DETROIT (AP MODIFIED) - The father and stepmother of Charlie Bothuell V will stand trial on second degree child abuse charges, a judge ruled today.

The Detroit boy was missing for 11 days before he was found in the family's basement a year ago.

The search for Charlie Bothuell led to an investigation of his father, also named Charlie Bothuell, and Monique Dillard-Bothuell.

Charlie says he was struck with a stick or PVC pipe if he disappointed his dad and stepmother. Charlie described his home as a "terrible place."

But defense lawyers say Charlie is lying. If he was stuck in the basement, they say he had many opportunities to leave the house during those 11 days.

KOTA BARU - Police have arrested and re­­mand­ed the couple suspected of severely abu­sing a five-year-old girl.

The father and stepmother were picked up at a shop in Jalan Bayam here at 10pm on Sunday.

Kelantan police chief Deputy Comm Datuk Mazlan Lazim said yesterday the man aged 39 and his 25-year-old wife had been remanded for a week to facilitate investigations.

The child was admitted to the Raja Perem­puan Zainab II Hospital here after her biolo­gical mother found welts, cuts and bruises on her body and lodged a police report.

Medical examination showed that the child, who has 13 broken bones, might be permanently disabled.

The abuse, believed to have been inflicted on her over the past two years, might have resulted in her one thigh bone being shorter than the other.

The father kept the child after he divorced her mother in 2013.

Her medical condition came to light after the stepmother handed over the girl to her biological mother recently, saying they were unable to care for her.

Trial for Sioux City father charged in baby's death continued

A Sioux City man charged in connection with his son's death has had a falling out with his attorney and will not go to trial next week.

Michael Williams said in a letter to the court he no longer trusted Matt Pittenger, his court-appointed attorney, because Pittenger did not have his best interests in mind and doesn't believe Williams is innocent.

Williams asked Pittenger to withdraw. At a Monday hearing, Pittenger told District Judge Jeffrey Neary that the attorney-client relationship with Williams had broken down.

Neary approved Williams' request and continued the July 7 trial date.

A new trial date will be set once Williams has a new attorney.

Williams told Neary his family is attempting to hire a private attorney to represent him.

Williams, 27, is charged in Woodbury County District Court with three counts of neglect of a dependent person and single counts of child endangerment resulting in the death of a child and child endangerment resulting in bodily injury of a child.

Williams had taken his dead 2-month-old son, Leonard Williams, to a hospital emergency room on April 29, 2014. An autopsy showed that the infant died of malnutrition and dehydration.

Woodbury County Attorney Patrick Jennings said at Monday's hearing that the continuation was warranted, but he did not want to see the case continue to drag out. Charges were filed in May 2014 and additional charges were filed in November.

The trial has been continued twice before, and Williams has twice been on the verge of agreeing to plead guilty, only to reject a plea offer.

"We can't continue to do this," Jennings said.

According to court documents, Williams told police he left the baby unsupervised for long periods of time in the apartment he shared with Leonard's mother, Rebekah Williams-McCarthy, in the 2800 block of West Fourth Street.

Williams-McCarthy faces the same charges as Williams. Her trial is set for Aug. 4.

PORTLAND, Ore. (KOIN) — Just hours before a 3-month old boy was rushed to the hospital with “devastating” injuries, a pediatrician described the boy as alert and happy, police said.

Awes Sheikhuna, 28, was arrested shortly after 3 p.m. Thursday at Portland Police Bureau’s East Precinct after he turned himself in. He was booked into Multnomah County Detention Center a short time later.

On Wednesday afternoon, the Multnomah County District Attorney’s Office Multi-Disciplinary Child Abuse Team filed charges of first-degree assault and first-degree criminal mistreatment against Sheikhuna.

According to an arrest affidavit written by Portland Police Detective Erica Hurley, paramedics were called to an apartment complex in the 6700 block of Southwest 26th Avenue on June 15 when Sheikhuna called 911 after his three-month-old son became unresponsive.

Boy’s injuries described as ‘devastating’

The child remains at Doernbecher Children’s Hospital at Oregon Health & Science University “with significant brain injuries,” Hurley wrote. According to child abuse specialist, the boy’s injuries were diagnosed as “non-accidental trauma.” Dr. Tom Valvano told police the boy has “devastating” brain injuries and that he may die as a result of them.

“Dr. Valvano stated if (the boy) survived the brain injury that he would likely be permanently disabled,” Hurley wrote.

When doctors examined the boy at OHSU, they discovered he had “multiple bleeds to his brain and a spinal injury,” according to documents.

The injured boy has a brother, police said. Sheikhuna told police the boys’ mother is his girlfriend and they have been dating for 2 years, according to court documents. The girlfriend told police while they are not legally married, they are married “in the eyes of God,” Hurley wrote. Sheikhuna and his girlfriend reportedly do not live together.

The mother told police Sheikhuna comes over to her apartment to watch his sons while she works. On the day of the alleged assault, Sheikhuna arrived to watch the children and take them to the doctor’s office. She left the apartment around 2 p.m. on June 15, police said. Sheikhuna told police he made the appointment because both children reportedly had the flu, Hurley wrote. Sheikhuna reportedly told police that the children had been sick for “1-2 weeks”.

Boy described as ‘alert, happy’ by doctor

Sheikhuna and the children went to the doctor’s office around 3:30 p.m June 15, police said. The pediatrician noted the alleged victim “was alert, happy and easily consoled,” Hurley wrote. The doctor reported that the boy did not cry. “The physical exam was remarkable only for nasal congestion,” Hurley wrote regarding the doctor’s exam.

Shortly before 4 p.m. Sheikhuna returned to the apartment, police said. He called the mother of the children and told her “the doctor said nothing was wrong (with the boy),” Hurley wrote. But Sheikhuna reportedly claimed that the boy would not stop crying.

The boy’s mother got another call from Sheikhuna while she was at work, police said. Sheikhuna “told her something was wrong (with the boy),” Hurley wrote.

Sheikhuna told police while in the apartment, the boy continued to cry, court documents state. When police asked Sheikhuna about his actions, he told them he was “carrying (the boy) around and stroking his head to try to get (the boy) to stop crying but it didn’t work,” Hurley wrote. Sheikhuna reportedly said he gave the child liquid ibuprofen and some other liquid medication he purchased at a local market that “supposedly treats stomach ailments.”

Father ‘afraid’ when calling 911, doesn’t perform CPR

Sheikhuna told police to get his son to stop crying, he put the boy in a swing inside the living room, court documents state. He reportedly went to check on the boy after noticing the boy “got quiet”. Sheikhuna said the boy sounded like he was choking, so he then put water on him to get the boy to breath. At that point, he called 911 and was told by an emergency dispatcher to start performing first aid. Records show the 911 call was placed at 6:11 p.m. on June 15.

Sheikhuna “was afraid he would hurt (the boy) so he did not do CPR,” Hurley wrote. #Detectives Hurley and Nathan Tobey, both assigned to the Multnomah County Child Abuse Team, interviewed Sheikhuna at OHSU. Homicide Detective Erik Kammerer assisted, given the nature of the child’s life-threatening injuries. The interview was translated by Portland Police Officer Khalid Ibrahim who speaks Somali, court documents state.

Sheikhuna told the detectives and officer he didn’t do anything before the child started becoming symptomatic. He admitted there were no falls or accidents before the child was injured, court documents state. #“Sheikhuna said he does not know what caused (the boy’s) injuries,” Hurley wrote.

He told the investigators he was the only person supervising the children in the afternoon when the injuries occurred, court documents state. Sheikhuna told the detectives and officer he was not frustrated by the crying of the two boys.

Detectives have seized Sheikhuna and his girlfriend’s cellphones as part of the investigation. They have obtained warrants to analyze the phones, court documents show.

He is scheduled to be arraigned Friday at the Multnomah County Justice Center. His bail has been set at $255,000.

Arrest warrant issued for Lafayette woman accused of disappearing with three children in custody dispute

An arrest warrant has been issued for a Lafayette woman accused of violating a joint custody agreement with her ex-husband and disappearing with their three children, authorities said Wednesday.

Katelyn Cheree Stewart Gauthier, 30, is wanted on three counts of interfering with the custody of a child and one count of obstruction of a court order, the Lafayette Parish Sheriff’s Office said.

Gauthier left home Sunday with the children, ages 5, 6 and 11, and has not been heard from since that time, the Sheriff’s Office reported Wednesday. David Glenn Gauthier, 11, has brown hair, hazel eyes, stands 4-feet 8-inches tall and weighs 90 pounds; Samantha Claire Gauthier, 6, has blonde hair and hazel eyes and weighs 50 pounds; and Emily Gabrielle Gauthier, 5, has brown hair and eyes and weighs 60 pounds.

Deputies are seeking the public’s help in locating the woman and children.

Along with photos of the mother and three children, the Sheriff’s Office has released a photo of the car she was last seen driving, a late model, dark grey Toyota Camry with the license plate number XOA416.

Along with a day-long visit for Father’s Day, Gauthier was supposed to relinquish custody of the children to their father, Hubert Gauthier, 36, of Lafayette, on Monday, court records show.

The divorced couple agreed in May to joint custody. They had been embroiled in a bitter, three-year-long dispute following their petitions for divorce, with each accusing the other of violent behavior, court records show.

Hubert Gauthier pleaded no contest in 2014 to domestic abuse battery and aggravated assault for grabbing his then-wife by the throat, pushing her onto the bed and threatening her by chasing her with a handgun, court records show. The incident happened in May 2012, days before each filed for divorce.

Hubert Gauthier was sentenced to five months in jail, with all but 48 hours suspended; one year of supervised probation; eight, 8-hour days of community service; a domestic violence program and a $300 fine.

Katelyn Gauthier has no criminal record in Lafayette Parish.

Father gets 30 years for 'absolute torture' of baby girl

When a 10-month-old baby girl arrived at Children's Hospital last fall, her thighs were wasting away.

The front of her legs were covered with scalding burns, injuries so painful she simply stopped moving.

She had burns inside her mouth. Her neck and body were covered with bite marks and bruises. She had severe brain injuries, the kind that come from being violently shaken, slammed down or thrown.

#And the burn on her back matched the pattern of a charcoal grill in her parents' kitchen.

On Thursday, her father, Corey Burns, was sentenced to just over 30 years in prison for "cruelty and torture," as the case was described in a medical report.

"There are no words that encompass the level of depravity and the inhumanity that was shown to this child over a short period of time," Assistant District Attorney Matthew Torbenson said.

The baby and her mother, Chazzidy White, moved to Wisconsin from Texas in late October. Within days, White had a job and Burns became the child's main caregiver.

On Nov. 5, White called from work to check on the baby. Burns asked her to hurry home, saying their daughter was burned in bathwater. The explanation wasn't plausible, investigators say, because the baby was not burned on her bottom or back of her legs. She was burned only on the front, as if she was dipped in the scalding liquid.

White later told police her daughter's legs looked "like she was skinned."

White wanted to take her to the doctors, but Burns talked her out of it, saying child welfare officials would get involved, according to court documents. A week later, White noticed her daughter had circles on her neck, scratches on her face and bruises on her chin. The baby became lethargic.

On the morning of Nov. 22, White saw a grate burn and bruises on her daughter's back. Burns claimed the baby brushed against a metal heating vent. The burn pattern did not match the vent, but did resemble the markings of a charcoal grill in the kitchen.

"You took a child who was already severely burned over her legs, her lips, who has bite marks and all of these injuries to her body, who is no longer sitting up, who is not making eye contact ... and is basically laying there," Milwaukee County Circuit Judge Rebecca Dallet said.

"And you put her on a grill."

When the baby's back burns were discovered, White took the child to the hospital, where doctors found burns on 15% of her body. She and Burns were arrested. White, 22, pleaded guilty to child neglect and failing to prevent child abuse. She was sentenced in April to two years in prison and five years of extended supervision.

Burns, 21, pleaded guilty to three felonies. Four others were dismissed. When asked if he had anything to say, Burns cleared his throat before a brief statement.

"I apologize for my actions," he said. "I take full responsibility for my actions. And that's it, judge."

Dallet acknowledged Burns had a troubled life and had himself suffered horrific abuse but said nothing explains his actions, which have scarred his daughter for life.

"This was torture, absolute torture of your daughter, and it went on for many, many days," she said. "I see a lot of child abuse cases in here. I see a lot of cases of burns. I have never seen anything like this."

PORTAGE, Wis. - A document charging a Columbia County man with abusing his infant son said the man admitted to shaking the baby when he became fussy.

Raymond H. Koester, 26, of Doylestown, appeared in Columbia County court Thursday afternoon via video. He is charged with two felony counts of physically abusing a child intentionally causing great bodily harm.

Koester's infant son was admitted to UW Hospital in Madison Saturday for multiple bilateral subdural brain bleeds.

According to the criminal complaint, Koester admitted to a detective that he shook the baby twice. One time was about a week before the baby’s 4-month-old checkup when the the infant became fussy in his bouncy chair. Koester told the detective he picked the baby up and shook him about four times.

At the baby's checkup June 11, the doctor noticed his head measured larger than normal, and an MRI days later showed the baby had a fluid collection in his head, according to the complaint.

A Columbia County Human Services social worker contacted the sheriff's office when the baby was admitted to University of Wisconsin Hospital Saturday with suspicious injuries.

In the complaint, a physician’s assistant told a detective the injuries are consistent with the baby being shaken, his head being struck by an object or his head striking an object. A doctor said the injuries were consistent with an intentional act.

In addition to the brain bleeding, the baby had hemorrhaging in his eyes, which is consistent with shaken baby syndrome and could cause long-term vision problems. Tissue in the baby's mouth was torn, which was consistent with being force-fed or with a pacifier being forced into the mouth, officials said.

According to the complaint, Koester admitted to a detective that he shook the baby twice, once about a week before the baby’s 4-month-old checkup when the baby became fussy when he was in his bouncy chair, so Koester picked him up and shook him about four times. #Detectives believe the baby was injured on or around June 4 and June 12.

The baby underwent brain surgery Tuesday and was listed as stable. A physician's assistant said the baby's prognosis wouldn't be known until the injuries healed and he grew.

In court Thursday, the judge ordered a $20,000 cash bond for Koester. He was also ordered not to have contact with the baby. If convicted of the two he could face up to 40 years in prison.

ALBUQUERQUE, N.M. (AP) — The father of an infant who died from what doctors say were nonaccidental injuries has been accused of child abuse.

The Albuquerque Journal reports (http://bit.ly/1TRi5fH ) 25-year-old Spenser Phillips was charged Wednesday with child abuse in connection with the death of his 2-month-old son.

On May 30, the baby was taken to University of New Mexico Hospital in critical condition with a brain bleed.

According to a criminal complaint, a doctor told police the baby had suffered abusive head trauma and nonaccidental injuries.

The child's mother told police Phillips had been caring for the child that day.

In an interview, Phillips told police the child had fallen out of his chair and hit his head.

The child died days later.

Phillips has been booked into the county jail on $50,000 bail.

Fritz says action will be taken against anyone who withheld information pertaining to this case.

DOUGLAS, GA. -- The Douglas Police Department said last Saturday they were called about a possible child abuse case.

An 11-week-old had two fractures to her skull, multiple fractured ribs and a fractured leg. The child was taken to a hospital in Jacksonville where she remains in critical condition.

Doctors ruled her injures non-accidental and officials discovered she was with her father, 28-year-old Ferris Battle, when the injures happened.

Battle was arrested Friday and has been charged with aggravated battery (family violence) and cruelty to children in the first degree.

Battle is at the Duval County Sheriff’s Office awaiting extradition back to Douglas.

The case of a woman taking her abusive father to court attracted widespread publicity

An Afghan court has passed a landmark judgement, using DNA evidence to convict a man for the multiple rape of his daughter.

The victim who cannot be named to protect her safety, was abused for more than 10 years, bearing two children.

Violence against women is endemic in Afghanistan and victims of sexual abuse are often themselves jailed for "moral crimes".

I met the victim, who is in her early twenties, for the first time last year after the trial against her father was suspended with the judge asking for DNA evidence.

She was pregnant as a result of the abuse and held her four-year-old on her lap. "This is my daughter and my father's daughter," she said. "She is the result of my father raping me. We are both mother and daughter and sisters at the same time."

As sunlight streamed through the drawn curtains of the impoverished home she shares with her mother, she told me the story she had presented in court for the first time last summer.

According to the victim, the abuse began when her father returned from Iran after eight years abroad.

She was 12 years old. "I was expecting that my father will love me the way my uncles love their children because I was thirsty for a dad's love during all the years I was deprived of him," she says. "But when I found myself in my father's arms it was too much."

She recalls how he touched her intimately, making her feel uncomfortable. "I went to my grandmother and complained but she blamed me. I was told that every father caresses his children."

Then one night her father raped her: "I was scared badly, I was shocked and lay in the corner of the room and didn't know what to do."

Afghanistan's patriarchal society is not used to women taking such cases to court

When she became pregnant, the father moved the family to another province. The baby was born but he took it away - she never saw it again.

The abuse lasted more than 10 years, during which the daughter went through multiple pregnancies and abortions.

She says that her father used a variety of drugs which she later learned were attempts at contraception.

Eventually another child was born. "When I became pregnant again, I kept the baby and didn't abort my child," she says: "I kept it to have proof for my claims against my father - my child was my only evidence."

With the support of her mother, she finally managed to end the abuse.

The final attack, she told me, happened in July last year, one day before Eid. "Me and my mother had told the whole story to the mullah, neighbourhood elders and the district police and they told us to inform them if I was attacked again."

That night the father sent his wife out of the home before assaulting his daughter again.

He was arrested as the mother returned with police and elders as witnesses.

The woman now faces the dilemma of what to tell her children about their father in the future

"What will I tell them when they are older?" she asks

Even though he was put on trial, the daughter's ordeal was far from over.

As the father denied all charges, claiming his daughter had extramarital relationships with other men, the victim herself was challenged in court.

"The judge questioned me, asking why I didn't kill the baby that was in my belly?" she told me. "I answered that if I killed the child I could be accused of aborting it because the father was another person. I kept my child to prove I have a case against my father."

The court then suspended the trial, asking for DNA samples of the accused, the victim and her daughter.

What followed was a campaign to seek justice.

The victim had taken the unusual step of appearing on Afghan television to tell her story. Women's rights activists began organising support.

There are virtually no facilities for genetic forensic testing in Afghanistan, making foreign assistance imperative.

The woman's supporters lobbied embassies and non-governmental organisations for help.

But it still took almost a year before a DNA test could be arranged, by which time the victim had given birth to another child.

Finally a committee of officials from the attorney general's office and the interior ministry took on the task. "They took blood and saliva samples from the father, the woman and her children and transferred them to the US via Bagram airbase," says Ruhulla, the victim's lawyer. "If we didn't have this test result, my client would have been punished based on the codes and laws of this country," she says.

The samples were processed by the US firm "Ideal Innovations", specialists in forensic testing who are also active in Afghanistan, providing fingerprint and biometric identification technology. They did the test for free.

When the results were finally returned they showed that the accused had indeed fathered his daughter's children.

The judge sentenced him to death.

The case is not yet closed, though.

The father is appealing against the sentence, protesting his innocence.

DNA evidence is very rare in Afghan court cases, making this trial highly unusual.

The victim, meanwhile, told me that even if her abuser is executed, she remains fearful.

"I'm so worried about the future of my children," she says "What will I tell them when they are older and ask me about their father?"

As often happens with the media, we have a real slick erasure of a lot of backstory. "Somebody" granted this UNNAMED DAD custody, and allowed him and the step to torture this child over two years. Obviously, the mother must have had her contact cut off, as she couldn't have "discovered" old scars and signs of malnutrition if she had had contact all along. So "somebody" also allowed the father to shut the mom out--very common with child abusers who like to punish Mom and not get caught. But of course, "somebody" is never named.

PASIR MAS: A husband and wife duo has been brought to face the Magistrates Court today to help facilitate investigations in the case of an abused five-year-old girl.

Pasir Mas Senior Registrar, Rashid Mustafa, ordered the suspects to be remanded for four days beginning today.

The suspects are the victim’s stepmother, 25, and biological father, 39, and were detained at a restaurant in Kota Bharu on Sunday at 9pm.

The two are believed to have been trying to evade authorities following the incident on June 25, 2015.

It was previously reported that Nur Zuliana Zaara had suffered from severe trauma after being made a victim of torture at the hands of her stepmother for the past two years.

She was discovered by her biological mother, Sana Abdul Malek, 28, who found old and new scars on her body. She was also found to be malnourished.

Doctors found a total of 13 broken bones on her body including her backbone, and also fractures on her hips, arms and thighs.

Nur Zuliana is currently being warded at the Raja Perempuan Zainab II Hospital and will undergo surgery today.

The case is being investigated under Section 31 (1) of the Child Act 2001.

The suspects were represented by a lawyer who had filed for a release on bail for the female suspect as she is nursing an 11-month-old baby.

The man plead guilty to two counts of rape and two of indecent assault

A Laois father of seven will be sentenced later this month for the continued sexual abuse and rape of his young daughter over 30 years ago.

The man, who cannot be named to protect the identity of his now 43-year-old victim, pleaded guilty at the Central Criminal Court to two counts of rape and two counts of indecent assault on dates between July 1981 and July 1987 when his daughter was aged between nine and 15 years old. He has no previous convictions.

The woman who has since moved to County Carlow first made a complaint to gardaí in May 2013.

She and her mother, who had by that time divorced the man, had months earlier confronted him about the abuse. He didn't deny it but was hostile in his response to the women.

The man was later arrested in June 2014 and admitted to sexually abusing and raping his daughter. He described “making love” to his eldest daughter when she was too young to consent to it.

He claimed that she never resisted him and denied ever having forced himself on her.

Ms Justice Margaret Heneghan remanded the man in continuing custody and adjourned sentencing until July 13 next. The man had been registered a sex offender when he pleaded guilty earlier this month.

The woman stated in a victim impact report, which was read into court that she contemplated suicide at 11 or 12 years of age. She said she had hoped that this would lead her mother to question what had been wrong with her and her father would have to confess.

She recalled sitting on the landing one day and seriously considering throwing herself off it.

“I hated being a girl. I used to wish I was a boy. His 'special girl' came at such a price,” the woman stated before she said that the abuse turned her into a “pathetic wimp” who had been “tainted by this awful secret”.

She said her father had robbed her of her childhood, her teenage years and much of her adult life that she would never get back.

The woman said that her father was violent and hard to live with. “He was only affectionate to me when he made me do special things,” she said before she added that she hated him.

She described being left at home by her mother to complete household chores and said her father would take those opportunities to sexually abuse and rape her.

She said she felt she would get into trouble if she told anyone and said her father would “shake his fist at me” and threaten to kill her any time she suggested she would disclose the abuse to someone.

She described being in abusive relationships as an adult directly as a result of her father's actions.

“I was tormented, living on my nerves even now. Your parents are supposed to protect you, not do something like this to you,” the woman continued.

“I am not sure I will ever get over it. I certainly will never forget it. I feel like I am not worthy of love or being loved,” she said before she added that her father had never apologised for what he did.

John Peart SC, defending told Ms Justice Heneghan that he had clear instructions from his client that he is ashamed of his behaviour and apologises “from the bottom of his heart for what he did to his daughter”.

Just another sign of how the New York family courts have been completely taken over and corrupted by the fathers rights people.

You know what strikes me? Dad BRYAN TANNER isn't just a pothead. He's a pothead who lies, and he is a pothead who was more intent on getting rid of the evidence than staying with his daughter as she was near death.

These family court parasites will bleed this mother till she is destitute.

That's what the family courts in Chautauqua County did to me. Judge Judith Claire, just like these people, is more interested in scoring point with her FR buddies than doing right by kids. She made my daughter stay in a home that was filled with abused animals in cages, a house that reeked of urine and feces--all because the sick hoarder at this house was her father.

SYRACUSE, N.Y. -- Bryan Tanner smoked a marijuana pipe while driving down the state Thruway with his 4-year-old daughter in the backseat. He drove off the highway, causing a crash that nearly killed his child.

The girl's head took the brunt of the collision into a tree. Most of the bones in Peyton Bean's face shattered.

Tanner was alone with his daughter on that day last year because of a family court order. After Peyton recovered, her mother Taylor Decker went back to court with a request: that Tanner never be allowed to see Peyton again. A family court official told her no.

Even after Tanner, 25, admitted in criminal court to smoking marijuana while driving his daughter, an Onondaga County Family Court referee granted Tanner day-time visits with the girl on alternating weekends, to be supervised by his parents.

The referee, Salvatore Pavone, found the crash was not grounds for imposing the "drastic remedy of denying all visitation." Tanner will likely emerge from jail next year with the right to continue to visit Peyton.

The fight over the father's access to Peyton shows how much irresponsible behavior the court system will tolerate to make sure a child knows both birth parents. If smoking pot while driving with a kid in the car isn't enough to deny a parent visits, what is?

The crash

Tanner and Decker exchanged their daughter Peyton Bean, who took the mother's maiden name, on Sept. 25, 2014. They met at day care in Clay around 4:15 p.m. As Tanner was driving west on the Thruway to his home in Canandaigua, Ontario County, he smoked marijuana from a pipe.

Tanner lost control of the Plymouth Breeze and veered to the left. He overcorrected and veered to the right. The car went down an embankment on the right side of the road. The back passenger's side of the car, where Peyton was strapped into a booster seat, hit a tree.

Her face and head took the impact. Many bones were broken, even shattered. A first responder described seeing a steady flow of blood from her mouth and her leg contorted between the front seat and the tree.

A helicopter crew put Peyton on life support as they rushed her to Strong Memorial Hospital in Rochester.

Tanner had minor injuries. When state troopers arrived, he was in a nearby wooded area. He told investigators all he remembered was drifting off to sleep while he was driving, and he'd gone to the woods to vomit.

By the end of the night, his story changed: He admitted he was throwing a marijuana bowl into the woods. Investigators found another pipe with marijuana residue in the car. A blood test confirmed he was high when he crashed.

Decker, 22, and her husband Robby, 27, both of Clay, learned the news from Tanner's girlfriend. They found a babysitter for their daughter Odette, 2, and rushed to the hospital.

They stayed at Strong for 18 days, taking turns sleeping on a single-person cot and pillows on the floor. After 11 days and a seven-hour surgery, Peyton was awakened from a medically induced coma.

Doctors worried she would lose sight, hearing, taste and smell. Memory loss and brain damage were also concerns. Peyton had to relearn how to talk and swallow. She returned for a second operation in mid-November, which required three more days of hospitalization.

The battle resumes

In December, after Peyton's recovery, Decker returned to family court, armed with an Onondaga County Child Protective Services report saying Tanner had showed "irrefutable negligence."

CPS also deemed Tanner an inadequate guardian and said he was a high risk to his child. Decker provided the report and 200 pages of court filings and transcripts to Syracuse.com.

In her effort to strip Tanner from Peyton's life, Decker also argued Tanner had been inconsistent in his involvement in the girl's life. He had multiple license suspensions for failing to pay child support.

In April, before family court made a decision about the visits, Tanner admitted in criminal court to smoking marijuana in the car and causing the crash.

In an interview, Tanner said he only admitted in court to smoking while he was driving in order to get a plea bargain.

"Honestly I did not," said Tanner, who now lives in Marcellus. "I have never smoked in front of my daughter, especially in the car."

Two weeks after Tanner's plea, Pavone decided Tanner should have access to Peyton, for two six-hour visits, supervised by his parents, every other weekend. Through his office, Pavone declined to comment.

Decker and Tanner met as students at Marcellus High School. As a senior, she got pregnant.

Tanner was already in college at Finger Lakes Community College in Canandaigua. By the time Peyton was born on Easter Day, 2010, the two had separated. Peyton went home with Decker.

Despite those things ... it is still a fundamental right of a parent to visit with a child.

It wasn't clear what role Tanner would have in her life. When uncertainty boiled over into dispute and Decker suspected Tanner was using drugs, she went to family court.

For the next four years, they would appear before Pavone multiple times, each at Decker's request. Decker has had primary physical custody throughout the court fight, with Tanner sharing legal custody. That means he can participate in decisions about Peyton's schooling, religious upbringing and medical care.

At one point, Decker told the court she felt Peyton was unsafe in the car with Tanner, Pavone said he gave the father the benefit of the doubt because he had a valid license and a car seat.

Decker complained of Peyton coming home unfed, without a nap and in dirty diapers. The judge's response: "Are you a child psychologist, ma'am?"

When Decker said Tanner was using drugs, Pavone ordered a drug test. The hair follicle test came back negative. Before the results were revealed, Pavone said the father would retain visits with the child no matter the outcome.

"... You need to understand that despite those things that it is still a fundamental right of a parent to visit with a child. It's presumed to be in the best interest of the child," Pavone said, according to a court transcript. "This is not one of those extremely rare situations where the court can employ what – what the Appellate Division has called the drastic remedy of cutting off all contact between the father and the child."

In the appellate case to which Pavone was referring, Acker v. Acker, a father was stripped of his visits after his oldest of three children testified that the visits were upsetting.

The court ruled that the best interests of the children would be served by supervised visits at a neutral site. In that case, from 1995, there is no mention of abuse or neglect on the part of the father.

Experts said there are few situations in which a judge will deny a parent access to a child. #Judges must act in the child's best interest, but they have broad discretion in determining what those interests are, said Peter Charnetsky, managing partner at the Tully & Rinckey law firm in Binghamton.

"Sometimes that means continuing and enhancing the relationship [between a father and child]," said Charnetsky, a former Broome County Family Court judge.

Because many people believe it is important for child to know both parents, proposed laws which would allow judges to strip a parent of visitation have failed, said Sarah Ramsey, former family law professor at Syracuse University.

"I can't imagine -- as the mother, I would be so upset if that happened to my child," Ramsey said of the crash. "And then the court says I have to keep letting him see her."

Still, she said, previous cases suggest, "It would not be within the judge's discretion to totally deny visitation."

Despite Decker's concerns, family court gradually permitted Tanner more time with his daughter in the years before the crash. He was awarded unsupervised visits with the girl every other weekend.

Tanner maintains that he will always be in Peyton's life. He said the court only takes away a parent's rights to visit under "wildly extreme" circumstances, like murder or molestation.

"I broke the law and I fessed up to it. I'll get what comes to me and I'll come out the other end and I'll jump through all the hoops -- rehab, counseling, drug testing -- as frequently as they like," he said. "I made a mistake and I regret it every day since it happened.

"I am her father. I'm always going to be her father. I'm going to be there always."

Life after the crash

Nine months after Peyton nearly died in a car crash, she is a playful, active 5-year-old. She has posed for the cover of Rochester Golisano Children's Hospital's magazine and is featured on its website as a "Miracle Kid."

She has all her senses. Her smell and taste returned when a splint was removed from her nose just before Thanksgiving. Around that time, Peyton was taken off a soft-food diet and the cast on her left leg was removed. On the way home from the doctor's office, the Deckers stopped at a gas station for popcorn, one of her favorite foods.

The surgical incision still sometimes makes her skin sensitive when her mom brushes her hair. Decker styles her hair to cover up the scar. Peyton will have yearly checkups with a plastic surgeon at least until she is a teenager.

For days after the crash, Peyton's hair was messy with blood, her mother said, until a nurse at Rochester's Strong Memorial Hospital cleaned and braided it.

Now, Peyton and Odette roughhouse and jump on the beds in the room they share. The Deckers asked the hospital for a face plate to protect Peyton. Doctors reassured them Peyton would be better able to take a hit than her little sister.

When Peyton sees a car on the side of the road, she asks about the occupants' safety, her mother said. In the winter after the crash, she asked Decker a lot of questions about how to drive in the snow.

Peyton's therapist called these triggers that can result in intense distress. The therapist wrote the family court judge to say that visits with Tanner negatively affect Peyton's emotional stability and capacity to heal from the crash.

Decker, who worked at Peyton's day care center, hasn't been able to return to work. She estimated her and her husband, who does maintenance and handiwork, spent at least $10,000 on court and attorney fees and lost wages since the crash.

They are pregnant with another child, a girl Peyton wants to name Lucy, after one of her favorite "Despicable Me" animated characters.

Peyton calls Robby Decker "daddy" without prompting. #"Since all this has happened, I'm sitting in the back of the courtroom with Pavone up there, and I just want to say, 'Hey, Pavone, count me in!' " Decker said. "Dad's right here. I've been here since Day One."

Tanner is expected to be sentenced in July to nine months in jail and five years' probation. Taylor Decker expects she will return to court for the next 13 years after that, until Peyton is an adult.

"Everything I have to offer is nothing anyone wants to hear," Decker said. "So I feel like the only thing left to do in the court system is continue to reappear and express my beliefs for what's best for my child."

A father and his wife who are charged with murdering his daughter wept in court on Thursday as lawyers detailed the abuse and torture that led to the young girl's death.

Andrew and Hilery Maison of Port Huron, Michigan will stand trial on charges of murder, two counts of torture and two counts of first-degree child abuse in the death of Mackenzie Maison, Andrews 5-year-old daughter.

Mackenzie was found dead at the couple's home on May 26 weighing just 25 pounds, while her 3-year-old sister Makayla, who managed to survive, weighed just 17 pounds.

Both girls were severely malnourished and dehydrated.

'These children were dying in front of these defendants, and they did absolutely nothing while they are taking adequate and appropriate care of the other two children,' Senior Assistant Prosecutor Mona Armstrong said in court Thursday according to The Times Herald.

Andrew and Hilery were at times quiet, and other times seen openly crying in court.

Despite their tears however, the prosecution argued that these girls ahd been suffering for a long period of time.
 
'Malnutrition alone doesn’t occur in a day or two days or, really, in a week. Malnutrition is more a prolonged type of a process,' Dr. Daniel Spitz, medical examiner for St. Clair County, testified in court.
 
'I think I can say this child was malnourished over a period of months and, more likely, years.'
Mackenzie's body was also bruised in numerous places and she had multiple infections

Makayla meanwhile drank four glasses of water when police arrived - after the couple called them when Mackenzie suddenly went unconscious - and could barely stand up according to their report.
 
She was also so weak she had trouble biting into an apple at the police station.
She was released from the hospital on June 1 and is now in foster care.
 
Michael Boucher, Hilery’s lawyer, and Frederick Lepley, Andrew’s lawyer, argued that the two did not knowingly deprive the girls of nutrition.

The results of Mackenzie's autopsy have not yet been released.
 
The girls' mother, Shelby Coffee, had lost custody of the two in 2013.

Father Wanted in Slayings of Infant Son, Mother Surrenders in Pond

Police released information about a man wanted for questioning in connection with the deaths.

A California man sought in the slayings of his infant son and the child's mother surrendered Tuesday after authorities found him in an Orange County park pond following a brief pursuit.

The mother and her infant child died Monday after being assaulted inside an apartment in the 2600 block of West Ball Road in Anaheim Monday at around noon. Investigators found Kwane Carpenter's car in the parking lot of the Fountain Valley Hospital at around 3:30 a.m. after a tip-off from a security guard, and following an exchange of shots he fled in his vehicle, a spokesman for the Anaheim Police Department said.

"He woke up, started the vehicle immediately and drove off through the parking lot," said Sgt. Tony Luce, of the Fountain Valley Police Department. "He struck several vehicles in the parking lot and, at one point, drove the vehicle in the direction of one of our officers."

He then drove into a park at the corner of Edinger Avenue and Euclid Street and jumped into a pond in an apparent attempt to escape, police said. Carpenter was later tracked down by K-9 officers and taken into custody soon after he surrendered in neck-deep water, police said.

"The dog then jumped into the lake and grabbed ahold," said Luce.

Carpenter was identified by police as a person of interest in the killings. Carpenter remained hospitalized early Tuesday afternoon.

Investigators said the mother of his child, who has not been identified but was in her 20s, was dead when they arrived at the apartment Monday. Her 6-month-old son was taken to the hospital, where he died.

A coroner's report is pending.

Kyle Elsbernd said he tried to comfort a woman who arrived at the apartments and told him she lived in the unit and was the victim’s sister.

"When they brought the baby out, she recognized the baby and she freaked out," Elsbernd said. "It was heart-wrenching," Elsbernd said.

Shortly after, witnesses say the baby’s grandmother arrived at the scene.

Police previously said they were looking for 24-year-old Carpenter as a person of interest in the deaths.

"We are looking for a person of interest that we think could shed some light on this incident," said Lt. Eric Trapp of the Anaheim Police Department.

The usual stupidity in reporting. The fact that the (suburban) neighbors observed nothing out of the ordinary is actually more typical than not. In reality, very few of these suburban abusive males are anything but "nice" or "polite" as the neighbors see it. That means nothing.

That Mom (presumably) never called the cops means nothing either. Most victims don't.

That doesn't mean Dad just "snapped." These family annihilator guys almost always have a history of escalating abuse and control issues that are usually invisible to people outside the family.

ROY, Utah — A Utah family of four was found shot to death in their home in what authorities believe is a murder-suicide, police said Monday.

Officers discovered the bodies of Russell Smith, 29; his wife, Shawna Smith, 26; and their children, 6-year-old Tylee and 2-year-old Blake on Sunday night. It appeared Russell Smith shot himself, and investigators were not looking for any suspects, police Lt. Kevin Smith said.

The department received a 911 call about an assault at 10 p.m. Sunday from a relative who stopped by the house in Roy, a city about 32 miles north of Salt Lake City.

There was no history of police responding to the home near Roy High School, Smith said. Investigators talked to family members and were trying to uncover a motive.

The relative who discovered the family decided to come by the house after failing to hear from anyone there since an afternoon text message, said Smith, who is not related to the family. He declined to specify the person’s relationship to the victims or what the text message said.

Neighbor Lynn Everley, 68, said the Smiths were a quiet, young family, and he had never heard any fights or seen any indication of problems.

Everley said Russell Smith worked in the nearby city of Ogden at a company that recycles outdated military supplies, while Shawna Smith worked at a child care facility. Everley said the family lived in the home for at least several years — as long as he had been in the neighborhood.

“They’re a couple that you would never have expected this to happen,” Everley said. “But then, what makes a person snap?”

I am not underplaying other factors that played into this killer's actions, like the ready availability of guns in an extremely racist culture. That said, I get tired of all the fathers day MRA propaganda blaming single mothers for crime and all the other social problems in the world when FBI research clearly shows a very high correlation between violent fathers and murderous offspring.

Notice that it has become so common for abusive and controlling fathers like FRANKLIN ROOF to assume full custody that nobody even asks how he got custody, who gave it to him or what happened to the mother.

The white loner accused of shooting dead nine people at a black church was raised by a violent father who beat up his stepmother and hired a private detective to follow her when they split.

These shocking charges were made in court papers by Paige Mann - the ex-wife of Dylann Roof's father Franklin - that were obtained exclusively by DailyMail.com.

Franklin Bennett Roof, 52, who is known as Benn, bought his son the gun he allegedly used for the massacre.

He is also said to have subjected his wife Paige to a ‘pattern of control and mental manipulation’ that ended with a vicious assault.

Exclusive photographs obtained by DailyMail.com show multiple bruises to her body allegedly caused by him.

She claims he battered her on the back of the head in 2008 and made her ‘world fall apart’.

Franklin is said to have shredded Paige’s self esteem during their ten-year marriage.

He also kept her in a 'virtual prison' by calling her several times a day and demanding to know what she was doing.

The heavily tattooed builder repeatedly told Paige she was lazy and spent too much money.

 He allegedly once said: ‘You’re not a very good maid but I’ll keep you around’.

When they split, Franklin is said to have taken his revenge by accusing her of having a lesbian affair and hiring a private detective - who took graphic notes about her spending the night with her boyfriend.

When the divorce was finalized in 2009, Dylann’s last chance of a stable family life disappeared.

His main anchor in life was a father who was away travelling for four days each week with his construction company.

Dylann, who was then 15, began to skip classes, did not finish high school and became unemployed - living ‘on and off’ with his father while he spent his days taking drugs and playing video games.

According to police, his journey into the wilderness ended on Wednesday night when he went on the rampage at a Bible study group at the Emanuel AME church in Charleston, South Carolina.

He is accused of calmly sitting with them for 45 minutes before opening fire and telling the group of black worshippers he was doing it because they had ‘raped our women and are taking over our country’.

He has now been charged with nine counts of murder and has reportedly confessed to the shootings.

The roots of his extreme hatred have yet to be fully explained but documents filed at the Richland Family Court give the clearest indication yet of how he was brought up.

The files show that Paige was the closest thing Dylann ever had to a mother - until Franklin’s alleged abusive behavior removed her from his life.

The former couple married in November 1998 in Florida, when they were living together in Columbia, South Carolina.

Dylann was just four and his half-sister Amber was 11. In 2000 Paige and Franklin had a daughter together, Morgan.

Paige writes that she ‘raised (Franklin’s) kids from a very young age, took them to all of their activities, and Benn’s kids have spent almost every weekend with me. “

‘Benn travels a great deal, usually four days a week, so I would always care for and raise his kids’.

Paige tried working at Sears but Franklin said he wanted her to be a stay-at-home mom, so she quit.

Despite her ‘great reluctance, Franklin moved the family to the Florida Keys, away from her family, friends and support network'.

It was a terrible move.

Paige wrote in her affidavit to the court that their ‘fighting and arguing became worse’ and Franklin ‘constantly belittled me about how lazy I was’.

She wrote: ‘After we moved to Florida our marriage really began to deteriorate when Benn became so controlling.

‘He controlled my whereabouts, the checkbook and everything about my life.

‘On September 20, 2008, my whole world fell apart when Benn and I got into an argument.

Benn violently pushed me to the ground and hit me in the back of my head.’

That night Franklin took the credit card from Paige that she had been using to pay the grocery bills.

She said it was her only source of income.

He also said he was ‘cutting off the electricity and taking my car’.

Paige claimed he told her he would ‘relinquish his rights to our daughter if I would waive child support’.

The pictures of her injuries, allegedly from domestic abuse, were included in a court fuke Paige wrote that she was ‘so scared of him that I knew I had to get out of this violent situation’.

She moved back to Columbia with Morgan - leaving Dylann with his father.

The court file contains numerous other documents filed in support of Paige’s claims.

Her mother Patricia Hastings said in a letter to the court that her daughter’s nature was ‘one of caring, cheerfulness and devotion to her family’.

“ Paige was there for Amber and Dylann on the occasions where their own (mother) chose not to be, including church, driving Dyalnn to and from school and extracurricular activities.”

She wrote that her daughter ‘loved Bennett Roof’s other children Amber and Dylann unconditionally as her own’.

And she added: ‘I was afraid that love for these children clouded her judgement in getting involved with Bennett Roof.’

Dylann stayed with Paige and Franklin far more often than with his own mother, who was supposed to have him every other weekend, Patricia noted. ‘Paige was there for Amber and Dylann on the occasions where their own (mother) chose not to be, including church, driving Dylann to and from school and extracurricular activities.’

Her daughter’s marriage had been a ‘source of great concern’ on numerous occasions, she added.

‘Prior to the marriage, a pattern of control and mental manipulation was evident to me and many of (Paige's) friends.

‘Having worked 30 years as a registered nurse and most of those years were in women’s health services, I am well acquainted with the signs of an abusive relationship.

This is even more frightening when you see it unfolding in your own child’s life’.

She described how over the years she saw Franklin ‘isolating (Paige) from her friends and family’.

Hastings said that Franklin was ‘manipulative’ and that once in January 2009 he came round and was ‘pounding on the front door and yelling in the extreme’.

Paige’s friends wrote in court documents that they saw similar incidents.

The most blunt was Sally Moore, a special education teacher, who had known Paige for 20 years.

She wrote in a letter: ‘Benn was tough on Paige. He called her several times a day to check up on her and find to what she was doing, and what was for dinner.

‘If he should make it home, I heard him making comments about her cleaning: "How long is that laundry going to stay in that f***ing chair?

'"What in the hell have you been doing all day?" and "You’re not a very good maid but I’ll keep you around".

‘Benn began to work out of town more and more, staying out of town for a week or more at a time.

‘Paige had the responsibility of their child Morgan and her two stepchildren.

‘The toughest time for Paige was 2004-7.

‘Paige and Benn built a house and their living expenses became more exuberant. Benn questioned every penny Paige spent, even at the grocery store. I heard him question: "What did you buy for $200 at Food Lion?" and "Morgan’s shoes cost how much?"

‘We had many play dates where Paige just cried because she felt so inferior, not trusted and just plain unhappy.

‘Benn did not even trust our relationship. He at one time accused us of being lesbians... it seemed odd to me since I know how truly selfless Paige is and what a kind heart she has.’

Another letter was written by Paige’s friend Leslie McArver who had known her for four years.

She wrote: ‘(Paige) always made sure Dylann was able to visit his father, even taking him to and from his house every weekend. She has been very active in all of the children’s lives for the past 10 years and caring for them as her own.'

Yet another of Paige’s friends, Whitney Malson, whose daughter went to the same school as Morgan, wrote that she was ‘afraid’ of Franklin.

She wrote: ‘My husband witnessed him banging on Paige’s door at night and yelling at her. He kept banging on the door, yelling out her name, and I called out to him and said she was not at home.

‘Last week he showed up at school and was borderline physical with Paige. He was trying to pull Morgan’s backpack off Paige’s shoulders and was violent about it. He was harassing her all the way to the car in his own daughter’s school zone,’ she claimed.

Paige and Franklin split in December 2008 and the divorce was finalized in February 2009.

But in January of that year Franklin hired a private investigator to investigate Paige.

In his affidavit Franklin wrote: ‘I now know she has a boyfriend. I hired a detective and found out my suspicions were confirmed. She has omitted this affair to me’.

The word ‘omitted’ appears to be a typo and he seems to have meant ‘admitted’.

According to the surveillance report by McKay Investigations, a Columbia-based detective agency, agents tailed Paige over two weekends and observed her being affectionate with her new boyfriend, Scott McWhite.

Franklin entered it into the divorce files to demonstrate what he saw was a wrong against him.

The report reads: ‘As Scott leaned against the Cherokee, Paige put her chest to his and leaned on him. ‘They kissed. Paige rubbed Scott’s chest and wrapped her arms around his neck and hugged him. He in return wrapped his arms around her waist.

‘Paige became extremely loving. It was as if she simply could not keep her hands, lips and body off of Scott.'

The agents write that the pair were ‘very free with their actions and in no way tried to be discreet’.

Over one weekend the agents carried out almost 24-hour surveillance on the couple, watching them in a club until after midnight and then back at McWhite’s apartment where they sat watching them relaxing by candlelight until they closed the curtains.

The agents returned the following morning at 5.24am, checked that Paige’s car was still there and watched as the naked couple put on their clothes and got ready for the day.

The report says: ‘She picked her pants up from the floor and put them on. Paige and Scott stood in front of the bathroom mirror.

‘Paige picked up her bra from the floor and put her arms through the straps. Scott stepped out of the bathroom and fastened her bra.’

In his filings Franklin denied some of the allegations against him.

He said that he did not object to Paige having custody of Morgan but he could not pay much child support as his business had been ‘living off borrowed money for over the last year’.

He claimed it had been ‘difficult to stay afloat’ after the 2008 economic crash, even though tax filings show he earned $48,000 that year.

Paige’s lawyer accused him of lying about his income and said that in his 2008 tax return he claimed to earn $5,100 a month - but it was actually $7,1500.

In her affidavit Paige also alleged that Franklin had done ‘extremely well’ in construction, and in 2008 alone put $168,000 in their bank account.

The final terms of the divorce were that Paige got custody of Morgan and that Franklin would pay $570 per month in child support.

There was no mention of what happened to Dylann.

Franklin did not return calls for comment but neighbours at his house in Columbia said he was an 'easygoing guy' who likes to take holidays in Florida.

He said: 'Benn likes a beer, he likes going to Key West. He's got lots of tattoos, sailor tattoos. I've never had any trouble from them the time I've been here. 'Benn owns the house on his property and rents it to a black guy. Benn has never struck me as racist or a white supremacist.'

Franklin's home is a two-storey property in a working-class area of Columbia.

On the porch at the front is a sign that reads: 'Harley Davidson Parking Only.'

A sign on the front door reads: 'Beware of the Dog'.

A Stars and Stripes flag hangs off a pole from the front of the house.

When DailyMail.com went to the house, Roof's sister Amber shouted: 'We've called the police. You've got to go.'

Three squad cars arrived and Franklin came out the house but refused to comment.

He pointed at the officers and said: 'I'll let them deal with you'.

DailyMail.com also visited the house of Roof's grandparents Joseph, 77, a prominent local lawyer, and Lucy, 76. Joseph answered the door and said: 'I've got three phones ringing and I'm trying to deal with this.'

His wife said: 'No comment, no comment,' and closed the door.

Roof's last known address is a ranch-style home on a main road in Eastover, a 30-minute drive north-east of Columbia, owned by Danny Beard.

A sign outside one of the properties reads: 'Peaceful Acres'. A Stars and Stripes flag hangs over the front porch.

Beard appears to be a patriot as there is a large shed on the grounds with more than a dozen vintage-style plates and signs, including the logo for gun maker Smith and Wesson.

Another reads: 'Don't Tread On Me' whilst others are for Route 66, Indian Motorcycles, Boar's Nest - a barbecue restaurant in Columbia - Winchester Rifles and the Ford Motor Company.

One bears the words 'Land of the Free'. Another has an American Eagle with the message: 'Everyone Remembers. No one forgets. POW MIA.'

A man who spoke from behind the locked front door said: 'This is private property, leave.'

Numerous other relatives of the Roof family told DailyMail.com to 'get off the property' when approached. .

TWO young children who lost their mother to cancer must now stay with their "emotionally abusive" father, Britain's top family judge has ruled.

The girls, aged just three and four, had been offered a new life in America by their maternal great aunt and uncle.

But, a leading family court judge has ordered the kids to live with their father in Britain despite serious concerns over his parenting.

The kids' mother tragically died from cancer in 2013 amidst an ongoing family court battle.

The mother had been hoping to take custody of both children after suffering domestic violence at the father's hands.

The custody battle then spilled over into an international tug of war after the mother's passing.

The children's great aunt and uncle from Illinois stepped in to give the kids a home away from their father.

An earlier judge ruled the father 'emotionally abused' both the mother and children after taking the youngsters to Pakistan without permission.

The father even tried to use a 'false will' and a 'bogus confession', which he claimed the mother had signed, to keep custody.

And, following the mother's death, he "laid the ground for attempting" to obtain a life insurance payout, the court heard.

However, Sir James Munby, president of the Family Division, blocked the great aunt and uncle's bid to adopt the children.

He insisted: "The case for adoption is simply not made out. "I am very conscious that the consequences of this, in a sense, is that the father wins by default.

"The children go to him because the only alternative is ruled out because adoption is ruled out.

"But it is fundamentally important children are not to be adopted merely because their parenting is less than perfect, indeed, perhaps only barely adequate".

Despite the 'serious findings' against the father, an independent social worker claimed he had "a positive relationship" with the girls.

He also praised the "generally high quality" time he spent with his children.

The children are currently with their great aunt and uncle in America on holiday but have been ordered to return to their father by August.

Since their mother's young death, the children have spent three extended holidays with family in America.

The judge also ruled that the two young girls will continue to be monitored by the courts.

Names involved in the case remain anonymous under regulations governing family court actions involving children.

DEL CITY, Oklahoma - An arrest warrant has been issued for a man accused of immersing his 2-year-old child in scalding water in Del City.

The suspect, 22-year-old Trashawn Deon Lanier, is wanted on a complaint of child neglect.

According to authorities, on May 30, officers responded to the report of a possible child abuse involving a 2-year-old girl at Baptist Hospital. The child was transported to Southwest Medical Center and then transferred to Baptist Hospital Burn Center, suffering from 2nd and 3rd degree burns over 24 percent of her body.

Based on medical examination, doctors found out that the victim had been immersed in scalding hot water.

Lanier is the victim's biological father. On May 28 at a home in Del City, Lanier was giving the victim a bath when he claimed the toddler climbed into the bath tub, which was filled with scalding hot water, and then fell into the tub.

However, a doctor said that the forensic evidence does not match Lanier's version of how the incident happened. The doctor said based on the child's injuries, Lanier would have had to physically place the victim in the water.

UPDATE: 9:30 P.M. — Newark Police confirm the father is in custody, and the baby is safe.

According to police records, the man holding the baby captive was 37-year-old Rudy Soto.

The police report reads, “The patrol officers attempted to talk with the Soto, but he refused to speak to the officers. Officers initially feared the victim of the domestic violence may have also been inside the apartment. Officers were able to contact the victim, and were able to determine she was at work, but her one year old son was inside with the Soto, who is the father of the child. After 12 hours of negotiating with the Soto, he calmly exited the apartment with his baby in a stroller and surrendered to police. Soto has been taken into custody and the baby is safe and unharmed.”

UPDATE 5:00 P.M. — Police are negotiating with a domestic violence suspect who is allegedly holding a baby captive in Newark this evening, a Newark police commander said.

Commander Mike Carroll said the father has been involved in two other domestic violence incidents in the past two weeks, and a warrant is out for his arrest.

Carroll said police are going to be very patient because a baby is involved. Officers have thought they were going to be able to resolve the situation at numerous points today, but it has continued into this evening, Carroll said.

NEWARK (KRON) — Police are on the scene of a standoff situation at an apartment on Sycamore Street in Newark.

It is unknown how many people may be inside, but it’s believed at least one person is refusing to cooperate with police.

The incident began at 11:45 a.m. Sycamore Street is closed between Thornton Avenue and Mayhews Landing Road.

CHP is assisting.

People are advised to avoid the area.

CLEVELAND, Ohio – Police are searching for the father of a 2-month-old baby who was found abandoned in an alley.

Authorities say the infant was found on the sidewalk by a passerby, who then called police.

John Dorsey was driving by the area with his children when he spotted the car seat.

He says he stopped the car and asked his son to make sure there wasn’t a child in the car seat.

“He walked up to the car seat, and he was like, ‘This is a baby, pops!’ So I just jumped back the car, and grabbed the baby and put him in the backseat,” Dorsey said. “It was like somebody threw the diaper bag out the window because all the stuff was scattered down the street. Yeah, so we had to like, pick everything up and put it in the bag once we put him in the car.”

Dorsey took the child home where he and his family cleaned up the baby and fed him until police arrived.

“Why? That’s all I want to know. Why would somebody do this? And he was a beautiful little baby,” Dorsey said.

The baby was taken to a hospital to be checked out before being placed in protective custody.

WJW obtained surveillance video that captured the baby being left behind by a car.

Officials say the boy’s father, DeShawn Holiday, had custody of the child at the time he was abandoned.

Now, a child endangerment warrant has been issued for his arrest.

Workers say the child won’t be in protective custody for long since there is already another family waiting to gain custody.

“I want him,” Dorsey said. “I do, my whole family wants that baby. We called him little brother.”

Dorsey, a father of four, says he hopes the child is healthy and knows he is lucky to have found the baby when he did.

A 4-month-old boy was fighting for his life at Albany Medical Center after being beaten by his father, a state police lieutenant said Thursday.

Lt. Michael Drake said the boy was in critical condition as of Wednesday and was “in no way, shape or form out of the woods.”

Drake said the boy, whose name was not released, was being “monitored diligently by the hospital” and continued to have seizures due to pressure on his brain caused by cranial bleeding.

The boy’s father, Kirk Berry, 27, of 512 state Route 32A in Palenville, was caring for the child at their home on June 5 when he “became angry” and caused the life-threatening injuries, Drake said.

Berry was arrested Tuesday and charged with felony assault.

The child’s injuries were the result of “blunt force trauma to the brain, caused by being struck,” Drake said, adding police had not determined a motive for the assault.

Drake said investigation has revealed “a little bit of a pattern” of physical and verbal abuse by Berry of the infant, the boy’s 2-year-old sibling and the children’s mother at the family’s residence.

The 2-year-old, whose gender was not provided, has been removed from the home by Greene County Child Protective Services and will remain in that agency’s custody “until we can sort things out,” Drake said.

He said the children’s 25-year-old mother, who he described as “also a victim,” is still in the area.

The infant was taken to the Albany Medical Center by ambulance after Berry called 911 from the residence, Drake said.

Police were notified of the assault by the Albany Medical Center after personnel there “realized the injuries were due to something other than a natural cause.”

Berry was arraigned in Cairo Town Court and sent to the Greene County Jail in lieu of $50,000 bail.

A BABY boy was discovered at a tram stop by passers-by last night after his father allegedly left him for dead in the freezing cold

Shocking CCTV footage appears to show the moment a father dumped his nine-month-old baby in bushes by the side of a tram stop.

A video clip of the incident appears to show the man pushing his nine-month-old son in a pram before boarding a train and leaving the child in freezing conditions.

It is thought the incident occurred at a tram stop south east of Melbourne, Australia.

The child reportedly sat alone in the pram for ten minutes until shocked passersby discovered it and called police.

Seven News in Australia claim the 31-year-old was later tracked down at a different tram station. It is claimed that the man refused arrest and became so aggressive that police were forced to use pepper spray.

Reports suggest that the mother's details were found inside a wallet in the pram during a police search but it is unknown whether she was aware of the incident.

The man was charged with reckless conduct and endangering life.

He was taken into custody over night but has since been bailed to appear in court in September.

The child is reported to be in good condition after being taken to Monash Children's Hospital for medical treatment.

The Department of Human Services are now investigating the little boy's case.

SPENCER, Tenn. — A Middle Tennessee man has been indicted on a charge of aggravated child neglect following the death of his 7-month-old daughter.

The Tennessee Bureau of Investigation says 20-year-old James M. Green of Spencer was arrested Tuesday and was to be held on $50,000 bond in the Van Buren County jail.

The TBI says the child, who died Jan. 25, was found not breathing after sleeping in bed with her father. An autopsy determined Brooklyn Green died of asphyxiation.

In many way a classic DV homicide. Mom had just left this violent control freak--one of the most riskiest times for women. Plus Dad PHIL SEIDLE was a cop who played at being model citizen, meaning he was becoming increasingly emboldened over time.

The custody "dispute" fits right in with the abuser's need for ongoing control over his victims. By demanding more time in his children's lives, he could continue his abuse of the family.

Of course, the fact that he shot Mom numerous times in front of a permanently traumatized 7-year-old girl proves he doesn't give a sh** about the kids. And he obviously didn't care that he was robbing nine kids of their mother.

This poor woman. His freaking cop friends standing there doing nothing while Daddy shot her again and again. The only way she could have survived this divorce is if Dad had been locked up years ago for his assaults and death threats--which obviously didn't happen. And wouldn't happen, given the intensely corrupt nature of the New Jersey criminal justice (criminal protection) system.

A recently divorced New Jersey police officer accused of chasing and gunning down his ex-wife with his service weapon as their youngest daughter watched made his first court appearance Wednesday and entered a not guilty plea.

A shackled Neptune Township police Sgt. Phil Seidle, 51, was led into Monmouth County Superior Court Judge Honora O'Brien Kilgallen's courtroom, where he was formally charged with first-degree murder, unlawful possession of a weapon and endangering the welfare of a child.

He continues to be held in jail on $2million, as his attorney's efforts to have the bail amount lowered to $1.2million proved unsuccessful.

Judge Killgallen rejected the request for a lower bail and ordered Seidle to have no contact with his children or his late ex-wife's family, reported NJ.com. The 51-year-old also must surrender his passport.

Defense attorney Edward Bertucio argued that his client was an upstanding member of the community and a veteran law enforcement officer who was not a flight risk.

But Marc LeMieux, first assistant prosecutor for Monmouth County, contended that facing a first-degree murder charge that carries a 30 years to life sentence could drive Seidle to flee.
 
'He turned into a criminal and a murderer,' Lemieux said of the officer.
 
Seidle was suspended without pay from his $120,000-a-year job after his arrest Tuesday.
 
Dressed in a yellow jail garb, a teary-eyed Seidle was observed mouthing the words 'I love you' to his relatives seated in the courtroom.  

Seidle had his 7-year-old daughter in the front seat of his car while he pursued a black Volkswagen Jetta driven by his ex-wife, Tamara, shortly before 11.30am Tuesday.
 
The chase ended moments later when Tamara Seidle crashed into a parked car.
 
Philip Seidle then emerged from his vehicle and fired his .40-caliber Glock service weapon several times into the woman's vehicle through the driver's side, fatally wounding her, according to police.
He then pointed the gun at his head, but changed his mind, made his way around the Jetta and fired more rounds through the windshield, said Charles Webster, spokesman of the Monmouth County Prosecutor’s Office, during a press conference.
 
Questions have been raised about the actions of the arresting officers, who chose not to shoot Seidle when he briefly stopped firing on his wife.
 
'That's under investigation at this point in time,' said prosecutor Marc Lemieux.
 
Police officers who happened to be in the neighborhood for an unrelated traffic accident saw the shooting unfold and took the child from her father's silver Honda Pilot. The girl apparently was not injured.

Tamara Seidle, 51, was taken to a hospital, where she died a short time later. No other injuries were reported in the shooting.
 
The shooting was followed by a 30-minute police standoff, during which Seldie held a gun to his head before officers convinced him to surrender. He was then taken into custody.
 
The couple had nine children, ranging in age from 7 to 24, and their divorce was finalized late last month. Authorities say the shooting apparently was spurred by an ongoing child custody dispute. 
 
Michael Terrell, who witnessed the shooting, told the Asbury Park Press that Seidle was yelling at his ex-wife about their child custody fights, how he was tired of paying her alimony and having limited access to their children.

'The guy was in the middle of the street,' Terrell told the newspaper. 'He was saying, "I'm tired of going to court."'
 
Seidle then raised his gun, firing multiple shots at the woman.
 
'It was shocking,' Terrell said.
Another eyewitness, Trina Poysner, recalled hearing Seidle cry out in despair: 'My kids, my kids! I'm not going to see them anymore.'
 
Seidle, 51, is a US Navy veteran who served as a sergeant with the Neptune Township Police Department. He has served on the force for 22 years.
 
Township resident Dianna Harris told the newspaper that Seidle was a popular officer who cared about the community. Harris, who is president of the Neptune-based Midtown Urban Renaissance Corporation, said Seidle would often visit the nonprofit group's community garden.
 
'He was a well-respected cop in the area,' Harris said. 'Nobody knows what triggered this, and that's what makes it so sad.'
 
But court documents paint a starkly different picture of the well-respected law enforcement official and model family man.

In her divorce complaint, Mrs Seidle described her spouse as a violent man who was addicted to pornography and video games, and who was unfaithful to her in the course of their tumultuous marriage. 
 
Susan Doremus, who worked with Tamara Seidle during Neptune school athletic events and booster club functions, said the 51-year-old was diagnosed with breast cancer in 2010.
