed him.

The man had convictions for assault and causing actual bodily harm to his partner.

His barrister, Jayne Beckett, said the man’s offending was caused by drink and he had taken steps to address the problem. He voluntarily attended Project 6 in Keighley and was receiving help from his probation officer.

He no longer saw his children and they were in no danger from him.

He was sentenced to an intensive community order with 12 months’ supervision, an alcohol treatment requirement and a three month overnight curfew.

A former Monument man accused in the murder of his 7-year-old daughter pleaded guilty to a lesser count Monday, a week after a judge cited what he called “stunningly sloppy police work” on the case.

Slated to begin trial Monday, Hanif Sims took a last-minute plea to child abuse resulting in death, averting courtroom battles over a tape that proved Sims never made a confession that authorities said he did.

Sims, 31, faces 27 to 40 years in prison rather than the automatic life term he would have received with a murder conviction.

Prospective jurors were thanked and released from their subpoenas Monday — marking an unexpected end to a trial that was expected to last up to a month.

Whether “sloppy work” by the El Paso County Sheriff’s Office led prosecutors to sign off on Sims’ 11th hour plea deal wasn’t clear because prosecutors Margaret Vellar and Sharon Flaherty declined to comment, citing a gag order.

Sims will be sentenced April 14 by 4th Judicial District Judge G. David Miller.

Sims’ former girlfriend and co-defendant Monique Lynch has already been sentenced to 27 years in prison. She also eluded a first-degree murder charge in the case — by agreeing to testify against Sims at trial.

After Lynch made the deal with prosecutors last year, they dropped the murder charge against her and filed a first-degree murder count against Sims, citing new details that Lynch provided as a condition of the plea.

The couple have blamed each other for causing the girl’s death, leaving investigators with disputed accounts of what happened. An autopsy found that the girl, Genesis, died as a result of a homicide but didn’t determine how, with an El Paso County coroner saying her body was too decomposed. Genesis had been wrapped in plastic and left in the crawl space months before Sims and Lynch were arrested.

Sims and Lynch both were implicated in child abuse documented by New Jersey child welfare workers, who testified at pretrial hearings. Prosecutors alleged that Sims and Lynch left New Jersey to avoid the agency’s scrutiny.

According to testimony on the stand, New Jersey authorities determined Genesis was once made to carry her fecal matter to school as punishment for soiling her bedroom. The girl reportedly said she was too afraid to make it to the bathroom.

At Lynch’s sentencing, Miller said there were “many circumstances” in which she could have intervened in acts of abuse by Sims.

The case against Sims was weakened before trial by the revelation that El Paso County sheriff’s detectives made a series of false statements about a confession from Sims.

The proof came in December, when a missing tape turned up and established that regardless of what the detectives said, Sims didn’t confess to leaving his injured daughter to suffer for two days on a bed before she was possibly buried alive.

Sheriff’s detectives Ralph Losasso and Sgt. Robert Jaworksi, who conducted the interview after Sims and Lynch were arrested in Henderson, Nev., and who stood by their claims, were cited by Judge Miller for “stunningly sloppy police work.”

Confronted with the evidence, lead detective Losasso said on the stand he was sleep-deprived when he misinterpreted one of Sims’ answers.

Losasso and Jaworski had previously said they inadvertently destroyed notes of the interview and didn’t record it.

After Miller ordered a review of evidence-gathering practices by the sheriff’s office, a District Attorney’s investigator tracked down a copy of the interview from a Nevada police detective who was in the room at the time — even though Losasso said no one else was present.

After reviewing the record, Miller directed harsh words at the detectives but said he couldn’t determine if they were lying or mistaken.

Miller tossed out other evidence from the interview and ordered that Sims’ attorneys Matthew Werner and Tracey Eubanks would have “wide latitude” to question investigators over the errors.

Eubanks earlier this month offered a glimpse of what a jury might have seen as a result — by pushing Losasso on the stand until he was visibly shaken.

The judge said that dismissing the case would be too extreme a penalty for police misbehavior.

Police: Toddler dead after abuse from father

A 1-year-old boy has died from serious injuries and his father is in jail, accused of beating him, police said.

Channel 2's Amy Napier Viteri spoke with the child's mother who said she never expected something like this to happen.

Toni Brown said she had to make the difficult choice to take her 13-month-old son, Mikkah, off of life support.

The child's father is facing serious charges.

Brown described Mikkah as always smiling and a joy to be around. She returned home Friday after work to find the baby unresponsive after leaving him in the care of his father, Ryan Edwards, 34.

"He had suffered a severe brain injury, fractured skull and severe brain damage, Brown said.

Brown said she took him to an urgent care facility near her Morrow home. Because of the seriousness of his injuries, crews brought Mikkah to Children's Healthcare of Atlanta Egleston. She said the news was not good.

"If he did recover, he would be severely handicapped. He would not speak. He would not walk," Brown said.

Clayton County police arrested Edwards and booked him into the Clayton County Jail on charges of child cruelty and aggravated battery.

Brown made the difficult decision to take her son off life support Monday evening.

"I'm devastated. I am, like I said, I have my good moments. I have my bad moments," Brown said.

Brown said she has never had trouble like this before with Edwards.

Mikkah's grandmother, Ruby Huntley, told Viteri she's still trying to understand how this could happen.

"For him to take my grandson. I'm mad, I'm very, very mad," Huntley said.

"Children are innocent and people should pay for hurting the innocent," Brown said.

Edwards is currently in the Clayton County Jail. Investigators said more charges are pending.

The father of Zahra Baker, who was killed and dismembered by her stepmother, has been deported to Australia with his daughter's remains.

Adam Baker, 33, had moved to Hickory, North Carolina to be with Elisa Baker, whom he had met online and went on to marry.

Ten-year-old Zahra travelled with Mr Baker, who had gained custody of the child when her mother suffered postpartum depression.

But Zahra, who had lost a leg and her hearing to two bouts of bone cancer, soon began to endure abuse at the hands of her new stepmother.

When she was killed, her disappearance was not reported for weeks. Investigators eventually determined she had been killed.

They found her prosthetic leg and parts of her body scattered among animal remains across two counties.

Investigators also found parts of her vertebrae which indicated her spine had been sawed at the neck. They never found the girl's head.

Adam Baker was never arrested in connection with the murder of his daughter.

His attorneys told WSOC that Zahra's remains will be buried in a family plot in Australia.

Baker left the country two weeks ago, after he received a suspended sentence for misdemeanor crimes, the Charlotte Observer reported.

While charges remain against Baker in other counties, his attorney Shell Pearce said he did not think he would be made to return for hearings.

His departure comes after authorities revealed last year that Baker was in the country illegally and officials were organising his deportation.

Elisa Baker, 42, pleaded guilty to second-degree murder in September last year and was sentenced to 15 to 18 years in jail.

She claimed she had found the child dead in her bed and, together with Baker, decided they couldn't report to police it as he was undocumented.

Adam Baker told his wife he 'would take care of it' and cut up the girl's body in a bathroom, his wife told police. He told his wife he needed her help in finding places to dispose of the body, she said.

Following Elisa Baker’s arrest, police found she had been married to someone else while married to Baker. At the time of the trial, he found out he was her seventh husband.

LISBON - A father originally accused of causing "shaken baby" injuries to his child in 2009 was sentenced to four years probation by Columbiana County Common Pleas Court Judge C. Ashley Pike on Monday.

Randy A. Wylie, 26, currently residing in Boardman, pleaded no contest in December to a first-degree misdemeanor endangering children charge. In a plea agreement, the charge had been reduced from a second-degree felony endangering children charge, which could have led to up to eight years in prison.

Assistant Prosecutor Tim McNicol had asked Pike for a six-month jail sentence for Wylie. He also stated the child's mother was in the courtroom and was in agreement Wylie should serve some jail time.

McNicol had agreed to reduce the charge after his medical expert and the defenses medical expert had each come up with distinctly different explanations for the then 4-month-old baby's injuries.

Defense attorney Richard Hura described Wylie as a father who when his son was in the hospital and they were looking for explanations for the seizures, had tried to come up with many possible explanations. Wylie had reportedly offered that he had aggressively picked up the child once and had also accidentally bumped his head off a door frame. Hura offered that many parents have accidentally bumped their child's head and he felt confident Wylie would not repeat his mistakes.

"I would never harm my child purposely," Wylie said to Pike, adding that the media coverage has caused people where he used to live in East Palestine to give him a hard time about this. "I did not do this. I love my child. All I want is my child."

Hura said Wylie is currently working his way through a case plan with Children Services, one that requires him to take anger management and parenting classes, hold down a full-time job and have a stable home. Wylie found a full-time job shortly after his felony charge was reduced to a misdemeanor, Hura said.

Hura showed video clips and photos of Wylie playing with his son during a supervised visitation, the only times he sees the child since the charges were filed in 2010. McNicol pointed out Wylie had not seen his son since the video was taken before Christmas and had not completed the classes. Hura contended if Wylie attends the visitations during the day he cannot work, therefore he would lose his job. He also added the classes are only offered so often.

Pike cautioned Wylie as part of his probation he is expected to finish the requirements in his Children Services case plan and be of general good behavior. The consequences of not doing so could still lead to him spending six months in the county jail.

A 24-year-old man faces child endangerment charges, after admitting he violently shook his 3-month-old baby.

The Santa Barbara Police Department said it was contacted on January 27 by Santa Barbara Cottage Hospital, to investigate a possible child abuse case. The hospital told police the baby girl had been brought in unconscious the night before, but showed no external injuries. Police said the baby was suffering from hemorrhages on both sides of her brain. The baby's doctor told police this type of injury under these circumstances is almost always associated with violently shaking babies.

The baby's father, Nathaniel McKnight, was interviewed by police, and admitted to violently shaking his baby while angry with her for crying. Police said the shaking caused the baby's head to snap back and forth.

The baby is in stable condition.

(Newser) – A Virginia man in the middle of a custody battle for his 3-year-old twin daughters funneled carbon monoxide into his suburban Richmond house and cut the throats of his girls and himself. Police aren't certain yet whether the gas or the cuts killed the three. The twins' mother called deputies, and was found sobbing on her knees in the driveway. "My babies are dead," she told officers. Before they could enter, deputies had to first break windows to ventilate the house, which was filled with fumes from a flexible tube Robert King, 40, had attached to the exhaust pipe of his car. He placed the other end of the tube in the bedroom where the three bodies were found.

King filed for divorce last year, claiming wife Kristina Hooper had abandoned the family. Hooper argued in court that she was driven from the home by King's paranoid behavior and verbal abuse, which made "living conditions intolerable," reports the Richmond Times-Dispatch. The girls, Madison and Caroline, lived with Hooper, but were spending the weekend with King when he killed them.

FATHER accused of killing his baby son made his first court appearance over the weekend.

Lee Clark was released on bail after appearing at Peterlee Magistrates’ Court in Peterlee, County Durham on Saturday morning.

During the 20 minute hearing, Mr Clark, 27, who was wearing a grey polo shirt and jeans, spoke only to confirm his name, address and date of birth.

He is accused of the manslaughter of five-month-old Charlee Cameron Clark.

Charlee was admitted to Darlington Memorial Hospital with serious head injuries on February 25 last year.

The infant, who lived with his parents at a house on Neville Close in Gainford, between Barnard Castle and Darlington, was rushed to a specialist unit at the Royal Victoria Infirmary in Newcastle for treatment.

The child died from his injuries the following Tuesday, March 1, prompting the arrest of Mr Clark and an 11-month long police investigation.

He answered his bail on Friday, and was then charged by police.

Mr Clark’s bail conditions mean he must now live at the home of a family member in Fife, Scotland, and report every Wednesday lunch time to Cowdenbeath Police Station.

He will remain on the conditional bail until his next court appearance, which is due to take place at Newcastle Crown Court on the morning of Wednesday, February 8.

Charges re-filed against Monroe father for allegedly killing 8-month-old son

A Monroe man remains in jail after new charges were filed in the death of his 8-month-old son in 2010.

DeAngelo Tremaine Wilson, 32, of 406D Plaza Drive, Monroe, had been scheduled to appear in magistrate court Thursday for a bond hearing but remains in jail after a new charge of murder was levied by the district attorney’s office.

Wilson had previously been charged with murder, cruelty to children, possession of a firearm by a convicted felon and a probation violation after being arrested Oct. 14. Wilson was charged with the crime in the Dec. 6, 2010, death of his son, Dyuntre, which had originally been listed as an accidental death but left police concerned after evidence collected in the child’s autopsy.

Wilson went before a judge in a preliminary hearing last year for the three charges, where the murder charge was dismissed due to lack of evidence, leaving him clear to post bond.

But, after being placed on the court docket for a bond hearing Thursday, Wilson was forced to withdraw his request after assistant district attorney Peter Boehm said new evidence was found to draw up a new warrant on the malice murder charge.

Police accuse Wilson of suffocating his child with a pillow found in the crib, claiming Wilson complained of the child’s crying and wanted him to sleep.

A neighbor called 911, telling police Wilson had come complaining his son wasn’t breathing, and emergency medical personnel responded to the scene and performed CPR on the child before taking him to Walton Regional Medical Center, where the infant was pronounced dead.

The medical examiner allegedly found signs of abuse on the child, including a broken rib and bruising on his head and back, leading to the initial charges.

Wilson remains in custody and will continue to stay in the Walton County jail while awaiting trial.

Hanover officials say deaths were murder-suicide

Hanover County authorities and the state medical examiner's office have concluded that all three victims found Saturday at their home near Mechanicsville suffered carbon monoxide inhalation and lacerations to the neck area.

Authorities ruled the deaths a murder-suicide.

Sheriff's Sgt. Chris Whitley said this afternoon that his department would not release a specific cause of death but that each of the victims, twin 3-year-old daughters, and their father, Robert D. King, died either from the lacerations, the inhalation of the deadly gas or a combination of both.

"We're not going to get into the specifics beyond that because of the nature of what happened" and out of respect for the family, Whitley said.

According to a search warrant filed today, the mother of the twins, Kristina Hooper, King's estranged wife, entered the house and found the three together before calling authorities.

The search warrant describes how Hooper lifted up one of her daughters, finding her cold to the touch, and then placed her back down before calling 911. It was not clear how Hooper was able to negotiate the carbon monoxide fumes, which police vented from the home by breaking windows.

Whitley said there is no indication that an intruder was involved in the killings and that there is no effort under way to locate a suspect.

A man and his 3-year-old twin daughters were found dead in their Mechanicsvile home Saturday by the man's estranged wife, according to court documents.

A search warrant affidavit and divorce petition records on file in Hanover County Circuit Court this morning indicated Kristina Hooper found the bodies of her two daughters and her husband in a front bedroom that had been linked to the exhaust pipe of a van parked outside the Mechanicsville house.

The court records said Hooper called 911 at 3:36 p.m., and when Hanover County deputies arrived at the house in the 7900 block of Wynbrook Lane, just off Mechanicsville Turnpike, they found Hooper in the driveway “crying on her knees and stating, ‘My babies are dead. They’re in the house.’ "

Deputies also found a van backed up near the residence with flexible duct tubing attached from the exhaust pipe “which continued into the bedroom” where the three were found, the court papers indicated. When authorities tried to enter the house, “they were initially overcome by fumes and began ventilating the residence.”

Among the items investigators recovered at the house, according to the court documents, were blood-stained sections of duct tape tubing, a wallet and two notes of unspecified content.

Declared dead at the scene were Robert D. King, 40, and Caroline R. King and Madison R. King. Hanover County authorities have declined to discuss how the three died.

The three bodies were taken to the medical examiner's officer in Richmond, where autopsies were scheduled for today.

Court records indicated Hooper married King in March 2008 and their twin daughters were born Aug. 15 of that year.

The couple's divorce petition indicates Hooper left King on Sept. 28, 2011, and has been living in the 5000 block of Pole Green Road.

TIMMINS -- A 61-year-old man tearfully apologized to his daughter in a Timmins court Wednesday after admitting he had sexually abused her as a child.

The victim was 11 years old at the time.

The man was sentenced to two months in jail, six months of house arrest and two years of probation after pleading guilty in the Ontario Superior Court of Justice in Timmins to invitation to sexual touching, indecent exposure and voyeurism.

The subject of the father's voyeurism was a young friend of his daughter who stayed at the house for a sleepover.

The offences occurred over a period of a few months in 1990 when the family lived in the West Nipissing area.

The family moved to Timmins not long after those offenses occurred.

The daughter's victim impact statement was read aloud to the court.

"A father is someone who is supposed to protect" their child from abuse.

Instead, "innocence was taken from me" by her own father. "I trusted that person and loved that person with all my heart."

The daughter said she kept this secret for 20 years. Throughout that time, it haunt her and she suffered nightmares as a result.

In 2010, she notified the Timmins Police Service and filed a complaint against her father.

The court imposed a publication ban protecting the identity of the father since it would indirectly lead to the identity of the primary victim.

Assistant Crown Attorney Dale Cox said the trouble started when the daughter arrived home from school one day, entered the bathroom and caught her father masturbating.

Defence lawyer Ted Tichinoff described it as "purely bad luck that she walked in while he was" pleasuring himself.

Cox said, "That was the start of similar activities happening in her presence."

There were further incidents where he exposed and stimulated himself in front of his daughter.

The prosecutor cited another occasion where the father encouraged his young daughter to watch pornographic videos with him.

He then "directed her to disrobe" and "touch her vaginal area."

The voyeurism charge stems from a single incident involving a nine-year-old female friend of the daughter.

Cox said the two girls were sleeping in the same bed during a sleepover when the father came into the room in the middle of the night and woke up the young guest.

He told her the family cat she had been handling was sick and she needed to thoroughly wash herself.

Cox said the girl "was certainly old enough to wash herself." However, the father insisted that he remain in the bathroom as the girl disrobed, "with her genitals in full view," and watched as she cleaned herself.

Judge Robert Riopelle said this sleepover should have been a happy memory for the two girls.

Instead, "that event is so badly scarred by something" the offending father "did in another huge breach of trust."

Riopelle said under the circumstances, he could easily justify imposing a jail term of 12 months.

However, the judge accepted the joint recommendation of the prosecution and defence attorneys and handed down a lighter sentence of 60 days in jail followed by six months of house arrest.

The accused will be permitted to serve his 60-day jail term on weekends in order to retain his job.

The defence lawyer, Tichinoff, said the accused is not in very good health and he is very frightened of going to jail.

"This 60-day sentence (of real jail time) speaks loud and clear."

Tichinoff further justified the sentence by saying the incident occurred over a "relatively brief period," the offender has no criminal record and he has been undergoing psychological counselling.

Prosecuting attorney Cox said one of the mitigating factors for him was that "right from the get-go" when police arrested the father, he admitted to his offense and expressed concern about putting his daughter through any more pain.

The court heard he gave up his right to a preliminary hearing because he said he didn't want to put his daughter through the ordeal of being called to the stand and testifying against him.

The two years of probation begins right away since the father is serving an intermittent sentence.

Throughout that period, he is prohibited from having any contact with his daughter unless she agrees to amend the order.

The court also made an order that the father's name be added to the national sex offenders registry.

CINCINNATI -- A grand jury indicted a man accused of binding his daughter with duct tape and locking her in a dog cage.

James Tapke, 41, was indicted Friday on one count of unlawful restraint, a charge that carries a possible 60-day jail term.

Tapke was accused of restraining his 12-year-old daughter's hands and feet Jan. 10 using a duct tape before placing her in a dog cage. Then, investigators said, while his daughter was in the cage, Tapke dropped small amounts of water on her face.

"While the initial allegations were shocking, I think that the grand jury made the correct call," said Hamilton County Prosecutor Joe Deters. "This definitely does not rise to the level of a felony. Fortunately, the victim was not injured. Referrals have been given to the family to help with the family dynamics that gave rise to this situation."

According to court papers, the girl was in the cage for about 20 minutes before her 13-year-old brother let her out. When she got out, authorities said the victim poured water on her father's head and in his ear.

Tapke then bound his daughter again with duct tape and put her back in the dog cage, investigators said, and while she was in the cage, Tapke told his son to go to the garage and retrieve an electrical jump pack so he could electrify the cage. The girl's brother brought the jump pack and sat in front of the cage so his sister could see it, investigators said.

Tapke never attempted to electrify the cage, but investigators said he told his daughter several times he should.

Tapke let the girl out of the cage, and her grandmother assisted her with taking off the duct tape, authorities said. During the entire incident, authorities said the girl's brother and her father took pictures of her in the cage.

Her brother posted the pictures on Facebook, investigators said, but the pictures have already been deleted.

The girl was sent to live with her maternal grandparents in Springfield Township, and prosecutors said Tapke's legal rights to the child were stripped and turned over to his parents.

ST PETER — In an emotional court hearing Friday, family members of an infant who was killed by his father pleaded with the court to impose a harsh sentence, while Chris Farris and his attorney pleaded for leniency.

In the end, neither got they wanted. At least not yet. Nicollet County District Court Judge Todd Westphal said he'll announce his decison Feb. 14 after reviewing testimony from the hearing, as well as reading written arguments from both sides.

At stake is roughly four years in prison, as Farris is hoping for a 128-month sentence, while prosecutors and the baby's family are hoping for 180 months, or 15 years.

Keisha Moniz, 3-month-old Dawson's mother, testified, as well as Allison King, the child's grandmother, each characterizing Farris as an often-drunk, aggressive man who was not a good father.

Brad Peyton, Farris' attorney, offered a Powerpoint presentation that featured audio from Farris' parents talking about their son, and from a woman who is the mother of two other children of Farris' (he had two with Moniz,) who called Farris an excellent father, and urged Westphall to minimize the amount of time he is away from the children he has with her.

Dawson had stopped breathing one day in September of 2010 and Farris drove him to the hospital. After a criminal investigation, it was revealed Farris had violently shaken the child and bit his cheek when he stopped responding.

Dawson was pronounced dead shortly after arriving at the hospital. He later was charged with several felonies in connection with Dawson's death, but pleaded guilty to unintentional murder.

A Pretoria father convicted of killing his two-year-old son yesterday told the Pretoria High Court that he was sorry and pleaded that he be sentenced to correctional supervision.

Sibusiso Phetla's son died after being admitted to hospital in an unconscious state with a fractured skull, arms and legs, a ruptured liver and burn marks on his body.

He sustained the injuries while he visited his father for a few days in Lotus Gardens, Pretoria, in 2008.

Phetla, 29, told the court that he had taken the infamous drug "Nyaope", a street name for heroin, the day before the child died but said he had no idea how the injuries occurred on little Solomon Maditla.

Phetla had asked to spend a few nights with Solomon, who lived with his mother, Ouma Maditla. He claimed that some of the injuries could have occurred while Solomon was in the care of his mother before he was brought to him, but medical reports showed that the injuries were fresh.

He claimed that some of the burn marks were probably caused when a heater "fell" on the child.

The fractures, he said, were probably the result of the child falling off the sofa.

During the trial two doctors testified that the burn marks were caused by something like an iron, while the blisters across the boy's body were probably caused by boiling water and that the fracture to the skull was, in their opinion, caused by some blunt-force trauma.

He also contracted pneumonia, which the doctors said was consistent with someone who had suffered a fractured skull.

Through his legal representative, advocate Mike Ramoshaba, Phetla said he started using drugs at an early age and was an addict.

He asked the court to have mercy and said that he was willing to get help and be rehabilitated outside prison. He told the court that he loved his son.

In a psychological report compiled by psychologist Sunette van den Heever, Maditla (the boy's mother) said she was still angry and sad. She said Phetla never apologised to her for the death of her son and she could not forgive him.

State prosecutor Grace Mosethla said Phetla killed a defenceless child and showed no remorse and that he should be sentenced accordingly.

Judge Vivienne Tlhapi convicted Phetla of murder, but she could not find that it was premeditated. Phetla will be sentenced today.

NORTH MIAMI, Fla. - A man faces child abuse charges after police said he hit his 4-month-old son in the face, causing the baby to hit his head on a nightstand and break his skull.

Police said Yosi Mahlab, 30, called 911 on Saturday to report that his 4-month-old son, Javon, was unconscious.

The child was taken to Jackson Memorial Hospital, where doctors found he had a skull fracture, subdural bleeding, a retinal hemorrhage and bleeding in the brain, police said.

According to police, Mahlab admitted that he hit the baby in the face twice, causing the child to slip off his lap and hit his head on a night table.

Police said doctors found that the baby has no brain activity.

Mahlab was arrested on child abuse charges. He is being held at the Miami-Dade County Jail on $200,000 bond.

A FATHER has been jailed for more than 12 years after a court heard he sexually abused his three children so regularly on a Saturday night, they grew to dread that night of the week.

Although events were happy and normal on other nights the two girls and their brother knew what would happen to one or more of them when their mother went to visit her sister that night of the weekend.

Philip Adams, prosecuting, told Leeds Crown Court yesterday the abuse spanned about a 10-year period from 1973 but the children felt they could not speak out, and even when they were adults and spoke for the first time together they decided to remain quiet for the sake of their mother.

But he said the offences came to light last year after their father told his sister what he had done and the police were informed.

An investigation began and the trio then described their childhood ordeal, revealing how their father would indecently assault them while washing them in the bath and make them touch him sexually after he had a bath.

One girl said she knew what would follow when he told her to bring the cleaning fluid to the bathroom.

He also accepted simulating sex with one of the youngsters in the bath. The boy said his sisters suffered more attention than him.

One of his sisters said she was also made to touch her father in front of her brother on occasions while they were watching television downstairs.

In a victim impact statement one said: “A dad should be someone who you can put your trust in, who does not betray your trust.”

Jailing the 63-year-old grandfather from Leeds for a total of 12 and a half years, Judge Sally Cahill QC told him: “It appears every Saturday night was a night these three children came to dread.”

She said when their mother went out “you targeted these three children and used them for your own purposes.”

While there was no physical coercion there was emotional pressure because “you were there father which meant these children had no choice whatsoever.”

The father admitted 14 charges of indecent assault and 14 of indecency with a child.

Insanity. That's what it is when young clueless, testosterone-fueled dudes like CHRISTOPHER SAUNDERS are given custody of an infant. He was still living at home (i.e. not financially independent) and didn't support his girlfriend/ex-girlfriend during her pregnancy in any way, shape, or form (apparently didn't even KNOW about the pregnancy, which SHOULD tell you something about either his character and/or the situation). Obviously, there was NO marital commitment or personal commitment of any kind to the child or the mother.

The girlfriend, who was probably very young as well, realized she couldn't care for a baby adequately and tried to find another home for the baby. That's when Daddy swoops in.

The courts SHOULD have realized that this dude was no better prepared than she was, and probably worse, given that young men--as a general rule--are not tempermentally inclined towards the demands of infant care. (Notice how one of Daddy's buddies punched the courthouse wall after the trial. This is how many young men when "provoked" tend to act.) But no. Thanks to fathers rights and "equal parenting" ideology, young dudes like this are given infant custody. And then they end of maiming or killing the baby with clueless bull**** like throwing them around like footballs at a frat party. Why are we perpetually surprised?

Periodically, I remind Dastardly readers that virtually every study of shaken baby deaths (now more frequently referred to as abusive head trauma) shows that fathers dominate as perpetrators, followed by boyfriends and stepdads (e.g. other male caretakers). Dad to serve 20 years in infant's death

Friends and family members were vocal in their dismay Wednesday afternoon in Roanoke Circuit Court as a young father was sentenced to 20 years in prison for the death of his infant daughter.

Christopher Lloyd Saunders, 21, who in October pleaded no contest to felony homicide in the death of 7-month-old Arieya Michelle Lindsey, shook his head slowly as Judge Charlie Dorsey found him guilty and gave him 40 years, the maximum allowed, to be suspended after he serves half that. Upon his release, he'll be on supervised probation for 10 years and will be restricted from contact with anyone younger than 18 during that time.

As part of Saunders' plea agreement, prosecutors did not pursue an additional charge of felony child abuse.

Saunders' mother wept openly as he was led from the courtroom.

"Love you, boy," spectators called from the gallery. "Love you, Chris."

One of Saunders' acquaintances punched a courthouse wall and cursed the ruling as he left the building.

The homicide charge against Saunders stemmed from an incident in July 2009, when an emergency crew was summoned to Saunders' parents' Roanoke County home. There, they found Arieya on a bedroom floor, no longer breathing.

Prosecutors in October 2011 said Saunders' statements to doctors and detectives afterward had varied, but he eventually told an investigator he had tossed the child in the air and she had slipped through his grasp and fallen to the floor.

Saunders also told the detective he slightly shook the baby, but prosecutors said a hospital physician found that Arieya had suffered extensive bilateral retinal damage that indicated she had been violently shaken. A medical examiner's report concluded that "this child was subjected to repeated abuse."

Just three months before Arieya's death, in May 2009, emergency crews had been called to aid the child after she reportedly fell out of bed. She was treated for three broken ribs and a bruised torso, which Saunders said had been caused when he performed CPR.

At the October plea hearing, Saunders' lawyer, public defender Anna Bagwell, argued that Saunders' statements to medical staff and police were consistent with his daughter's injuries.

"Arieya was by all accounts well-nourished and cared for," Bagwell said.

Saunders met Arieya's mother in 2008, when they both worked at Kmart. Contact between them dwindled after their brief romantic relationship ended, prosecutors said, and Saunders didn't know of his daughter's existence until after she was born, when Arieya's mother gave the child to foster care. When Saunders learned about the girl, he opted to raise her himself, according to prosecution and defense accounts.

Downriver firefighter to be tried in alleged sex abuse of daughter

Romulus — A Downriver firefighter accused of sexually abusing his teenage daughter over the course of several years was bound over to Wayne Circuit Court on Wednesday.

The man, 48, of Romulus, waived his right to an exam Wednesday afternoon before 34th District Judge Brian Oakley in Romulus.

The 16-year veteran of the River Rouge Fire Department has been charged with two counts of first-degree criminal sexual conduct with a child under age 13, three counts of first-degree criminal sexual conduct with a child 13-15 years of age, and one count of child sexually abusive material.

The man's name isn't being released because The News doesn't identify sexual abuse victims.

Police said the man's daughter reported in December that her father allegedly forced her to engage in sex acts, including intercourse. The girl also reported her father took nude photos of her.

Defense attorney Ron French said his client has no criminal history.

"He's been a good man all the way through," he said.

The suspect is out on bond but on a GPS tether and will appear for an arraignment Feb. 1 at the Frank Murphy Hall of Justice in Detroit.

Oakley granted the prosecution's request for DNA testing, but denied their request to reinstate a $250,000 bond.

Two girls, who were alleged to have been sexually abused by their violent father for years, were given a choice of sex or a beating, a Court heard yesterday.

The Bradford dad fathered three children by his daughter and stepdaughter when they were in their mid-teens, Bradford Crown Court was told.

Prosecutor Kitty Taylor told a jury the girls lived in an atmosphere of intimidation and fear over a number of years, during which they submitted to his sexual demands.

Mrs Taylor said the alleged victims lived in a dysfunctional and violent environment in which family values were blurred and corrupted by the defendant.

She said the defendant was a “violent, aggressive and controlling” parent, which went beyond reasonable chastisement of children. They would be beaten if they did not have sex.

Mrs Taylor told the jury: “To put it bluntly, they were offered a choice of a beating or sex, and on many occasions they chose the latter, rather than get a beating.”

The 51-year-old man pleads not guilty to nine sample charges of rape against the two girls, and two charges of child cruelty, involving both girls.

Mrs Taylor warned the jury: “It is not a case for the faint-hearted. You will hear evidence that may disturb or upset you. But you must try this case on the evidence you hear and not the emotion you may feel.”

The prosecutor said there was no dispute the man fathered the children by his daughter and stepdaughter, but the defence case would be that it was consensual.

But she said that, in a prepared statement the man gave to police, in which he denied raping or any physical abuse, at no stage did he assert consensual relationships.

Mrs Taylor said the rape charges were samples and the girls alleged the sexual abuse took place frequently.

One described him as “manipulative and controlling” and the other said he would use a belt or stick on her.

Mrs Taylor said the man made his children become members of a religious order and punished them if they did not go to church.

She said he would hit them if they disobeyed him. He would beat, slap, or hit them, particularly with a belt with a buckle, leaving marks on their flesh.

“The girls were frightened and scared of him,” Mrs Taylor said.

The trial continues today.

ROCHESTER - A local man is accused of injuring his 6-week-old baby.

Thomas Mulari, 19, was arrested Wednesday and charged with second-degree assault. His arrest came after police opened an investigation Tuesday night when they were called by Frisbie Memorial Hospital personnel concerning an injured infant.

Police did not disclose what kind of injury the baby suffered saying the child's injury is considered protected health information.

Mulari is being held on $10,000 cash/surety bail in the Strafford County jail, pending arraignment Thursday in 7th Circuit Court, District Division, Rochester.

The infant is in the custody of the mother.

Bond set for father accused of beating, injuring son with belt

JASPER COUNTY - by Steve W. Stewart/KJAS - Jasper County Sheriff Mitchel Newman said on Tuesday that a man is in custody, and accused of beating his 2-year-old child so severely with a belt that he left injuries on the toddler.

Sheriff Newman said the investigation began on Monday when workers at a Jasper day-care reported the injuries on the child.

According to Newman, Lieutenant Kenneth Stanley observed bruising on the boy's face, hands, buttocks and legs, and he also noted that the child's hands were swollen.

Newman said an investigator interviewed the child's father, later identified as 34-year-old Elvin Tyrone Collins, of Jasper, and Newman said Collins admitted that he did assault the boy.

Precinct 3 Justice of the Peace Mike Smith issued a warrant for Collins and he was later arrested.

Collins appeared before Precinct 5 Justice of the Peace Brett Holloway on Wednesday and was officially charged with assault, and injury to a child with intent of bodily injury. His total bond was set at $50,000.00, and at last word he remained in the Jasper County Jail.

A man was being questioned by detectives last night on suspicion of murdering his five-year-old son, who died after being found injured in a Yorkshire house.

Paramedics were called to the semi-detached house in Wakefield, but were unable to save Haroon Ahmed, who died in hospital.

His 34-year-old father, who has not been named, was arrested after the ambulance service called in the police to the Aberford Road house at about 11.40am on Monday.

The case is being investigated by detectives from West Yorkshire Police’s elite Homicide and Major Enquiry Team.

The boy was taken to nearby Pinderfields Hospital but died from his injuries.

It was unclear last night how the boy had been harmed. Police forensic officers remained at the house to gather evidence as the inquiry moved into its third day.

Neighbours said the property was bought two years ago by a man of Asian origin, who had started renovating it.

“He kept himself to himself, he was working on the house most days,” one said. “I think he may have moved into the house a few months ago, but I have never seen a child in the house.”

A couple living nearby added: “An Asian man bought the house about two years ago and was renovating it. He was friendly. We said hello now and then.

“He mentioned he may be bringing some family to live in the house, but wasn’t sure, and never mentioned this again.

“As far as I knew, nobody was living in the house. It was dark at night and I never saw a child, a woman or a family at the house. It’s a mystery.

“The last time I saw him was last Thursday when he was locking up the house for the night.

“It didn’t seem like anybody was living in the house or why would he be locking it up?”

Jasper County Sheriff Mitchel Newman said on Tuesday that a man is in custody, and accused of beating his 2-year-old child so severely with a belt that he left injuries on the toddler.

Sheriff Newman said the investigation began on Monday when workers at a Jasper day-care reported the injuries on the child.

According to Newman, Lieutenant Kenneth Stanley observed bruising on the boy's face, hands, buttocks and legs, and he also noted that the child's hands were swollen.

Newman said an investigator interviewed the child's father, and he confessed that he did assault the boy.

Precinct 3 Justice of the Peace Mike Smith issued a warrant for injury to a child, and the man was arrested. He is currently in the Jasper County Jail awaiting formal charges and arraignment, his name has not yet been released.

Then it came out, uh, that the baby also had healing rib fractures, which suggested this wasn't the first time Daddy had battered the baby. So Daddy now has "supervised contact" and the baby is in foster care. It's not clear here why the mother no longer has custody of the baby. But it's not uncommon for mothers to be punished for the sins of the father, whether she knew about the abuse or not, or whether she was even around at the time of the abuse or not. By contrast, when abusive or neglectful mothers are prosecuted, absent fathers are virtually never mentioned. It's just assumed they aren't responsible for the actions of the mothers.

Dad James Horton avoids jail for battering baby

A young dad who lost his temper and broke his baby daughter’s arm was told he had has escaped a jail sentence by the skin of his teeth.

James Horton was sentenced on the basis he was a loving father who had a momentary lapse of control.

He was not being punished, said a judge, for several older fractures baby Scarlet was found to have to her ribs.

The 27-year-old former Maidstone schoolboy, of St Theresa’s Close, Ashford, was given a suspended sentence of just under a year with 250 hours unpaid work and two years supervision.

Horton denied cruelty to a person under 16, causing grievous bodily harm with intent and a lesser offence of inflicting grievous bodily harm.

He was convicted in November of inflicting grievous bodily harm by an 11-1 majority and cleared of the other charges.

Maidstone Crown Court heard the child was just three months old when she was taken to the William Harvey Hospital in Ashford on March 30 2010.

He had been looking after Scarlet while her mother was visiting friends.

He later claimed the injury to the child’s upper left arm may have been caused by her getting tangled up in the bars of her cot.

Horton, who left Swadelands School in Lenham with six GCSEs before working on the railway, denied he had harmed his daughter in any way.

Asked if it was true he had assaulted and mistreated Scarlet, he replied: "No, of course it isn’t. I loved her."

Judge David Griffith-Jones QC said he made it clear that while it was a disturbing feature she was found to have historic injuries, he was being sentenced on the basis it was a single offence and he did not intend to cause serious injury.

"I sentence you on the basis the injury was the result of a sudden and momentary loss of control on your part," he said.

"Plainly, she was vulnerable. At the material time she was in your care and wholly dependent upon you."

The child, now in foster care with Horton having supervised contact, had recovered, he added, with no ongoing complications.

Upper Township father, 24, charged with assault after hospital workers discover baby's broken ribs

UPPER TOWNSHIP — Police charged a father of two children with aggravated assault with serious bodily injury after he allegedly fractured the ribs of his 3-month-old daughter.

State Police in Trenton said John Teti, 24, of the township’s Petersburg section, was arrested and charged Monday with assault and endangering the welfare of a child.

The family took the child to Shore Medical Center in Somers Point on Sunday for treatment of a respiratory illness when doctors discovered at least six and as many as eight fractured ribs, some of which were in the process of healing, State Police spokesman Sgt. Brian Polite said.

“The injuries are believed to be from multiple incidents,” Polite said.

The New Jersey Division of Youth and Family Services alerted police about the child’s injuries.

Police allege that Teti caused the infant’s injuries. He was in the Cape May County Jail on Tuesday in lieu of $60,000 cash bail.

Teti’s family said they were in disbelief at the criminal charges.

“I don’t want anyone to rush to judgment,” said Teti’s father, John Teti. “He’s not capable of this. I should know. I raised him.”

The elder Teti said his son, a graduate of Ocean City High School, worked as a shift manager at a local convenience store. He served in the U.S. Air Force after high school.

“He loves his children. Everyone who knows him knows he wouldn’t hurt his children,” Teti said. “The facts will come out. Everybody is shocked. He’s a good man and a good father.”

State Police said the infant was being treated Monday at Shore Medical Center.

No additional information was available Tuesday.

(WMC-TV) – A Covington father is out of jail after he confessed to investigators that he put his own baby in the hospital.

The five-month-old baby is recovering at Le Bonheur Children's Hospital. Doctors are running tests to determine the extent of her injuries while investigators try to learn more about what happened to her.

Robert Daniel Brasch, 23, of Ripley, TN, is charged with aggravated child abuse after he told authorities he shook his daughter because she would not stop crying.

"He's the biological father," said Donna Turner, of the Tipton County Sheriff's Office. "The mother was away. That was not uncommon for the biological father to baby sit the child."

Investigators said Brasch told the child's mother the infant had fallen off the couch while he was caring for the child.

"When the mother got home, she noticed the child was acting differently," Turner said.

The mother took the child to a hospital in Covington and then the baby girl was then airlifted to Le Bonheur Children's Hospital.

Doctors there determined the child's injuries were not consistent with a simple fall from a couch.

Authorities said Brasch later confessed to shaking the infant.

"For anyone to be injured, especially a child at this tender age and the injuries you historically see in these types of cases can result in permanent damage that can affect the child, obviously for the rest of her life," Turner said.

Brasch is out of jail on $5,000 bond. He is scheduled to appear in Tipton County General Sessions Court on February 14.

Investigators are not releasing the baby's condition at this time.

SALIX — The father of a South Fork infant admitted to police that he broke the boy’s legs and shook him so violently that he became unresponsive and later died, a Cambria County detective testified Tuesday.

Detective Kevin Price was one of three witnesses to testify in a preliminary hearing for 23-year-old Justin Michael Charles Sr., who is charged with criminal homicide.

Seven-week-old Justin Charles Jr. died Dec. 23 at Children’s Hospital of Pittsburgh. The boy was declared brain dead and was removed from life support, said Dr. Janet Squires, head of a child-advocacy program at Children’s Hospital, paramedic Chad Stiffey said.

“From the moment the baby arrived, there was essentially no hope the child would live,” Squires said in testimony via telephone.

The infant was suffering from multiple leg fractures, retinal hemorrhaging and subdural hematoma. The boy’s injuries indicated child abuse, Squires testified.

District Judge Rick Varner ordered Charles to county court to face trial. In addition to criminal homicide, he also is charged with aggravated assault, simple assault, reckless endangerment and endangering the welfare of a child.

Charles was returned to Cambria County Prison, where he is being held without bond.

STOCKTON - An infant unexpectedly dies under his father's watch.

The child's medical history shows the 4-month-old had been plagued by sicknesses, including a bout of pneumonia around the time of death.

But physicians' opinions indicate a more sinister cause of death.

Donald Wilson, 23, is accused of killing his son, and doctors said the baby had sustained brain damage likely caused by shaking or an impact.

A preliminary hearing began Tuesday for Wilson, who is charged with child abuse resulting in death. He could face life in prison if convicted.

Brandon is the second child fatality of 2011 reported by San Joaquin County Child Protective Services.

The other was a 3-year-old named Noah Morgan, whose stepfather, Joe Anthony Correia of Escalon, has been charged with the death.

According to courtroom testimony, Donald Wilson called for emergency help Aug. 1, when Brandon stopped breathing in a choking episode. The father had been watching the baby that day while the mother worked.
The following day, the baby was transported out of San Joaquin General Hospital to a children's intensive care facility.

Brandon was comatose and was placed on a ventilator, said Dr. Angela Rosas, a pediatric specialist in child abuse and neglect with Sacramento-based Sutter Medical Group. He was completely unresponsive, Rosas said.

Doctors ran a battery of tests on Brandon and then determined he had bleeding in the brain and had sustained abusive head trauma.

San Joaquin County medical examiners concluded the cause of death to be diffused axonal injury, which indicates the damage spread throughout the brain.

Donald Wilson's lawyer, Pittsburg defense attorney Carin Johnson, raises the question whether Brandon's death was caused by ongoing illness.

San Joaquin County Superior Court Judge Elizabeth Humphreys is presiding over the preliminary hearing, expected to last more than two days, and will decide whether there is enough evidence to send Donald Wilson to trial.

A golf-obsessed father who wanted his young sons to be "the next Tiger Woods" beat them with clubs when they fluffed their shots, a court heard.

The 33-year-old dreamed his two boys aged six and eight would both become world champions and would give the children golf tuition at home before school every day and then later at his local golf club or in nearby fields.

But whenever the youngsters played poorly at the driving range, mis-hit a tee shot, missed a putt, or went into the bunker, their pushy father would fly into a rage and beat then with a golf club, Burnley Crown Court was told.

On one occasions he even sank his teeth into and pinched the skin of the youngsters.

Despite the elder child winning a junior golf tournament, he was beaten about the leg with a golf iron when he played a bad shot and also had a ball hurled at him from feet away, gashing and bruising his ear.

The younger child, who was struck in the knee with a ball, was left with multiple injuries, including a scratched eye.

The father from Burnley, Lancs, was arrested after the six year old turned up at school with a mark to his face and distressed and a teacher asked him what had happened.

When police spoke to the boys the children told them they enjoyed golf and said it was ''their job.'' The six year old declared: "We are going to be championship golfers when we get older."

The father's wife was said to be unaware of the pain he was inflicting on their sons, even though the trio had golf lessons in the living room every morning, before school.

She was upset and sobbed when she found out and he had to leave the family home. He is now only allowed contact with his sons by the local authority.

The father, who cannot be named for legal reasons, admitted two counts of assault causing actual bodily harm and one of common assault, in June last year. He was given 52 weeks in jail, suspended for two years, with 12 months supervision.

Sarah Statham, prosecuting, said the dad gave his sons golf tuition before and after school every day and if they did not play well, they would be assaulted.

After the six year old went to school injured last June 10 and told his teacher his father had pinched his eye as they played golf that morning, the authorities became involved. Both boys were taken for medical attention and were interviewed by the police.

Miss Statham said the six year old told officers his father had also grabbed his leg in a " clawing action" and he had been hurt and upset.

The eight year old was struck in the knee with a golf club and his ear was cut after his father threw a golf ball at him, from about four feet away.

A paediatrician who examined the boy found several other injuries to the ear. The six year old had pinching injuries on both hands and his thigh, his face and the top of his scalp were scratched and he was bruised.

Miss Statham said the defendant was arrested and interviewed last June 11 and made out a lot of the injuries were accidental.

In mitigation defence lawyer Miss Carolyn Smith, for the dad, said he was ordinarily very much a family man, who lived for his wife and children.

He had been separated from his family since the offences after the involvement of child protection agencies and that had served as significant punishment already, before the punishment he would receive in court.

The barrister said :" They are clearly serious offences and he does now acknowledge that." She continued :" He had an almost obsessive desire for his sons to become championship golf players."

Miss Smith said the defendant had a "loving relationship" with his sons and had been having contact with them. She continued:"To deny the defendant his liberty at this stage would mean the children would be denied contact with their father."

Sentencing, Judge Beverley Lunt told the defendant his actions must have hurt the children considerably and said it was "beyond belief" that as their father, he had assaulted his children over golf shots.

She added :"This is child cruelty. It's inexcusable and I do not believe any right thinking person could make any sense of it whatsoever. If you permit your obsession with golf to overcome you again and lay a finger on either of them you will immediately come back before me and I will send you to prison."

Waukesha – A Waukesha man who allegedly uses corporal punishment on his children was charged this week in Waukesha County Circuit Court for hitting his 9-year-old son.

The 46-year-old man was charged with a felony count of physical abuse of a child for an incident that allegedly occurred Dec. 8.

According to the criminal complaint filed Jan. 23, the boy was at his father’s residence when his father became angry as the boy was doing poorly in school and the man accused the child of lying. The boy told police his father got out a belt but did not use it but the man did strike the boy "hard on the buttocks" and grabbed the boy "around the neck from behind and started throwing him around," the complaint said.

The boy told police that he had pain in his neck and jaw and officers did see red marks on the boy’s neck, the complaint said.

A MAN who hid a video camera in his family's bathroom captured images of his children and their friends showering and dressing, a court has heard.
The Victorian County Court was told police executed a search warrant in October 2010 at the man's Melbourne home and found 198 films depicting the children getting in and out of the shower, changing into school uniforms and other activities.

The man, who cannot be named for legal reasons, recorded the incidents between 2003 and 2010, Prosecutor Susan Borg told the hearing.

The victims were aged between 12 and 16 when the offending took place, she said.

Australian Federal Police originally charged the man with accessing and possessing child pornography and he served a three-month sentence last year.

However additional charges were laid when investigating police realised the videos had been captured in his own home, the court heard.

A second search warrant was executed in May last year and the full extent of the man's offending was uncovered.

Prosecutor Susan Borg called for the man to be jailed for a maximum of four to six years with a minimum of two to four years.

The man's barrister George Georgiou called for his client to be spared jail and sentenced to a community corrections order so he could continue to be the full-time carer for his seriously ill wife.

The father of two has pleaded guilty to seven charges of making child pornography, four counts of indecent acts with a child under 16 and installing an optical surveillance device.

He will be sentenced before Judge Christopher O'Neill on February 9.

Long list of charges includes child pornography, bestiality

An Edmonton-area man has pleaded guilty to more than a decade of sexual abuse of minors, including his son and daughter.

The 41-year-old, who cannot be named to protect the identity of his victims, entered guilty pleas to 27 of the 40 charges against him, including charges of sexual touching, child pornography, unlawful confinement, incest and bestiality.

He pleaded not guilty to 13 others, including 10 charges of sexual assault. He is scheduled to face trial on those charges on March 12. Only after that trial will he be sentenced.

The man's victims included his son, his daughter, the daughter of a girlfriend and two daughters of a fiancée. Four of five victims were minors at the time of the abuse.

The crimes stretch from 1999 until 2010, according to an agreed statement of facts heard by the court.

The man's daughter told police of sexual abuse that started when she was six years old, though she didn't recognize it as abuse until she was 11. Her father never became violent with her, the now 18-year-old told investigators.

"He talked nicely and softly to her and kept telling her that he loved her," court heard.

When the girl was 11, her father ordered her and her 10-year-old brother to have sex. Her father had sexual intercourse with her. There were numerous instances of abuse in the following years.

It took several hours to read the man crime's into the court record. He entered his pleas in a soft voice and had to be told to speak up.

The man's son, now 17, said his parents divorced when he was young. Growing up, his father often asked him to participate in sexual activity with himself and women. The teen declined.

The father told both his children that he was teaching them about sex "for later in life."

The siblings were afraid to tell anyone of their father's crimes and both attempted suicide as a direct result of the abuse.

From 2003 to 2008, the man was in a relationship with a woman who had a young daughter. When they were alone, the accused sexually touched the girl and forced her to touch him. She once woke up to him abusing her. More recently, the man abused two daughters of a woman he was engaged to in 2009 and 2010.

The mother once allegedly held her daughter down while the accused had sex with her. The mother will face a criminal trial later this year. The man also brought a friend to their home to have sexual activity with the girl. That man now faces charges.

On April 30, 2010, the man and his fiancée argued and she left the home with her youngest daughter.

Police were contacted within the week. They searched the man's home and seized note-books, photos, CDs, a computer and data storage devices. Officers with the Integrated Child Sexual Exploitation Unit found 10,455 images and 8,355 videos of child pornography.

Dad HANIF SIMMS managed to get and retain custody despite ongoing child abuse investigations and a weapons warrant. COLORADO SPRINGS, Colo. -- Defense attorneys for a father accused of murder want the charges dropped, but a judge is refusing.

The body of Genesis Sims was found by contractors working on a home in Monument in 2010.

Her father, Hanif Sims, is charged with first-degree murder. His girlfriend, Monique Lynch, pleaded guilty to child abuse causing death and was sentenced to 27 years.

Lynch had been charged with first-degree murder, but that was dropped after she agreed to testify against Sims.

Lynch told detectives that Sims grabbed his daughter by the throat and punched her in the chest, causing her to collapse. When his attempts to revive her failed, Sims allegedly told his girlfriend he wanted to dissolve the body in the tub with acid but changed his mind after learning he would need a special license to get the type of acid he needed, according to a detective's testimony.

Sims' trial is scheduled to begin Jan. 30.

However, Sims' attorney now wants the first-degree murder charges dropped, saying that a tape recording proved that detectives misrepresented what Sims said in a jailhouse confession, according to the Colorado Springs Gazette.

But the judge said dismissing the case because of improper police behavior would be too extreme and wouldn’t serve the interests of justice, the newspaper reported.
In an interview in July 2010, Sims and Lynch told KRDO-TV that they buried their 9-year-old daughter in the basement crawl space of a Monument home, saying they found her dead in the shower.

Lynch said they couldn't find a pulse and the girl had turned blue.

"My husband tried to give her mouth to mouth ... but she was blue," Lynch said.

"We don't know what the hell happened to her. I didn't kill her," Sims said.

They said they laid the girl's body on a bed in the master bedroom.

"We just sat there and stared at her for at least two days," Lynch said, describing their state as "just totally unbelievable shock."

Then the couple decided to bury the girl in the basement.

"We put flowers. We prayed," Lynch said of the basement burial.

When asked why they didn't call 911, Lynch said that is a question both struggle with each day. She admitted it was a "dumbass" mistake, but was worried she would get into trouble for leaving Genesis alone while the couple went next door to a neighbor's home.

When asked about the girl's whereabouts, after she hadn't been seen for some time, the couple told neighbors Genesis had been sent to live with an aunt back east.

In April 2011, Lynch changed her story and gave investigators at the El Paso County Sheriff's Office an eyewitness account of Genesis' death, which she characterized as part of a long history of child abuse by Sims.

Sims' attorney, Matthew Werner, said in court that Lynch's statements since her arrest have been riddled with "wonderful inconsistencies."

Daddy did the BS parenting course, but the authorities refused to take the kids away. Meanwhile, Daddy figured out which neighbors had ratted him out, so he started targeting them with his abuse. Big surprise.

Finally Daddy assaulted one son badly enough to perforate his eardrum, and the boy finally told a teacher. THEN the authorities finally got off their collective duff and rescued the kids.

But the authorities are really, really sorry. They "misjudged" dear daddy. But what was there to misjudge? We soon find out that that DADDY ALREADY HAD A VIOLENT CRIMINAL RECORD! What was there to misjudge? It's not like the guy was a choir boy with no track record for this kind of behavior.

Meanwhile, Daddy's doing a whopping 20 months in jail. Big whoop.

So here's the question that's still being ignored: why and how was this criminal a "solo" father? Is the mother deceased? If so, do we know for a fact that her death was from natural causes? Did she "disappear"? Did Daddy get custody through the courts? You have to wonder when a violent dude like this gets custody, as it's more than likely he used violence against the kids' mother in the past.

Child, Youth and Family has launched an investigation into why it failed to protect two children from abuse by their father for almost three years after it was reported by neighbours.

Troy Dunn was a solo father with two children he was abusive towards, and his neighbours at Arkles Bay on Auckland's North Shore, heard it.

The neighbours, Grant and Merryn, told TV ONE's Close Up they heard Dunn verbally abusing the children, sometimes several days a week, and were sure there would be violence if they did nothing about it.

Merryn said she called CYF because she was scared for the lives of the children.

CYF paid Dunn a visit and put him on a parenting course which he completed.

But Dunn realised his neighbours had dobbed him in and he became abusive towards them.

As a last resort they wrote a detailed letter the chief executive of CYF, which the department can't find in its records.

Grant and Merryn did not hear back from CYF.

Almost three years later, on January 12, Dunn pleaded guilty to assaulting his son and injuring him with intent.

Dunn had thrown his son down the stairs, hit him, kicked him, punched him in the head and perforated his ear drum.

All of this only came to light when the abuse became so bad that he boy told his teachers.

After Close Up's inquiries the head of CYF, has launched an investigation. Bernadine MacKnezie said she is very concerned about some of the decisions that were made, which were "not child centred".

Dunn already had a long criminal history including a number of convictions for violence, but CYF did not remove the children from his care.

The neighbours said the abuse continued for almost three years after they reported it and CYF "let the kids down".

CYF admits it got it wrong

Child, Youth and Family said in a statement to Close Up: "We can understand why these neighbours feel let down by us. We weren't proactive. We made some poor judgments. We misjudged the father."

The department is apologising to the two children it failed to protect.

Despite numerous requests for an interview, CYF refused to front on camera.

Dunn's children survived the abuse. They have been removed from his care and Dunn has been jailed for 20 months.

OAKLAND -- A SWAT team rescued a 3-year-old girl Monday morning from a Fruitvale district apartment, where her father had held her captive for almost five hours, authorities said.

After handing the child to officers through a window about 7 a.m., the father surrendered. No injuries were reported.

The incident began about 2 a.m. on the 2900 block of Capp Street where the man lived with his child and the child's mother. It was not immediately clear if the man was married to the woman.

The man, who may have been intoxicated, got into an argument with the woman, 29, who fled with two other children and called police, authorities said. The man apparently threatened to kill himself and the 3-year-old who remained with him at the house.

The man, 30, refused to let his daughter go. Police said they were told there were guns inside the apartment, which added to their concern.

Patrol officers initially responded to the scene and tried to negotiate with the man to surrender. When it became apparent he would not, SWAT officers were called to the apartment complex about 3 a.m.

As SWAT officers approached the unit where the man and child were, the man saw them from a window. The child was handed to a SWAT officer and moments later the man surrendered.

No one was injured. Some guns were found inside the apartment.

The man was booked on a domestic violence and child endangerment charges, and the little girl was later reunited with her mother.

Mumbai Upholding the conviction of a man who raped his daughter since the time she was eight, the Bombay High Court recently observed, “One who could, taking advantage of age of his daughter, molest his own daughter repeatedly does not deserve to be dealt with leniently.”

Finding no fault with the order of the sessions court that handed out a 10-year prison term to Bhiku Jadhav from a village near Panchgani, Justice M L Tahaliyani wrote in his order that Jadhav “is a person of the nature in whose custody even closest of the female relative was not safe.”

The case of the prosecution was that Jadhav had been sexually abusing his daughter since she was eight years old and slept next to him. However, the girl lodged a police complaint in 2006 when she was pregnant after being repeatedly raped by her father.

The girl, at the age of 13, delivered a baby boy. There was a delay in filing the FIR as the victim was 34-weeks pregnant at that time.

The victim, Additional Public Prosecutor P S Hingorani argued, silently suffered at her father’s instance as he had threatened to poison her if she told her mother about the alleged rape.

However, her step-mother brought her to Mumbai and confiding in her, the victim agreed to lodge a police complaint at the Panchgani police station.

Jadhav was booked under section 376 (punishment for rape) and section 506 (criminal intimidation) of the Indian Penal Code.

The court observed that it is difficult for anybody to find out the reason for non-disclosure on the part of a sexually abused child. “The psychologists have cited many reasons,” Justice Tahaliyani said. He observed that if the child is raped and threatened by its custodian, a child tends to obey, as psychological studies have indicated.

The non-disclosure by a sexually abused child for long time, by itself cannot be a reason to throw away the evidence of sexual abuse if it is otherwise believable, the court said.

The court felt that the account given by the victim was genuine and supported with evidence and statements of other witnesses that included her step-mother as well.

A city man arrested Saturday after officers found his southeast side residence in “total disarray” while checking on the well being of several young children is free on bond.

The man, 24, was arraigned Monday in Municipal Court on one court of child endangering, a first-degree misdemeanor. The Independent generally does not name suspects charged with misdemeanors. The man was released from jail after posting 10 percent of a $1,000 bond. He pleaded not guilty and is due back in court Feb. 21 for a pre-trial hearing.

Police reportedly observed a 1-year-old girl trying to eat fingernail polish at the residence after responding to the residence in the 1200 block of 16th St. SE. Officers also reported that they found drug paraphernalia in the kitchen and little food in the refrigerator. There were five children at the home, including two who were visiting. The arrested man, the father of two of the children, had alcohol on his breath, according to police.

“Apparently, there was a subject that went to the house and was checking on the situation,” said Massillon police Sgt. J.J. DiLoreto.

“... (Suspect) was supposed to be watching them but he was passed out upstairs. They woke him up and apparently got a hold of the mom who was at work. Another gentlemen who was supposed to be there watching the children apparently went to work.”

Police notified Child Protective Services, which placed the three children who lived at the residence with a family member, police reported.

Jason Gallaway was either a loving, caring father or a man who beat his 3-month-old daughter to death because her crying interrupted his video game.

Those were the dual and opposing portraits of the 32-year-old Seaford-area man that emerged Monday as he went on trial in the death of his daughter, Marissa, on a charge of murder by abuse.

She died Dec. 5, 2010, from injuries suffered three days earlier. Gallaway could get 15 years to life in prison if convicted.

Gallaway, 32, who took care of his daughter while his wife worked as a high school teacher, repeatedly physically abused Marissa, prosecutor Casey Ewart said during opening statements Monday. She said the little girl had suffered a fractured rib, fractured shoulder, fractured arm bone and had bruising on her face.

"It may be difficult to comprehend why a parent would abuse his child," she said. "But only the defendant knows what he did and why. ... This was not an accident."

Marissa's death was caused by injuries to her head, which prosecutors said happened because Gallaway struck her and the defense team said happened because she fell off his lap in a tragic accident.

The head injuries, Ewart said, could not have been caused by a 2-foot fall onto a floor. "They're more consistent with a fall from a two or three-story building," she told jurors.

Defense attorney Rob Robinson said Gallaway's life centered around his daughter.

He fed her, bathed her, dressed her, played with her and took her to doctor's appointments.

"In addition to the loss of his daughter, he has to defend himself against charges that he murdered her," Robinson said.

He noted that none of the doctors or nurses who performed her check-ups noticed anything that would have suggested abuse. Nor did Gallaway's wife, he said.

"Not once during that time did she think Marissa was in any danger from Jason Gallaway," Robinson said.

Gallaway sat beside his public defenders, Robinson and Dean Johnson, listening to opening arguments. He shook his head no when Ewart stated that he had killed his daughter.

Gallaway was originally arrested and charged with two counts of assault by abuse or neglect on Dec. 2, 2010, when he called 911 to report Marissa had stopped breathing. Police officers found her lying on a coffee table, skin blue. She was taken to Nanticoke Memorial Hospital, diagnosed with a fractured skull and three bleeds on her brain, then put on life support and transported to Alfred I. duPont Hospital for Children in Rockland.

Gallaway told authorities he had dropped Marissa on the floor twice -- once that day, once the day before -- when she was sitting on his lap and he was doing exercises with her, but then was startled, Ewart said.

After her death, prosecutors re-arrested Gallaway and charged him with murder by abuse.

Ewart said Gallaway was tired and short of sleep before Marissa's death, and also played a lot of video games -- including the one that was paused on the TV screen when Seaford police arrived at the home, "Assassin's Creed: Brotherhood." A manual for the game was propped open on the couch, she said.

Ewart said jurors will also hear the testimony of a prison inmate who shared Gallaway's cell, who will testify that Gallaway told him what he did to Marissa.

Robinson said jurors will hear from Gallaway, as well.

"Accidents can happen," he said. "Babies are fragile, and sadly, many die far too early."

Two weeks have been set aside for the trial, before Sussex County Superior Court Judge Richard F. Stokes.

A Gloucester Township man is in jail after police say he assaulted his infant son.

On Friday Richard Pease, 28, was alone with his 5-month-old baby. Investigators say Pease claimed he became frustrated after the child began to cry. Pease then allegedly shook the baby and threw him onto a couch. Police say he then called 9-11 and reported the infant was non-responsive.

The baby was taken to Cooper Hospital and treated for multiple skull fractures and bleeding on the brain. He is currently in critical but stable condition.

Pease was arrested and charged with aggravated assault and endangering the welfare of a child. He is being held at the Camden County Jail on $150,000 bail.

Palestinian police have freed a young woman whose father kept her locked in the bathroom of their house for about a decade.

Spokesman Adnan Damiri said the 20-year-old woman was in a "deplorable" condition when she was found on Saturday. Damiri said on Monday it remains unclear why she was locked up.

Baraa Melhem, 20, revealed that she spent the decade by listening to the radio that her father had given her and by eating an apple that she got to eat every day.

Her father locked her up in the bathroom after she ran away from home to escape the torture at the age of 10. The police caught her and brought her back home. Ever since then, her father would lock her up in a bathroom that measured about 3ft-by-3ft. Her father also forced her to sign a statement saying she didn't want to go back to school, she told Daily Mail.

She would be allowed to get out of the bathroom only in the middle of the night so that she could do the house work. She would be locked inside again around dawn. She did not see any sunlight for about a decade.

Baraa was given only a blanket, radio and a razor blade by her father and stepmother, and both of them encouraged her to kill herself, the daily said. The girl was often physically assaulted and her father would shave her head and eyebrows to punish her further.

He would often threaten to rape her till she got pregnant so that he could kill her in the name of honor killing.

After about a decade of torture, the police officials were finally tipped off by an aunt. When she was found locked away in the bathroom, she was wearing tattered clothes that were on the point of degeneration.

Baraa is enjoying her freedom at her mother's place. Her parents were divorced when she was barely 4 years old. Her father got her custody and her mother got the custody of the couple's son. The mother told the daily that she took her son with her because the father used to spray perfume in her son's eyes. At that time, the father never abused his daughter and she thought Baraa would be safe with her father.

The 49-year-old father, an Arab, and her stepmother were detained and handed over to police.

Police spokesman said the father was suspected of physically abusing the young woman. He is being held in a jail pending a court hearing.

LYONS, Ore. - A 3-month-old Linn County girl is in the hospital recovering from bleeding in her brain and several broken bones and her father has been arrested.

Her twin sister is in state custody with a broken leg and ribs.

Deputies say their father, Corey Repucci, 22, caused the injuries to both small children.

They arrested Repucci on Friday after he brought the more-injured child to the hospital for breathing problems. Repucci is from Lyons, Ore.

Dad tried to sell children to their own mum

A 34-year-old father of two has been sentenced to eight years in prison after he kidnapped his six and seven-year-old sons, took them to Tunisia, and told their mother to pay him 170,000 francs ($182,000) if she wanted to get her children back.

Janine Schoch, 30, said she had told Swiss authorities on several occasions that she was afraid her husband Issam would follow up on threats to kidnap her children, newspaper Blick reports.

“I did everything in my power to prevent the abduction,” she told Blick. “I reported it to child protection authorities, but they thought I was a hysterical woman who wanted to discriminate against a poor foreigner."

But Schoch, who lives in Winterthur, near Zurich, had her worst fears realized on August 22nd 2010, when Issam [not his real name] took the children and flew them to his home country.

Eight days after the kidnapping, Schoch received an e-mail from Issam. He said she would be permitted to move in with him and be with her children again if she agreed to send him 170,000 francs.

“It was as if he wanted to sell me my own children,” she said.

In October 2010, Issam was arrested during a trip to Morocco and extradited to Switzerland.

"I could not continue living in Switzerland,” the 34-year-old Tunisian told the judge. “I was treated like a dirty dog by my wife, her family, and the migration authorities,” he explained, adding he was not serious about the money he requested. “I am a decent person,” Issam added.

On Thursday, he was jailed by a Wintherthur court on charges of kidnapping, attempted extortion and issuing threats.

Although Issam is already in prison, Schoch has not yet been able to recover her two sons, who live with their grandparents in the Tunisian city of Jendouba. They have custody of the children following a verdict from a Tunisian court.

Still Schoch feels confident that she will soon have her sons back with her in Switzerland.

"When the judge announced the verdict, I felt the children very close to me. I realized it was a reality that I have a chance to get them back,” she told Blick.

Schoch met her husband in 2002 in Turkey, where they both worked as children’s entertainers.

The couple married and move to Frauenfeld, where their first son was born in 2004. A year later, their second child came.

“Then it all started,” Schoch recounted. Her husband began to pray, went to the mosque every Friday and removed his gold wedding ring. He insisted on her adhering to Islamic customs, but she refused.

Schoch said she initiated a separation after he started teaching his children to spit at Christian churches and the Swiss cross.

She hasn't seen her children in a year and a half.

A 31-year-old Stillwater man may face child endangerment charges after he pushed his 4-year-old son's stroller to the liquor store Thursday without a hat or gloves in temperatures hovering around zero degrees.

A 31-year-old Stillwater man allegedly registered a .26 blood alcohol content while pushing his 4-year-old child down Third Street in a stroller with an unzipped coat, no hat or mittens on the coldest day of the year so far.

It was 1 degree outside at about 6:18 p.m. Thursday when police were called to a report of a welfare concern involving a seemingly intoxicated man pushing his child’s stroller through downtown Stillwater.

A witness called police to say that he saw the man walking from the liquor store while pushing a stroller—stopping every 10 feet while traveling about 50 yards in 10 minutes.

The witness told police the man almost fell off the curb with the stroller a couple of times and at one point was nearly hit by a car while trying to cross Olive at Third Street.

At that point the witness lost sight of the man, and called police.

When police arrived, the officer made contact with the man near the Historic Courthouse.

The man told the officer he had just come from the library and was on his way home, the report states. The officer smelled an odor of alcohol on the man—and a preliminary breath test done on the scene revealed a .26 blood alcohol level.

While conducting a pat search, police found two bottles of ketchup in the man’s jacket—and a third in the stroller. The man told police he had ran out of ketchup at home, so he stole them from the Dairy Queen in downtown Stillwater.

When asked where he had been drinking, the man said he was “sipping” out of 750-milliliter bottle of Karkov vodka while he was downtown.

Police then transported the boy and his father to the Stillwater Police Department until the officers could make arrangements to have the child picked up by a family member and the father taken to Detox.

The boy’s mother, who lives in Maplewood, was eventually contacted and she picked her child up at about 9 p.m.

While the child was in the stroller without a hat and gloves, the police report notes that the man had on two winter hats, gloves and a jacket.

The child was not in any distress, the report states. There were no obvious signs of frostbite or redness to his fingers or his face. The child had a hat with him, the report states, but was not wearing it.

While in custody, the child’s father was allegedly crying and apologizing to his son, of whom he has part-time custody.

The man was cited with theft of ketchup from Dairy Queen and having an open container of alcohol in public.

KSTP published the man's name in this report. Although his named appeared on police records, it is Stillwater Patch's policy not to name a suspect until they have been officially charged with a felony crime by the Washington County Attorney's Office.

The case was forwarded to Washington County social services and the county attorney’s office for review of possible child endangerment charges.

I had no idea that kids under 3 listened to anybody, so he obviously has no idea of what appropriate expectations are for infants and toddlers. So why does this guy have custody and who gave it to him? Not one clue here. Now that he has pleaded guilty, will Mom have a shot of custody? Who knows. There is no mention of her one way or another.

Sentencing will be in February for a Kenosha father who said he was overwhelmed, frustrated and depressed when he “whaled” on his three children, ages 1, 2, and 3, a criminal complaint says.

Daniel B. Jewell, 27, faces three years in prison. He pleaded guilty in December to one count of felony child abuse. In exchange, two other charges were dismissed but considered for sentencing.

Jewell was charged in December for the November incidents. Jewell’s girlfriend called police after she said he threatened to kill himself and harm the children, the criminal complaint says.

“I can’t do this anymore! They’re not listening! I’m afraid I am going to kill them!” Jewell allegedly said. The girlfriend took the children and, later, found bruises on them.

“They weren’t listening, and I just whaled on them,” Jewell allegedly told her. “I barely remember.”
Jewell told a crisis worker that he was raising the children alone and was overwhelmed because they were all crying at once. Jewell did not explain how the children were hurt, the complaint says.

Nurses found bruises on the children’s faces and bodies. Two of the children had bruises along their spinal columns. One child had injuries around the mouth comparable to those seen after a child bites an extension cord, the complaint said.

Jewell is in jail because he has not posted bond.

Police say two children allegedly left alone inside a Canberra unit on a sweltering day this week were ''screaming hysterically'' when officers arrived at the scene.

As temperatures in the capital pushed above 30 degrees on Thursday, the three-year-old girl and her infant brother were allegedly left in the north Canberra unit when their father went to the shops.

The father, who cannot be named for legal reasons, has been charged with two counts of child neglect and faced the ACT Magistrates Court yesterday.

The 44-year-old, who has also been charged with common assault, is further accused of slapping the children's mother in the face, splitting her lip and drawing blood.

The foreign national was yesterday released on bail after Magistrate Peter Dingwall was satisfied tough bail conditions could prevent him from allegedly reoffending.

The family came to police attention on Thursday when the children's mother arrived at Gungahlin station and reported the assault.
According to a statement of facts, the pair's relationship was ''a tempestuous one, characterised by frequent arguments about money''.
Later that afternoon police went to the couple's unit and found the door locked.

They then saw a three-year-old girl running up to the front door, according to the police document.

''She was hysterically crying, yelling, 'Mummy!' several times while trying to turn [the] door knob of the front door,'' the document stated. Police broke into the unit through a window at the opposite end of the house, in a bid not to harm the child. But the girl allegedly came running through the broken window glass to get to the officers, who later picked small shards of glass out of her hair.

The officers then found the nine-month-old boy in a cot in one of the bedrooms, allegedly ''screaming hysterically, hot to the touch and soaked in sweat''.

The girl was also allegedly distressed by the heat, which police said felt hotter than 30 degrees in the poorly ventilated, un-air-conditioned home.

The mother returned to the home to take care of her children, but it was allegedly several hours before the father returned to the home.

Constable Rebecca Williams told the court the defendant later demonstrated no remorse for the alleged assault or leaving his children at home.
Constable Williams also said the father indicated it was not the first time the pair had argued violently, and not the first time he left the children alone.

But the court heard the man had no previous convictions, and Mr Dingwall said while the allegations were relatively serious, strict bail could reduce the risk of reoffending.

He has been banned from approaching within 100m of his wife, their home or - unless supervised and approved by authorities - his children.

The man was ordered to surrender any passport in his name and forbidden to leave the territory.

SHAH ALAM: A father of three who raped his 11-year-old daughter has been jailed a total of 33 years and ordered to be caned 30 times.

The 33-year-old factory worker was found guilty of three counts of raping the girl at a house in Taman Bukit Beruntung on April 14, 15 and 17, 2010.

Session Court judge Slamat Yahya in his ruling said the accused had never denied his presence in the house during the alleged incidents.

“The court finds the victim a credible witness and (who) has no reason to create stories against the accused,” he said here yesterday.

Earlier DPP Siti Syakimah Ibrahim asked the court to mete out a harsh punishment as incest was a serious crime.

“The offence not only humiliates the family but the community as well.

“The court must consider the victim who is traumatised by this episode and how it can ruin her future.

“As a father, the accused should be responsible in protecting the child,” she said.

The accused, who was unrepresented, said that he was innocent and pleaded for a lenient sentence if the court wanted to punish him.

Slamat then sentenced the accused to eight, 10 and 15 years jail for the first, second and third counts respectively.

He also sentenced the accused to 10 whippings for each count.

The jail term is to run concurrently.

LIVINGSTON PARISH, LA (WAFB) - A Livingston Parish man has been arrested and charged with attempted first degree murder and other charges after shooting his son.

The shooting happened just after 1 p.m. Friday in an Albany mobile home park on Strawberry Lane.

Deputies found Scott J. Hardy, 36, shot in the back. An Acadian ambulance took Hardy to a Hammond area hospital with critical injuries. He was later transferred to a New Orleans area hospital.

The victim's father, George W. Hardy, Jr., 54, was taken into custody by LPSO Detectives for questioning and charged with one count of attempted first degree murder, one count of child desertion, and one count of illegal use of a weapon.

The child desertion charge was filed because a two-year-old child was inside the mobile home at the time of the shooting. Detectives recovered the shotgun used in the shooting.

The father and son live together in the mobile home.

George W. Hardy, Jr. is being held in the Livingston Parish Detention Center in lieu of an $85,500.00 bond.

Notice that Daddy was on the lam for years, and when they finally up with him caught him on a DUI in Florida they let him go on a $10,000 bond, so he disappeared for a few more years. What a bunch of nitwits.

Man gets 45 years in prison for sex assault of daughter

Twenty years after being sexually assaulted by her biological father, a woman saw him brought to justice this week in an Angelina County courtroom.

Although he spent nearly two decades on the run, an Angelina County jury found Adolfo Turcios, 48, guilty of aggravated sexual assault of a child Wednesday, sentencing him to 45 years in prison. Assistant district attorney Art Bauereiss said that when sexual predators like Turcios flee, prosecutors fear they will never see the inside of a courtroom.

Turcios, now of Homestead, Fla., reportedly assaulted the girl Nov. 7, 1992, when she was 6 years old while living in Lufkin. She did not make an outcry to her mother until a couple of months later, after she began seeing Turcios lurking outside her elementary school, Bauereiss said.

The victim, now in her mid 20s, testified against Turcios this week, recalling the graphic details of his assault. She remembered it as the last time she ever visited her biological father, Bauereiss said. The tragic element of the case, he said, is that two months after the girl made an outcry and Child Protective Services began its investigation, her mother was killed in a car accident.

Turcios and her mother were divorced in 1991 and she remarried in 1992. The girl and her brother were then adopted by their stepfather, according to Bauereiss.

She was set to testify against Turcios in 2004 after he was extradited from Florida on a driving under the influence charge. At that point he had been on the run for more than 10 years and even avoided extradition once by using a different name when arrested in Florida in 1995 on DUI, Bauereiss said.

Three days after being put in jail, Turcios made a $10,000 bond, meaning he only paid $1,000 for his freedom. The morning of the trial, Dec. 9, 2004, everyone showed up to court but him.

“When he didn’t appear, a warrant was issued,” Bauereiss said. “He stayed on the lam again until July of 2011.”

At that time, he was arrested in Florida and brought back to Texas, where he remained in jail without bond, according to county records.

The jury heard three days of testimony, returning a guilty verdict around 9 p.m. Wednesday, Bauereiss said. Jurors came back the next day to hear testimony in the punishment phase.

“At punishment, two of her aunts testified that when they were younger girls he tried to do very similar things to them,” Bauereiss said.

Dad Accused Of Locking Girl In Dog Cage

CINCINNATI - A Springfield Township father who stands accused of tying his daughter up, then locking her in a dog cage and threatening to electrify her, told a judge on Friday that it was all a big joke.

James Tapke, 41, appeared in court Friday on a charge of child endangering, ONN's affiliate WKRC reported.

Court documents indicate that the alleged abuse happened on January 10.

Tapke apparently bounded his 12 year old daughters' hands and feet with duct tape and shoved her in a dog cage. He then dropped water on his daughter's face and kept her trapped for 20 minutes. That's when her brother let her out.

Once freed, the girl allegedly tried to get back at her dad by putting water on his face. At that point, police said that Tapke bound her up with the duct tape again and put her back in the dog cage.

Tapke then allegedly ordered his son to get a portable battery jumppack from the garage so he could electrify the cage while his daughter was locked inside and threatened to use the jumppack.

Tapke finally let the girl out of the cage, but not before allegedly taking pictures of her bound and trapped.

Police said that Tapke's son posted those pictures to Facebook, but those pictures have been deleted.

The abuse allegedly happened at the family's home on Waterbury Circle.

Tapke's lawyer told the judge in court on Friday that his client was just joking around and believes that the Facebook photos will prove that case.

The prosecutor asked the judge to double Tapke's bond to show the seriousness of the allegation.

Tapke is now being held on $50,000 bond.

During the arraignment, Tapke shook his head, muttered profanities under his breath and then made an obscene gesture at the cameras when he left.

Tapke's daughter and son are with their mother at this time while he remains behind bars.

Police arrested a 29-year-old man Thursday and charged him with felony child abuse after they say he beat his daughter 82 times with a leather belt while her stepmother watched in North Suffolk.

Child Protective Services removed the girl from her home in the 2800 block of North Shore Drive as her father, Victor Gomez, was taken into custody, said spokeswoman Debbie George. The girl suffered bruising and welts on her back, buttocks and upper legs.

The girl's stepmother, Andrea Delagarza, 39, also was arrested Friday and charged with contributing to the delinquency of a minor, George said. Police said Delagarza stood by and counted the number of times the girl was struck.

George would not say what prompted Wednesday's beating or who notified police of the incident.

Father faces charges in child-abuse case

FUQUAY-VARINA -- A Holly Springs man was arrested Thursday and charged with child abuse and attempting to kill his 7-month-old son in December.

Carlos Lemar Murray of 616 Guerin Road was arrested at 634 Angier Road in Fuquay-Varina. Murray, 23, was charged with two counts of child abuse with serious bodily injury and one count of attempted murder, Fuquay-Varina police said.

Wake County Human Services contacted Fuquay-Varina police on Jan. 5 to report that the 7-month-old was displaying symptoms of shaken-baby syndrome, said Susan Weis, Fuquay-Varina police spokeswoman. Both of the child's eyes were swollen nearly shut, and he had bruising on the bridge of his nose, according to Murray's arrest warrant.

The human services report indicated that the abuse might have occurred on the afternoon of Dec. 26 while the child was with Murray, Weis said.

Police investigated allegations that Murray shook the child to the point of causing severe physical injuries on at least two occasions. According to the arrest warrant, he also is accused of placing the child in a bathtub and allowing him to submerge and inhale water, rendering the baby unconscious.

The child is now recovering and is in protective custody, Weis said.

Here we have a dad with a record of a previous violent felony (i.e. assault) and evidence of previous child abuse. Yet despite his "anger" problems, he got custody of a young girl anyway. Again, we have to ask the same questions that we raised in 2010. What California judge gave this abusive father with a criminal history of assault custody of a young girl? How did Dad get moveaway permission in a state that routinely denies these rights to mothers? Was Mom denied all visitation? Why? Especially since she's apparently not the homicidal one?

Notice that the authorities come up with one bland and totally ineffective solution: parental education. What we don't need is useless "education" targeting violent felons and child abusers. What we need is more education directed to the public so they know the abuses that the courts are committing in the public's name.

Mark Weeks sentenced to 48 years for child abuse in Alexis McClain murder case
Will serve concurrent with life sentence on murder conviction

STERLING -- Mark Weeks sat handcuffed and looking down at his lap through much of the sentencing hearing at Logan County District Court Thursday.

Weeks appeared before Judge Michael Singer to be sentenced on a charge of child abuse causing death related to the murder of his 3-year-old daughter, Alexis McClain. After a request for a change in venue by the defense, Weeks was convicted by a Morgan County jury on that count and a primary charge of first degree murder of a victim under 12 by one in a position of trust on Nov. 8, 2011. The mandatory sentence of life without parole was imposed immediately, but there were some questions to be answered before sentencing on the second count could be done.Weeks returned to Logan County Court for that sentencing because Singer had only granted a change in venue for the trial itself, not for the entire case.

In court Thursday, the defense team of public defenders Damon Brune and Thomas Ward was offered the first opportunity to enter an argument on the sentencing but declined.

Chief Deputy District Attorney Brittny Lewton, representing the People of Colorado, argued that while the law requires that charges related to the same crime against the same victim require a concurrent sentence, she felt the evidence in the case proved that there had been distinct acts that would warrant a consecutive sentence. She cited testimony of prior abuse and evidence of past injuries, saying "the act that killed (Alexis) was separate, or perhaps a culmination, of all the other acts."

Lewton also noted in her argument that the case had been a difficult and emotional one for all involved. She said it involved the most "dismaying and disgusting set of facts" many of the investigators and legal team had ever seen. However, she said, Weeks never showed any signs that he felt remorse, during any phase of the investigation or trial. She said if there had been any doubt about his role in Alexis's death, it was cleared up by his lack of emotion, even when autopsy photos of the child were displayed in court.

"We hope he suffers every day," she told the judge. "There is never going to be a punishment that is good enough."

She offered praise to those who were involved in the case, saying they all gave " the best fight we could have put forward" from the day in July 2010 that the Logan County Sheriff's Office began investigating the allegation of child abuse and the toddler's death. She said the professionalism demonstrated on the case showed that the justice system works.

She also noted that the DA's Office is tasked to represent the state -- not the victim, "We do give voice to those who have none."

"That child, when she died at the hands of her father -- that was a gift to her," setting her free from the torture and abuse that she had experienced, Lewton said.

The defense offered no rebuttal to the argument, and Weeks declined the opportunity to address the court before Singer handed down his decision.

Singer cited case law and questioned whether there were distinct enough acts to impost a consecutive sentence. He noted that the Colorado legislature has made it clear that courts should maximize the intent of a jury's verdict. However, he felt the jury was given the task of weighing two different theories on the same incident. The jury rejected the idea that Alexis's step-mother, Ginger Weeks, who pled guilty to a reduced charge in exchange for testifying against her husband, was the only guilty party or that the death was an accident, and found Mark Weeks guilty on both, Singer said.

Singer said the evidence made it clear that Alexis died of blunt force trauma, but what exactly happened on the morning of July 8, 2010, is a mystery that may never be made clear. The evidence presented showed a pattern of conduct of abuse, as Alexis's body had a number of bruises of varying ages, and signs that she was healing from a broken rib. However, the cause of death was same, and he felt it required a concurrent sentence.

"If I could impose a consecutive sentence, I would do so," Singer said.

The circumstances of the case, as well as a 2005 assault conviction in which Weeks apparently was involved in an unprovoked fight in California, led Singer to issue an aggravated sentence. He said it was evident that Weeks has no control over his anger and was unable to cope with the challenge of caring for a 3 year old.

"Nothing the court does today can satisfy Alexis's interests," he said before handing down a sentence of 48 years, with five years of mandatory parole.

He addressed Weeks, saying, "I hope before you meet your maker you find out who you are... and beg to make amends."

Lewton said today that she wasn't surprised at the judge's decision that Weeks would serve concurrent sentences, and that the system had done the best it could. The important thing, she said, was that Weeks will "never hurt anybody again."

The case was "really, really sad," Lewton said, and while she's glad it's over, she can't be happy because of the circumstances surrounding it.

She said one message that was made clear through the course of the case was that there is a need for parenting education. There's not one right way to raise a child, she said, but "All parents struggle," and need to know how to react to challenges like potty-training issues and other frustrations

There's no mention of a mother either--just a passing reference to a grandmother. So what happened to Mom? Whenever the custodial dad appears especially sicko--note that he was threatening to ELECTRIFY THE CAGE TO SHOCK THE GIRL--you got to wonder. Especially if she's "missing" or died under "mysterious" circumstances. Wonder why the word "torture" is not used here. Ohio father jailed after locking daughter in dog cage

SPRINGFIELD TWP., Ohio – In a case of what police describe as discipline going too far, a father is accused of binding his daughter's hands and legs with duct tape, locking her in a dog cage, photographing her and having the images posted on Facebook.

James Tapke, 41, is being held at the Hamilton County jail facing one count of child endangering because, according to court documents, Tapke was too extreme in disciplining his daughter on Jan. 10 by restraining her in a "cruel manner" and binding her hands and feet with duct tape .

Tapke then threw her in a "large" dog cage and locked her in so she could not get out, police wrote in a sworn statement filed in Hamilton County Municipal Court.

While the girl was in the cage, he dropped small amounts of water on her face. The child was trapped in the cage for about 20 minutes until her brother let her out.

To get back at her father, she began pouring water on his head and in his ear, according to police.

Tapke bound his daughter again with duct tape and stuck her back in the cage. Then, he ordered his son to go to the garage and retrieve the electrical jump pack so he could electrify the cage as another means of punishment for his daughter.

Tapke never actually attempted to shock the cage, but he threatened to several times. His son obeyed his father and brought the jump pack in from the garage, which was set in front of the cage so the girl could see it.

Finally, Tapke let the girl out of the cage and her grandmother helped her remove the tuct tape.

During the entire incident, the father and his son photographed the girl in the cage. The boy downloaded the pictures to the social networking website Facebook.

The photos have since been removed, police said.

Child caseworkers are investigating.

It is not clear how old the children are, or who is now caring for them with their father in jail.

SUFFOLK, Va. (WAVY) - Suffolk Police arrested 29-year-old Victor Gomez Thursday for felony child abuse and neglect.

According to Debbie George with Suffolk Police, a 13-year-old girl was allegedly struck 82 times with a leather belt by her father, while her stepmother stood by and counted.

The child had significant bruising and welts on her lower back, buttocks and upper legs, according to George, and Child Protective Services removed the girl from her home.

Gomez was charged with one felony count of abuse and neglect. There is an outstanding warrant on file for the stepmother, 39-year-old Andrea Delagarza, for one count of contributing to the delinquency of a minor.

TUCSON - A father was arrested Thursday on charges of abusing his baby boy.

Tucson Police says they received a call from staff at a local hospital Wednesday afternoon where staff reported a child in the emergency room with signs of physical abuse.

Detectives determined the 7-month-old baby boy's parents brought him to the hospital. The boy, who lives with both parents in the 2300 block of North Camino Castile, had spent the day with his father, 21-year-old Justin Alber.

Afterward, his mother noticed he was having difficulty moving his arms. During the medical examination, hospital staff discovered evidence of multiple fractures of both upper and lower extremities and evidence of soft-tissue blunt force trauma injuries.

The child remains hospitalized in stable condition and in the temporary protective custody of Child Protective Services.

The child's mother will be working closely with Child Protective Services to be reunited with her son.

Detectives charged Alber with five counts of class four felony child abuse.

Provo • A Santaquin man is accused of breaking the arm of his 1-month-old son.

According to court documents, the Division of Child and Family Services notified Santaquin police Saturday that the infant had been brought to Mountain View Hospital in Payson with a broken arm. An emergency room doctor told police the break appeared to be the result of someone pulling on the arm.

The child’s mother told police she didn’t know how the child’s arm was broken, but the doctor heard the child’s father say he had been drinking the night before and had gotten up at 3:30 a.m. to feed the baby.

The mother said she went to bed at 11 p.m. the night before, and that her husband and the baby were still up. When she went to feed the baby in the morning, he was crying as if in pain, and was sensitive to having his arm touched. Later, she noticed the arm was swollen, and took him for medical help.

The father later told police that after having "a couple shots of rum," he had picked up the baby by both arms, fed him and put him in a playpen where he went to sleep. He said he then drank some more alcohol, fed the baby again and put him in their bed.

The father is charged with third-degree felony aggravated child abuse, and public intoxication, a class C misdemeanor. The officer who interviewed the father reported smelling alcohol on the suspect’s breath.

INDIANAPOLIS (WISH) - Police officials say a 1-year-old girl is safe again after being snatched from her home while shots were fired.

The girl was taken from the 1300 block of North Pershing Avenue around 2 a.m., police officials say. Her father is the person suspected of taking her, but he doesn’t have custody of the child.

A neighbor reported hearing gunshots at the same time the child was taken, and dispatchers say the mom of the child said the non-custodial father fired shots in the air. Baby clothes were also strewn across the home’s front steps and yard.

Police recovered the child around 4 a.m. and reunited her with her mother.

The father was taken into custody. It’s unclear what, if any, charges he will face.

A mother whose baby daughter was allegedly murdered by the child's father has told a court that her partner "did not really" interact with their child.

Nichola Haddock was giving evidence at the trial of Craig Jamieson, accused of killing four-month-old Abbie on February 8, 2008.

The child's mother told the High Court in Glasgow that her daughter's birth was "the happiest day of my life" and said Jamieson showed the same excitement.

She told the jury she was "delighted" to be a new mother, but when asked about how Jamieson felt about the baby's arrival, she said: "Ok, I suppose".

Asked how he interacted with his new child, she appeared to start sobbing and replied: "He didn't really".

Jamieson, of Knightswood, Glasow, is charged with killing his daughter by inflicting blunt force trauma to her head and body leaving the girl so severely injured she died at the city's Yorkhill Hospital on February 8, 2008.

He also faces two allegations of assaulting Abbie, on December 7, 2007 and again between February 1 and 7, 2008.

Miss Haddock told the court she met Jamieson at a Glasgow bar in 2004 after moving to the city from Belfast to start a university degree in social work.

The couple later lived together at a flat in Dumbarton Road in the Scotstoun area.

He denies all of the charges against him. The trial, before Lord Matthews, continues.

LAREDO, TX .- Bail was set by the judge of District Court 49, Joe Lopez, who said Renteria may be free if he guarantees that amount. The man of 20 years is accused of killing his baby, Alan Vincent Renteria , 3 months, on January 12th at his home in 1920 East Kearney.

Renteria called 911 for help because his son was not breathing. When the paramedics came and found the child dead , they realized there signs of blows to the face and demanded the presence of officers from the Police Department . By interrogating the father and his wife, they said the child was suffering a medical condition but Allan acknowledged that he had beaten the face.

Although it was initially given charges of injury to a minor , the district attorney , Isidro Alaniz, recommended that they charge him with the death. Renteria is in the Webb County Jail waiting to go free while being processed in a District Court .

When we first posted on this case, I wondered if there was a back story like this.

Turns out I was right.

Dad DERRICK SUMMERS had threatened to kill Mom and the 2-year-old daughter before. Mom even succeeded in getting a restraining order against him. But the father-friendly courts gave him SUPERVISED VISITATION ANYWAY.

Supervised visitation is a stupid idea, especially when it involves parents who have made active death threats. And supervised visitation is expecially ridiculous when the "supervisor" is an unqualified, untrained "relative" or "friend." How is a "relative" or "friend" going to stop a violent father intent on homicide? Well, a "relative" or "friend" can't do it--even when they aren't in denial about Daddy's potential for violence as many of them are. We've seen many examples of that here at Dastardly Dads.

So now we have a 2-year-old in critical condition--thanks to abuser-friendly/father-friendly policies.

CHARLOTTE, N.C. -- Eyewitness News obtained records that show the man police said tried to commit suicide while holding his young daughter had a restraining order against him.

Police said Derrick Summers and his 2-year-old daughter, Lizziah Summers, were hit as he ran across Interstate 77 on Sunday.

Records show the child's mother was issued an order of protection against Summers earlier this month, after he threatened to kill her and their young child. But Summers was granted visitations, supervised by a relative.

"The mother was trying to provide safety for herself and her child by obtaining a restraining order to keep him away," said Pat Kelly, of Mecklenburg County's Victim's Assistance.

It's unclear how Summers obtained his daughter on Sunday.

Both are recovering in the hospital.

Summers will face attempted murder and child abuse charges.

A father who admitted to purposely burning his 9-week-old son's face apologized Wednesday before being sentenced to six years in prison.

Shawn Roberts Sr., 25, of Warren, pleaded guilty to a charge of endangering children.

"I am sorry for what I have done," said Roberts. "I know now that it was wrong of me. I was not in the right state of mind. I am truly sorry."

Assistant Trumbull County Prosecutor Diane Barber told Judge Wyatt McKay that Roberts' son was taken to the hospital with marks and burns on his face in June.

Hospital officials also said the baby had bruises on other parts of his body.

"The defendant did to his 9-week-old son, whose date of birth was April 22, 2011, hold the child's face over a lit burner on the cooking stove in the kitchen of that residence, and the child sustained second-degree burns to his face," said Barber.

Barber said detectives checked the burner and found that within a short period of time the temperature reached more than 700 degrees.

Roberts first told police his son was injured because he sat out in the sun too long. He later told reporters it was an accident, but prosecutors said he then confessed to polygraph expert Bill Evans and said he did it on purpose.

Warren Detective Michael Currington, who investigated the case, said it was one of the worst child endangering cases he has handled during his career.

He and Barber, however, said the baby is expected to recover.

"If there is anything good that will come out of this, this child will probably not remember any of this," said Currington.

A 2-month-old infant is in the hospital in critical condition following a report last week of a severely injured child.

According to the Gordon County Sheriff’s Office:

Father of the infant William Stanley Cornett, 28, of Plainville, has been charged with aggravated assault and cruelty to children in the first degree.

On Wednesday afternoon, January 11, the Sheriff’s Office received a report of a severely injured infant at Cornett’s home in Plainville. The 2-month-old was taken to Floyd Medical Center in Rome, and was later airlifted to the Scottish Rite Children’s Hospital in Atlanta that same evening.

As of Sunday, January 16, the baby remained in critical condition at Scottish Rite.

The Sheriff’s Office said Cornett was on probation for previous criminal convictions in Floyd County and now remains at the Gordon County Jail pending judicial proceedings. A bond was denied for Cornett by the Magistrate Court on Saturday, January 15.

Police in Memphis say a man suspected of fatally shooting his girlfriend and her parents surrendered to authorities two hours later with his 4-year-old daughter in tow.

Police spokeswoman Karen Rudolph says police were called to the victims' home early Thursday. They found the woman and her father dead. The woman's mother was injured and died later in a hospital.

Rudolph said the shooter fled the scene, but then turned himself in at a police station with the child, who had been in the home but was not hurt. The preschooler was the daughter of the alleged shooter and his girlfriend.

Police have yet to release identities of the victims or the suspect. Charges are pending. Rudolph says police do not have a motive.

ROCK HILL, S.C. -- A Rock Hill man is accused of beating his sons with the ladder from their bunk bed, officials say. Phillip Boyd, 36, was arrested early Thursday on charges of unlawful conduct of a child, according to Rock Hill police records. He is in Rock Hill City Jail awaiting a bond hearing.

The charges stem from Aug. 25, when a school official noticed an 8-year-old boy had three knots on the top of his head, according to a Rock Hill police report. The boy said his father had hit him in the head with a brush and his fist at home.

The 10-year-old brother told DSS officials that their father hits them all the time, the report states. He said his father also uses the ladder of his bunk bed to beat them sometimes.

After a lengthy investigation, Boyd was charged.

Suspect in Orlando mom Michelle Parker's disappearance no longer paying child support

ORLANDO, Fla. —
The prime suspect in the disappearance of Orlando mother Michelle Parker has won a round in court, authorities said on Thursday.

Dale Smith II no longer has to pay child support. Smith is the father of Parker's twins.

However, if Parker is found alive, Smith will have to resume paying child support, said a judge.

The judge's decision comes at an interesting time because WFTV has learned that Smith was fired from his job this week.

The decision means Smith will now be able to get back child support he's paid since Parker disappeared.

The state said it was holding the money automatically deducted from Smith's paycheck since Parker disappeared.

Smith's attorney argued that it did not make sense because the money was sitting in an account and was not being used for the children.

The judge's decision also means that Smith can get the money in that account back and use it on the children.

"It's important that all funds are available to the children," said Smith's attorney, Stanley Silver.

Silver said Smith likely wouldn't have to pay the money retro-actively if Parker is found alive since he has custody of the children.

Silver said he was likely fired from his cabinetry company due to being a suspect in Parker's disappearance and the ensuing media attention.

ALBUQUERQUE (KRQE) - Cops say a 6-year-old boy was sexually assaulted by his father for a couple years. A tipster said day care workers alerted Children, Youth and Families Department (CYFD) to the problem even before that, but nothing happened.

KRQE News 13 told you about Shaun Derossett last week. The accused child rapist who wasn't arrested at first but dropped off at a truck stop until police could get a specialist to interview the boy.

Late Wednesday night a tipster contacted KRQE News 13 with much more to this story.

Shaun Derossett is still in jail from his Christmas time arrest, but a tipster says he should have been there much earlier.

That tipster, who wants to remain anonymous, said Derossett's 6 year-old son told daycare workers that his father was inappropriately touching him. That was three years ago. That tipster said the daycare alerted CYFD in 2009.

Spokesman Enrique Knell said, “It’s difficult to tell what happened in this case and I’m not in a position to confirm or say that we have not received any phone calls.”

CYFD was under a different director back then and Knell said he has staff looking through all their records to see if a tip was called in. The problem is some tips are passed along to other agencies.

“We have reports that are either screened in for further investigation or screened out,” said Knell. “We also have a majority of our calls that are also cross reported to law enforcement or other agencies.”

If the tip is vague CYFD turns it over to other agencies to see what they can find. Once a call is screened out, CYFD said it's out of its hands, “We don't have a process where we track what happens with phone calls that are screened out.”

Knell said any tip is important, but those called in by teachers and daycare workers are even more so because of how much time those educators spend with children.

“Those are calls we look very closely at and that we take very seriously,” said Knell.

CYFD said it's trying to track down if it did get a tip on Shaun Derossett, and say it's possible that they did but no longer have the paper record of that tip. Investigators are having to comb through paper records because CYFD didn't start entering tips into a computer network until 2010.

It's hard to feel anything but major disgust with dad LESLIE "BIRD" SCHULER and the supporting actors who helped him take custody of his son, only to kill him within a month. This dad ignored his son for seven years. He avoided paying child support, didn't bother to do a paternity test, though the state of Alabama offered him the chance. He had no experience taking care of children and had a criminal history of assault.

But unfortunately, we are encouraged to believe that "Dad" is a magic word, and that all dads take little boys on fishing trips and the like, and provide a fine "father's example." This little boy fell into that trap. So did Grandma. So did the courts.

Meanwhile, Dad had obtained a fairly decent job and was getting nailed for back child support. So he pulled a play right out of the father's rights handbook--go for visitation, then push for full custody. So he did, and he was successful.

And not even four weeks pass after he gets the child that this piece of sh-- dad had beaten this little boy to death.

There's an object lesson here: Beware of fathers looking to get their child support zeroed out by going after custody/visitation (Schuler got his retroactively cancelled by the courts). At best, these are not "take the son on fishing trips" kinds of dads. At worst, they're abusers and murderers. We need to stop going gaga over a dad fantasy and look hard at the father's actual track record for once.

Man charged with murdering son seeks change of venue

WORCESTER — The lawyer for a city man charged with murdering his 7-year-old son on Father's Day three years ago asked a judge today to move his client's trial outside Worcester County.

Alan J. Black, who has been appointed to defend Leslie G. Schuler on murder and assault charges stemming from the June 23, 2009, beating death of his son, Nathaniel Turner, told Judge Richard T. Tucker during a hearing in Worcester Superior Court that he did not believe Mr. Schuler could get a fair trial in the Worcester court.

Mr. Black cited “prejudicial” pretrial publicity about the case that he said was likely to have tainted the pool of potential jurors in Worcester County.

The only way to ensure a fair trial for his client, Mr. Black said in his motion for a change of venue, was “to move the venue to a location whereby the potential jury pool has not been affected by the pretrial publicity.”

Accompanying the motion were copies of stories about the case that appeared in the Telegram & Gazette, The Boston Globe, the Boston Herald and other media outlets.

“It's an inflammatory type of case,” Mr. Black said.

Assistant District Attorney Courtney Sans, who is prosecuting the case, opposed the request for a change of venue, which was taken under advisement by Judge Tucker.

Ms. Sans told the judge that prospective jurors could be questioned individually to ensure that they could decide the case based solely on the evidence and that they had not been unduly influenced by anything they might have read or heard.

Judge Tucker said he agreed that the case was one that people were likely to remember to some extent, but noted that the 7-year-old died in 2009 and that most of the publicity closely followed.

“This is three years after the event,” he said.

Mr. Schuler, 39, formerly of 13 Arline St., is alleged to have severely beaten his son and slammed his head against a wall on June 21, 2009.

He is also charged with a series of alleged assaults on the boy between May 27 and June 22, 2009.

Authorities say Mr. Schuler physically disciplined his son after the 7-year-old came to Worcester from Alabama to spend the summer with him and his fiancée, Tiffany Hyman.

The child had been living with his grandmother in Alabama.

Ms. Hyman, 31, is also facing charges. She and Mr. Schuler took Nathaniel to the hospital, bruised and unconscious, on June 22, 2009.

Mr. Schuler has pleaded not guilty to charges of murder, two counts of assault and battery on a child causing substantial injury, assault and battery on a child causing injury, three counts of assault and battery with a dangerous weapon (belt, wall, floor,) two counts of assault and battery and a single count of reckless endangerment of a child.

Ms. Hyman, who is under indictment as a joint venturer, is awaiting trial on charges of assault and battery on a child causing substantial injury, assault and battery on a child causing injury, permitting an assault and battery on a child causing substantial injury, reckless endangerment of a child and being an accessory, after the fact, to assault and battery on a child causing substantial injury.

A trial date has not been set.

Also taken under advisement by the judge today was a motion filed by Mr. Black asking that the cases of Mr. Schuler and Ms. Hyman be tried separately and motions by Mr. Black and Ms. Hyman's lawyer, Michael C. Wilcox, seeking dismissal of some of the charges lodged.

Judge Tucker continued both cases to Feb. 29.

The lawyers said a trial date may be set at that time.

A FATHER assaulted his disabled teenage son because he repeatedly played songs on his iPhone at high volume in their one-bedroom flat.

The father pleaded guilty at Bristol Magistrates' Court to twice assaulting his son by beating at their North Bristol home last year.

A court order was put in place by magistrates yesterday in order to protect the identity of the child.

Laura Opie, prosecuting, said: "The victim in this case has a series of health issues and disabilities.

"He has mild cerebral palsy, moderate learning difficulties and ADHD (attention deficit hyperactivity disorder).

"On September 30 he told the head teacher at his special educational needs school that his dad had assaulted him the previous evening.

"He said he had done that by smacking him in the face and by head butting him. Examinations confirmed a lump to his head.

"On October 4 he said he had been hit on the wrist where there was redness and swelling.

"In a later statement regarding the first offence he said he was headbutted and pinned down on the sofa and had been punched and kicked.

"He said his father was angry with him for being naughty but that he hadn't done anything naughty.

"His father attended the police station voluntarily and admitted he and his son had a violent relationship and that they would wind each other up because of the lack of space.

"He added that his son would play the same songs on his iPhone over and over again at high volume.

"He admitted the headbutt but described it more as pushing his son away with his head."

Miss Opie said Social Services had assessed the situation and think it best the boy remains with his father.

Zoe Lash, defending, said: "There are a number of behavioural issues and he has found it very difficult to cope," Miss Lash said.

"He accepts that he has not always behaved appropriately in situations that have occurred.

"Clearly one of the main problems has been the lack of space for the two of them. It would be fraught between a father and son in a normal situation and this is not a normal situation."

She said the father was previously of good character.

Magistrates adjourned the case for a probation report and the man will be sentenced next month.

A Murray County grand jury has indicted a Chatsworth man for felony murder after an autopsy report referred to “shaking” head trauma in the death of his daughter in November 2010, a court officer said.

Isaac Whaley, formerly of a G.I. Maddox Parkway address where the alleged incident occurred, was charged with felony murder and cruelty to a child on Wednesday, said Assistant District Attorney Bert Poston, who presented the case on Monday.

Whaley took his four-and-a-half-month-old daughter, Jaidyn Alexis Whaley, to Murray Medical Center unconscious on Nov. 17, 2010, and she died two days later at T.C. Thompson Children’s Hospital in Chattanooga, officials said.

“An indictment warrant was issued ... (and) there is a $50,000 bond that was agreed to by his attorney,” Poston said. “He is expected to turn himself in later this week.”

Whaley is currently not represented by counsel, according to an attorney who represented his family before the indictment but said his firm would most likely not continue as attorneys of record.

An eight-page autopsy report from the state crime lab dated June 13, 2011, detailed in an “opinion” section that the cause of Jaidyn Whaley’s death was “traumatic head injury” and the manner of death was “homicide.”

“The autopsy discloses ... findings (that are) consistent with accelerated rotational (shaking) mechanism of the head trauma,” the autopsy report states. “A focus of occipital scalp hemorrhage represents a probable blunt force component.”

Poston said grand jury findings must be returned in open court to the presiding judge, and the first chance to do that was Wednesday.

Man Accused of Injuring Infant Son

A man from Edwardsville is locked up after police said he caused severe injuries to his son when the child was just six weeks old.

The alleged abuse took place last August, but police arraigned Kevin Getz, 25, Wednesday morning.

Court papers show the child suffered numerous injuries, including fractured legs and ribs and bruises. Police said the infant's father admitted he is the one who caused those injuries.

According to court papers, the abuse happened last summer at the baby's mother's apartment in Edwardsville. Police said the mother noticed the boy had a swollen leg, and took him to the hospital last August.

Tests revealed far worse injuries, such as fractured legs and ribs and bruises. Police said Getz admitted causing those injuries shortly before he was about to take a lie detector test.

"It wasn`t that the investigation took so long. We had to do a lot of medical testing to make sure it wasn`t something that leads us to believe something else caused the injuries. Just waiting for test results to come back, that`s why it took that long," explained Edwardsville Police Officer Mike Lehman.

Neighbors said they can't believe someone would hurt a six-week-old baby.

"I have a baby on the way. I`m pregnant right now. Someone like that living two doors down from me. I`m disgusted. It makes me sick to my stomach," said neighbor Star Rowles.

"I think it`s sad. They both should pay. I've seen the baby. He was adorable. The cutest little thing you ever wanted to see," said neighbor Debra Ricek.

Officer Lehman called this one of the most disturbing cases of abuse he's ever seen.

"I have a child the same age. It's very disturbing. No law enforcement officer would want to investigate this. It`s part of our job we have to do it," said Lehman.

Getz is being held at the Luzerne County jail on $50,000 bail.

Police added the mother's three children, including the six week old, were removed from her home by Children and Youth Services. The prosecutor working this case said the investigation continues and charges against the mother cannot be ruled out.

There is little doubt that dad DENNIS LEROY ROSS, JR. is a hot-headed, irrational, and violent man. Because the baby has a birthmark resembling his brother's. So? That's not the baby's fault. And I assume that you all share a parent or parents in common. Could that explain a similar genetic inheritance? Honestly, this guy is too dumb and repulsive to breathe.

And Mom's great crime and why she lost custody to CPS? Besides having a weakness for incredibly ugly and stupid men? I'm just going by what is written here, mind you. She was confused as to the timeline because she was on painkillers for a CAESARIAN SECTION (which is major surgery) and was sleeping while Daddy was supposedly "caring" for the baby. But even with the meds, it was MOM who noticed that something was wrong with the baby and apparently got him to the hospital.

Yet both mom and dad are being treated the same. No custody, no visitation. This is why we keep hearing that mothers and fathers are "equally" abusive when they are not.

Holland — Shortly after Jessica Mullins’ baby was born, she and her boyfriend, Dennis Leroy Ross Jr., noticed a small birthmark on his neck — much like the one Ross’ brother and his children had on their necks.

In Ross’ mind, it was proof Ross was not the father of the newborn, Mullins testified Wednesday in Holland District Court.

The idea that his girlfriend was allegedly cheating on him with his brother infuriated Ross — and might explain why Ross allegedly caused such severe head injuries to baby Dennis Ross III. The 4-day-old baby had to undergo emergency surgery.

“He said, ‘I threw him down. He is not mine,’” Mullins testified in Holland District Court on Wednesday.

That’s the scenario the prosecution tried to show at Ross’ probable-causing hearing on first- and second-degree child abuse charges.

Ross, 38, told police the baby fell off an ottoman chair Feb. 1, the day he and Mullins brought the baby to the Holland Hospital emergency room for head trauma.

Hospital staff became suspicious, however, when they examined Dennis Ross III’s injuries, Brian Cote, a physician working that day, testified.

Cote quickly determined the bleeding in the baby’s brain was life-threatening, he said. The baby was transferred to Helen DeVos Children’s Hospital in Grand Rapids for emergency surgery.

There, physician Sarah Brown found Dennis Ross III’s injuries were not consistent with a fall from an ottoman chair, she testified.

“(The injuries) indicated something very violent had happened to the baby,” such as a blow to the head, said Brown, who specializes in child abuse cases.

Yet Ross — who said he had been watching the baby — could not explain to social workers how the baby fell. Ross told them he’d fallen asleep.

“He said things like, ‘I should’ve stayed awake,” and “I feel really bad about it,’” Bethany Kuik, a social worker for Spectrum Health, testified.

When she took the stand, Mullins — who is no longer dating Ross — seemed to have difficulty recalling the timeline of events leading up to the incident, which was nearly a year ago.

She said she believed the baby fell from the ottoman on Ross’ watch around 5:30 a.m. She was sleeping, too, and had taken prescription painkillers several hours before the incident for pain she had after her Cesaerean section, she said.

When she tried to nurse the baby around 1:30 p.m., she saw the swelling on his head, she said.

On the way to the hospital, Ross asked Mullins what she planned to say if doctors asked how the baby was injured, Mullins said.

“He said, ‘You better tell them one of the (other) kids did it,’” she testified.

Over the next months, Ross would frequently change his story — denying any wrongdoing one day and admitting his guilt the next, she said.

Since the incident, Child Protective Services removed Dennis Ross III from the custody of Ross and Mullins. They do not have any visitation rights. The baby is currently in a foster home.

Judge Susan Jonas said although there may be questions about Mullins’s credibility, there was enough evidence to send the case to trial in circuit court.

She changed Ross’ bond from a $25,000 cash surety bond to a $5,000 10 percent bond, at the request of the defendant’s attorney, who said Ross has been responsible in attending other custody hearings.

Ross’ next court date has not yet been set, but the case has been forwarded to Allegany County Circuit Court.

New information is coming to light about what led to the child abuse charges against a father and his girlfriend in Sunbury.

Both are accused of attacking a two-year-old boy several times, authorities said at times, so severely the child suffered broken bones and bruises.

The woman accused of beating the child told police she wants to be a pediatric nurse, and only a psychopath would do that to a child. But those dreams may be put on hold. Grabbing and squeezing the child's face, beating him and yelling at him are just some of the things the couple is accused of doing to the two-year-old boy.

Police said the two-year-old child was severely beaten last week by his father and his father's girlfriend at their home in Sunbury. Police arrested Jason Philhower and April Baker on charges of child abuse and assault. The child's aunt was at the home when she said she saw Baker pick up the boy by his ankle and throw him on the couch. The boy's aunt took him to a hospital for a broken leg, several bruises and a bloody mouth. Police said it's not the first time Baker and Philhower have abused the child.

According to the paperwork, another adult was staying at the house at the time and saw Baker abuse the boy throughout the week, even putting him in time out for hours on end. The boy's aunt told police she heard Baker yelling at the child saying,"Keep it up and you will not get anything to eat " and "I wish you would get out of my life."

Baker denies the accusations. She told police, "Only a psychopath would do that to a child, and I would never do that because I want to be a pediatric nurse."

"If they don't want the child and they're abusing it, they should put it in a foster home where it can be properly taken care of," said neighbor Debra Houseknecht.

Some of the couple's neighbors in Sunbury said the situation hits too close to home. Jesse Savidge lives two houses away from the family.

"I have my own kids, and I have a grandson. It worries me to bring him here to visit," said Jesse Savidge.

"When it comes to child or animal abuse. I get very upset," said neighbor Janet Dockey.

Jason Philhower and April Baker are scheduled to appear in court on January 26. They are both in jail on $75,000 bail.

A young father from Wilkes-Barre accused of shaking his baby was ordered Wednesday to stand trial.

Kashawn Butler, 17, was arrested in early December after his three-month-old son suffered a severe head injury.

Police said Butler was feeding the baby when the infant vomited and began crying. Investigators said Butler admitted shaking the baby.

Officers went to the home after a report of an infant who was not breathing.

The baby was flown to Geisinger Medical Center near Danville and diagnosed with massive head injuries consistent with shaken baby syndrome. According to investigators, doctors said it is unlikely the baby will recover.

East Alton, IL - Last week, police arrested Harry A. Woods III, 43, after he allegedly attacked his son and held a meat cleaver to his throat. The violent episode began over a batch of burned biscuits meant for a Sunday breakfast, according to Sgt. Charles Keshner of the East Alton Police Department.

Woods’ daughter placed the biscuits in the oven and left to visit another relative, reminding her family to keep an eye on them, police said.

However, no one checked the baking biscuits and when the elder Woods discovered they had been burned, he became enraged, turning his anger on his son, Harry Woods IV.

The younger Woods reportedly told his father: “They’re just burnt biscuits, we’ll make more.”

Apparently, that did not sit well with the hungry man who then smacked his son over the head with a serving platter, bit his finger and threatened to kill the 24-year-old with a meat cleaver, according to police.

Woods has been charged with aggravated battery and held on $20,000 bond.

A 36-year-old father was arrested Sunday night after police were called to a Meridian residence to investigate a possible case of child abuse.

Adam Christopher Simonds was booked into the Ada County Jail on a charge of felony injury to a child.

Simonds was arrested after investigators found evidence that Simonds had put his 13-year-old daughter into a stranglehold, according to Meridian Police Deputy Chief Tracy Basterrechea. The girl's injuries did not require hospitalization Basterrechea said.

The child is now in the custody of another parent, Basterrechea said.

Simonds is set to be arraigned at 1:30 p.m. Monday at the Ada County Courthouse.

Family: Dad Was Waiting With Gun For Teen
Plymouth Man Accused Of Shooting Son, Self

BOSTON -- A Plymouth father has been accused of shooting his teenage son and turning the gun on himself on Jamies Path off Route 80 near the Colony Place shopping area.

Officers said the incident started as a domestic dispute about 5:30 p.m. Richard Panepinto, 53, was found in the driveway with an apparent self-inflicted gunshot wound to the chest.

"He's a good kid. He is a real good kid. He just doesn't deserve this," said Rita Webster, the teen's grandmother.

It's been a torturous 24 hours for the boy's grandmother, who said his father was waiting in the driveway for him to come home Tuesday.

"He was coming home from basketball practice. Apparently, he was waiting there," Webster said.

Police said Panepinto shot his 15-year-old son, Shawn, and then shot himself in their driveway. A neighbor carried the boy to safety.

"He had said, 'Am I going to die?' He said, 'Make sure you call my mom.' I said, 'No Shawn. Just relax.' He said, 'Call my mom. Tell her I love her,'" neighbor Mark Miller said.

Family members said Shawn was shot once in the abdomen. They said it's not the first time his father's been violent. Five years ago, neighbors say he lashed out at the boy's mother.

"She was beaten with a bat. Shawn called 911," neighbor Bob Nash said

Court records show he was charged with assault with intent to murder after beating his wife with two bats in a bathroom.

Family and neighbors said there's a long history of trouble.

"We were concerned with all the weapons they pulled out. I don't know how he gets the gun again," Nash said.

"I couldn't imagine it happening to my family. We are an extremely close family," Webster said.

Police said both were still alive and were in critical condition in Boston hospitals. Panepinto is under police guard and is charged with assault and battery with a dangerous weapon, armed assault with intent to murder, unlicensed possession of a firearm and domestic assault and battery.

A 23-year-old man has been sentenced to 16 to 54 years in prison for the 2010 beating death of his 3-month-old son.

Andrew Mendoza in December pleaded guilty to six counts of child abuse for the death of Angel Mendoza. As part of a plea deal, prosecutors dropped a murder charge.

Andrew Mendoza was sentenced Jan. 5 by District Judge Douglas Herndon.

According to court documents, Mendoza at first said his son's injuries were caused by a fall in the bathtub.

But doctors didn't believe him when the boy was first taken to University Medical Center with a skull fracture and a lacerated liver in February 2010. The boy also had adult-sized bite marks and bruises all over his body and widespread retinal hemorrhaging consistent with having been shaken.

Mendoza later admitted to investigators he physically abused the boy, authorities said.

Angel Mendoza died March 18, 2010, according to the Clark County coroner's office.

Second Infant Death Raises Questions About Father

CARTER COUNTY, Tenn. -- A father charged with murder in North Carolina has local authorities taking a second look at how one of his other children died three years ago.

There are new questions about the 2008 death of an infant at the Lynn Ridge apartment complex in Elizabethton. Officers say the child's death appears very similar to a case in Avery County, North Carolina, where Jacob Ollis faces second degree murder charges.

"My understanding from talking to the sheriff up there, this death appears to have happened while he was sleeping with the child," said Carter County sheriff Chris Mathes.

Officers say Ollis was with both infants, and they both died from similar causes. We stopped by the Elizabethton Police Department and picked up a copy of the report from December 13, 2008. In the report the child's mother told officers the baby was sleeping on the bed with Ollis, and the baby was face down when she found it.

The mother accused Ollis of rolling over onto the child. The death was ruled accidental.

After picking up the report we spoke with the original detective on the case. He says based on the new case, he wants to take a second look at the facts of the original.

"This being the second death related to this parent is extremely alarming to me," Mathes said.

Elizabethton police told us they hope to make a decision about re-opening a criminal investigation into the first child's death in a couple of days.

Jacob Ollis is still in the Carter County jail as of Tuesday night. He is waiting to be extradited back to Avery County, North Carolina.

If so, do we know for a fact that she died of natural causes? You have to wonder when she had a psycho like this as a boyfriend/husband. Many important unanswered questions here.

An unidentified Covington County woman is suing Alabama Department of Human Resources, the Covington County Department of Human Resources and 13 other defendants in which she accuses employees of failing to protect her nephew.

The child’s father, Jerry Cowan, identified only as “J.C.” in the lawsuit, was sentenced to 40 years in prison in September after pleading guilty to domestic violence II and aggravated child abuse. He was charged after school officials reported signs of horrible physical abuse. Investigators said he used a steam iron and bamboo walking cane to abuse his child.

The suit, filed by Birmingham attorney Tommy James of Morris, Haynes and Hornsby, identifies the plaintiff as “D.B.,” and the victim’s aunt. In a press statement released when the suit was filed the attorney said, “Multiple entities and individuals, including the boy’s aunt, notified DHR numerous times of suspicious that the child was being abused by his father.”

James said the child’s injuries are an example of systematic problems within DHR in the state.

“This is really the worst case of physical abuse that I have ever seen in my almost 15 years of representing abuse victims,” James said. “The pictures of my client show scarring and mutilation worse than prisoner of war photographs I have seen where the soldiers had been tortured. This is one of the most tragic cases I’ve handled. It is shocking that the DHR workers did nothing to protect this little boy.”

The suit claims that DHR employees “acted willfully, maliciously, fraudulently” in failing to remove the child from an unsafe environment and asks for compensatory and punitive damages plus costs.

Named individually in the suit are Alabama DHR Commissioner Nancy Buckner; former Covington County DHR director Cathy Leverington; and local case workers and supervisors.

Contrary to all the typical whining you hear about fathers being "shut out," realize that this volatile and dangerous nutcase already had joint custody. But he wanted more! He wanted complete control! He wanted Mom shut out! In his last court appearance, he wasn't successful in getting what he wanted. So to show everybody that Daddy Wasn't Happy, he embarked on a mass shooting spree that killed his son's mother and many others. And now he's pleaded not guilty. Riiight.

The man accused in a mass shooting at a Seal Beach beauty salon in October pleaded not guilty Wednesday to eight counts of murder with special circumstances and a single felony count of attempted murder.

Scott Dekraai wore a mustard-yellow jumpsuit and glasses, his hands hancuffed in front of him. He was kept behind a barrier and did not speak during the hearing in Santa Ana.

Dekraai will next appear in court Jan. 27. The shooting was the largest mass killing in Orange County history.

Dozens of family members and friends of the victims were at the hearing. Before letting them enter the courtroom, however, an Orange County sheriff's deputy warned them to have no outbursts, saying he knew there was a lot of emotion connected with this case.

Some of those in attendance wore pins with loved ones` faces. Others wore T-shirts with hearts bearing the words "Support in love Seal Beach."

Paul Wilson, whose wife, Christy was killed, wore four pins with her photo and had tears in his eyes when he left the courtroom.

"He knows we`re here," Wilson said of Dekraai. "He can feel it. I`m not here for him; I`m here for Christy. My life literally changed in two minutes."

A grand jury Tuesday indicted Dekraai in connection with the Oct. 12 shooting at Salon Meritage, where his ex-wife, Michelle Fournier, worked.

Prosecutors are seeking the death penalty in the case. Dekraai pleaded not guilty in November at an earlier arraignment.

He is accused of walking into the crowded salon and shooting Fournier before turning his gun on others. Dekraai had been involved in a bitter custody dispute with Fournier over their 8-year-old son, according to court records.

Note that the narrative explantion here behind this murder is pretty convoluted and hard to put together. We know, obviously, that dad WILBERT FRANK JR., murdered his wife in front of their teenage daughter. That's simple enough.

Reading a bit more carefully, we see that this separated couple were meeting so they could "exchange winter clothes and toys for his children." So obviously, Daddy STILL HAD ACCESS TO THE KIDS, or this exchange would have been pointless, right?

Reading further on, we see that Daddy has a history of domestic violence against BOTH THE WIFE AND KIDS--but STILL HAD CONTACT/ACCESS ANYWAY. The daughter's so-called denials don't really mean much in this context; abuse victims are frequently pressured to recant. And the proof is in the pudding. Daddy really was a violent man who eventually shot and killed his wife in cold blood.

And we also see that Daddy continually used a "child custody dispute" to further harrass and control the mother. It's not clear here whether Mom really "denied" him visits or not, since we only have Daddy's word for it here. But it seems to me, in retrospect, that if she had, she no doubt understood that Daddy was a dangerous and volatile man--and his actions proved that this assessment was absolutely correct. Too bad nobody gives mothers credit for their experiences and judgements BEFORE they are killed by their abusers.

The irony, of course, is that Mom was murdered WHILE SHE WAS FACILITATING THIS FATHER'S ACCESS TO THE KIDS. Not blocking or denying visitation. But I'm sure all the FR forums are finding a way to blame Mom anyway. They always do. In their twisted world, criminals are never responsible for their own actions.

A Temecula man was sentenced to 50 years to life last week for shooting his wife to death in front of their teenage daughter outside a San Jacinto Mexican restaurant.

The sentence virtually ensures Wilbert Frank Jr., 50, will die in prison.

He was convicted last month of murdering Sylvia Frank, his estranged wife, who had met him Nov. 30, 2010, to exchange winter clothes and toys for his children. The couple had separated that August, and Wilbert Frank had moved from Temecula to Hemet.

Frank was caught on video pulling a shotgun from the trunk of his car instead of toys. His daughter ran inside seeking help, but Sylvia Frank died in the parking lot of Santana’s Restaurant off State Street in San Jacinto.

During the sentencing hearing Friday in a French Valley courtroom, Wilbert Frank and family members made statements before the judgment was read, according to court records. Frank faced a mandatory sentence of 25 years to life and another 25-year sentence for committing the murder with a gun.

Before the case was presented to a jury, Frank’s defense attorney’s tried to argue that Frank was involuntarily intoxicated by carbon monoxide poisoning from a malfunctioning fireplace in the home he moved to after the separation, and therefore he was unaware of his actions when he killed his wife.

The judge did not allow the jury to hear the argument, calling it irrelevant and too far-fetched.

Prosecutors said Frank had a history of domestic violence with his wife and children. In a 2008 case, he was convicted of misdemeanor spousal battery but acquitted of a felony charge after his daughter admitted in court that she exaggerated a domestic violence report to police.

Defense attorneys told the jury that since the separation, the couple was locked in a bitter custody dispute and Wilbert Frank was continuously denied visits with his children.

The defense admitted he shot and killed Sylvia Frank, but asked the jury to find him not guilty of murder.

Research shows a strong link between domestic violence and child abuse.

Various studies show that in 30 to 60 percent of families where there is woman battering or child maltreatment it is likely that both forms of abuse exist.

That's according to Jeffrey Edleson, a University of Minnesota professor and authority on children exposed to domestic violence.

Jackie Johnson, the children's services supervisor for Harmony House, said she's seen this in some of the children she cares for.

"When a woman is being abused, there's a greater likelihood of child abuse," Johnson said. "Some of our girls have been sexually abused as well."

Researchers have found that the children are also more likely to be abused in larger families. Abused mothers might, in turn, abuse their children.

Florida psychologist Lenore Walker, who has studied battered women extensively, found that battered women were eight times more likely to use harsh discipline on their children while living with the abuser.

"They're much more likely to use abusive techniques than when they're not in abusive relationships,"

Walker said. "I think there's just a sense of desperation to get the kids quiet or do whatever the batterer wants them to do."

Johnson said mothers sometimes come to her for advice in how to discipline their children. She showed one mom how she encouraged the children when it was time to pick up toys by singing a song.

Kendall Seal, an attorney for Legal Services of Southern Missouri, said if the Springfield community wants to get serious about chid abuse, it needs to confront domestic violence.

Seal said, "If we're not dealing with the family unit where we know there's violence, are we really that surprised when children end up dead or battered or used as pawns?"

Domestic violence advocates say batterers sometimes use child custody proceedings as a way to continue to exert control.

"They can control so much of what happens to the children," said Jackie Johnson, the children's services supervisor for Harmony House. "They can make sure that when the children are with them there won't be any boundaries. When you think about it, it's all about them. They're doing this to hurt her. They're hurting the children, and they don't care."

Missouri is what's considered a "friendly parent" state, meaning that state law tells judges to presume that joint custody is in the best interest of the child. Parents are supposed to share custody so that the child has "frequent, continuing and meaningful contact" with both parents.

But Kendall Seal, an attorney with Legal Services of Southern Missouri, said this language can lead to problems when there's domestic violence.

"How can it be meaningful if the child is watching his mother being abused?" Seal asked. "There's not a lot of discussion about what that means in terms of domestic violence."

Missouri law requires divorce judges to consider the mental and physical health of people in the case and a history of any abuse. If a judge decides that awarding custody of a child to an abusive parent is in the child's best interest, the judge must explain this decision in writing.

Seal said this can happen if the abusive parent successfully manipulates the court system.

"Victims of domestic violence can be made to appear less healthy and less stable in court, especially without legal counsel, which is a result of the abuse they have suffered," Seal said. "Abusers capitalize on this appearance and present a cognitive frame to the court that they are the 'responsible parent,' and the victim is in fact mentally unstable and financially unwise. Far too often this results in abusers being given too much control over children and the non-abusive parent."

Springfield attorney Mark Millsap said a judge might award custody to an abusive parent if there is domestic abuse on both sides.

"The judge typically does not have the choice of two perfectly functioning, stable and emotionally supportive parents to place custody," Millsap said. "The judge must view the custodial placement from the perspective of the best interests of the child, all within the parameters of the controlling statutes. That is not an easy thing to do."

Millsap said judges here take domestic violence very seriously when deciding child custody.

"If they suspect there's any credibility to the allegation, I think they tend to err on the side of caution," Millsap said.

About two dozen other states such as New Jersey have stronger statutes than Missouri for addressing domestic violence and child custody decisions. These laws, modeled after language developed by the National Council of Juvenile and Family Court Judges, say that the court assumes -- unless someone proves otherwise -- that it is not in the best interest of the child to be placed in the custody of a perpetrator of family violence.

Zachary Wilson, the development director for the Missouri Coalition Against Domestic and Sexual Violence, said he thinks Missouri should have the stronger language. The coalition has not taken a position, and there's no pending legislation that would make that change.

"I believe it should be that way," he said. "I don't believe it's going to get that way any time soon."

Toby Kleinman, a New Jersey attorney who is an associate editor of The Journal of Child Custody, said a schism sometimes exists between what the law says and how it is implemented. She said batterers, who are often male, often appear more professional and believable while the ex-wives come across as hysterical and angry.

"If you've been beaten time and time again, you might have post-traumatic stress syndrome," Kleinman said. "One of the hallmarks of PTSD is anger. Well, you're not supposed to be angry. One of the things that family courts want and expect from custodial parents is that they can set aside their anger for the welfare of the child. That's not an unreasonable request, except when you've been brutalized by the other parent."

Americans are always "shocked!" when some father who lives at the end of a cul-de-sac murders his family in cold blood. He was so "loving"! Such a "good guy"! And how do they know this? Because they guy who mowed down three people once waved to them while mowing the lawn. In fact, most people outside a traditional village or settled urban neighborhood really DON'T know their neighbors. They have NO IDEA how Daddy threatens or treats his family behind closed doors.

In the same way, people are just SHOCKED that "doting" dad JOHN MILLER slaughtered his 8-year-old daughter and her mother, and abandoned a terrified and shell-shocked 4-year-old daughter at the murder scene. A terrified girl of four was found hiding just a few feet away from the bodies of her murdered mother and eight-year-old sister.

Omelia Miller was discovered cowering by police officers inside the family’s semi-detached property on Saturday after her father was arrested at a nearby nature reserve.

He was being held last night on suspicion of murdering his partner, Sarah Laycock, a 31-year-old primary school teacher, and eight-year-old daughter Abigail.

Friends said the couple had experienced relationship problems in the past and may have been struggling financially.

It is understood work had dried up for John Miller, a 36-year-old plasterer, and that he had been spending increasing amounts of time weightlifting in a gym.

He is expected to have a psychiatric assessment in the coming hours before he is formally questioned by detectives.

His daughter Omelia was taken to hospital as a precaution and treated for ‘minor injuries’ before being discharged.

'She is now being cared for by her maternal grandmother and is expected to be interviewed by specialist officers in the next couple of days as a potential witness.

It is not yet known if she saw her mother and sister being murdered at the family home or was hiding moments before the killings took place.

A friend said she had been left ‘shaken’ by her ordeal and suggested that officers would wait until they had quizzed her father before speaking to her.

Miller was arrested by officers at 4pm on Saturday at the Fairburn Ings nature reserve, five miles from his home in Garforth, West Yorkshire.

He was initially seen by walkers struggling with a leg injury. They approached him and asked if he needed any help before calling for an ambulance.

Paramedics arrived at the scene and began treating Miller, but as they tried to close the ambulance doors he became violent and they called the police.

He is then said to have stripped off in an attempt to break free. Six officers soon arrived and restrained him before eventually taking him to Pinderfields Hospital.

While being treated there, Miller is understood to have made ‘one or two disclosures’ to police which led them to the bodies of his partner and daughter.

The street was immediately cordoned off and forensic officers entered the £150,000 property.

The bodies were last night removed from the property in a private ambulance ahead of a post-mortem examination to determine exactly how they died. Miss Laycock, whose brother is believed to be a serving police officer, went to the same school as Miller. They moved into their current home five years ago.

Last night, friends and neighbours described Miller as ‘a doting father’ who would have done anything for his two children.

He was out with them in the street on Christmas Day as they had a first ride on their new bicycles.
Suzie Parker, 35, who works in a nearby newsagent, said: ‘The two girls were in here on Friday after school with their dad buying sweets. He was a doting father. You could just tell. I’m a parent too and you could tell that he adored them. Whatever they wanted they got.

‘The youngest would take her time choosing the sweets whilst the eldest would hurry her along.

‘They were in here most days. I keep seeing that four-year-old’s face in my head. I just can’t believe what has happened.

‘They appeared to be such a close family. There was no hint of a problem. He was just a typical soft-touch father, as far as I was concerned.

‘He absolutely adored them. There was nothing to suggest that this might happen.’

Neighbour Audrey Bottomley said: ‘He loved the children. I can’t understand it. I was quite shocked when I heard.’

Another neighbour, Janet Hutchinson, said: ‘I last saw the girls riding their bikes on Christmas Day. They just seemed a normal family.

‘We are all shocked. You just don’t know what is going on in other houses, do you?’

A regular at the local Garforth Working Men’s Club said work had dried up for Miller and that he had been spending more and more time in the gym.

The local man in his 50s, who did not wish to be named, said: ‘John had been getting less work so he’d been spending a lot of time at the gym bulking up.’

My question is why did this volatile nutcase have access to this child? Crazy moms are perfectly capable of giving birth and creating havoc on their own. But crazy dads have to be GIVEN ACCESS to a child to pull this kind of bullsh**. So how did Daddy get access to this child? Who gave it to him? Where is the mother anyway?

Father, 2-year-old daughter seriously injured in suicide attempt

CHARLOTTE, N.C. -- Police have released new details after a man and his daughter were hit along Interstate 77 Sunday night.

Police said a father ran into traffic near Remount Road in an attempt to commit suicide while holding his 2-year-old daughter about 8:20 p.m..

They both suffered major injuries, police said.

Police said the accident caused a multi-vehicle pile-up.

The father will be charged with child abuse inflicting serious injury and attempted first-degree murder, police said.

All northbound lanes of I-77 were closed for several hours following the accident. The interstate reopened just before 11 p.m.

The man’s identity has not been released by investigators.

When I got to the part about the spiral fracture, I had already guessed this was a diaper changing incident--and I was right. There are a surprising number of injuries just like this (see tab below). And they're nearly always committed by male caretakers, especially young male caretakers like UNNAMED DAD. Partly it's the lack of patience, either through nature or nurture. But men also tend to underestimate their upper body strength. There are not a lot of women, unless they lift weights, who would even be physically capable of twisting and breaking a baby's leg. Speaking of women, where is this baby's mom?

Iowa father arrested after infant's leg broken

WATERLOO, Iowa— A Waterloo father has been arrested on suspicion of child abuse after doctors discovered his infant suffered a broken leg.

The Waterloo Courier (http://bit.ly/xt2DMs) says police were called to Covenant Medical Center on Thursday for a 9-month-old child with a suspicious injury. Doctors determined the child had a spiral fracture to his femur.

The father told police he believed he may have broken the baby's leg while changing a diaper, but authorities say that scenario is inconsistent with the child's injury.

The 23-year-old father was arrested and faces a charge of felony child endangerment.
