Clark, Macradee Aegerter and Barrett Tryon, updated on: 02:56pm, May 22, 2013 <br /><br />LEXINGTON, Mo. — The father of a 10-week-old girl who died after suffering a fractured skull and brain damage has been charged in her death. <br /><br />Prosecutors charged Alex Gilbert, 24, with one count of second-degree murder. <br /><br />According to the Lafayette County Sheriff’s Office, deputies responded to a home on Linn Road in southwestern Lafayette County on May 17. An infant was reported to be unresponsive and was having trouble breathing. <br /><br />The child was transported to St. Mary’s Hospital in Blue Springs were medical staff discovered the infant had sustained a number of injuries. "The extent of damage is unknown at this time." <br /><br />Her dad, 18, was arrested Wednesday for investigation of first-degree assault of a child. He has not been formally charged. <br /><br /> Everett police spokesman Aaron Snell said the girl's mother appears not to have known anything about the alleged abuse. <br /><br />"He is the only suspect based on what has been said and written," Snell said. <br /><br />The Everett couple called 911 on Wednesday after the baby seemed lethargic and had trouble breathing. She was taken to Providence Regional Medical Center Everett before being transferred to Children's. <br /><br />Doctors became suspicious of the parents' explanations for how the injuries occurred. They called state Child Protective Services and the Everett Police Department. <br /><br />The suspect initially told authorities that he was holding the girl in a bedroom when she pushed her body up and hit her head against his chin. The mother said she had no idea how her child could have sustained a head injury. <br /><br />In a follow up interview with a detective, the suspect allegedly admitted to getting angry when the baby was fussy and wouldn't stop crying. <br /><br />"He described shaking (her) in vigorous, short, repetitive movements in an attempt to stop her fussiness," the detective wrote. "He <strong>described shaking her once or twice a week since she was two weeks old</strong>." <br /><br />He allegedly said the baby began having problems after he shook her Wednesday. Trial began Monday with jury selection, opening statements and the first witness, Everette's mother, being called to the stand. <br /><br />By Mattie Cook <br />Updated May. 20, 2013 @ 10:26 pm <br /><br /> Ionia, Mich. — Keith Thibeault of Portland has been charged with one count of felony murder and one count of child abuse in the first degree in the March 2012 death of his 3-month-old son, Everette. <br />Thibeault's trial began Monday with jury selection, opening statements and the first witness, Everette's mother, being called to the stand. <br /><br />Thibeault's trial is taking place in the Ionia County 8th Circuit Court with Chief Judge Suzanne Hoseth Kreeger presiding. Jury selection began at 9 a.m. and lasted until just after noon. <br /><br /> Ionia County Prosecuting Attorney Ron Schafer explained the timeline of events leading up to the incident to jurors. Thibeault got off from work early on March 23, 2012, and picked up his twin sons, Everette and Keagan, from day care after 9 p.m. After getting home, he put the boys in bed and then at 4 a.m. woke to feed both sons. He placed both boys on the couch and when he looked away, Everette was on the floor. At 6:12 a.m., Thibeault called 911. <br /><br />According to Schafer, the defendant's story has undergone many changes based on the audience. <br /><br />The first responder to the 911 call was Thibeault's mother-in-law, who then informed Nicole Thibeault, her daughter, that Everette would be on his way to Sparrow Lansing Hospital. <strong>Nicole worked as a medical secretary at Sparrow Lansing Hospital.</strong> <br /><br />After Everette arrived at Sparrow, a series of tests were conducted to determine the cause of his injury. Schafer argued that the medical experts assisting his case have posited that the injuries Everette had could have been caused by shaking or slamming his head against a soft surface. According to Schafer, <strong>Everette died from inflicted, severe brain injury</strong>. <br /><br />Along with questioning Keith Thibeault's interest in his child while at the hospital, Schafer reminded the jury that they are expected to determine the results of the case based on whether or not the defendant is guilty beyond a reasonable doubt. Schafer reminded the jury that reasonable doubt does not mean that it is beyond possibility, but rather that the decision should be based on reason and common sense. <br /><br /> "We are going to ask that you hold his (Everette's) father accountable for his actions," Schafer said to the jury. <br /><br /><b>THE DEFENSE</b> <br /><br />The opening statement provided by the defense was led by criminal defense attorney Kevin Peterson, who told the jury that it is important to get a second opinion, whether because of a medical issue or if on trial. They'd often seen him and his wife take their two children to the park, and they'd pop out to local restaurants for dinner together. <br /><br />So why on earth did Julian Stevenson apparently brutally kill his own children? How could a father turn on his own flesh and blood and attack them so viciously? <br /><br />The 48-year-old Briton has <b>reportedly admitted cutting the throats of his two children — Matthew, ten, and Carla, five — after he was allowed to see them alone for the first time since his bitter divorce </b>from their French mother. <br /><br />After killing the children, Stevenson escaped his blood-splattered flat in Lyon, France, on a pair of rollerskates. <br /><br />While I was as horrified as anyone else at the brutality of this killing, I have to admit that I wasn't in the least bit shocked. <br /><br />As a criminologist specialising in murder, I have just completed research into the phenomenon of parents killing their children. <br /><br />And <b>my discoveries left me wondering not how it could happen — but just how soon it would be before another case of parental murder would hit the headlines</b>. <br /><br />Perhaps the most terrifying thing I have learned from my research is that the incidence of parents murdering their children is becomingly increasingly common. There have been 71 cases since 1980 - and the numbers are speeding up alarmingly. <br /><br /><b>In the Eighties, fewer than one child a year was murdered by a parent. Over the past decade, numbers have risen to two or three a year - a rate that is increasing steadily</b>. <br /><br />Though mothers are also capable of murdering their children, <b>the vast majority of murders - 59 of the 71 - are committed by men. I call them Family Annihilators because they cold-bloodedly plot their family's destruction</b>. <br /><br />And the reason why these apparently normal, loving men turn into ruthless killers? At the inquest into the deaths, she recalled how her husband stood in front of her on the last night they spent together, crying, holding his wedding ring and asking if he should take it with him. <br /><br />I examined all of the cases of murders by parents of their children since 1980, looking at everything from the fathers' jobs to the day of the week they committed the murder — and uncovered some quite extraordinary patterns. <br /><br /><strong>In seven out of ten cases, the children have been at the centre of a bitter family break-up</strong>. <br /><br />Of course, I wouldn't for a minute suggest that divorce inevitably leads to murder. <br /><br />Far from it. <br /><br />However, what's extremely worrying is that there is a small minority of men who find it impossible to cope when their families break up. <br /><br />These men come from all walks of life. They include doctors, businessmen, electricians, lorry drivers and security guards. <br /><br />But they all seem to have one thing in common. They feel that their masculinity is being threatened. <br /><br />In getting divorced, they believe they are losing the one thing that makes them feel like successful men: their families. <br /><br />In murdering their children, they are, in some twisted way, wresting back control not just of their children, but often of their wives, too. <strong> </strong><br /><strong></strong><br /><strong>Killing their children is the most shocking and dramatic way they can think of to shout to the world: 'Look how powerful I am.'</strong> <br /><br />In murder, many are also seeking the ultimate revenge. They know that in killing their children they are killing the things that are most precious to their former wives. <br /><br />Horrifically, many of these men leave notes at the scene, blaming their ex-wife for the tragedy. Some even add the extra twist of writing: 'I hope you will be happy now.' In so many ways, then, the case of Julian Stevenson is very typical if he is eventually found guilty of the killings. <br /><br />He was in the <strong>throes of a bitter custody battle</strong> with his French ex-wife, Stephanie. <strong>He had been banned from seeing his children alone after attacking her in 2010, so last weekend was his first unsupervised access visit with his children in three years. </strong> <br /><br />There are two patterns that Family Annihilators follow — both equally dangerous for children. <br /><br />The first scenario is that the parents are living together, but the family is fracturing, often because the husband or wife is having an affair. The father can't bear the thought of losing his children and is often raging at his wife, so he exacts the ultimate punishment. <br /><br />In the second scenario — as in the Stevensons' case — the marriage is already over, the family has broken up and the children are living with the mother. <br /><br />Far from satisfied with the outcome and filled with impotent rage, the father wants revenge. <br /><br />I don't know about Stevenson's wife, but often the trigger is that the spouse is with a new partner or is pregnant. He may have been dreaming of a reconciliation: now he has to face the reality of losing his wife for ever. <br /><br /><b>In half of all cases of Family Annihilator, the murderer kills his former wife</b>, too. <br /><br />One of the most chilling examples is that of 53-year-old Brian Philcox, a security guard from Runcorn, Cheshire, who was in the middle of a bitter marriage breakdown. In June 2008, on Father's Day, he collected his children — Amy, seven, and Owen, three — and drove them to a remote beauty spot in Snowdonia, North Wales. The funeral of Amy and Owen Philcox at All Saints Church in Daresbury in June 2008 <br /><br />After sedating them with drugs and makeshift chloroform masks, he joined them on the back seat of his Land Rover and waited for exhaust fumes to kill them all. <br /><br />Meanwhile, he'd left a booby-trap bomb in his home, designed to explode when his ex-wife opened a note he had left addressed to 'The Bitch'. Luckily, it failed to explode. <br /><br />For most parents, the thought of sitting down and plotting how we are going to take our children's lives isn't just abhorrent, it's simply unimaginable. <br /><br />But that is exactly what these fathers do. They spend weeks — sometimes months — planning every gruesome detail. <br /><br /><strong>And perhaps most frightening of all, they are able to do it all while keeping up a facade of normality</strong>. While they are plotting, no one guesses what's on their mind. <br /><br />The terrifying truth is that these men are silent killers. In most cases, no one has seen the clues — not their wives, not their friends and not their families. Friends and neighbours often say they appear to be loving and devoted fathers. <br /><br /><strong>Not surprisingly, perhaps, most murders occur between Friday and Sunday nights. I'm sure this is because weekends are commonly when estranged fathers get to see their children alone — giving them the opportunity to kill.</strong> <br /><br />The way that Stevenson is alleged to have murdered his children — by slitting their throats — is horrifying in its violent brutality. <br /><br />Incredibly, though, it's not rare. In fact, one of the most shocking things my research has uncovered is that <b>one-third of men stab their children to death</b>. <br /><br />Stabbing usually occurs where the murderer is full of violent rage and anger and wants to damage his victim's appearance. <br /><br />It's a violent way to kill, and a horrible way to die. But these men seem to want to inflict maximum damage on their children as a way of proving just how powerful they are — and as a means to inflict the maximum pain on their wives. <br /><br />It appears that Stevenson was a violent alcoholic, with a record of attacking his wife. In this, he is uncommon. Fewer than 10 per cent of Family Annihilators have a record of domestic violence. <br /><br />Even more frightening, perhaps, <b>most have no record of mental illness</b>. They have simply slipped beneath the radar. <br /><br />But the most disturbing aspect of my research is that, as far as I can see, these parent-on-child killings are going to continue happening with increasing regularity. Marriages are going to continue breaking up. I hope he rots – I don’t think he has realised how much he has destroyed my life.”<br /><br />Jurors at Roach’s trial heard Ms Hopkins left him to look after Roxie as she nipped to the supermarket on September 23, 2010.<br /><br />When she got home minutes later she found paramedics at her door and her daughter fighting for her life inside.<br /><br />Roxie’s life support machine was switched off the following day – less than a month after she was born on August 27.<br /><br />The little girl suffered retinal haemorrhaging and bleeding within her skull and brain. Had she survived she would have been blind and brain damaged.<br /><br />Jobless Roach first tried to pass off the mite’s wounds as being caused by a cold.<br /><br />He later confessed to dropping Roxie on to a carpet – but claimed it was an accident and that he only shook her to try to revive her.<br /><br />Doctors, however, told the court her injuries could not have been an accident and jurors convicted Roach of manslaughter.<br /><br />Bernard Tetlow, defending, said Roach was a loving parent who would live with the “burden of guilt” for the rest of his life.<br /><br />Jailing the dad for seven years, Judge Graham Cottle told Roach: “The injuries were described by one of the witnesses in the case as some of the worst he has seen. Grieving mother Kelly Hopkins branded her former lover a ‘monster’ for killing their daughter.<br /><br />“It was the injuries of a child being very violently shaken and deliberately thrown or dropped. Only you know what happened but ever since you have evaded the truth.<br /><br />&nbsp;“Nearly three years have now gone by and you have continued to deny Kelly and others the opportunity to have some closure over Roxie’s death.<br /><br />“You have been concerned only by covering your own self. Alexander that on Sept. 9, 2012 <b>Berman's 9-month-old son was left in his care while the baby's mother worked in Boston</b>.<br /><br />Berman became frustrated with the baby and bent the child's leg back toward his head, causing it to fracture. In a statement to Simsbury police, Berman said he was tired and trying to sleep, but the baby was keeping him awake. Angry, he grabbed the baby's right leg. "I bent his leg forward toward his head and heard a popping noise," Berman said.<br /><br />Berman also faced charges for an earlier incident where he allegedly squeezed the baby, causing him to go into cardiac arrest. If convicted, he faces up to 3-1/2 years in prison and/or up to $10,000 in fines. <br /><br /> According to the criminal complaint, Gardner's seven-month-old baby was transported to the hospital on May 6 for possible seizures. Based on an emergency assessment of the baby's condition, he was then transported to Lutheran General Hospital in Park Ridge, Illinois. There, doctors diagnosed him with two separate brain bleeds. <br /><br />At first, the baby's mother tried to explain the injuries were a result of the baby falling and hitting his head on a carpeted floor, but after interviewing Gardner, police determined the injuries were caused by being shaken, the complaint reads. <br /><br /> Part of the doctor's report included in the complaint against Gardner reads, "The extended timeline of bleeding is worrisome for abuse, over a duration of days, and the story of a fall off the chest a few inches does not seem to correlate with the findings.” <br /><br />The boy's mother told police that Gardner sometimes "plays too rough" with the baby and that on several occasions he put the child in a bouncy seat and shook the seat to try and get the baby to stop crying, the complaint reads. <br /><br />On May 5, Gardner reportedly told officers he could have inflicted Shaken Baby Syndrome when the baby wouldn't stop crying as Gardner tried to feed him rice cereal. The baby was in the bouncy seat at the time, the complaint confirms. <br /><br /> Police say that on May 6, the child's mother left the baby in Gardner's care while she took other children to the park. When she returned, the baby was limp and gasping for air. <br /><br />Gardner says he propped the baby up in the bouncy seat with a bottle and went to take a shower, police say. When he got out of the shower, the baby was gasping for air and had stiff arms so Gardner ran to a downstairs apartment with the baby and called 911. <br /><br />Gardner remains in the Racine County Jail on a $10,000 cash bond. Daddies don't kill because they're kept from their kids; they kill because they are GRANTED ACCESS TO THE KIDS.&nbsp;</i><br /><br /><a href="http://www.examiner.com/article/to-court-uphold-dad-s-life-sentence-for-beating-17-month-old-boy-to-death">http://www.examiner.com/article/to-court-uphold-dad-s-life-sentence-for-beating-17-month-old-boy-to-death</a><br /><br /><b>Supreme court upholds dad's life sentence for beating 17-month-old boy to death</b><br /><br />MAY 20, 2013<br /><br />BY: KIMATHI LEWIS<br /><br />The Supreme Court of Georgia upheld a man's murder conviction and life sentence for beating his 17-month-old son to death, officials said.<br /><br />An 18-year-old <b>Clayton County dad beat his 17-month-old son to death, possibly with a baseball bat, after refusing to provide financial support for the child and threatening the toddler’s mom.</b> <br /><br />Still, Mr. Jamall DeCarlos Mathis appealed to the Supreme Court of Georgia to overturn his murder conviction and life sentence, claiming the punishment was too harsh and that the evidence was insufficient.<br /><br />But on Monday, the state’s highest court said it has denied his appeal — closing the door on Mr. Mathis’ last hope for freedom.<br /><br />Mr. Mathis was 16-years-old when his girlfriend, Ms. Tiasha Jones, gave birth to their son, Ja ‘Mari Myckahi Jones, according to court records.But the teen was <b>unhappy about the pregnancy and threatened to have someone hurt the woman</b>.<br /><br />He <b>wasn’t there for the baby’s birth</b> and <b>after the boy was born, barely saw him and provided no financial support.</b><br /><br />In May 2009,<b> Ms. Jones began legal proceedings to gain child support from Mr. Mathis who asked her to drop the complaint</b>, the records show. But she refused.<br /><br />“<b>Shortly before his death, Ja ‘Mari returned from one of his few visits to his father’s house with a swollen knee that caused him to limp</b>,” according to the court records. “Mathis said the toddler “probably fell.”<br /><br />In September, Mr. Mathis asked for another visit with Ja ‘Mari. But this time, when he arrived to pick up the child, the baby cried.<br /><br />Around 11 p.m. on Sept. 15, Mr. Mathis, who was staying at his aunt’s with several family members including his mother, brother, sister and his sister’s baby, called Ms. Jones to tell her Ja ‘Mari had fallen off the bed and hit his head while sleeping with his mother and infant niece.<br /><br />Around 9 a.m. on Sept. 16, Mr. Mathis yelled from the bedroom that Ja ‘Mari was not breathing. Paramedics arrived to find Ja ‘Mari unresponsive.<br /><br />“One of the treating paramedics testified that on the way to the hospital, Ja ‘Mari’s skin was warm and dry, indicating his injuries were recent," the records show. "By the time they arrived at Southern Regional Hospital, the knot on the toddler’s head had swollen to the size of a softball, also indicating a recent injury.”<br /><br />Expert medical witnesses testified they found <b>“pattern injuries” to Ja ‘Mari’s chest and arm as well as a significant skull fracture extending “all the way to the base of the skull</b>.”<br /><br />Ms. Jones and her family took the baby off life support. A few days later, Mr. Mathis contacted Ms. Jones to ask if she was expecting an insurance check for Ja ‘Mari’s death. He also texted her saying he wished to have another child with her.<br /><br />“At trial, the medical examiner said Ja ‘Mari’s injuries were consistent with having been struck on the head at least three times but “very likely” more than that,” according to the court records.<br /><br />"Two baseball bats had been found in the house, and the baby’s head injuries were consistent with having been hit by a bat, but no physical evidence was introduced at trial directly linking the bats to the blows Ja ‘Mari suffered."<br /><br />In November 2010, Mr. Mathis was convicted of felony murder, aggravated battery, cruelty to children and other crimes. Children and adult women are routinely sold, tricked or kidnapped in epidemic numbers and trafficked into sex slavery for profit. Rarely do such pimps and profiteers bother to keep one girl (or boy) only for themselves. <br /><br />Civilian pedophiles do that. We think of pedophiles as depraved older men or, increasingly, as men of the cloth, whose prey is an under-age stranger. Once caught, they are registered as sex offenders and law enforcement can, potentially, keep eyes on them. <br /><br />But what if the pedophiles are fathers and their captive prey are their own children? How will the police ever learn about this? There is no system that monitors children in their own homes. When mothers try to do so, they often lose custody of their children. Pedophiles, including a child's own father, are often charming, docile, and seem "normal." <br /><br />Given that it is almost impossible to "police" a man's home (which is still his castle), mothers are on the front line in terms of protecting children. There is no one else. But when mothers try to protect their children from physical or sexual abuse they often lose custody of them. <br /><br />This past weekend I delivered a keynote speech at the tenth annual Battered Mothers Custody Conference. This conference was founded by Dr. Maureen ("Mo") Hannah and has functioned as a life line forbattered and "protective" mothers. The program included keynote speeches by Terry O'Neill, NOW's national President and Toby Kleinman, prominent family law attorney and champion for women's rights. More than 15 sessions took place, led by the most dedicated and fearless lawyers, mental health professionals, and mothers. More than 150 people attended this conference. Forty people delivered lectures; 10 of them were custodially challenged mothers. <br /><br />Some mothers lost custody of their children to their batterers. Many battered mothers lost their children when they alleged that their violent husbands had also been sexually abusing their child. Often such mothers are seen as "crazy," and as "alienating" the child from their perfectly nice father. I first broke this scandal 27 years ago when I published my book Mothers on Trial. The Battle for Children and Custody. There have been some improvements. Documented domestic violence is often factored in a bit more often; where there are assets, judges may award mothers a greater percentage of them; gay parents and mothers with demanding careers do not lose custody as they once did for these reasons. <br /><br />However, matters have worsened in many areas—so much so, that I added eight chapters to the 25th anniversary edition of this book. Two chapters are titled "Court-Enabled Incest in the 1980s and 1990s," and "Court-Enabled Incest in the Twenty-First Century." <br /><br />The court system does not want to believe that a well-spoken, charismatic man could really be a savage wife-beater or child abuser. It is easier to believe that his traumatized, sleepless, frightened and rapidly impoverished wife is lying, exaggerating or imagining things. I have interviewed many such mothers, and many more were present at this extraordinary conference which was held in Washington DC at the George Washington University Law School. <br /><br />The police do not rescue these children. In fact, the courts often award custody to their abusers and severely limit the "crazy' mothers' visitation. When such mothers finally run away to save their children, they are routinely captured, imprisoned and lose access to their children for a very long time. <br /><br />One such mother, Holly Collins, was beaten badly for a very long time in the American state of Minnesota. Her children were beaten, too. No one came to their rescue. On the contrary. Eventually, the father, who terrified his children, gained custody of them. The court system nearly destroyed this mother and her children. And so, in 1994, Holly fled the country. She carried her entire legal file with her in her suitcases. In 1996, after an extensive legal review and appeal, Holland granted this American mother political asylum (!) on the grounds that America had not protected her or her children and did not seem likely to ever do so. Garland Waller directed a riveting documentary about Holly, titled No Way Out But One. The film was shown to the conference. According to Dr. Hannah, their reaction was "highly positive." <br /><br />The National Coalition Against Domestic Violence, the Battered Mothers Custody Conference and The National Organization of Men Against Sexism presented an award to the "People and Government of the Netherlands and to the extraordinary lawyer who fought for Holly and her children, Els Lucas. <br /><br />The BMCC mothers asked me amazing questions. "Do we need to launch another world war to keep the children safe in America?" "Where is our Abraham Lincoln on this subject?" "What country should we live in if not here?" The mothers, including a group calling itself the "Mothers of Lost Children" demonstrated outside the White House. <br /><br />According to the testimonies of these mothers, their children either witnessed their mothers being beaten on a daily basis and/or were also beaten; some children were also sexually abused. These were households of terror, ruled over by a legal husband and father, not by a stranger. Yes, I know, some mothers falsely allege domestic violence; most do not, nor do most mothers allege incest unless a teacher, pediatrician, social worker or other mandated reporter does so first. And why? Because 21st century mothers have all been advised by their lawyers that they risk losing custody if they make such an allegation. Even so, these mothers still lost custody of the children they were trying to protect. <br /><br />Jennifer Collins, Holly's daughter, has created a website for children who, like her, are living "underground." Both Jennifer, who is working as a para-legal, and Holly, led a workshop at the conference. <br /><br />The work I began in 1976, when I testified in my first custody case for a mother and when I worked with "protective" mothers in the 1980s,continues. Now, there is a growing movement underway. Fathers are the leading perpetrators of abusive head trauma injuries due to shaking/throwing a baby. </em><br /><br /><a href="http://www.franklincountytimes.com/2013/05/18/father-charged-in-babys-death/">http://www.franklincountytimes.com/2013/05/18/father-charged-in-babys-death/</a><br /><b></b><br /><b>Father charged in baby’s death</b><br /><br />Published 6:06am <br />Saturday, May 18, 2013 <br /><br />A former Franklin County resident was arrested on capital murder charges Wednesday after authorities alleged he was responsible for the death of his three-month-old son in July 2011. <br /><br />Pablo Diego Larios, 23, 201 8th Ave. SW, Decatur, was arrested and charged with capital murder on Wednesday afternoon, Franklin County Sheriff Shannon Oliver said. <br /><br />Oliver said the capital murder charge was warranted since the victim was under 14 years old. <br /><br />According to Oliver, the alleged incident took place on July 2, 2011, but because of a backlog of cases due to budget cuts and lack of funding, forensic autopsy results have not been available until the sheriff’s office received the official report from the Department of Forensic Sciences on Tuesday listing the cause of death as homicide. <br /><br />Oliver said once the report had been received, the case was able to move forward. <br /><br />Oliver said on the day of the incident, the sheriff’s office received a call that a baby located at a residence in the Town and County Trailer Park was not breathing. <br /><br />Oliver said when officers arrived on the scene, the three-month-old child was still not breathing and was transported to Russellville Hospital where he was unable to be revived and pronounced dead. <br /><br />Oliver said investigators returned to the residence at the trailer park where they interviewed Larios, who was the child’s father. <br /><br />Oliver said the mother of the child was not home and he was the only parent at the residence at the time. <br /><br />“At the time of that interview, the suspect admitted to tossing the child in the air,” Oliver said, “but the forensic results we received on Tuesday listed the cause of death as homicide and stated that the injuries the infant suffered were consistent with shaken baby syndrome and that it appeared to be very violent.” <br /><br />Oliver said after receiving the autopsy report, investigators obtained a warrant for Larios’ arrest Wednesday morning. <br /><br />Oliver said investigators received word that the suspect had moved from his residence in Franklin County to a home in Decatur so the FCSO contacted the Decatur Police Department who assisted them on the arrest on Wednesday afternoon. <br /><br />“We are relieved that an arrest has finally been made in this case after we have been pursuing it for almost two years,” Oliver said. <br /><br />“It’s disheartening that because of budget cuts and a lack of funding that a case like this took so long to be resolved. He is currently being held without bail at Franklin County Jail.<br /><br />On July 27, Cleeves allegedly shot and killed three people in a Quincy Township driveway -- his estranged wife, Brandi Cleeves, 25; her boyfriend Vincent "Luke" Santucci, 28; and Santucci's mother, Rosemary Holma, 55.<br /><br />Kevin and Brandi Cleeves lived together since the birth of their daughter, Leia, on Dec. 28, 2007. They did not marry until Feb. 29, 2012 and were separated by June 17, according to court records.<br /><br />In custody papers filed in Franklin County Central Court, <b>Brandi Cleeves alleged she fled in June to escape the troubled relationship, concealing her address</b>; however, she still maintained contact with Kevin Cleeves, formerly of 14 N. Phillips Ave., Waynesboro.<br /><br />Brandi Cleeves "finally decided to end the relationship when<b> (Kevin's) alcohol use became so detrimental to the parties relationship that (she) feared for her safety</b>," the records state.<br /><br />However, Kevin Cleeves, who worked in information technology for Martin's Famous Pastry Shoppe in Guilford Township, filed for custody of Leia on July 6 and said in documents that while he wasn't concerned about the safety of their daughter or Brandi's ability to care for her, he was worried about her emotional reaction to her mother's behavior.<br /><br />In the papers, he cited the living arrangements between Brandi Cleeves and her new boyfriend as a concern and claimed that Leia shared a bed with her mother and boyfriend. He also worried about Leia being affected by Brandi Cleeves changes of address and her recent unemployment.<br /><br />According to July 11, 2012 court documents, Brandi Cleeves had changed her address to Boonsboro, Md., stating she had previously been living with her boyfriend, but had since moved in with her parents. Prior to this, she had not disclosed her address "because she feared for her safety."<br /><br />Brandi Cleeves had been working at Applebee's in Waynesboro. While Kevin Cleeves alleged she was fired, <b>she claimed she stopped returning for her scheduled shifts after he allegedly called her work so many times she feared to return</b>, the records state.<br /><br />She "admits that (Kevin) is capable of caring for the child but denies that he can provide a more stable environment for the child than she can," the records state. <b>"Since September, (Kevin) has threatened (Brandi's) life by text message and physically fought (Brandi) in public. (Kevin) has a license to carry and has held a gun in his hand while the parties had an argument at a custody exchange."</b><br /><br />Residents who apply for a license to carry are subject to a background check through the Pennsylvania Instant Check System in Harrisburg, according to the Franklin County Sheriff's Office. Officials in Harrisburg only provide whether a license was approved, denied or undetermined. They do not disclose what comes up in the background check. Public Opinion was unable to get a date for when Kevin Cleeves received his gun permit. On July 12<b> a temporary order was granted giving Kevin Cleeves primary custody of their daughter</b>, court records state. Custody exchanges were to take place at noon on Saturdays and 10 a.m. on Wednesdays at the Waynesboro residence of Sarah Killingsworth, Brandi's grandmother.<br /><br />A conciliation conference was scheduled for Sept. 11, 2012 where an "effort will be made to see if the issues can be resolved by agreement of the parties," court records state.<br /><br />That day never came. According to charging documents, Pennsylvania State Police said Kevin Cleeves told relatives he had been trying to contact his wife to make arrangements to pick up their daughter and went to Santucci's house in Quincy Township on July 27 to make sure the girl was safe. Kevin Cleeves allegedly confronted his wife and Santucci in a car with Leia in the driveway, but was ordered off the property. Around 9 p.m., he opened fire shooting Santucci in the car, his wife when she jumped out and Santucci's mother as she ran toward him.<br /><br />Police said he took Leia and fled, later telling authorities he was trying to get to a relative's house in Michigan. An Amber Alert was issued and Kevin Cleeves was apprehended on Saturday, July 28 after police in Austintown, Ohio, said the car was spotted in a hotel parking lot off Interstate 80. The car was later stopped in the parking lot of the Weston Plaza on Route 46 where Kevin Cleeves was arrested without incident, police said. Leia Cleeves was located in the car and was unharmed.<br /><br />On Aug. 13, 2012, Leia's grandfather, Jeffrey Killingsworth, of Boonsboro, Md., who has been caring for the child since July 30, was permitted to retain physical and legal custody of her.<br /><br />He "has enjoyed a close, loving relationship with the child since her birth.
